She tells young people to be good to each other and ignore people bringing negativity.

“That’s how we were taught – not to talk back or hit back, even if somebody hit us or verbally abused us.”

If you respond to hate with more hate, “that’s when you’re going to be the loser,” said Iguptaq.

For Louie Innukshuk, another Elder telling stories, he said it’s important to respect the Elders.

The program ran all week in the evenings, with about a dozen youth attending the session Friday, Oct. 6. After some country food, youth ages 10 and above joined Elders on the couches of Rankin Inlet’s drop-in centre to hear their wisdom and ask questions.

“I think the Elders really enjoy telling their stories and how they lived in their childhood,” said Nicole Ymana, president of Live for Life, an organization that began before Covid with the goal of spreading mental health awareness in Rankin Inlet and beyond.

“We wanted to help the community out by bringing people together and celebrating life,” said Ymana about the group, which paused operations during the pandemic but is up and running again.

For Ymana, hunting is her key to mental clarity.

“That’s what I do when I feel like crap,” she said. “I go on the land and just go hunting. To me it feels like you connect to the nature. It’s so peaceful there, no traffic, you see one hunter or two here and there. For me, that’s therapy.”

She thanked Pulaarvik Kablu Friendship Centre for help in making the Elder-youth storytelling a success, and she hopes to continue running regular events again with Live for Life.

New Iqaluit barbershop aims to show residents ‘you don’t need to go somewhere else’ for a good haircut

Blue Ice Barbershop will offer ‘every type of haircut, every type of design’

Getting a quality haircut in Iqaluit is easier than ever thanks to the opening of Blue Ice Barbershop.

The city’s newest barbershop, which is situated behind the Legion, officially opened its doors with a ribbon-cutting ceremony on Wednesday, Oct. 11.

“The excitement is real,” said Mohammed Osman, who founded the shop with fellow Iqaluit residents Samson Mattews and Surafel Asres.

“People are excited for something different.”

Osman and his colleagues, all experienced barbers, decided to open their new shop in response to growing demand for haircuts in Iqaluit.

There are now roughly 8,000 people living in the Nunavut capital, but until recently, there were only a few places to get a haircut in the city.

“The community is large, and there’s a lot of people in town and a lot of people who come in and out who need a haircut,” Osman said.

“People kept saying that they wanted to go down south, or they were waiting for a haircut. We decided to come together to meet the growing demand of a growing community and put up a barbershop to make people feel like they don’t need to go somewhere else.

“We want them to feel like everything they need is here in Nunavut – the professionalism, the atmosphere,”

he added.

Blue Ice Barbershop opened with all new equipment on site, and specializes in all hair types, according to Osman. He and his colleagues will even offer free cuts to residents who can’t afford to pay.

“We do every type of haircut, every type of design,” he said. “There’s so many different people that come together here.

“We’re all one big family here. If somebody needs a haircut and they can’t afford it, we’ll give them a free haircut to help them out.”

The shop’s founders also intend to offer training to local young people.

“We’re also going to be doing training for the locals, for any young kids, to help them learn to cut hair,” said Osman.

The shop’s community-minded ethos is reflected in the outreach Osman, Mattews and Asres did ahead of their grand opening.

Over the Thanksgiving weekend, the trio delivered dozens of meals to needy Iqalummiut as a way of thanking the city for allowing them to open their new business.

“When people are thinking of grand openings, they’re thinking of making their quota for the day and how many clients,” he said. “We thought we should take a different approach by giving thanks to the community for giving us the opportunity to open.”

“We’re part of the community and we want to show our gratitude and communication however we can.”

Kevin Iksiktaaryuk and James Taipana will be on fall election ballots

Kevin Iksiktaaryuk came second in Baker Lake’s 2019 municipal election for mayor, losing out to Richard Aksawnee by 46 votes.

He got back on council due to a vacancy in 2022, and now he’s aiming for the mayor’s seat again alongside candidate James Taipana.

“I’m running for mayor because I want to continue the good work that our hamlet has been doing,” said Iksiktaaryuk.

Born in Baker Lake, he also previously served on hamlet council in 2017 and has worked for the Government of Nunavut and Qulliq Energy Corporation.

But it was his time at Nunavut Sivuniksavut that steered him toward politics and ignited his passion to do good for his community.

“I like to help people,” said Iksiktaaryuk, adding that his priority is to improve engagement with residents through better communications from the hamlet. “I feel like we can always improve communication, just to streamline things and make things easier for the community.”

His next priority would be economic development and developing five-, 10- and 20-year strategic plans for infrastructure, economic growth and social programs.

