Nunavut Court of Appeal rules Kivalliq Hall was a residential school Decision means former students could be entitled to thousands from the federal government

Former Kivalliq Hall students scored a major victory last week after the Nunavut Court of Appeal upheld a ruling requiring the federal government to pay out compensation for its role in running the school.

“It makes me feel like we’re finally treated equally and the same as any other Canadian citizen,” said former student Simeon Mikkungwak.

The case has been ongoing since 2013 when Mikkungwak brought forward his claim on behalf of himself and other students with the support of Nunavut Tungavik Inc. (NTI) that Kivalliq Hall was a residential school.

Kivalliq Hall was run as a boarding home for students attending high

school in Rankin Inlet between 1985 and 1995.

Residential school survivors have been eligible for common experience payments ever since the federal government settled the largest class action suit in Canadian history with the Indian Residential Schools Settlement Agreement.

The Kivalliq Hall court case was originally settled in Mikkungwak’s favour in 2016 but the federal government appealed the decision.

Mikkungwak is hailing the recent verdict as a milestone. However he remains cautious because the federal government might still seek to challenge the case in the Supreme Court.

“When you look at the six year stretch, it’s all from the Government of Canada’s side to really prolong this,” said Mikkungwak, who was been the MLA for Baker Lake for

the past five years. “If they were smart after two court rulings they wouldn’t appeal. But you never know with the Government of Canada.”

The federal government argued Kivalliq Hall students should not be eligible for compensation as the school was run by the Northwest Territories, before Nunavut became a territory, and not Canada.

In the court’s ruling, which was made public on July 20, the three judges presiding over the appeal upheld the original ruling that this fact did not absolve the federal government.

According to the accepted facts of the case, the government funded the entire construction costs as well as some of the operating costs of Kivalliq Hall. At the time, the territory was governed by a federally appointed commissioner.

Ever since the original ruling, Mikkungwak said he has received an outpouring of support from other former students for bringing forward the case on their behalf.

“After that ruling, the phone and the computer messages have been nonstop,” he said.

If the Nunavut Court of Appeal decision holds up, Kivalliq Hall students will be eligible for $10,000 for the first year in attendance and $3,000 for every subsequent year.

Anyone who experienced abuse or harsh treatment can also apply for additional compensation.

Matthew Dillon-Leitch, spokesperson for Crown Indigenous Relations, said his office was reviewing the court’s ruling.

“We are committed to providing a fair, comprehensive, and lasting resolution to address this dark

chapter of Canada’s history,” stated Dillon-Leitch in an email.

Mikkungwak made it very clear that he suffered no abuse and received a good education at Kivalliq Hall. He also has little use for the money, he said.

However, he knows some residential school children who faced terrible conditions.

More than anything, Mikkungwak said he is passionate about winning the case as a matter of principle. Now it’s just a matter of waiting to see if the federal government wants to keep up the fight, he said.

A new playground GN replaces old structure due to safety concerns

Baker Lake didn’t go without a playground for long.

The Department of Education installed a new play structure last week, just a few days after the community’s SAO Sheldon Dorey raised concerns that the previous one had been demolished with no attempt to salvage it.

In an email to Kivalliq News which included comments that were mistakenly not printed in a previous story

on the matter, (Anger after GN bulldozes playground’, Aug. 1), department spokesperson Sandi Chan said the previous structure was removed due to safety concerns.

“The playground structures in Baker Lake were inspected by a certified play structured installer and all the equipment that was removed was removed due to public safety concern,” she wrote. “Removal is important as the department cannot stop public access to the unsafe equipment.”

According to the depart-

ment, play structures have an installation requirement which meant the process had to be supervised by a CSA approved and certified play structure installer.

“The firm that the Department of Education uses have certified people on staff.”

Chan wrote than any parts of the playground which could not be reused were destroyed.

“Any salvageable (equipment) has been stored in a sealift can for the hamlet to reinstall at another location as the hamlet sees fit.”

Vancouver-based Dunnedin Ventures has recovered 338 diamonds from the Kahuna project near Rankin Inlet.

Over 300 diamonds recovered at Kahuna project near Rankin Inlet Rankin Inlet Dunnedin Ventures recently recovered 338 diamonds from a new kimberlite pipe at its Kahuna property located near Rankin Inlet.

A July 11 news release stated the diamonds were recovered from 127.7 kg of material.

“We are very pleased that our DIM-based exploration protocols have discovered the concealed extension to a potentially high-grade diamond source with high-quality diamonds," stated Chris Taylor, CEO of Dunnedin, in the release. "The number and quality of larger diamonds in this initial sample are very encouraging."

Boil water advisory Whale Cove A boil water advisory was issued for Whale Cove by the Department of Health on Aug. 3.

A news release from the department stated the advisory is a “precautionary measure due to total coliform bacteria in the water system.”

Whale Cove has had a long history of boil water advisories, with the last one coming at the end of June.

In 2017 the community was under a four-month boil water advisory in the summer. The government has paid $500,000 to purchase more advanced filters for the system with a focus on targeting coliform. The upgrades are expected to be installed later this month.

During a boil water advisory, people can shower and bathe using tap water, but should avoid drinking it unless it has been brought to a rolling boil for at least a minute.

