Message From the Editor Welcome to the first fall issue of E The Magazine for Today’s Female Executive. In this issue, we are featuring groups and populations impacted by COVID 19. We are focusing on new waves of innovation, education and social rebuilding. In a word-Hope.

In times of uncertainty, consistent passion works. Consistent passion will beat out seasonal opportunity every time. I challenge you to use of this down time to pick what you want to do, no-what you love to do, I mean really looove to do and do it. Be the best at it.

But before you get started. I want to introduce the concept of “Roaring Hope”! In normal times, normal levels of hope and inspiration will to the job.

When you apply consistent passion to what you love to do and do it. You will eventually create your own weather system. You will master your market, you will learn the competition, you will rise in your industry and you will thrive in your passion.

“Hope I make it to work on time”, “Hope I don’t gain 10 pounds”, “Hope I pass the test”, “Hope this project gets completed on time” You see how it works? normal hope for normal things. In normal times, you can squander your precious existence with safe ideas such as Safe and Logical, Status Quo and Good Enough. Safe and logical never built anything extraordinary -but it’s great for maintenance. Status quo is good for stabilizing things and Good enough is excellent for something that you intent to let die. But in these extraordinary times of stop and start, no go’s and I don’t knows there is nothing better than hope with a booster of ROAR!!

Spend your time becoming the best at your passion. Learn everything about it and operate in excellence. This is what creates legends… One more thing, you may ask yourself, how does roaring hope work? Roaring hope creates that burst of energy and skill that gets a car out of the ditch, gets planes off the ground and rockets into space. It defies gravity and all the other reasons to stay put. Become Legendary- acquire a roaring hope in your passion and soar! I hope you enjoy this issue…. Althea

When most of us think of our front porches, there’s a grandmother, a friend or a pet. There’s a breeze and maybe a few birds. There is the sound of life slightly removed.

The porch is the place to practice the art of sitting, reflecting and silence.

Sometimes it’s even the place to have those serious talks. Where rather than make eye contact we make hearts connect..

It’s especially the place where our elders slowly spill the bits of family history that reflectively pop into their heads. When they and reach back and with moments of clarity and great detail they tell you about your history, your family and even stories of times long past.

In the south or places with dark nights, bright stars and an even brighter moon. With fire flies that dance around the trees. A porch at night is where friends regather after dinner and escape the residual heat from the house. The Summer Hammock Once while driving through the older part of Los Angeles, I passed a corner home with a big front porch. The porch stood under a massive tree. Under the tree was a hammock and in the hammock was a little boy. Sound asleep. He couldn’t have been more the 6 or 7 years old. The leaves freckled his face with sun light and he dreamed the dreams of a kid in summer.

Wash your hands before you come in Page 22 E The Magazine for Today’s Female Executive

5 across. A place that combines the outdoors with indoors. A place to sit, talk and watch the world Porch Therapy. Sit on the porch and do something mundane. Snap fresh green beans, arrange your flowers or drink a fresh glass of lemonade or cucumber water. Be caught doing nothing very important and that will be one of those really great days.

Dr. Joanny Lui

Old habits are hard to break. Habits are like cobwebs that have turned into steel. Habits fill our thoughts to the point that we aren’t really thinking. We’re just going about our days on autopilot.

are definitely challenged by the change and your paradigm really stares you in the face because you cannot adapt well to the change. It’s Time to Look at the Bright Side of Life

An old job is a habit. An unhappy relationship is a habit.Poor health is a habit. When you’re unhappy and not doing well in any part of your life it’s become a habit. It makes you think a certain way. It makes you feel a certain way. And it makes you behave a certain way.

I have no doubt that COVID-19 has been a major disruption in your life. Maybe it’s upset you. Maybe it’s made you curious and do research. Maybe you’ve become outspoken in some way. Maybe it’s changed your life forever!

In my work, a paradigm is a multitude of habits and they live in your subconscious. The subconscious governs you all day long.

