If you asked me at the beginning of my real estate career if we would be where we are today, I don’t think I would have believed you, but here we are. As we conform to a world of in-person and virtual experiences, how we conduct business will change. How we network and collaborate will only get better. As we safely return to in-person events, we will value the experiences we may have taken for granted in the past. Celebrating 100 years is a huge accomplishment and milestone, and I am honored I have had the privilege to serve as president during it all. I am excited for the journey ahead for NC REALTORS®. We will continue our mission to help build stronger communities, be advocates for fair housing for all and set the trail ahead for the next 100 years of innovation in our industry. In this issue you will find articles that highlight our past, celebrate where we are today and form the foundation for our future. Cheers to 100 years of advocacy, professionalism and leadership.

NC REALTORS® is the leading voice for real estate in North Carolina. In the last 100 years, the association has thrived through global economic hardships, recessions, pandemics and industry challenges, growing from 135 members to now over 56,000 NC REALTORS®. 1921 1922 1935 1946 The North Carolina Association of Real Estate Board (NCAREB) was established.
The first Convention was held July 26 – 29 in Asheville.
The NCAREB was incorporated. A complete set of By-Laws were formerly adopted by the Board of Directors and members at convention in Winston-Salem.
Erle Stapleton was employed as the first Field Secretary of the NCAREB effective July 1. The first issue of The Tarheel REALTOR® (now Insight magazine) was published in September as a monthly bulletin. How much were membership dues in 1934? Answer: $4

the making 1948 1950 1958 1960 The first approved forms were adopted by the Directors for use by the members. The State Association numbered 23 Boards with 498 members. The first REALTORS®’ Institute was held June 14 – 19 at UNC-Chapel Hill with 75 students in attendance.
Kemp C. Clendenin of Greensboro presented to the association a sterling silver cup to establish the REALTOR® of the Year award. Since then, the Clendenin Cup is given annually to an NC REALTOR® who has rendered the most outstanding service.
The association’s name was changed to the North Carolina Association of REALTORS®, Inc.
The groundbreaking ceremony of the first NC REALTORS® headquarters in Greensboro was held on October 5.
A poll of the membership favored the association owning its own office when this became feasible.

1961 1965 1968 1969 The new NC REALTORS® office at 1030 Homeland Ave in Greensboro was dedicated on January 11. The officers and directors of the REALTORS®’ Institute were formed into the North Carolina Real Estate Educational Foundation, Inc. (NC REEF).

Legislative Meetings was established, featuring a Legislative Seminar in Raleigh with guest John C. Williamson, Secretary – Counsel of the NAREB REALTORS® Washington Committee, and several members of the State Legislature. The purpose was to explore avenues of working more effectively with State and National legislators.
1978 On Monday, October 16, 1978, NC REALTORS® purchased 50,000 square feet of land for $65,000 on which the new head quarters building on Seawell Road would be located. The purchase price of $65,000 was paid in full with NC REALTORS® reserve funds and savings accounts.
The Graduate, REALTOR® Institute (GRI) designation was awarded to qualified graduates of the REALTORS®’ Institute for the first time.
The NC REALTORS® headquarters was expanded to meet the increasing needs and growth of the association.
1971 NC REALTORS® celebrated 50 years of service with its membership number at 2,890.

1980 1981 1982 1983 The first ever NC REALTORS® Political Awareness Seminar was held at three locations across the state during March. The groundbreaking ceremony for the new headquarters located at 2901 Seawell Road in Greensboro was held on Monday, April 21. The building was occupied on Wednesday, October 29. The dedication ceremony was held on Wednesday, December 17.
The 60th annual convention, which was on October 6 – 7 at the Myrtle Beach Hilton, established a new attendance record with 1,078 registrants. For the first time in the history of NAR’s Make America Better Contest, NC REALTORS® won the State President’s Award.
The REALTORS®’ Institute was offered at UNC-Charlotte, Appalachian State University, and UNC-Chapel Hill. This was the first time in the 35year history of the school that it was offered at a location other than Chapel Hill.
44 NC REALTORS® were appointed to NAR committees, which is a record number for the association. The North Carolina Fair Housing Act was established. A record number of 651,500 copies of the NC REALTORS® Standard Contract Forms were distributed along with 3,388 pins and other member supplies.