The department said it would provide an update about the situation if there are any changes.

Butchering class for suicide prevention Arviat A group of 10 youth in Arviat will be taking part in a meat butchering project aimed at people who are searching for healing from Aug. 9 to 11.

The group of five males and five females will head to 3rd Bridge for three days and two nights.

During the day they will go hunting and learn how to cook and prepare caribou meat. At night they will take part in twohour long healing sessions.

The females will sleep in the cabin while the males will sleep in the tents. Transportation will be provided but participants may also use their own vehicles to get there.

Ball hockey hits the tundra Arviat Two time World Champion Mike Hunt will be coming to Arviat to put on a roller hockey clinic in the community next week.

Hunt will be arriving in town this week and plans to install a roller hockey floor in the gym on Friday.

Dates have yet to be confirmed for the camp but Hunt says he hopes it will run for four to five days beginning Aug. 11.

Polar bears illegally shot

Five unharvested animals killed in Arviat following death of Aaron Gibbons

The killing of five polar bears around Arviat in recent weeks has sparked a debate over how the population should be managed.

The animals were left unharvested and hunters had already used up all the tags allocated for the Kivalliq region earlier this year, which means the bears were shot illegally.

The slaughter comes just a few weeks after Aaron Gibbons died protecting his children from a polar bear attack on Sentry Island near the community. The bear is one of the five that was killed.

Paul Irngaut, director of the Wildlife and Environment department of Nunavut Tunngavik Inc., said it is understandable bears are being killed in Arviat given the tragic circumstances.

“It’s natural for any community to take action,” he said. “We feel for the community and we know they’re hurting and we’re very supportive.”

Arviat’s deputy mayor Brian Aglukark Sr. has been an outspoken critic of the government’s approach to polar bear management ever since Gibbons’ death.

In a Facebook post on July 31, he called on Arviat North-Whale Cove MLA John Main to start a dialogue with his constituents on the issue.

Aglukark witnessed the attack on Gibbons and was one of several people who tried to revive him at the scene.

Aglukark could not be reached for comment. However in a public Facebook post from July 7, which received 76 likes, Aglukark advocated killing polar bears without harvesting them.

“In the absence of a system that protects Inuit, it’s life traditional style, when I come across a polar bear while I camp, while berry picking, fishing, hunting an animal or marine mammal, I shall without remorse, guilt or

According to section 5.6.52 of Nunavut Lands Claims agreement, “a person may kill wildlife if it is necessary to preserve a human life or to protect that person’s property.”

The Department of Environment declined an interview request to discuss polar bear management.

In an email to Kivalliq News, senior policy analyst Jonathan Pynn stated the department is working with the Arviat Hunters and Trappers Organization, “to prevent any further illegal killings of polar bears.”

Communities in the Kivalliq and especially Arviat have long been calling for an increase in polar bear harvesting

quotas.

Earlier this year, the Nunavut Wildlife Management Board bumped up the quota for polar bear harvesting to 34 animals from 28, and it would like to see that number increased even more, said Irngaut.

“We’ve advocated for the HTOs, requests and we’ve always supported the communities for an increase,” he said.

At the time, the Government of Nunavut requested for the quota to be kept at 28 because the territory’s polar bear population declined to 842 animals in 2016, down from 1,030 in 2011. The management plan for Kivalliq’s polar bear population is currently being reviewed.

The NWMB is expected to hold community consultations on polar bear management in Arviat this fall.

Feds should admit defeat Northern News Services

They say that good things come to those who wait, but the Canadian justice system can take a long time to deliver.

For the past six years, Baker Lake’s Simeon Mikkungwak has been fighting the Canadian government to compensate students for being sent to Kivalliq Hall.

The facility was run as a boarding home for students attending high school in Rankin Inlet from other communities between 1985 and 1995.

When Canada agreed to pay out compensation to the Indian Residential Schools Settlement Agreement as part of a class action suit in 2006, Mikkungwak, who is a former Kivalliq Hall student, was left wondering why he and other students who attended were not included under the agreement.

Celebrating family in Rankin Northern News Services

Rankin Inlet was busy throughout July 28 as the community celebrated its annual Family Fun Day. The afternoon kicked off with games, a barbecue and music, the highlight of which was a throat signing competition.

Draws for big prize items like barbecues, bikes and trampolines drew big crowds as the day wound down.

The evening wrapped up with a square dance and a jigging competition that went well into the night.

Louie Inukshuk, 67, won first place in the walrus pull. He beat out people half his age after it took eight grown men to pull him over. The victory didn’t come without a slight injury to his hand though.

“I want to try and be a role model and provide inspiration,” said Glen Sutherland, who has been a volunteer firefighter from Kugaaruk for 22 years.

He knows what it takes to make the team. He has tried out eight times in total and was selected to be on Team Nunavut on 2016 and 2017.

He said improving his attitude, cutting back on drinking and working hard were the difference makers in the years he made it.

Sutherland will be unable to compete in this year’s games because he was notified that he’d been hired as Kugaaruk’s fire chief while he was training in Rankin.

However, he said he has been happy to pass on advice to the new blood.

“I don’t mind seeing younger people going,” he said.

The National Aboriginal Firefighters competition will take place in Dauphin, Manitoba from Aug. 8 to 12.