But in every situation there are positives and there are negatives. This is due to a universal law called the Law of Polarity or the Law of Opposites. For example, to have a room, you have to have an inside and an outside. There’s cold and there’s hot. There’s up and down.

Paradigms are great because they can save you time, but they can also harbour self-doubt and lies about yourself. When you want to do something different, they can actually stop you from pursuing goals because a paradigm is trying to keep you safe.

In every situation there is both good and bad. For instance you finally get that big promotion that you’ve wanted for so long. Doubt creeps into your mind and you think it means a big raise (yay) BUT a lot more responsibility and maybe less time for family (boo.)

It may often keep you small. It can try to keep you from making the changes that you so badly need to make. You keep falling back into your habitual way of thinking, feeling and acting.

You’re an entrepreneur who just made their biggest sale ever, but you’ve got to ramp up fast to complete the order. You’re not sure how you’re going to do this!

Then you feel trapped. You want a different life and you wonder why nothing changes.

What happens to many people is they start focusing on the potential bad. They don’t discipline their minds to focus on the positives. You don’t have to look too hard for them. It’s up to you to become

Have you heard of a paradigm?

When something like COVID-19 hits, you

conscious of them. It’s a choice. It you’re an optimist, focusing on the good is easy. A pessimist will have a harder time. Numerous studies show that optimists attract more success faster. An executive is a young father of 3 young girls. Family is very important to him. But he travelled over 200 days in 2019 and often felt torn. During the COVID-19 lockdown, he found that he could conduct most of his meetings online. And get the results he wanted. He realized that he could deal with most issues staying put. It meant that he could be the father he wanted to be. A win-win for everyone, his prayers were answered. You may have a lot more time on your hands. Even if you still have a job and you’re working from home, you don’t have to commute to your office in a far off downtown. For some people that’s a savings of 2 – 4 hours every day! For many families it has meant much more meaningful time together rather than rushing the kids to their organized activities. They’re getting to know each other. These are just some unanticipated positives with COVID-19. Personal Tragedy Strikes COVID-19 aside, you’ve likely already experienced many challenging events in your life. I had my own deeply unhappy moments, which forced me to make changes.

Page 47 E The Magazine for Today’s Female Executive

As a professional engineer, I experienced job loss and lay offs for one reason or another for the first 10 years of my career. My last full time position lasted 8 years and I was VERY unhappy. Through much of my career, I had very few bosses I respected. I disliked or even hated one in particular. I knew my behavior was sometimes bizarre to people. I didn’t know it at the time, but it came down to a complete lack of gratitude. Stress does that to a person. Your brain stops working. You hurt yourself and other people. The worse time of my life happened when I was in my late 30s. We were a young family. We had two little boys whom we loved very much, but it was time for a serious conversation. I didn’t want to be on the pill any more and neither of us wanted any more children. So I strongly suggested my husband get a vasectomy. He agreed. He made the appointment and it was done. Great. But sometime later, I discovered I was pregnant again! And I had just started a new job! My doctor said all she could say. “They botched the vasectomy.” Much later I found out that this was not a rare occurrence!

Subscription Link ETMMedia.net

That night my husband and I had another serious discussion. And we made the most difficult decision that I could ever imagine. We knew we didn’t want another baby. My own mother went through with her third pregnancy. She had no choice at the time. And of course, there could be no regrets as my baby brother was a cute little guy.

bring a damaged baby into the world. Other women have made that decision and they live with regret and worse every day!” So I had to face the facts. I went with the second procedure and this time it worked. I went back to being a loving wife and mother. I went back to my job as a professional engineer. I buried the story. For nearly 25 years.