1984 1986 1989 1991 The membership number was 14,570 in 72 local boards in November, making NC REALTORS® the 19th largest state association in the nation.
The NC REALTORS® Strategic Planning Committee met on May 2 and 3 to develop the mission statement and purpose. The membership number is up to 16,946 in November. The North Carolina General Assembly enacted the North Carolina Real Estate Appraisers Act which provided a voluntary mechanism for real estate appraisers to become “Statelicensed” or “State-certified”.
How many boards did the association have when it was incorporated?

Breaking Ground: NC REALTORS® Headquarters History NC REALTORS® is a non-profit trade association founded in 1921 and incorporated on Saturday, September 14, 1935 under state laws as the North Carolina Association of Real Estate Boards. In 1958, the association’s name was changed to the North Carolina Association of REALTORS®, Inc. (NCAR). Today, the association is known as NC REALTORS®. From an initial membership of 135, NC REALTORS® today has a membership of over 56,000 real estate professionals, representing 45 local associations statewide. Homeland Avenue A membership poll taken in 1958 favored NC REALTORS® owning its 22 INSIGHT • November 2021
own office when it became feasible. The following year, in 1959, a resolution was passed at the NC REALTORS® annual Convention to immediately proceed with the construction of the first headquarters office building located at 1030 Homeland Ave in Greensboro, N.C. On Wednesday, October 5, 1960, association officers gathered for the groundbreaking, including H. Kapp Ogburn, President Alton Stanford, C.C. Smithdeal, Paul Johnson, and Herb Wentworth. On Wednesday, January ll, 1961, the office building of NC REALTORS® was officially dedicated. Eight years later, the NC REALTORS® headquarters office was expanded to
meet the increasing needs and growth of the association. Seawell Road One of the highlights of 1980 was the groundbreaking for the new state association headquarters located at 2901 Seawell Road in Greensboro. The association broke ground when the “dooms dayers” were shouting recession and depression. Even though the American economy was suffering through a deep recession during that time, NC REALTORS® wanted to show that it had complete faith in the economy and that the housing industry of North Carolina was strong and would be an even
stronger force in the years to come. Prior to the decision to have the new headquarters on Seawell Road, several other areas were discussed by the NC REALTORS® Site and Building Committee, including Interstate 40 at High Point Road, West Wendover Avenue, Pinecroft Road, and Meadowview Road. The committee stressed that the final site selected should be readily accessible to the association membership as well as staff members. There were also discussions as to whether the association office should remain in Greensboro. Ultimately, the Seawell Road office offered the membership more opportunities for education and professionalism. NC REALTORS® purchased the 50,000 square feet of land for the headquarters on Monday, October 16, 1978, for $65,000. The purchase price of $65,000 was paid in full with NC REALTORS® reserve funds and savings accounts. The groundbreaking ceremony was held on Monday, April 21, 1980, and staff moved in on Wednesday, October
29, 1980. The construction cost was approximately $296,680 with J.R. Graham and Son, Inc. of High Point as General Contractor and Allred and Mercer, also of High Point, as ar chitects. The structure contained 10 offices, a president’s meeting room, a library, a lounge, a large operations room, mechanical-storage facilities, and a 1,500-square-foot conference and training center. A total of $233,500 in NC REALTORS® building bonds were sold at rates varying from 8.5% to 10.5% interest to finance the construction. These bonds would mature in five series with the last bonds due and payable on September 1, 1994. On-site parking was available for 37 automobiles with additional space directly behind the structure for future additions/parking. The dedication of the Seawell Road headquarters building was held on Wednesday, December 17, 1980. Approximately 160 NC REALTORS® members and special guests enjoyed the brief ceremony, luncheon and tour of the new facility.
The Jim Bichsel Building For 35 years, James “Jim” L. Bichsel, CAE (1931 – 1999) served with great distinction and honor as the chief executive officer of NC REALTORS®. During his tenure, Bichsel built the association into the largest trade association in the state while orchestrating extraordinary growth and change for the association. In Bichsel's memory, the newest and current NC REALTORS® headquarters was dedicated on Friday, January 25, 2002. The new, 15,000-square foot-NC REALTORS® headquarters—located at Grandover Commons in Greensboro— is easily accessible from Interstate 85 and Interstate 40. It includes administrative offices, conference facilities and an educational training center. This headquarters building was completed in less than nine months, thanks to an unusual spirit of cooperation and partnership by members of the design and construction team. Sharon Kelly of lnterior Dynamics in Asheville offered valuable interior design expertise. Alan McGuinn, AJA, of the Danie A. Johnson, FAIN Architect firm designed the headquarters' interior floor space and finishes while also
providing expert consultation to the NC REALTORS® executive staff. The Wilbur Kutz Training Center— located on the second floor of the current headquarters—is the result of an innovative partnership between NC REALTORS® and the North Carolina Real Estate Educational Foundation (NC REEF). Through a bequest from the estate of REALTOR® Wilbur Kutz of Chapel Hill, NC REEF was pleased to make a substantial contribution to the upfit and finishing of this education and training facility. REALTOR® Thomas R. Heffner of Chapel Hill played a

