Wednesday 1 May 2024 ISLAMABAD 02 NEWS PR OFIT m o n i to R i n g d e S k T H E federal government has introduced new financial regulations for all governmental bodies including ministries and agencies, to enhance control over public funds These regulations, part of the “Cash Management and Treasury Single Account Rules 2024 ” were developed with the guidance of international financial organizations such as the International Monetary Fund (IMF) and the Asian Development Bank As per news reports, the goal is to reduce the fiscal deficit by consolidating unutilised funds across various accounts Under these rules unused funds in bank accounts will be transferred daily to a central non-food account at the end of each banking day and returned the following morning This process is intended to improve the management and forecasting of cash flows The Budget Wing and Debt Management Office of the Finance Division will regularly estimate necessary cash buffers to ensure funds are available for authorised expenses Moreover, the Finance Division can use any surplus to reduce public debt, in coordination with the State Bank of Pakistan (SBP) Each month the accountant general of Pakistan Revenues will provide revenue and expense data to division secretaries, who must then submit a quarterly financial forecast to the Finance Division by the 20th of the subsequent month The Debt Management Office is tasked with creating quarterly debt service projections, and the Finance Division will generate monthly cash forecasts Government entities must adhere to these new rules for opening and operating bank accounts Requests to open accounts need to include legal justifications or government approvals Existing accounts will be evaluated, and any deemed unnecessary will be closed, with their balances transferred to the Federal Consolidated Fund or Public Accounts The SBP will provide quarterly updates to the Finance Division on all governmentoperated bank accounts and balances Government offices and entities are required to submit quarterly lists of their bank accounts detailing balances purposes signatories and legal authorizations The Finance Division will maintain an inventory of these accounts based on the data from the SBP and government entities
ISLAMABAD a h m a d a h m a da n i Ostensibly owing to delays in tariff determination by the National Electric Power Regulatory Authority (NEPRA) the consumers of K-Electric are likely to face a potential hike of up to Rs 18 57 per unit on account of fuel charges adjustment (FCA) for nine months As per details, K-Electric (KE) has requested fuel charge adjustments (FCA) for a period spanning nine months, in which KE proposed an increase in electricity prices for seven months with a reduction in power tariffs for the remaining two months covering the period from July 2023 to March 2024 Since the KE s multi-year tariff is currently under NEPRA s deliberation, the utility has adopted a proactive approach and filed an FCA based on three scenarios and has requested the approval of any one of the three scenarios for the authority’s consideration and guidance in determining the provisional FCA for above mentioned months to facilitate timely recovery of costs and avoid further accumulation of adjustments to be recovered from customers Under the first scenario, KE has proposed that the FCA be calculated as the difference between the actual fuel cost and the reference monthly fuel cost as per the interim tariff whereas as per the second scenario, it has been suggested that the difference between the actual and reference monthly fuel cost be considered as per the tariff petition filed by KE and currently under NEPRA’s deliberation The third scenario proposes the difference between actual fuel cost vs annual w e i g h t e d a v e r a g e f u e l r e f e r e n c e c o s t s being considered as per the tariff petition filed by KE and currently under NEPRA’s deliberation As per details the power consumers of KE will bear a total of Rs 12 94 per unit hike if the NEPRA approves the first scenario (FCA-Ref Interim Tariff-March 2023), while KE s consumers will face Rs 18 57/unit increase if the regulatory authority (NEPRA) approves second scenario (FCA-Ref Monthly Cost) and Rs 16 9/unit hike if NEPRA allows third scenario (FCARef Yearly Average Cost) for the period from July 2023 to March 2024 The NEPRA will hear the plea of KElectric on May 9 and following the hearing, NEPRA will issue a notification determining how the FCA will be calculated and instructions highlighting the method through which it will be applied to customer bills NEPRA, in a public hearing notice, has invited all the interested/affected parties to raise written or oral comments as permissible under the law at the hearing Fuel Charge Adjustments (FCA) are incurred by utilities due to global variation in fuel prices used to generate electricity and changes in the generation mix These costs are passed on to customers following NEPRA s scrutiny and approval The request for FCA is due to the utilization of fuel sources based on economic merit order and changes in fuel prices FCA – Ref Interim Tariff – March 2023: In this scenario FCA has been calculated based on a variation of actual monthly cost with respect to the Fuel Cost of March 2023 The reason for using March as a reference is that the tariff of March 2023 has been approved by NEPRA as an interim tariff till the determination of the tariff for the MYT 2024-30 In this scenario the net amount of FCA for 9 months requested by KE would be PKR 12 94 FCA – Ref Monthly Cost: In this scenario, FCA has been calculated based on the variation of actual fuel cost with respect to the monthly fuel cost references submitted by KE in its Tariff Petition The tariff petition is still under the determination of NEPRA however this scenario has been included in the FCA calculation for deliberation of Authority so as to avoid piling up of costs to be charged to consumers and impact of working capital on it as once the tariff as per petition is determined by NEPRA, the references in petition will be used for FCA filing In this scenario the net FCA for 9 months requested by KE would be PKR 18 55 FCA – Ref Yearly Avg Cost: In this scenario, FCA has been calculated based on the variation of actual fuel cost with respect to the weighted average of references submitted by KE in its Tariff Petition This scenario has been included for deliberation of Authority to avoid systematic under/over recovery of costs or additional working capital implications In this scenario the net amount of FCA for 9 months requested by KE Keep in mind that the idea for an LNG terminal was proposed by Engro, essentially shot down by the Zardari administration, and then finally accepted by the next government after Engro advocated heavily for it It would make sense that the contract would thus be awarded to Engro after a fair bidding process