“Transparency is an important thing for me,” said Iksiktaaryuk. “If I get elected into office, I want to help educate the community on what hamlet’s capable of, but also what our limitations are.”

There are a lot of expectations to fix problems, but the hamlet doesn’t always have the resources to tackle certain issues and runs a fairly right budget, he said. He’d like to keep meeting minutes updated and increase the hamlet’s “social footprint” in the community.

“My time at council has been very educational for me in how municipalities run, running a balanced budget and all the different subcommittees that exist,” he said.

Taipana declined an interview with Kivalliq News.

Residents donate their Thanksgiving food hampers to victims of a catastrophic blaze

Sanikiluaq residents are rallying to support a local family who lost their home in a fire.

The incident, which has been ruled accidental, occurred on the morning of Oct. 3. All seven residents escaped the blaze, including the Elder who owned the home, but the damage was catastrophic enough that the dwelling needed to be permanently vacated.

“The house was basically completely destroyed and now we have seven people living with their relatives,” said Ron Ladd, Sanikiluaq’s senior administrative officer. “They’re sharing homes with other family members, which were overcrowded to begin with.”

“The family lost everything,” he added.

Citizens of Saniqiluaq, which is perched on an island in Hudson Bay and is home to fewer than 1,000 people, were quick to spread news of the fire on Facebook, encouraging anyone in a position to help the family to do so.

Support was no less apparent

on the ground.

The fire occurred just before the Thanksgiving long weekend, during which time the municipality donated food hampers to every household in the community.

Rather than keep the hampers for their own Thanksgiving gatherings, several families donated their hampers to the people who had been forced out of their home by the fire.

“We were lucky to give a $300 food hamper to every house for Thanksgiving,” Ladd said. “People took their food hampers and they donated their food hampers to the family of seven. That meant them not having a food hamper for their own household, but they knew this family was large and they said, ‘No, we don’t want our hampers.’

“That’s how sharing the community is.”

The hamlet council also pitched in, earmarking $5,000 to support the people who lost their home in the fire.

Relative to the scale of the loss, Ladd noted, that’s “not a lot of money, because the family basically doesn’t have anything.”

Sanikiluaq’s new ATV bridge is the latest sign of progress in ‘a community that felt left out’ Bridge arrives after construction of new baseball diamond, soccer field and floating dock

Sanikiluaq’s new bridge for all-terrain vehicles will connect residents to their traditional hunting and fishing grounds, and it will benefit the small island community in more ways than that.

The $100,000, 12-metre bridge, which will be positioned along the six-kilometre trail that stretches behind Sanikiluaq’s new baseball diamond, has yet to be installed, but it has already been constructed.

It was put together in late September and early October by Sanikiluaq residents Kenny Pearce, Moses Ippak, Alexandra Arragutainaq, and Johnassie Amitook. Montreal-based steelworkers Justin and Joel Cote, who are nephew and uncle, also pitched in.

The structure will replace an existing bridge that has fallen into disrepair.

“It was put together as it should be by two steelworkers and four locals,” said Ron Ladd, the community’s senior administrative officer. “We’ll install it when we get time.”

Ladd expects the bridge to have a ripple effect in the way it helps the community.

Three of those residents, he added, were recruited after they helped with construction of Sanikiluaq’s new floating dock, and two of them had previously helped assisted in building the community’s baseball diamond and

soccer field.

When community members pitch in on these kinds of projects, they become more skilled, and may discover they have interest in fields like construction, architecture and engineering, according to Ladd.

“They now have perspective putting a floating dock together, putting a baseball and soccer field together, and now they’ve got perspective putting a bridge together,” he explained. “People are gaining experience, and that’s the key.

“They enjoyed it, and learned from it,

and now we have more skilled people here, which is wonderful,” he said. “It makes a stronger community and future projects.

“The guys from Montreal had very positive things to say about the community, and not only that, they’re happy we got some workers that learned things, worked hard, and got the job done,” Ladd added.

The bridge is also a sign of progress for a community that, situated in the southeast of Hudson Bay, has at times felt isolated and forgotten, he noted.

“People are very delighted that we’ve been able to move projects forward in a community that felt left out,” he said, pointing to other new projects like the floating dock, food bank, and local women and children’s shelter. “I hate to say it, but before I arrived, the community didn’t have a lot of projects going and now this [bridge] is one of many projects.

“We didn’t have the infrastructure.

Now we’re happy to say that we do have the infrastructure with the various partners we have in the federal government and Government of Nunavut. Without their support, we wouldn’t be able to do any of it, and now we’re starting to feel comfortable that we have the opportunities that other communities have had.”