So that night, we decided to have an abortion. And I cried. The arrangements were made and my husband accompanied me to the hospital. I cried. The nurses were kind because they told me how difficult it was for married women who already know what it’s like to have kids and a family to make that decision. I woke up from the anesthetic with tears in my eyes. It was over. But a few days later, I realized that I still “felt” pregnant! I went to the walk-in clinic in my office building and the doctor there confirmed my worse fears. He had a grave look on his face. And he also told me that I had a little girl. A little girl! I always wanted a little girl and now I had made a terrible, terrible mistake! I asked my doctor if there was any way at all to continue with the pregnancy. She gave me a long look and said, “No, Joanny. This baby is damaged. You can’t

Page 48 E The Magazine for Today’s Female Executive

But there was more to come. One day after an annual checkup my doctor’s office called me. They ONLY call if there’s bad news! I went in to see them. My doctor told me that I’d had a “positive” result from my PAP test. They found something abnormal. I needed to schedule exploratory surgery. The “C” word was used. When I left my doctor’s office I was enraged. How dare my body betray me! I was SO angry! I couldn’t believe it! I’d done everything I was supposed to do to keep healthy: good diet and exercise, but I found out it wasn’t enough. This event made me look inward and I discovered how truly unhappy and unfulfilled I was. While I was doing research on cervical cancer a nurse happened to comment that most victims of this cancer were people who had multiple sexual partners who also had multiple sexual partners – in other words, prostitutes!

Oh no, that wasn’t me! I was a professional engineer with a young family and I was a community leader. That day saved me because it completely changed my mindset. A few weeks later I was cleared from any indication of cancer. Those few weeks led to a transformation. I dropped the victim attitude. I quit my job and became a free agent. I became a contractor for IT services. All the while my husband and my parents asked me about benefits and retirement packages. They didn’t approve. I did it anyways. And for a few years it was lucrative. Then I had to change again! The events of that entire year led me to what I do today. A few years later I was at another crossroads with my life. It happened after Y2K and the lucrative work I was doing dried up. I then wondered what would truly give meaning to my life.

Medicine,” that I heard something that changed my life forever. My professor said that one minute of anger would hurt you more than the person or thing you’re mad at. A light bulb came on! That was 16 years ago. All these years of upset and anger and frustration, they all resulted in the crazy things that happened to me and ultimately led to my cancer scare. Today I understand that I survived the heartache and distress to show my clients that they too can thrive and create a better life in the aftermath of catastrophic life events. I teach them to understand themselves and how to take control of their emotional state and make their own right choices. I do that with lots of love (sometimes tough love) and empathy.

I picked a few things to look at: natural nutrition, western herbology and Traditional Chinese Medicine. I found that I knew more than the instructors did about nutrition. So that wouldn’t work because I wanted to learn something new. With herbology, I found out that I needed to enjoy gardening. Nix that too.

You’re Ancestors Made You Tough

With Traditional Chinese Medicine I really didn’t know what I was getting into. But I realized that it was a way to a means. So off I went to study for more than 3 years and that turned my head inside out and shook me up!

You are here because your ancestors, including your parents, not only survived, but thrived after the terrible things that happened to them. These survival experiences became embedded in their genes. And in yours!

Originally from Cuba and raised in Miami, Florida, Ileana Musa is the co-head of international wealth management and the head of international banking and lending at Morgan Stanley. Ileana hopes to instill her mantra in her young daughter, as well as those she leads and mentors. Take personal risks; never hesitate to ask; use your influence to serve, not take (in the Cuban American community, “hay que servír,” which translates to “be willing to serve.”). What are some of the issues surrounding financial opportunities for women and minorities, both locally and globally? Click to Listen

UN Women, the United Nations entity dedicated to gender equality and the empowerment of women, publishes relevant research on this topic. A few trends worth highlighting. Women’s economic equality is good for business. Companies greatly benefit from increased employment and leadership opportunities for women, which increases organizational effectiveness and growth.

Women are the new face of wealth: By 2030, American women will control much of the $30 trillion in financial assets that baby boomers will possess—a potential wealth transfer of such magnitude that it approaches the annual GDP of the United States (McKinsey). As more women direct their wealth and plan their legacy, and considering that 50% of the population in the US and globally is female, this segment must be further empowered. Latina-owned businesses are growing far more rapidly than businesses owned by other women, nationally – to the tune of 200 percent vs. 32 percent. That’s nearly seven times faster, and it translates to 71b to the economy. All things said, we can control our finances. While many women feel that financial independence is a long-term and sometimes unattainable goal, we need to anchor our focus on building the right foundation and habits. We need to develop a positive relationship with money as we do with any link.