But NAB would later make three main allegations about the process: That the government agreed to pay capacity charges to Engro which would be a burden on the national exchequer indicating the government gave Engro a deal that was suspiciously sweet That Engro was given the contract for Terminal-1 as the result of favouritism on the part of the government and might have been done in exchange for monetary benefit

Justice Shah noted there was a need to “lay down a court which is a clear firewall against all sorts of excesses and that a system needed to be put in place rather than dealing with individual incidents

He added that no one could influence a single judge during his own tenure as the IHC chief justice

The facts of the case go back to 2015 when the government of Pakistan awarded contracts for liquefied natural gas (LNG) terminals The accountability bureau claims government officials, including Mr Abbasi, awarded the LNG Terminal-1 contract through a non-transparent process to Engro But as Profit has pointed out in its previous reporting a combination of NAB documents and public reporting on the matter show while government officials may have made some errors in the processes used to award contracts for the liquefied natural gas (LNG) terminals in 2015, the government has yet to present any evidence of malfeasance or malintent To understand the entire story we go back to 2015 A T I M E L I N E O F E V E N T S Our story actually starts before 2015 In 2006 the government of Pakistan decided that it wanted to incentivize companies to engage in the domestic production of fertiliser As a sweetener to that fertiliser policy the government of Pakistan promised to provide 100 million cubic feet per day (mmcfd) of natural gas, the raw material needed to produce urea, which is the most common fertiliser used in Pakistan The bidding process for that permit saw two companies win: Engro and the Fatima Group which would go on to set up Fatima Fertilisers in Pakistan Engro, being the highly ambitious company that it is, decided to make their plant the biggest investment in a single project in Pakistan by a private sector company: they invested $1 1 billion in capital to set up the largest single-train urea manufacturing facility in the world The plant was supposed to begin testing in 2010 But that was exactly the time when Pakistan was hit by a natural gas crisis The government of Pakistan reneged on its sovereign guarantee to Engro to provide that 100 mmcfd of natural gas for the fertiliser plant that they had just spent $1 1 billion –most of it borrowed – in building This caused revenue and profitability at Engro to be hit badly as the company struggled to pay off the debts for a project (Interesting tidbit: This was during the tenure of Asad Umar as CEO of Engro Mr Umar was CEO of the company from 20042012 and oversaw these losses, which might have contributed to his ouster Later when the LNG reference would be made Mr

