Planning Act statements on the Transfer/Deed

To complete a purchase and sale, the lawyer for the Seller releases the Transfer and the lawyer for the Buyer registers the Transfer. The Transfer is evidence that ownership has passed from the Seller to the Buyer, previously called a Deed.

The lawyers for both Seller and Buyer each make a statement on the Transfer that they have determined, to the best of their knowledge, that the transfer does not contravene the Planning Act.

The rules for the subdivision of land into smaller parcels are contained in the Planning Act. All lands being transferred started out as part of a larger parcel. Over time, lands are subdivided into smaller parcels. For example, a 200acre farm may have been divided by consent or severance into two 100-acre farms. Or another example, a 20-acre parcel may have been divided into a 160-unit single detached residential subdivision.

The lawyers are required to investigate whether or not the rules under the Planning Act were followed. The types of investigation have changed over time and the use of title insurance may allow less investigation.
