The legal profession has had a difficult 18 months, with the property market nearly grinding to a halt during the first lockdown and then the surge of instructions due to the Stamp Duty Holiday. This created extreme pressure within the legal professional juggling the problematic aspects of working from home, employees self-isolating and the huge property boom at the same time. We are proud to say that we withstood these challenging times. It has also been an extremely tough time for families losing loved ones and we have been extremely busy drafting Wills and estate administration to ensure provision has been made for their nearest dearest.

I’m buying a property…what now?

Planning for the future: Make a will!

Your offer has been accepted and the property has been withdrawn from the market. What now?

During the pandemic, many people have lost family, friends and their nearest and dearest. It is therefore so important to ensure your loved ones are provided for in the event of your passing.

It is time to apply for your mortgage, this cannot be done by your solicitor. You will need to see a mortgage advisor or contact the bank/ building society direct. Now you are ready to instruct a conveyancer. Your conveyancer will handle the transferring of the property from the seller to you when you become the new legal owner.

Your conveyancer will now forward the starter documentation to you and ask for an initial fee to enable searches to be ordered.

This includes the local authority, water & drainage and environmental searches, etc. These searches flag up any potential issues with the property alongside your property survey.

Once your conveyancer has your searches returned, mortgage offer, replies to enquiries, all signed documents, reported to you and have received your deposit, it is time to exchange contracts and you are now legally committed to purchase the property. So, there is no turning back.

Once contracts are exchange and you have a completion date; it’s time to start packing and booking the removal company.

MOVING-IN DAY! On completion day the funds to purchase your new home will be released from your mortgage lender and transferred to the seller’s solicitors. Now you legally own the property, and you can collect your keys. Your property will be registered at the Land Registry by your solicitor who will also pay the Stamp Duty.

How do I make a will?

Firstly, you need to think who you wish to appoint as Executors.

An Executor is someone who handles your estate once you have passed away it is therefore important to choose someone you can trust.

Secondly, who do you want to leave your personally belongings to? Maybe your favourite ring or the watch that has been passed through the generations to a family member.

Now would you wish to leave anything to charity or anyone specific, like to your closest friend or someone that has cared for your over the years?

Thirdly, it’s time to think about your estate, who do you want to benefit from your savings, property etc. This can be anyone of your choice, children, grandchildren, family friend or charities.

Finally, it’s time to sign. You have now ensured that your assets will be distributed as per your wishes.