minal case The authorised forum gave the approval for the LNG terminal the court said in its decision And while Mr Abbasi was arrested during a time when members of his political party were down on their luck and facing the ire of NAB, Sheikh Imran ul Haque was also arrested in August 2019 and would not get bail in the case until November Despite NAB s initial claims that they needed him for interrogation for a couple of weeks he was in custody for over three months The arrest made no sense in the first place The accusations against Imranul Haque have essentially centered around him striking a good deal with the government And while it is up for debate whether Shahid Khaqan Abbasi or Imranul Haque had the better end of the bargain, he is currently being punished for doing a good job as a CEO There was little the interrogators could ask him His actions as CEO were legal and again he has not been charged with anything illegal either just a lot of conjecture His appointment as MD of PSO was perfectly legal and perhaps testament to the job well done that was his deal with the government Similarly, Hussain Dawood and Abdul Samad Dawood were also named merely for their association with a company that completed the LNG Terminal project before the deadline and has since made it a very successful project T H E T I M I N G E Q U AT I O N There are a lot of lessons to be learnt from this particular case At the time that the case was filed it was one among many references NAB accepted two other references along with this at the same time against Shehbaz Sharif and his children At the time, the Pakistan Muslim League Nawaz was down on its luck and its leaders were facing charges in a similar fashion to how leaders of the PTI are facing today albeit in a more heavy handed manner The case went on for six months caused damage to the reputation of business professionals and caused political harm to Mr Abbasi in addition to the jail time since it was a blot on his “clean” image The exoneration that has just come in has also been made because Sheikh Imran petitioned NAB to reconsider the validity of the reference Following the request the accountability watchdog decided to withdraw the reference on merit This was clearly the case of a man trying to clear his name and his reputation In this case he was successfully able to do so It is good that the case has been thrown out because otherwise it was setting a dangerous precedent that corporate professionals could face political repercussions for doing business with the government Remember, these professionals are not used to thinking of jail as a part of their jobs the way politicians do They cannot wear imprisonment as a badge of honour when they might want to work outside of Pakistan as well That is why for the sake of the economy if nothing else this precedent would have been unacceptable, and the exoneration is a step in fixing the wrongs of how accountability politics have worked in Pakistan After six years, NAB gives up on LNG reference against former PM Abbasi and Engro leadership citing no proof. AS expected, though perhaps delayed longer than the Pakistan government would have liked, the IMF s Board of Directors voted to release the last of three tranches of its Stand-By Agreement with Pakistan worth $1 1 billlion The BoD’s approval was perhaps merely a formality after the mission in March reached a staff-level agreement, and it also marks the successful completion of an IMF programme by Pakistan, which is relatively rare However, it is not so much the symbolism of a completion that counts as much as the fact that the IMF views Pakistan’s economic managers as being on the right track As the Pakistan government has said repeatedly and as the IMF has acknowledged Pakistan wants another IMF package an Extended Structural Adjustment Facility The Pakistan economy has therefore already had a number of steps carried out which the IMF would have insisted In fact, some of its anticipated measures have also already been carried out However there is still much more to be done especially in the area of broadening the tax base The IMF need not be right by definition but its prescriptions are not necessarily wrong Its prescriptions must be adopted when they are right, with rightness not being defined as popular

When interests clash with values

TH E USA has a long history of promoting values like human rights, environmental conservation, nuclear non-proliferation; and democratic values such as liberty minority rights sovereignty and so on The USA advocates these values on the global stage and urges other states to uphold the same principles It often calls out other states like China for disregarding human rights and causing environmental damage US officials validate their attempts to make regime changes and their military interventions by saying those were efforts to propagate universal human rights and democratic values However, the USA did not take such a strong stance when its ally Israel disregarded human rights values and violated international law Often the USA has to make a trade-off and choose either its long-propagated values or realpolitik (strategic interests) The realpolitik approach in foreign policy is when countries prefer strategic interests over moral values States take a pragmatic approach to gain geo-political advantage irrespective of ethical considerations Whenever this clash happens the USA often chooses its strategic interests over values During the Cold War American priorities shifted to defeat the USSR by all means It supported many dictators, murderers, and right-wing leaders, as long as they sided with the USA against communism In Chile Salvador Allende a democratically elected socialist was overthrown by a coup sponsored by the US in 1973 The new military dictator, Augusto Pinochet, had a record of human rights abuse The US, despite its pro-democracy stance, maintained close relations with Pakistani dictators because they served the US interests The US even normalized relations with the communist China President Nixon hoped that improved relations with China would benefit the USA against the USSR