pivotal role in securing a significant endowment for NC REEF from the estate of Wilbur Kutz. The Wilbur Kutz Training Center contains 1,804 square feet of classroom space and seats approximately 65 people when set in a classroom-style arrangement. Will’s All-Time Top Ten Questions BY WILL MARTIN, GENERAL COUNSEL
In commemoration of the 100th anniversary of NC REALTORS®, I wrote this article to reflect the top ten questions I’ve fielded through the Legal Hotline during my twenty-five years at NC REALTORS®. It was a really hard thing to do—so many questions! What I’ve done is list the most common categories of questions I’ve gotten over the years (in no particular order of importance), pose a question representative of each category, and identify two or three relevant Legal Q&As, which can be found on the NC REALTORS® website. Just for fun and as a nod to history, I’ve included an eleventh category of questions that I used to get all the time, but don’t get any more.
CATEGORY #1: Buyer’s right to refund for
misrepresentation/omission of material fact (This type of question has been around a long time, but is coming up more now due to the size of due diligence fees that are being paid.) QUESTION: Does a buyer have the right to a refund of their Due Diligence Fee if the property is misrepresented by the listing agent or seller? ANSWER: As a general rule, a seller doesn’t have to disclose anything to a buyer about their property, which is why the “no representation” option appears on the Residential Property and Owners Association Disclosure Statement. However, a
seller could potentially be held liable for any damages the buyer can prove they have sustained as a result of the seller misrepresenting the property in a material way or actively hiding some defect about the property, or for failing to disclose a latent material defect that would not be discoverable by the buyer in the exercise of reasonable diligence. A seller is also bound by his agent’s material misrepresentation of the property to the same extent as if he had made the misrepresentation himself; thus, a buyer may potentially have recourse against both the listing agent/listing agent’s firm and the seller for recovery of their DDF if the listing agent misrepresents the property. • A seller’s duty to disclose latent material defects Category: Disclosure • Can a buyer recover the due diligence fee based on a listing agent’s misrepresentation? Category: Disclosure.
CATEGORY #2: Has a binding contract been formed? (This category of questions is as old as dirt.)
QUESTION: Buyer agent submits signed written offer on Form 2-T to the listing agent. After communicating with the seller, listing agent texts buyer agent to inform her that the offer is acceptable to the seller and that as soon as the seller sign it he will email her a signed copy. If the listing agent later