With a goal to be able to serve more Kivalliq medical patients in a nicer facility when they travel south for care, Sakku Investments Ltd. officially opened its Uquutaq medical boarding home in Winnipeg Wednesday, Oct. 4.

“Today is an important day to celebrate this new facility for our people,” stated Dino Bruce, chairman of Sakku’s board of directors, in a news release.

“The name Uquutaq, in Inuktitut, means shelter, a place to rest and stay warm. This new facility will provide comfort to travellers for the nearly 70,000 bed nights when they have to leave our region to seek medical care in the south.”

Upward of 200 people per day from the Kivalliq are assessed and referred for medical travel and appointments. The new facility, which used to be the Clarion Hotel in the Polo Park area of Winnipeg, has 139 rooms and 40,000 square feet of commercial office space and event areas. It replaces the Kivalliq Inuit Centre, which often faced criticism about its services or the fact that when it became full, overflow travellers would be sent to other hotels in Winnipeg, causing stress for patients and their escorts.

Key to the new facility, says Sakku, is cultural space for programming and services to better meet the needs of care for medical travellers.

“Travelling for medical services is a challenging and stressful time for families and this wonderful facility will better meet the needs of Kivallirmiut,”

stated Kivalliq Inuit Association President Kono Tattuinee. “The KIA is pleased to support Sakku and to see their investments resulting in improved services and health outcomes delivered for Nunavummiut.”

Sakku purchased the building earlier this year and secured a short-term contract with the Government of Nunavut to provide medical boarding home services for travellers, which includes airport pickup, accommodations, meals, cultural spaces and transportation to medical appointments and services.

Hundreds of people came out, right on time, for some free turkey takeout dinners courtesy of the mental health department in Rankin Inlet Friday, Oct. 6.

The line started early and by the time 5 p.m. hit, the parking lot of the Tapariit complex was jam-packed with dozens, if not hundreds, of people waiting their turn for takeout.

Several organizations provided donations to make the event a success, and it included prizes such as Canadian North and Calm Air tickets.

With the first flakes of snow scattering earlier in the day and a warm sun sending off the evening, residents headed home with their dinners to enjoy the long Thanksgiving weekend.

Chesterfield Inlet, Whale Cove schools part of initiative

Victor Sammurtok School in Chesterfield Inlet and Inuglak School in Whale Cove are two of five schools testing full-day kindergarten in the territory for the 2023-24 school year.

The pilot program is the first step to help guide a phased system-wide rollout, the Department of Education told Kivalliq News in an email.

“Piloting the expansion of FDK (full-day kindergarten) in five select schools will help to ensure that the expanded programming is beneficial for students and staff,” stated the department.

A working group, comprising Inuit educators and kindergarten teachers from across Nunavut, was established to develop recommenda-

tions on how to use the additional instruction time to ensure that full-day kindergarten offers an “educationally beneficial” experience for students.

To that end, the working group has recommended that the program promote a holistic, integrated approach grounded in Inuit Qaujimajatuqangiit principles; be play-based; emphasize additional instructional time in the Inuit language, literacy and numeracy; and prioritize learning across a range of areas including physical, social and emotional health and wellness.

The other schools participating in the trial run are Nanook School in Apex, Qaqqalik School in Kimmirut and Jimmy Hikok Ilihakvik in Kugluktuk.

ing installation of a new sink, patched walls and new furniture. As of early October, there were six students registered in the program.

“The FDK program is well supported by the Chesterfield Inlet DEA and parents,” stated the department in an email. “Parents have said that the FDK is a blessing. Parents who work are happy and some parents are also at the school working.”

For Whale Cove, the school has seen several physical changes to accommodate full-day kindergarten including new bathroom accessories, a new door, new toilet and sink and new furniture.

“The program is taught by a qualified teacher who attended the FDK training in Iqaluit,” stated the department. “Our teacher feedback is that the training was a good opportunity for her to learn more about teaching and learning at kindergarten level.”

There were 13 students enrolled in the program at the Whale Cove school as of press time.

Currently, not all schools in Nunavut have the required space or resources to support full-day kindergarten, said the department, which is developing a long-term plan for the sustainable implementation of the program in all schools.

Phase 2 of the rollout will see the department focus on schools that would be the most cost-effective options in terms of renovations.

Currently, the department is considering schools in seven communities for the second phase of the rollout.

“Lessons learned from the pilot will be used to inform the Department of Education’s longterm plan and ensure that all schools in Nunavut are adequately prepared to offer full-day kindergarten in their communities,” stated the department.