In the Vietnam War the Nixon Administration wanted to either win the war or end it in a way that the American public accepted it So they took an extreme step to cut the supplies of the North Vietnamese and they carpet-bombed neighbouring Cambodia This attack was disproportionate and indiscriminate inflicting mass civilian casualties America dropped 2 7 million tons of bombs on Cambodia causing huge environmental damage The instability in Cambodia gave rise to radical communist groups such as the Khmer Rouge which eventually conducted the Cambodian genocide The USA showed no concern for the humanitarian loss and environmental damage in the attempt to win the war Again in the 1980s, the USA supported right-wing military dictators to counter leftist influence in central America particularly Nicaragua and El Salvador The biggest controversy in the period was the Iran-Contra affair in which the US covertly supplied arms to Iran intending to free US prisoners held in Lebanon The US used that money to fund Contras (rebels opposing the socialist government) in Nicaragua This was a violation of US policy as the US considered Iran a terrorism-sponsoring state The US Congress has also prohibited direct military aid to Contras because of their brutal military tactics and human rights abuses in the Nicaraguan civil war The whole Iran-Contra affair was done covertly which questioned the transparency of the Reagan Administration It contradicted the US government’s public stance of boycotting terrorist-sponsoring states and its commitments to human

rights and democracy In the Iran-Iraq war, there was strong evidence that Iraq used chemical weapons against Iran The USA still gave tacit support to dictator Saddam Hussain in this war to contain the revolutionary forces in Iran The USA has a controversial role in many other Middle-Eastern countries such as supporting Saudi Arabia despite its human rights violations and role in Yemen These are just some instances where the USA s actions contradicted its values of democracy, human rights environmental conservation nuclear non-proliferation and so on The realpolitik approach of the USA is evident in the Israel-Palestine conflict Israel has reportedly killed 35,000 Palestinians so far, since the Hamas attack on October 7 South Africa filed a genocide case against Israel at the ICJ This case is one of the five genocide cases ICJ has ever handled The ICJ considering this case for further hearing itself speaks of the gravity of the charges Despite the huge backlash the USA still maintains its unwavering support for Israel

This realpolitik approach explains why the USA supports Israel Historically, the USA did support a two-state solution for the Israeli-Palestine conflict The USA has raised concerns about the issue of the continued expansion of settlements in Israel calling it a hindrance to peace But its approach leans more in favour of Israel The US avoids officially calling settlements “illegal” to avoid having to place sanctions on Israel It has always vetoed resolutions against Israel The Trump Administration

N November the Justice Department unsealed an indictment containing the shocking charge that an official of India s government not identified by name, led a brazen conspiracy to assassinate a dissident Sikh political activist on U S soil Now that charge has become even more grave with The Post’s revelation that U S officials have identified the plotter as Vikram Yadav an officer in India s spy agency the Research and Analysis Wing (RAW) and have concluded the operation was approved by the RAW chief at the time, Samant Goel India should get to the bottom of this appalling murder-for-hire case and the United States should make clear that this country will not tolerate such crimes on its territory It appears those who hatched the conspiracy were working for the highest levels of the government of Indian Prime Minister Narendra Modi While the plot was moving ahead last June Mr Modi was being feted at the White House for his commitment to democracy The Post reports that U S spy agencies have tentatively assessed that Mr Modi s national security adviser, Ajit Doval, was probably aware of RAW’s plans to kill Sikh activists but officials said no proof has emerged The target was to be Gurpatwant Singh Pannun a U S citizen general counsel for the New York-based Sikhs for Justice, a group that advocates for some or all of Punjab state in northern India to secede and form an independent Sikh state According to the indictment the