Women’s economic empowerment includes women’s ability to participate equally in existing markets; Increasing women’s and girls’ educational attainment contributes to women’s economic empowerment and more inclusive economic growth. Women bear disproportionate responsibility for domestic work. Women tend to spend around 2.5 times more time on unpaid care and domestic work than men. Between their duties at home and work, many women spend so much time caring for others that they forget to make themselves— and their financial futures—a priority. Women are more likely to actively manage their day to day financing than wealth planning for the future.

Watch Rock The Vote!

Creating parity would result in a significant increase to GDP ($28 trillion, according to a McKinsey study. Page 59 E The Magazine for Today’s Female Executive

What role does financial literacy play in creating financial opportunities for women in minorities Click to Listen • Financial knowledge means better business decisions, outcomes, and more meaningful choices throughout life. I call it empowerment through choice. • It starts with us, learning everything we can about our finances… having an active and positive relationship with money. It cannot be trial and error nor deferred to others (a parent, a partner, etc.). • Financial literacy is the key to every woman’s financial stability later on in life. Small steps taken will empower you financially. The following are the steps I’ve made, which have served me well. • Have a Budget – in college, I created my first budget with a goal of 1) saving 10% of everything I made (not much at the time but here is where the habits come in, I would automatically transfer 10% to my savings) 2) buy my first home. I defer gratification – drive an older car, make coffee at home, eat-in…. it all adds up. I was able to save 12K to buy my first property and a home for my mother, my primary goal. She had rented her entire life. • By continuing to save the 10% added up over time allowed me to put enough investment in an IRA ($2500) and for an emergency fund. Again, it seemed small, but I did it every single year, and I INVESTED the money. $2500 invested over thirty years at an average rate of 6% translates to $212K! As my income grew, my savings did as well, and I kept to a strict budget. Savings and investing evolved into wealth creation. Page 60 E The Magazine for Today’s Female Executive

• Manage Debt, including Credit Cards – I paid my credit cards in full at the end of the month. If I could not afford to do so, I could not provide for what I wanted. So: hold to Franklin’s maxim: “a penny saved is a penny earned.” (Also, read his autobiography; it’s an excellent investment of your time. What he called your most valued asset!) • Negotiate – negotiate at home and work; practice when it doesn’t matter to prepare for when it does. Not negotiating an initial salary may cost women $1MM of income throughout their career. • Talk Money – with partners, with girlfriends; it builds confidence. • Tap Adults—namely parents, teachers, and mentors: we all need to support girls with opportunities to develop skills in money management. Financial literacy is learned at home. Involve your daughters in the family’s day-to-day economic activities and shared decision-making. At home, Bella and I play with her money, and she divides it into three pools – saving, spending, giving. The next step is to talk up how we will put the money saved to work by investing it! I can’t wait. How can the financial markets industry better serve these communities and target groups? • https://msreserved.com/article/ playbook_a_womans_guide_to_life_money • The power of education and trusted guidance will transform minority women’s relationship with money. Why: because it does for everybody else. We believe educated women create a ripple effect, inspiring generations of men and women to come. That is why we are committed to empowering you with the knowledge and tools needed to achieve your goals: whether you’re buying a home, starting a family, navigating a divorce, or giving back to a favored cause. Letting Go....