notifies buyer agent that the seller has decided to accept an offer from a second buyer, may the first buyer claim that there is a binding contract between the seller and the first buyer? ANSWER: The first buyer can certainly claim they’ve got a binding contract, but I think they would lose the argument in court. Why? For a couple of reasons: one, the text from the listing agent to the buyer agent didn’t bind the seller because agents don’t generally have the authority to make contracts for their clients; two, the offer was not signed by the seller as required by the express terms of the offer. • Do agents have the authority to make contracts for their clients? CATEGORY #3: Assistance animals
(This one made the list due to the dramatic increase in frequency of questions in this category in the past several years.) QUESTION: Is a landlord who has a “no pets” policy required to let a tenant keep a dog or other domestic animal on the property for emotional support? ANSWER: Very likely yes, assuming the prospective tenant provides adequate documentation of the existence of a disability and a disability-related need for the animal. • New Guidance on Assistance Animals Category: Miscellaneous/Other Laws and Rules
CATEGORY #4: Buyer or seller switching firms
(I’ve handled a steady stream of questions in this category for many years.) QUESTION: Can a buyer fire their buyer agent without cause and hire a new firm to represent them if the first firm won’t agree to terminate the buyer agency agreement? ANSWER: Yes, but that doesn’t mean the buyer can’t be held liable for damages for breach of the buyer agency agreement or that the first agent might not be entitled to the compensation offered in MLS on any property to which they introduced the buyer. • A Tangled Web Category: Insight Articles
CATEGORY #5: Fixtures and personal property
of the sale if it’s advertised in MLS but not identified in the Offer to Purchase and Contract? ANSWER: No. Buyers and sellers are not MLS participants, and nothing in an MLS listing magically becomes a part of any contract between a buyer and seller. The Contract also specifically provides that it contains the entire agreement of the parties. • Does a refrigerator stay if it’s not in the Contract? Category: Forms/Offer to Purchase and Contract/Fixtures QUESTION: Is a utility building that is not on a permanent foundation included as a part of the sale if it’s not listed as an exception in the Offer to Purchase and Contract? ANSWER: Yes. “Utility building” is on the list of items in paragraph 2(b) that the buyer and seller agree will be included as a part of the sale unless excluded if they are present on the property. The fact that the utility building is not on a permanent foundation is irrelevant in this situation. • Who gets to keep the utility shed? Category: Forms/Offer to Purchase and Contract/Fixtures
CATEGORY #6: Advertising another broker’s listing
(Not a new category of questions, but there’s been a sharp increase in their number, undoubtedly fueled by the popularity of social media.) QUESTION: May a REALTOR® include another firm’s listing in her print or social media advertising without the other firm’s consent so long as the other firm is identified? ANSWER: No. Advertising another firm’s listing without authority is a violation of the REALTOR® Code of Ethics. Even though the other firm and its client might not object to such advertising, the lack of objection cannot be assumed. • Can a REALTOR® include one of my listings in her print advertising without my consent? Category: Advertising • Can I advertise another firm’s property on social media? Category: Advertising • Legal Quiz (February 2021) Category: Advertising
CATEGORY #7: Handling multiple offers
(This category of questions has been around a long time; their frequency ebbs and flows depending on how hot the market is.)

QUESTION: If asked by a buyer agent if there are other offers, the listing agent is ethically obligated to always disclose the existence of other offers. True or false?

CATEGORY #8: Negotiating repairs
(Although the particular questions have changed due to the introduction of the “due diligence contract” in 2011, this category has been a popular source of questions during my entire 25 years as NC REALTORS® General Counsel.) QUESTION: So long as a buyer agent submits requested repairs prior to the 5 PM deadline on the last day of the Due Diligence Period, the buyer will be able to get their earnest money deposit back if the Due Diligence Period ends and the seller hasn’t agreed to the requested repairs. True or false? ANSWER: False. As stated in the WARNING at the beginning of paragraph 4 of Form 2-T: “Buyer’s failure to deliver a Termination Notice to Seller prior to the expiration of the Due Diligence Period will constitute a waiver by Buyer of any right to terminate this Contract based on any matter relating to Buyer’s Due Diligence.” In other words, a buyer doesn’t have the right to terminate the contract after the Due Diligence Period ends if the buyer is unable to negotiate repairs with the seller. • Taking the End of Due Diligence Period Seriously Category: Insight Articles • Can a buyer submit multiple repair requests during the due diligence period? intended and is not in need of immediate repair (I’d like to have a dollar for every question I’ve gotten that fell into this category, or that related to any of the many conditions and contingencies that were contained in the pre-2011 version of the Offer to Purchase and Contract. Remember? In addition to the condition that a long list of items were performing the function for which intended and not in need of immediate repair, there was a loan contingency, an appraisal contingency, a wood-destroying insect condition, a radon condition, a cost-of-repair contingency, and a flood hazard condition, and there were deadlines associated with many of those conditions and contingencies!) (NOTE: The following question appeared in a Forms Forum article in the February 2006 issue of Insight magazine. You can access the electronic version of the article by visiting ncrealtors.org/February2006LegalArticle) QUESTION: If a seller refuses to replace a retaining wall that the buyer’s structural engineer says was improperly constructed and will need to be replaced in no more than five years, may the buyer terminate the contract and receive a refund of her EMD, or may the seller keep the EMD if the buyer refuses to close? ANSWER: Very hard to say. The answer likely depends on whether the retaining wall is a “structural component” of the dwelling/outbuilding as that term was used was used in the Offer to Purchase in effect at that time, and whether a retaining wall that will fail in 5 years in the opinion of a structural engineer is in need of “immediate” repair. It is interesting to note that the article points out that if “Alternative 2” had been selected, there would have been no question that the buyer would have had the right to terminate the contract and receive a refund of her EMD if the seller refused to replace the retaining wall. “Alternative 2” was the precursor to what became the “due diligence contract.” • Difficult repair issue leads to consideration of Alternative 2