plotters hired Nikhil Gupta, an associate in India who has been involved in weapons and narcotics trafficking to orchestrate the assassination including hiring a killer in the United States At the request of the United States, Mr Gupta was arrested while traveling to Prague at the end of June and has been charged with murder for hire which he denies The killing was not carried out The plot was unfolding just when another Sikh separatist leader Hardeep Singh Nijjar, was killed outside a Sikh temple in British Columbia Mr Nijjar was an associate of Mr Pannun According to the indictment, on June 20, two days before Mr Modi spoke at the White House the chief plotter now identified as Mr Yadav sent Mr Gupta a news article about the Canada murder and told him the assassination of Mr Pannun is a priority now Prime Minister Justin Trudeau announced in September that Canada had “credible evidence” of India’s involvement in Nijjar ’s death

Both cases mark a serious and disturbing escalation in transnational repression governments brazenly attempting to punish, kidnap or assassinate critics, activists, dissidents and journalists far beyond their own borders, violating the laws and norms of other countries with impunity The practice has become alarmingly frequent including in the United States According to Freedom House, the top 10 perpetrators are: China, Turkey, Tajikistan, Russia, Egypt, Turkmenistan, Uzbekistan, Belarus Iran and Rwanda

The United States has strategic interests in a solid long-term relationship with India which President Biden has correctly pursued in hopes India will prove a

accounts with the federal government paving the way for the provincial government to receive Rs 14 billion from the centre The said amount could be transferred to the provincial government in May According to Khyber Pakhtunkhwa Finance Advisor Muzammil Aslam several cases between the centre and Khyber Pakhtunkhwa are under discussion Talks are underway on about 12 issues, ranging from funds slashes petrol price by Rs5 45, high-speed diesel by Rs8.42 ISLAMABAD S TA F F R E P O R T The government on Tuesday slashed the price of petrol and high-speed diesel (HSD) for the next fortnight by Rs5 45 and 8 42, respectively In a notification, the finance ministry said the reduction was due to price variations in the international market because of a decreasing trend in prices of petroleum products during the last fortnight It said the new petrol price was Rs288 49 per litre and that of HSD was Rs281 96 A fortnight ago, the government had increased the price of petrol and HSD by Rs4 53 and Rs8 14 per litre The government has already achieved Rs60 per litre petroleum levy maximum permissible limit under the law on both petrol and HSD Informed sources had earlier told media that the prices of petrol and diesel were expected to drop by about Rs5 and Rs9 per litre, respectively, mainly because of a fall in the international prices and import premiums The sources said the prices of petrol and HSD had declined in the international market by about $3 and $5 per barrel respectively in the last fortnight IMF urges Pakistan to protect ‘most vulnerable’ sections of societ y WASHINGTON S TA F F R E P O R T The International Monetary Fund (IMF) has emphasised the continued protection of the most vulnerable sections of Pakistani society and accelerating structural reforms as means to achieve strong, long-term inclusive growth It also stated that priorities should “include advancing the reform of state-owned enterprises (SOEs) including to ensure that all SOEs fall under the new policy framework; strengthening governance and anti corruption institutions; and continuing to build climate resilience A day earlier, the Fund granted its approval for the disbursement of the final loan tranche, amounting to $1 1 billion, under the Stand-By Arrangement (SBA) The approval signalled the successful conclusion of the second bailout package within eight years In a statement released following the approval the IMF said that the completion of the second review reflects the authorities stronger policy efforts under the SBA, which have supported the stabilization of the economy and the return of modest growth” “To move Pakistan from stabilization to a strong and sustainable recovery the authorities need to continue their policy and reform efforts including strict adherence to fiscal targets while protecting the vulnerable, said the statement The latest approval has brought the total disbursements under the arrangement to about $3 billion “A market-determined exchange rate to absorb external shocks; and broadening of structural reforms to support stronger and more inclusive growth the press release added Pakistan s nine-month SBA approved by the Executive Board on July 12 2023 successfully provided a policy anchor to address domestic and external imbalances as well as a framework for financial support from multilateral and bilateral partners During the staff-level discussions Pakistan assured the IMF that it would continue with the timely implementation of power and gas tariff adjustments to keep average tariffs consistent with cost recovery while protecting