Gay Thomas Wilson: Author, Speaker & Life Coach

Has there been a shift in your life that demands that you let go of people, places or things that have been part of you and your life for years? For whatever reason you are crystal clear that this decision is non-negotiable and that fact resonates deep inside you? I CAN’T BREATHE is the cry from most of us who have hit the proverbial wall and understands that our lives must change in some very primal ways. A fashion photographer who has worked in the industry, from the same space for 25 years, decided it was time to let go and found a new space where she’s now collaborating with artist from her community. A woman who has dated the same man for many years and had planned to marry him but decided to let go and is now seriously considering starting her own business. A sister in law, who was the caretaker of her family after 2 deaths, decided it was time to let go, re-evaluate her life, and make time to get her own health back on track. A brother who had not seen the value of his business partner decided it was time to let go of the mindset he had developed over years and share the business profits in a more equitable way. They are now getting business counseling in hopes of creating a more equitable partnership. A married couple realizes they cannot continue the war they’ve been in with one another for another day. They desperately want to let go of the pain they’ve caused, the hurt they’ve held on to for 20 years and to begin again. They’ve decided to separate and start over by creating a more sensitive and communicative relationship with each other. It seems we’ve come to a crossroad about many pass habits, old friends, long time bosses, and the mind-set that once we’ve defined and held us captive to these areas of our lives, they have suddenly become obsolete. Or is it that we’ve known all along but didn’t have the courage, to move forward and so Page 66 E The Magazine for Today’s Female Executive

chose to just stay in our comfort zone rather than traverse a new land of uncertainty. WHY? Is it Covid-19 that has caused this shift, is it the exposure of this country’s politics, is it threat of racism landing on your doorstep or the fear of losing the entitlement you’ve enjoyed for generations? There’s something deeply sacred about having the time to be who you are, even when it’s not necessarily the choice you would make right now. The un-welcomed necessity to familiarize yourself with who you have become and decide if that’s actually who you want to be, what you care about and what you long for, is often a necessity we put on indefinite hold. With death sitting at our doors we have been forced to re-evaluate. And as result find our way to each other, like it or not. We are thrust into actually living vs rushing through life with a force that is fueled by fear of survival or a false desire for more, more of everything. The say the last few months has caused a pause however, it’s been more like a dead stop, forcing us to touch down and reconnect to our most primal desires including family, food, safety, love and empathy. Having let go, finally we have all met in the same place, and found the familiar ache for contact, realizing that we are made to feel, to grieve, to hate, to love, to care for one another to thrive.

For example - with the recent release of California Governor Gavin Newsom’s proposed 2020-21 budget is an optimistic sign that positive change is happening. The budget proposes more than $70 million, a 40 percent increase in funding over previous years, to improve students’ access to freshly prepared California-grown food, give school food service staff tools and training to succeed, and boost local California agricultural economies and farmer incomes. This success has been the result of a collaborative effort with the Center for Ecoliteracy, the Office of Kat Taylor, TomKat Ranch, and a coalition of allied organizations in agriculture, education, and public health. Overall, the proposed funds will support schools to purchase and prepare healthy school food that research shows will lead to better academic and behavioral outcomes for students, as well as contribute to healthier, more resilient California agricultural economy.

Laurie Forster The Wine Cool Wines Coach for the Hot Weather Cookouts are one of my favorite things to do in the summer. Casual get-togethers with close friends that start in the afternoon and end whenever the mosquitoes become intolerable are part of the summer tradition. These gatherings may not require elaborate plans but pairing wines with the standard cookout fare can be a challenge. Ranging from burgers to cucumber salad and anything in between, it is difficult to find one wine that goes with a little bit of everything. The good news? There are some delicious (and affordable) wines that will taste great with the traditional backyard menu. Sweltering hot weather seems to make cold carbonated beverages even more satisfying. Rather than grabbing a diet soda or an icy cold brew consider having a sparkling wine on hand. One of my absolute favorite affordable bubblies is Spanish Cava. Named after the underground caves where these wines are produced, Cava is a blend of three native grapes: Macabeo, Parellada and Xarel-lo. Cava has been made since the 1800s, using the same tried and true process developed in Champagne, France. Page 84 E The Magazine for Today’s Female Executive

