Launched by the government in 2013, Unbiased reports that over 225,000 buyers have taken advantage of the Help to Buy equity loan scheme.

The Help to Buy scheme has played a huge part in the Stonegate Homes BN Vista development exceeding 30% of reservations, and with prices from as low as £235,000, this development gives first-time buyers an opportunity like no other, with

All said and done, property has always been a fantastic investment and during the period of your stewardship of your current home it’s unlikely that you will, either historically or indeed in the future, see the value of your home drop in real terms.

I believe that the current and spectacular rise in house prices is as much to do with a shortage of supply than anything else. We in the property business hope that with an increase in supply, the market will start to behave more normally, whatever that might look like, and that you will be more able to, in the future, rely on securing your new home at the asking price.

Most likely we will see buyer demand drop off slightly as the pressure of rises in the cost of living take hold, plus an increase in stock, giving buyers more choice, will result in a natural adjustment to demand and supply. There are signs that this is the likely outcome that will be massively better than the prospect of a property crash. No one wants that!”

Mortgage rates have increased since October last year and buyers are generally paying more per month for their mortgage. Some local authorities are enthusiastic towards airspace developments, and, with the change to permitted development rights (within the ‘The Town and Country Planning (Permitted Development and Miscellaneous Amendments) (England) (Coronavirus) Regulations 2020’), the opportunities for such developments have been increased. At the start, however, it is worth emphasising that a Certificate of Lawfulness will still be required and the new rights do not apply to all buildings.

Developing the airspace above buildings is not only the domain of the institutional property owners. The freehold owners of multi-occupied buildings (including resident owned blocks) can now find more ways to exploit the potential value in building upwards and converting unused airspace into something more valuable.

It’s now nearly two years since the Government introduced new rules allowing blocks of flats to be extended upwards, by two storeys to create new homes, without the need for planning permission.

The disposal of the airspace may also be subject to a tenants’ right of first refusal, and consideration will need to be given as to whether notices under the Landlord and Tenant Act 1987 need to be served. A failure to comply with this Act is not only a criminal offence but the anti-avoidance measures mean that a landlord’s failure to comply allows the leaseholders to compulsorily acquire the airspace lease direct from the purchaser developer, for the price it paid.

It will surprise no one that airspace schemes can meet with resistance from existing leaseholders and neighbouring property owners from the outset and during the construction phase. All will have concerns about noise, disruption and the possible impact on the enjoyment of their own properties. Of course, sweeteners can be offered to existing leaseholders, from a newly refurbished building exterior, communal areas, lifts, etc. and, of course, a new roof. All of which is undertaken outside of the established service charge and at no cost to the existing leaseholders. An offer to extend leases, or even a profit share arrangement, are other incentives which might be available. Whatever the deal ultimately ends up being, it will need to be correctly documented.

The core requirements for developing an airspace are similar to any development, the usual components being: land (airspace); services; funding and the actual construction. Building on top of an existing building presents obvious technical and design challenges and developers should also consider the legalities including existing leaseholders’/tenants’ rights, rights of access, light and also party walls. Existing leases should be checked to ensure that the freeholder actually owns the roof and airspace. Any developer needs to check existing rights carefully, especially as a majority of services can be found in roof voids (e.g. air conditioning, lift plant, ventilation, chimneys, fire/

Do not be seduced into a jointagency agreement. It can look a little desperate, end up being more expensive and can be demotivating for the team trying to sell your prized asset.

Ask three agents to value your property. Include a local independent – they tend to care more, have better local knowledge and are generally hungrier and more motivated (I know we are). Do not necessarily go for the highest valuation. A recent Which? Report concluded that overvaluing by just 5% resulted in a delay in completion of 2 months and a 7.7% reduction in eventual price when compared to correctly priced properties. And don’t just automatically choose the agent you may be buying through. There is not always a discernible benefit to be had. Choose the agent who is really active in the marketplace. The one who is most authoritative. The one you feel most comfortable with. Above all, the one you can trust.