Rankin Inlet mother balances home life and entrepreneurship

Soon after graduating high school in Rankin Inlet, Nathalie Taylor welcomed her first daughter into the world, and suddenly she needed money.

“With the shortages of childcare in Nunavut, I couldn’t get a job, so I started sewing to make income,” said Taylor, now 24.

Her business began as Nathalie Taylor Creations, as she sewed parkas, mitts and other pieces to sell.

“Parkas are the most popular,” said Taylor, adding that she’s fielded a lot of amauti orders this year.

As her business grew, Taylor changed the company name to Inspired by Nabvat, referencing her daughter Piujulia (Nabvat) Taylor, whose birth inspired the pursuit in the first place.

When it comes to her work, she won’t make the same thing twice.

“I like the idea that you have something and nobody else will have it,” said Taylor.

She will repeat a style, but she uses different colours or makes other changes, as that way, there are no replicas.

For a parka, furs can cost $250 to $310, with the rest of the material being over $200 per coat.

“So you’re looking at spending about $400, $500 on the material, and then you could flip that and make over $1,000 sometimes if you’re lucky.”

Each coat takes her between five and 12 hours to make. She mostly avoids selling spots – a common way of auctioning clothing in the north – and prefers to sell direct on Facebook, Instagram and anywhere she can connect with customers.

Most of her buyers are in Nunavut, with a customer base in Manitoba and Alaska as well.

One of her challenges is the amount of scam artists online, she said, who will take her photos of parkas for sale and dupe unsuspecting buyers who pay but never receive the product.

Earlier this year, Taylor had a tradeshow booth in Ottawa, but sold only two parkas. That was a hit to her energy at the time, and she pivoted to doing eyelash and beauty work in Rankin Inlet in addition to fashion.

But when it came to the 2023 Kivalliq Trade Show, her booth at the art market sold out completely, reigniting her passion.

“I’m doing okay,” she said about total income from her work. “It’s a lot of hours, a lot of working, but it’s worth it in the end.”

Eventually, her goal is to open her own shop.

For the time being, she’s working to make her business more ‘official’ with marketing, a website and similar.

She loves seeing her children get excited about her work.

“The main thing that really makes me enjoy it every day is having my kids, seeing them proud,” said Taylor about the benefits of running her own business.

Her advice to hopeful entrepreneurs: “Just put your all into it. Go 100 per cent. Don’t doubt yourself and just go all in.”

Prime Minister Justin Trudeau got an up-close look at the burned-out remains of homes and vehicles Wednesday as he toured parts of the Northwest Territories ravaged by a record wildfire season.

Trudeau, along with local politicians, walked up residential driveways in the community of Enterprise to see the damage in the community of about 100 people.

Chaal Cadieux, a foreman with the hamlet, told the prime minister that everyone got out safely.

A fast-moving wildfire in August tore through Enterprise, destroying nearly all its homes and structures. About 20 residents have returned, but many are staying elsewhere in the territory and other parts of Canada.

Cadieux said his family has found a place to rent 40 kilometres away in Hay River.

As Trudeau and Cadieux walked over to a charred snowmobile trailer and swing set in Enterprise, Trudeau asked about something on the ground. Cadieux said it was for a zip line.

“I know that hitch,” Trudeau said.

Later in Hay River, the prime minister met with the town’s fire chief, Travis Wright, and Mayor Kandis Jameson.

Wright showed Trudeau a series of maps depicting the growth of fires that threatened the community over the summer.

Trudeau said he knows how it feels to face multiple crises. “(Former U.S. president Donald) Trump, the pandemic, the war in Ukraine, to India, to Israel now — it’s like, OK, we are in a time right now where all of us are learning how to respond,” he said.

The NWT saw nearly 70 per cent of its population displaced during the fire season, including a three-week evacuation order that forced about 20,000 people to flee Yellowknife.

Wildfires have burned a record amount of area across the territory since flaring up in the spring.

Ninety-five were burning as of Tuesday.

People in Hay River and the nearby K’atl’odeeche First Nation were forced to leave because of fire in May and again in August. Houses and the band office were damaged in K’atl’odeeche.

It was the later fire, fuelled by raging winds, that tore through Enterprise. Officials said 80 per cent of structures in the community were destroyed.

A few families who no longer have homes are staying in recreational vehicles parked outside the hamlet’s gas station as they wait for information on whether they will get a temporary house or can start clearing debris off their property.

They recounted stories of fleeing a wall of smoke that quickly moved in and the devastation they felt when they were able to return and found the blackened remains of the lives they had built.