The history of the early North Carolina Association of Real Estate Boards (NCAREB) is a history of the growth pattern of North Carolina itself. These early pioneers of the real estate profession fought hard for tax reform, adequate housing and particularly for a real estate license law which they felt would upgrade the business and help eliminate the “curbstone dealers.” They were men and women of foresight, as REALTORS® today still seek answers for many of the same problems. As an NC REALTOR®, you are part of a living legacy of advocates, change-agents and thought-leaders reaching back a century and shaping our industry into the force that it is today. 1935 • The North Carolina Association of Real Estate Boards (NCAREB) was first incorporated under State laws. 1947 • A proposal for group life insurance for members of the NCAREB through Pilot Life Insurance Company was adopted. • After much consideration, it was decided that “the time was not right” to submit the proposed license law bill to the Legislature. 1951 • An Association-sponsored License Law Bill failed to clear Committee in the Legislature. • An Urban Re-Development Bill sponsored jointly by the Association and the League of Municipalities was enacted. 1953 • The License Law Bill died after passing the Senate when the House failed to act on it prior to adjournment.

1960s 1962 • NC REALTORS® President Glenn Tucker traveled to Europe with Governor Terry Sanford on a mission to “sell” North Carolina to European Travel Agencies. Glenn Tucker
1963 • The state-wide MLS was discontinued when it threatened the Association’s tax exempt status. • The Association-sponsored Condominium Housing or Unit Ownership Bill passed the Legislature. • Governor Terry Sanford delivered the keynote address to the 542 REALTORS®, associates and spouses registered for the 42nd annual convention in Asheville.
1964 • In Washington, D.C., the Congressional Reception and Dinner drew the largest Tarheel turnout in history with nearly 100 REALTORS® and wives. 1965 • A one-day Legislative Seminar was held in Raleigh with guest John C. Williamson, Secretary-Counsel of the NAREB REALTORS®’ Washington Committee and several members of the State Legislature. The purpose was to explore avenues of working more effectively with State and National legislators. 1966 • NC REALTORS® President Kemp C. 1967 • REALTORS® engaged in a broad publicity campaign based on the slogan, “It’s a Good Day for Buying a Home.” • The North Carolina License Law was amended with NC REALTORS® support to require a sixmonth apprenticeship period prior to obtaining a brokers’ license or equivalent education. 1968 • NC REALTORS® President David L. Godwin of Fayetteville issued a statement to all news media voicing the Association’s objection to Forced Housing. David L. Godwin
1969 • The North Carolina Real Estate Educational Foundation, Inc. (NC REEF) pledged $50,000 over a 10-year period to East Carolina University to aid in establishing a chair in real estate. • REALTOR® A.P. Carlton of Greensboro was named chairman of the N.C. Real Estate Licensing Board.

1971 • NC REALTORS® experienced its most successful legislative year to date in terms of co-operation from members and recognition by members of the General Assembly.