Remember: the highest offer is not always the best offer. Discover as much as possible about your buyer’s circumstances. A good agent will know how they are financing the purchase. Whether they are first time buyers. If they have a related transaction. The timescale they are working to. Your final decision will need to take all of these into consideration. And be prepared to negotiate. There is always a negotiation to be had.

This is where the hard work happens. And the key to success is: communication; communication; communication. You need to make yourself available to both your agent and solicitor at all times. Equally, you need to be able to chase them at all times. Clarity, common purpose, communication – and a quality agent – will get you over the line.

Preparation is key. Instruct a solicitor to do your conveyancing early. Ask them to prepare a draft contract and apply for the title deeds while you put together your own paper-work : any relevant building or safety certificates and any work guarantees. You should ensure your Conveyancing Solicitor has all the funds needed from you to close on completion day. Try to include in your budget an amount for other costs like changing locks, domestic connections, other miscellaneous fees and service charges etc.

If you’re in a chain of people moving this is not recommended as it would only take one person to have an issue with the exchange for all your plans to be void. If you are using Help to Buy Equity Loan the Homes and Communities Agency (HCA) could take up to 1 week to release the funds between exchange and completion, whilst this may or may not apply to you, it may be relevant to some parties in the chain. Allowing a week between exchange and completion will also give you time to make final arrangements now a definite date is known such as setting up a Royal Mail postal redirect service, which takes up to 5 working days, informing your removals company, booking time off work etc.

Removals company can help with packing and can pack up your entire house in a day or two or to reduce costs you can decide to pack belongings into boxes yourself. Do start this at least a week before your move. Pack your breakables carefully with bubble wrap, or old t-shirts and curtains etc. to avoid breakages. Label all the boxes with the room they will be going to in your new house to help your removals company. Decide what you want to take with you, what you can recycle or find a new home for; envisage your new home to see where your furniture is going to be placed to save you moving anything that you do not have room for.

5. PACK UP YOUR BELONGINGS WAY IN ADVANCE OF MOVE DAY

This may be the last thing on your mind, but do ensure your policy has started and everything is covered for your new home. It would be awful if you your foot goes through the ceiling whilst unpacking and your home insurance policy has not been updated so you’re not covered.

2. METER READINGS

Children will want to be involved in the move, but it can be a distraction for you and unsafe environment for them. Pets also will be distressed and confused, so asking someone to help look after them on the day will allow you to concentrate on your move.

2. YOUR FIRST MEAL

Having good neighbours can be a great benefit. As well as making new friends, you can reciprocate keeping an eye on each other’s homes, take in deliveries if you are not at home etc

When you’re tired later and you can’t face anymore unpacking, you can hop straight into a comfy bed and get a good night’s sleep. This way you will feel revived and ready to crack on again in the morning! Putting up curtains in the bedrooms are also a great start.

This will help you on your first night and day once you arrive in your new home to help you find clothes and toiletries that are otherwise packed away.

As when you left your previous home, take meter readings of all your metered services, record the numbers and call the relevant suppliers to ensure your services don’t get cut off, there are no outstanding balances on these services from the previous owners and they have your new details.

5. THE NEIGHBOURS

Who knows how many helpers you will have and you are bound to have worked up an appetite. To be very organised a grocery delivery would be one less job, but you need to ensure that you have your kitchen organised by the time it is delivered. Budgeting for and locating a local takeaway delivery company so when you get hungry in the middle of building the beds and wardrobes you can have a welcome break without taking too much time off!

Before you leave, get a final meter reading of all your metered services and call the relevant suppliers to inform them of the numbers so you can settle up the final balance and close the account ready for moving.

If the children are old enough to help, find age appropriate tasks for them so they can feel part of the move. They could help make beverages if old enough, or help with the final clean up and say goodbye to their old house.

Make sure you are fully prepared for the day ahead. Go through each room of your home and ensure that you have not forgotten anything. Do leave your old home in a clean and tidy condition for the new owners; if you have time before the move a spring clean is recommended and do remember if leaving white goods in the kitchen to give them in good condition and consider a professional oven clean. It is a good idea not to pack the vacuum cleaner and give the house a good clean once it is empty.