Eighty-year-old Amy Mercredi recently re-

turned to the community and said she cried when she saw the reality that the home she’d lived in for decades was gone.

She recalled having to leave with her two young grandsons and, once they had arrived in northern Alberta, learning that their home burned.

Mercredi said one grandson asked about his Lego, his most prized possession that was left behind. She held back tears as she kept driving.

She returned to Enterprise to make sure her grandsons could continue school in nearby Hay River, but they don’t have a permanent place to stay.

Many who visited their burned homes said

hotel rooms are not a long-term solution. The local hotel was also destroyed by the fire, so many are staying in Hay River, where accommodations are scant.

Blair Porter, a senior administrative officer with Enterprise, said he wants to make sure residents can return. The hamlet is trying to find solutions for those who lost their homes.

“One of the things we don’t want to have happen is that people just get fed up … throw their hands up in the air and say they are not coming back,” Porter said.

But, he said, the community needs co-operation from other levels of government to get it done.

Confusing claims about the online streaming law abound.

How does it really work?

Last week, the CRTC asked services that broadcast audio or video to register with them by Nov. 28 Confusion over Canada’s Online Streaming Act is running rampant on social media, clouding debate over what the legislation actually does.

Billionaire Elon Musk, podcaster Joe Rogan and other commentators have been sharing dubious interpretations of the law to their millions of combined followers.

Conservative Leader Pierre Poilievre has repeatedly called it a “censorship law” and promised to revoke it should he become prime minister.

The fact that many of the details are still to come through regulations and ongoing consultations is also prompting questions and fuelling debate.

Here are some key things to know about the controversial legislation.

What is the Online Streaming Act? The Online Streaming Act, formerly known in Parliament as Bill C-11, is the Liberal government’s second attempt to bring major online streaming services into Canada’s broadcasting system, and eventually have them contribute to supporting local music and stories.

A first version, introduced in 2020, did not pass before the 2021 election.

Traditional broadcasters have been part of this system for decades, contributing billions of dollars towards Canadian content.

But broadcasting is no longer available just on TV, radio, cable and satellite.

Broadcasting now happens on streaming services such as Netflix, Amazon, YouTube and Apple. It’s why you no longer need a cable subscription — or even a television — to watch live talent competitions, newscasts and sporting events. It’s why you don’t need radio to listen to music or get local news.

Both Liberal and Conservative governments have passed laws related to broadcasting Canadian content. The last major overhaul of broadcasting law happened in 1991, under Brian Mulroney’s Progressive Conservative government, when streaming services did not yet exist.

What does the legislation do?

Right now, what exists is a framework that sets out the role and powers of Canada’s broadcasting regulator, the Canadian Radio-television and Telecommunications Commission, which operates at arm’s length from the government.

The bill says online broadcasters will be required to contribute to the creation, production and distribution of Canadian content. It also seeks to support Indigenous content and original French-language programming.

But key aspects of the regulations that will implement this law have yet to be defined, including criteria to determine what exactly is considered Canadian content, or the level of support companies will need to provide.

When is the legislation going to take effect?

Final decisions from the CRTC about how the law is to be implemented are still years away.

The regulator is consulting Canadians about what the new broadcasting system should look like, but has said it is not predetermining any outcomes.

Over the next few years, it will ask Canadians to help it design the broadcasting system of the future. The CRTC said that will include a major public process next year to define what Canadian content is.

Once a definition is in place, the CRTC says it will then start looking at streaming companies to see whether the new broadcasting rules will apply to them.

Who will fall under the legislation?

Last week, the CRTC asked services that broadcast audio or video — meaning those that could potentially be regulated under the law — to register with them by Nov. 28, a requirement already in place for large cable companies.

The demand applies to companies that make more than $10 million in annual broadcasting revenues in Canada. The CRTC wants baseline information such as the business name and address, contact information and what kinds of broadcast services the company is offering online.

Such services include streaming services, social media services, subscription TV services that are available online, radio stations that livestream on the internet and services that offer podcasts.

The regulator went with a $10-million threshold because companies that large could be seen to have an impact on the Canadian broadcasting system.

What about content creators and social media?

The Liberal government and the CRTC have said they are not interested in content creators, whether they upload makeup tutorials, review restaurants, follow dance trends on TikTok or rage against the machine.

Draft policy issued by the government tells the CRTC to leave out social media users, including businesses, who upload content online.

The Department of Canadian Heritage said the act targets the kind of professional, licensed commercial content that is found in traditional broadcasting, such as TV and radio.