Sparkling Cava is typically dry and crisp with flavors of apple, pear and citrus and a touch of earthiness. The crisp acidity and palate cleansing bubbles make Cava a great pairing for seafood, especially clams, mussels and a variety of fish. Another one of my “go to” wines in the summer is Spanish Albariño which originates in Galicia, a region on the northwest coast of Spain. The specific region best known for quality Albariño is Rias-Baixas. Galicia, settled by descendents of the Celts, resembles Ireland more than Spain. Much of Spain is hot and dry; in contrast Galicia is lush and green. The wet conditions can be a Subscription Link ETMMedia.net

challenge for wine makers but their persistence has paid off. Albariño is now the darling of sommeliers around the country for its ability to match well with a variety of dishes. Classic pairings include summertime favorites like steamed mussels, shrimp, scallops and lobster. Spicy dishes like paella, Cajun spices or sausage pizza also match nicely with this wine. What can you expect when you taste an Albariño? This medium bodied white has aromas of peach, apricot and orange blossom that are balanced by food friendly acidity. Even though we instinctively gravitate toward whites, there are times when we still want the comfort of a red. Lightly chilled fruity reds like Beaujolais are always an option, but if you want something bigger I suggest a Malbec. Argentina has made Malbec a star. While its’ supporting role in Bordeaux has a long history, it became somewhat lost in the blend. Made as a single varietal and grown in the warm sunny climate of Argentina, Malbec has flourished. Full bodied and rich, these reds have aromas of plums, cherry, blackberry and a hint of dried flowers. Argentinean Malbec has a firm tannic finish that is a perfect match for heartier summer foods like grilled burgers, steaks or other red meat barbeque fare. So go ahead, enjoy the dog days of summer with a backyard barbeque and some of these suggestions. Grill the burgers.

but it

won’t be from trying to find the perfect wines for your cookout! So, stock up on these wines for your next party or long weekend at the beach:

Mont Marçal Brut Reserva, Spain: Cava and Champagne have many things in common. They are both a blend of three grape varieties and both use the traditional Méthode Champenoise to create their bubbles. Basically that mean the bubbles are created in the bottle using an age old process rather than in a tank like Prosecco. Cava (literally translated as “cave”) comes from the Penedès region of northeastern Spain. Costing only a fraction of what most French Champagnes sell for, this is one sparkler you won’t feel guilty uncorking at any cookout.

Invite your neighbors. As things heat up in the summer sun, you may break a sweat,

Pazo de Senoransariño, RiasBaixas, Spain

Terrazas de los Andes Malbec Reserva, Mendoza, Argentina

If there were a Grand Cru designation for Albariño, the wines of Pazo de Senorans would be on the list. Marisol Bueno not only won Pazo de Senorans, but she also helped Rias-Baixas achieve recognition as one of the top wine regions in Spain. This is a serious Albariño with a richness that is full of peach, apricot with a sense of minerality. Classically crisp, this wine is a perfect partner for treats from the sea. Shuck some oysters, grill some shrimp and prepare yourself for an amazing experience!

Deep in color, this Malbec is brimming with fruit flavors of cherry, plums and violets with hints of vanilla. Full bodied, with structured tannins, this is a meat eater’s red. Terrazas is a subsidiary of Moët Chandon, one of the most famous producers of Champagne. In the fifties they sent one of their winemakers to scout the area of Mendoza—he was immediately impressed. Recognizing the potential of the area, Moët Chandon decided to create the first subsidiary vineyards ever outside of France in Mendoza. This Malbec shows what can happen when you blend a perfect climate with a wealth of winemaking history.

Voting is Messy Business but SOMEBODY’S got to do it!

Initially, our goal was to speak from the voter’s perspective. To discuss how cumbersome and complex some of the issues, currently on our ballots, are. Basically, to let our readers know that “we get it”. We were all ready to write THAT article until, we started looking at the work it takes to even create the opportunity to VOTE. It’s much easier to make up information, place spins on issues, lie, cheat and anything that will get mass amounts of people to consider a perspective they don’t quite understand. But it takes more work to clearly state truths… Only, when we looked at the huge task of permitting citizens of this country an opportunity to “weigh in”, did we start to realize the effort it takes to avail us that right. VOTING is the backbone of our democracy and while other countries ‘don’t get it…’ -WE DO. So with a bit of redirecting, Lets share what Ballotpedia has to say about the issues currently on the ballot. Take it away…