1999 • HB 438 Housing Authority Exemption – NC REALTORS® successfully amended the Housing Authority Exemption bill to limit the exemption to property owned or leased by the Housing Authority. • SB 974 – Vacation Rental Act – With the help of the NC Vacation Rental Managers Association, NC REALTORS® was successful in passing the Vacation Rental Act. The laws that had been in place dealt with long-term residential tenancies and did not address the specific concerns and needs of the vacation rental transaction • Legislative Day – On May 12, 1999, over 200 REALTORS® attended NC REALTORS® Legislative Day. REALTORS® lobbied their representatives and met afterwards for networking at a barbecue. In an effort to increase participation, a “Get on the Bus” tour was held. Buses made stops around the state to pick up REALTORS® and take them to and from Legislative Day. Speakers for Legislative Day were Senator Tony Rand, Senate Pro Tempore Marc Basnight, and Representatives Andy Dedmon and John Bridgeman, both licensed REALTORS®. • Real Estate Salesman/Broker Licensure – At the request of NC REALTORS® and the NC Real Estate Commission, the Real Estate Salesman/Broker Licensure was introduced for the 1999 session. NC REALTORS® successfully lobbied passage of this piece of legislation, which proposed a modest increase in required classroom hours. • NC REALTORS® PAC (NC RPAC) reaches state and national Goals in 1999 by raising $208,982.53, which was 104% of the fundraising goal.
2002 • HB 1120 – Beach and Fair Plan Amendments – passed into law. The bill will require the N.C. Beach Plan to offer a homeowner’s insurance product for primary residences in the coastal counties. This will enable those who can’t get a homeowner’s policy in the voluntary market to find coverage. HB 1120 established a study by the Commissioner of Insurance to continue to work on issues of availability of homeowner’s insurance and report his findings and recommendations to the General Assembly by April 1, 2003. • HB 1540 – allows the construction of swimming pools in the 60-foot setback zone on oceanfront lots. The bill, which was sponsored by Representative Bill Culpepper at the request of Dare County REALTORS® and homebuilders, reversed an overly restrictive rule adopted by the Coastal Resources Commission that would have prohibited all swimming pools inside the seaside buffer. This was a great common-sense victory for our industry. 2003 • HB 328 – Nonresident Commercial Licensure – authorizes nonresident real estate

REALTORS® Housing Foundation to promote safe, decent and affordable housing for all North Carolinians. • HB 1083 – Apartment Submetering – makes it easier for landlords to submeter, which is the practice of charging tenants for the cost of providing water and sewer service based on the User’s metered consumption of these services. It reduces the regulatory burden for landlords that wish to submeter. • HB 1464 – School Calendar Changes – improved school calendar/tourism season in NC. 2005 • REALTORS® at the General Assembly – REALTORS® successfully ran for office this year. In Senate District 35, Eddie Goodall won his first statewide election bid. Some of the other victorious REALTORS® include Senator Robert Pittenger, Representative Harold Brubaker, Representative Bruce Goforth, Representative Julia Howard, Representative Bill Owens and Representative John Rhodes. 2006 • RPAC milestones reached – The number of RPAC contributors across the state surpassed

This bill would prohibit the NC Appraisal Board from investigating anonymous complaints. 2009 • HB 1305 – Beach Plan Changes – benefited property owners and the market. • SB 1007 – Amend Home Inspector Licensure Laws – improved home inspection reporting and increased the professionalism of the home inspection industry. • Private Transfer Fees – prevented allowance of fees upon transfer due to investors, previous developers or owners which were not the current seller, other than fees to homeowners’ associations.

2010s 2010 • Inspections – streamlined home inspections summary documents to only material facts and issues of safety. 2011 • HB 92 – Repeal Land Transfer Tax • HB 485 – New Home Purchase Stimulus – due to the negative impact of oversaturation on the market and sellers. • HB 174 – Commercial Real Estate Broker Lien Act – an issue NC REALTORS® had been working on since 1997. • HB 332 – Clarify Development Moratoria Authority – clarifies that a local government may not impose a moratorium on development approvals for the purpose of developing and adopting a new or revised development ordinance. • SB 683 – Residential Building Inspections • SB 507 – Clarify Exception/Real Estate Broker Laws – NC REALTORS® helped develop the bill language. 42 INSIGHT • November 2021
HB 484 – Transfer of Foreclosure Program – the NC Commissioner of Banks and the NC Housing Finance Agency were both conducting foreclosure programs to help homeowners who have lost their jobs. In the wake of the budget crisis, the General Assembly made an effort to reduce multiple programs which are accomplishing the same tasks. As such, the program offered by the NC Commissioner of Banks was transferred to the NC Housing Finance Agency in House Bill 484 introduced by Representative Harold Brubaker (R-Randolph). NC REALTORS® has worked with the NC Commissioner of Banks with their foreclosure program and two years ago, provided them with a grant to help market the program. Earlier this year, NC REALTORS® received a second grant from NAR to continue assisting with this program. NC REALTORS® Government Affairs staff is now corresponding with the NC Housing Finance Agency to determine how to best use these funds to the benefit of the home owning public.