It could affect social-media companies. The CRTC says that depends on whether they broadcast licensed content. For example, people who upload videos on YouTube will not be regulated, but YouTube could potentially be regulated for its commercial content.

The regulator says it recognizes that the vast majority of social-media networks do not act as broadcasters, meaning the CRTC would have no input or control over how they work.

What about podcasts, adult content and video games?

The regulator says if something is considered trifling in terms of the overall broadcasting system, it may not even be considered by the law. For example, it does not view adult content and video games as currently affecting the system writ large.

Podcast services that make more than $10 million in annual revenue are being asked to register with the CRTC. The regulator says it expects that will end up applying to two or three companies, including Apple, Spotify and possibly CBC Listen, depending on the revenues that come specifically from podcasts.

Not all companies being asked to register will end up being regulated. The CRTC says it wants the information so that if podcasts affect the broadcasting landscape in a big way down the line, it can get in touch with the companies and make determinations about

how the law applies to them. Even then, the regulator would have to hold a public process.

Companies must self-identify. If they don’t want to comply, they can go to Federal Court, but the CRTC says most companies act in good faith to comply with the law.

Individual podcasters are not being asked to register, the CRTC says, and it cannot ask distributors of podcasts for any personal information about them. Companies that list a directory of podcasts won’t have to register, either.

The CRTC says it’s not aware of any individual in Canada who is making $10 million a year from podcasting. But even if a Canadian podcaster signed a $10-million deal, that person wouldn’t need to register and wouldn’t be regulated because only services, not users, are covered by the law.

Will the law moderate content, censor people or control speech?

The law is not concerned with social media users — not even those who criticize the prime minister.

The CRTC says it respects Canadians’ right to freedom of expression, and people will still be able to listen to and watch the content of their choice.

Sen. Marc Gold, the Liberal government’s representative in the Senate, told the Senate during its marathon study of the bill that the legislation “will not interfere with or stifle the expression of Canadian voices.”

Liberals’ bail-reform bill sparks concerns about need for more legal aid funding

Criminal lawyers, legal aid groups and some senators say they worry about straining legal aid services and provincial court systems

Many in Canada’s legal community are expressing concern about how the overloaded court systemand those needing legal aid could be affected by a Liberal bill that proposes to make bail harder to access.

Senators on a committee probing Bill C-48 will enter the final phase of their study later this month by going over the legislation clause by clause and suggesting amendments.

Federal Justice Minister Arif Virani has encouraged the Senate to pass the bill quickly, saying the fact that all provincial and territorial governments pushed for the measures underlines their urgency.

Police leaders also support the bill, saying these are much-needed reforms after a spate of high-profile killings by repeat violent offenders, who in some cases had been released on bail.

But civil society groups and legal advocates representing people who are Black, Indigenous or otherwise marginalized say its measures could worsen the overrepresentation of such groups behind bars — something Liberals have promised to address —while failing to make communities any safer.

The bill was drafted to target offenders who have a violent criminal past and came after sustained pressure from premiers and the federal Conservatives for the Liberals to enact changes.

It seeks to expand what are known as reverse onus provisions, meaning it would be up to an accused individual to argue why they should be released while they await trial, rather than Crown prosecutors having to show why they should remain jailed.

The Liberals want to expand existing reverse onus measures to include more firearm offences, including breaking and entering to steal a firearm.

Reverse onus provisions would also apply in cases of serious violent offences involving a weapon — which could involve weapons such as bear spray or knives — when the accused person was convicted of a similar offence within the past five years.

Many in the legal community are expressing concern about how the Liberals’ proposed bail-reform will impact an already overloaded court system by making bail harder to access for certain people charged with a crime. “We just need to be more attentive to what are the consequences of the legislation for the actors who will have to deliver the program,” Saskatchewan Sen. Brent Cotter, who chairs the Senate’s legal committee, said in an interview.

“Legal aid systems will likely get burdened more than they are now, and we haven’t been specifically proactive on that.”

While legal aid is delivered by provinces to

provide those who cannot afford to hire a lawyer a way to access legal advice, the system is cost-shared with the federal government. For years, lawyers have voiced concerns that legal aid in the country is not funded to the level of service that is needed.

Cotter added the expansion of reverse onus provisions will affect people who are of lower income, and have a disproportionate impact on Indigenous and Black people.

“If you’re in the lower economic range of people, you won’t have as easy a time mounting the case to get yourself released on bail. And so the support that the legal aid system can provide might be the most important professional resource that could be made available.”

The Association of Legal Aid Plans of Canada, which represents legal aid groups from across the country, said most people who end up in bail court rely on such services.