Voting Rights: A Short History The struggle for equal voting rights dates to the earliest days of U.S. history. Now, after a period of bipartisan efforts to expand enfranchisement, Americans once again face new obstacles to voting Carnegie Corporation of New York, November 18, 2019

began its great democratic experiment in the late 1700s by granting the right to vote to a narrow subset of society — white male landowners. Even as barriers to voting began receding in the ensuing decades, many Southern states erected new ones, such as poll taxes and literacy tests, aimed at keeping the vote out of the hands of African American men. Over time, voting rights became a bipartisan priority as people worked at all levels to enact constitutional amendments and laws expanding access to the vote based on race and ethnicity, gender, disability, age and other factors. The landmark Voting Rights Act of 1965 passed by Congress took major steps to curtail voter suppression. Thus began a new era of push-and-pull on voting rights, with the voting age reduced to 18 from 21 and the enshrinement of voting protections for language minorities and people with disabilities. Greater voter enfranchisement was met with fresh resistance and in 2013, the Supreme Court gutted the Voting Rights Act in its ruling on Shelby County v. Holder, paving the way for states and jurisdictions with a history of voter suppression to enact restrictive voter identification laws. A whopping 23 states created new obstacles to voting in the decade leading up to the 2018 elections, according to the nonpartisan coalition Election Protection. These activities have a demonstrable and disproportionate effect on populations that are already underrepresented at the polls. Adding to the problems, government at all levels has largely failed to make the necessary investments in elections (from technology to poll-worker training) to ensure the integrity and efficiency of the system.

Challenges to voting rights in this country, like the ones we've seen recently, are hardly a 21st-century invention. Entrenched groups have long tried to keep the vote out of the hands of the less powerful. Indeed, America Page 90 E The Magazine for Today’s Female Executive

a range of barriers, such as poll taxes and literacy tests, to deliberately reduce voting among African American men.

1920: Women win the vote

Despite their belief in the virtues of democracy, the founders of the United States accepted and endorsed severe limits on voting. The U.S. Constitution originally left it to states to determine who is qualified to vote in elections. For decades, state legislatures generally restricted voting to white males who owned property. Some states also employed religious tests to ensure that only Christian men could vote.

1800s: Official barriers to voting start to recede

During the early part of the 19th century, state legislatures begin to limit the property requirement for voting. Later, during the Reconstruction period following the Civil War, Congress passed the Fifteenth Amendment to the Constitution, which ensured that people could not be denied the right to vote because of their race. The amendment was ratified by the states in 1870. However, in the decades that followed, many states, particularly in the South, used Page 91 E The Magazine for Today’s Female Executive

Early in the 20th century, women still were only able to vote in a handful of states. After decades of organizing and activism, women nationwide won the right to vote with the ratification of the 19th amendment to the U.S. Constitution in 1920.

1960: Southern states ramp up barriers to voting

The struggle for equal voting rights came to a head in the 1960s as many states, particularly in the South, dug in on policies— such as literacy tests, poll taxes, Englishlanguage requirements, and more—aimed at suppressing the vote among people of color, immigrants and low-income populations. In March 1965, activists organized protest marches from Selma, Alabama, to the state capital of Montgomery to spotlight the issue Subscription Link ETMMedia.net

of black voting rights. The first march was brutally attacked by police and others on a day that came to be known as “Bloody Sunday.” After a second march was cut short, a throng of thousands finally made the journey, arriving in Montgomery on March 24 and drawing nationwide attention to the issue.

1964: The 24th amendment targets poll taxes

Poll taxes were a particularly egregious form of voter suppression for a century following the Civil War, forcing people to pay money in order to vote. Payment of the tax was a prerequisite for voter registration in many states. The taxes were expressly designed to keep African Americans and low-income white people from voting. Some states even enacted grandfather clauses to allow many higher-income white people to avoid paying the tax. The 24th amendment was approved by Congress in 1962 and ratified by the states two years later. In a 1966 case, the Supreme Court ruled that poll taxes are unconstitutional in any U.S. election.