2012 • Broker Price Opinion (BPO) – convinced legislators that BPOs aid the consumer. • Copper Theft – increased the penalties for criminals who steal copper. 2013 • Mortgage Interest Deduction – protected the mortgage interest and property tax deductions from elimination. Legislation allows filers to take the standard deduction or itemize their deductions with a cap at a maximum of $20,000. These remained as two of three deductions allowed. • Tax on Services – prevented 8.05% tax on real estate services and commissions. • Transfer Tax – prevented 1% state transfer tax. • Business License Tax – prevented 1.05% tax on all business entity assets regardless of profitability. 2014 • Patent Abuse Legislation – protected brokers, firms and MLS services through legislation preventing frivolous litigation filings. 2015 Gary Thomas, 2013 NAR President, and Andrea • Tax Credits and Grants – restored state historic preservation Bushnell, NC REALTORS® Chief Executive Officer tax credit program for income-producing properties and increased funding for film grant program. • Housing Affordability – protected tax deductions and improved funding for the Workforce Housing Loan Program and Housing Trust Fund. • Aesthetic Design – ended municipal overreach on residential construction and design standards. 2016 • Vacation Rental Act – improved the state’s act to allow for improved owner/broker responsibility. • Affordable Housing – protected tax deductions and improved funding for affordable housing programs in 2016 budget. • Map Act Changes – prevented NCDOT from perpetually holding property without just payment to landowners and adjusted fair market payments to property owners in new corridors. 2017 • Various Changes to Revenue Laws – updated the tax structure for RMI services and linen rentals 2015 Legislative Meetings under residential property rental agreements in response to concerns from the REALTOR® community. ncrealtors.org • INSIGHT 43

• Appropriations Act of 2017 – required the Department of Environmental Quality (DEQ) and the Environmental Management Commission (EMC) to complete rules regarding clean-up and remediation for underground storage tank removal. • Repeal Orange County Impact Fees – repealed impact fees placed on developments in Orange County for use in school construction. 2018 • SB 99 – Appropriations Act of 2018 – extended the moratorium on the Map Act for an additional year, until July 1, 2019. It also removed the exemption for collection of sales taxes from security systems on real property. It defines a property management contract and exempts those services and the repair, maintenance and installation (RMI) services done under those contracts from sales tax. It allows cities to use property tax funds to support education. SB 224 – Landlord Recovery of Expenses/Rule 60 Motion – In response to recent lawsuits challenging the ability of property management companies to recover fees incurred in summary ejectment proceedings, this legislation clarified those deemed recoverable. Examples of recoverable expenses are attorney’s fees, filing fees and service fees. 2019 • Led the coalition to pass Association Healthcare Plans legislation, giving independent contractors an additional option for health insurance. • NC DOT compiled a searchable database of state-maintained roads to provide needed information to consumers. • Extended the Historic Preservation Tax Credits for an additional four years. Repealed the Map Act to compensate property owners for future DOT use. • Protected property management contracts from taxes on typical services offered by property managers.
2020s 2020 • Successfully advocated for continued funding of the Housing Trust Fund and Housing Finance Agency. • Enacted liability protections for employers and offices to protect them from claims arising from contraction of COVID-19. • Secured a permanent change to the definition of the year-round school calendar to prevent schools from skirting the school calendar law enacted in 2004. • Passed legislation to allow real estate transactions to continue during the pandemic: › Legalized remote, video conference notarizations. › Allowed disbursement of funds prior to deed recording if the Register of Deeds was closed. 44 INSIGHT • November 2021