It warned that requiring more individuals charged with a crime to show why they should be released will not only “increase the length and complexity of many bail hearings,” but also put more strain on “defence and court resources” and risk worsening court backlogs.

The only way to mitigate such risks, especially for those who cannot afford legal representation, would be to boost funding to legal aid services, the association said.

British Columbia attorney general Niki Sharma, whose province supports the bill, also acknowledged a need to consider its impact on legal aid programs in testimony earlier this week.

She said B.C. is grateful for the increased funding it has received over the past few years, but noted it might not be enough.

“We think we need to work together with the federal government to get further increases for criminal legal aid to make sure people have that ability to get representation if they can’t afford it,” she said.

Boris Bytensky, a treasurer with the Criminal Lawyers’ Association, which represents nearly 2,000 lawyers, has suggested to senators that if Bill C-48 becomes law it will result in more bail hearings, meaning more courtrooms will be needed as well as more lawyers.

When it comes to legal aid, he said, “somehow additional funds are going to be needed,” whether they come from Ottawa or the provincial governments.

A spokeswoman for Virani said in a statement that provinces are the ones who administer criminal legal aid and noted the Liberals have increased funding, which has “offset significant cuts made by certain provinces.”

“Minister Virani will reiterate to his provincial and territorial counterparts the importance of working together to ensure stable and predictable funding for legal aid so that Canadians can access justice,” Chantalle Aubertin said in an email.

Polar bears may struggle to produce milk for their cubs as climate change melts sea ice, says researcher While on land, polar bears can lose around a kilogram of body mass per day, so making it to the end of the ice-free season requires them to carefully manage their energy. This fasting period is challenging for all bears, but particularly for polar bear mothers who are nursing cubs.

Our research, published in Marine Ecology Progress Series, found that polar bear lactation is negatively affected by increased time spent on land when sea ice melts.

Impaired lactation has likely played a role in the recent decline of several polar bear populations. This research also indicates how polar bear families might be impacted in the future by continued sea-ice loss caused by climate warming.

Challenges of rearing cubs While sea ice might appear as a vast and perhaps vacant ecosystem, the frozen Arctic waters provide an essential platform for polar bears to hunt energy-rich seals — the bread and butter of their diet.

Sea ice is a dynamic environment that can vary through time and in different regions of the Arctic. Polar bears in Canada’s western Hudson Bay area experience seasonal sea ice, which melts in the warmer summer months, forcing the polar bears to move onto land until cooler winter temperatures cause the sea ice to refreeze.

While on shore, hunting opportunities are rare and polar bears generally spend their time in a fasting state. Polar bears rely on their immense body fat stores to fuel them during these leaner months, with some individuals measuring almost 50 per cent body fat when they come onshore in early summer.

While on land, polar bears can lose around a kilogram of body mass per day, so making it to the end of the ice-free season requires them to carefully manage their energy. For most polar bears, this means reducing activity levels and conserving energy until the sea ice returns and seal hunting can resume.

Females with cubs must also factor in the additional burden of lactation. Polar bears produce high-energy milk, which — at up to 35 per cent fat — is like whipping cream. This highfat milk allows cubs to grow quickly, increasing from just 600 grams at birth to well over 100 kilograms by the time they are around two-and-a-half years old and leave their mothers to become independent.

During the onshore fasting period, polar bear mothers face a difficult trade-off: Stop lactating and risk the health of her growing cubs or continue nursing and risk her own survival as her energy reserves are depleted.

Moderating lactation Although lactation is important to both mothers and cubs, studies on polar bear lactation are relatively rare.

To better understand how females manage their lactation investment, our research team revisited a data set of polar bear milk samples collected in the late 1980s and early 1990s from polar bears on land during the ice-free period.

We estimated how long each polar bear mom had been fasting based on annual sea-ice breakup dates and found that the energy content of their milk declined the more days spent onshore. Some bears had stopped producing milk entirely. Both milk energy content and lactation probability were negatively related to the mother’s body condition, meaning females in poor body condition had to prioritize their own energetic needs over their cubs.

The bears who reduced their investment in lactation benefited by using up less of their body reserves, meaning they could fast for longer. Yet the cubs who received lower energy milk grew more slowly than offspring of females that maintained their lactation effort. In the long term, this may reduce cub survival and, ultimately, negatively affect population dynamics.

Climate change and population declines After around three months on land, the probability of a female with cubs lactating was 53 per cent. This dropped to 35 per cent for a female with yearlings (older cubs from the previous year).

The data in our study were collected around three decades ago. Since then, climate warming has meant that the ice-free season in western Hudson Bay has been extending by around seven days per decade. Polar bears are now regularly forced to spend more than four months on land.

As the ice-free season has increased and polar bears must go for longer without food, their average body condition has declined. The ability of female polar bears to nurse their cubs has probably also become increasingly impaired.

This may have contributed to the 50 per cent decline in the population size of the western Hudson Bay population over the last four decades, and is likely to contribute to further declines if climate warming and sea-ice declines continue as projected without mitigation.

This research adds another piece to our understanding of polar bear resilience to climate change. Without action to halt climate warming and sea-ice loss, survival of cubs will be at risk across the Arctic.

Innu take aim at Nunatukavut as court date postponed A long-simmering dispute about Indigenous identity boiled over into sustained attacks Tuesday, Oct. 10, as Innu Nation leaders told a news conference in Ottawa the Nunatukavut Community Council (NCC) has no historical claim to native status and is fraudulently attempting to steal land and benefits from Labrador’s Innu and Inuit communities.

The event was intended to take place on the eve of federal court hearings into a challenge by the Innu Nation against a 2019 memorandum of understanding (MOU) between the federal government and the NCC. Those hearings have been postponed indefinitely.

Nunatukavut, formerly known as the Labrador Metis Nation, claims to represent descendants of European settlers and Inuit along the south coast of Labrador.

“NCC has come from all parts of the world.

They have come to manipulate the Innu rights,” Innu elder Tshaukuesh (Elizabeth) Penashue countered on Tuesday.

“I want to cry, but I will be strong for my people.”

Newly elected Innu Grand Chief Simon Pokue said Nunatukavut is trying to rewrite history.

“Stop using your white privilege to take from

the Innu,” he said. “Stop pretending to be something that you are not.”

Central to the controversy is whether the NCC should get Section 35 Indigenous status under the Canadian Constitution.

Senwung Luk, a lawyer representing the Innu, said Tuesday the problem with the 2019 MOU is that it assumes the NCC has that status as a precursor to discussing future land claims.

Luk said it makes no sense for Ottawa to sign such an MOU, since the government has already rejected the NCC’s application for status four times, the last time being in 2013.

While the Innu Nation launched the challenge, the Nunatsiavut government (NG) — representing Labrador’s Inuit people along the northeast coast — has been most vocal over the past four years, challenging almost every word and action of the NCC. In November 2022, Nunatsiavut described the NCC’s plan to offer lessons in the Inuit language of Inuktitut as “cultural appropriation.”

The NG was granted limited intervener status in May 2023.

Last month, both Inuit and Innu leaders called for provincial Indigenous Affairs Minister Lisa Dempster’s resignation after Premier Andrew Furey offered an apology to residential school

survivors in the NCC. Innu leaders said Tuesday there’s a political dimension to the dispute, since Dempster, along with federal Labrador MP Yvonne Jones, claim to be Nunatukavut members.

Nunatsiavut has already reached its Labrador Inuit Lands Claims Agreement with Ottawa, but the Innu have not yet reached that point after four decades of negotiations.

The war of words between Nunatsiavut and Nunatukavut has taken on academic dimensions, as the two entities have exchanged a rebuttal and counter-rebuttal of a study called “Unveiling Nunatukavut” released by the NCC in 2010.

The study is based on documentation and anthropological findings that identify a unique marriage of southern Inuit and European cultures in the early days of Labrador settlement.

But Innu leaders insist those who trace their ancestry to those roots have lived lives indistinguishable from their English-speaking settler neighbours.

In a rebuttal report written for Nunatsiavut, researcher Darryl Leroux accuses Metis leaders of “inventing” an Indigenous identity that didn’t exist until the 1980s.

Meanwhile, NCC President Todd Russell is-

sued a statement late Tuesday saying he wasn’t surprised by the Innu Nation’s comments.

“The Innu Nation continues to intentionally spew misinformation and rhetoric about NCC and the rights of NunatuKavut Inuit. These baseless allegations are an obvious attempt to politicize the process and to negatively influence the federal government and our relationship with them.”

Russell said the NCC is not a “new group,” despite the characterization put forth by the Innu Nation.

“We are the descendants from generations of Inuit who have lived on our lands, ice and waters for hundreds of years.”

Answering claims that Nunatukavut could end up taking away scholarships and other benefits from Innu members, Russell said Indigenous rights and land claims are not a zero-sum game.

“The MOU itself sets out how NCC will work with Canada to develop a joint mandate for future negotiations. It in no way, shape or form diminishes or negatively impacts the Innu Nation or any other Indigenous group.”

A new court date has not been set.