Page 92 E The Magazine for Today’s Female Executive

Inspired by voting rights marches in Alabama in spring 1965, Congress passed the Voting Rights Act. The vote was decisive and bipartisan: 79-18 in the Senate and 328-74 in the House. President Lyndon Johnson signed the measure on August 6 with Dr. Martin Luther King, Jr., Rosa Parks, and other icons of the civil rights movement at his side. In addition to barring many of the policies and practices that states had been using to limit voting among African Americans and other targeted groups, the Voting Rights Act included provisions that required states and local jurisdictions with a historical pattern of suppressing voting rights based on race to submit changes in their election laws to the U.S. Justice Department for approval (or “preclearance”). In the ensuing decades, the preclearance provisions proved to be a remarkably effective means of discouraging state and local officials from erecting new barriers to voting, stopping the most egregious policies from going forward, and providing communities and civil rights advocates with advance notice of proposed changes that might suppress the vote.

1971: Young people win the vote

For much of the nation’s history, states generally restricted voting to people age 21 and older. But during the 1960s, the movement to lower the voting age gained steam with the rise of student activism and the war in Vietnam, which was fought largely by young, 18-and-over draftees. The 26th amendment prohibited states and the federal government from using age as a reason to deny the vote to anyone 18 years of age and over.

1982: Congress requires new voting protections for people with disabilities

Congress passed a law extending the Voting Rights Act for another 25 years. As part of the extension, Congress required states to take steps to make voting more accessible for the elderly and people with disabilities.

1993: “Motor Voter” becomes law

1975: Voting Rights Act expanded to protect language minorities

Congress added new provisions to the Voting Rights Act to protect members of language minority groups. The amendments required jurisdictions with significant numbers of voters who have limited or no proficiency in English to provide voting materials in other languages and to provide multilingual assistance at the polls.

Page 93 E The Magazine for Today’s Female Executive

Responding to historically low rates of voter registration, Congress passed the National Voter Registration Act. Also known as “motor voter,” the law required states to allow citizens to register to vote when they applied for their drivers’ licenses. The law also required states to offer mail-in registration and to allow people to register to vote at offices offering public assistance. In the first year of its implementation, more than 30 million people completed their voter registration applications or updated their registration through means made available because of the law. 2000: Election problems spotlight need for 2010: Philanthropy embraces need for reform reform

The extremely close Bush-Gore Presidential race led to a recount in the state of Florida that highlighted many of the problems plaguing U.S. elections, from faulty equipment and bad ballot design to inconsistent rules and procedures across local jurisdictions and states. The U.S. Supreme Court ultimately intervened to stop the Florida recount and effectively ensuring the election of George W. Bush.

2002: Congress passes the Help America Vote Act

Along with a core group of other funders, the Carnegie Corporation of New York began investing in voting rights and elections work in the United States in the 1970s and 1980s. However, it wasn’t until the early years of the 21st century that funders started to work more intentionally together in their support for voting rights. A key vehicle for collective funder action on these issues is the State Infrastructure Fund (SIF), a collaborative fund administered by NEO Philanthropy. The fund was created in 2010 and has raised more than $56 million from an expanding list of funders to invest in advancing voting rights and expanding voting among historically underrepresented communities.

June 2013: The Supreme Court strikes a blow to the Voting Right Act With memories of the problems of the 2000 election still fresh in everyone’s mind, Congress passed the Help America Vote Act in 2002 with the goal of streamlining election procedures across the nation. The law placed new mandates on states and localities to replace outdated voting equipment, create statewide voter registration lists, and provide provisional ballots to ensure that eligible voters are not turned away if their names are not on the roll of registered voters. The law also was designed to make it easier for people with disabilities to cast private, independent ballots. Page 94 E The Magazine for Today’s Female Executive

In its June ruling in the case, Shelby County v. Holder, the U.S. Supreme Court gutted the Voting Rights Act. Because of the Court’s decision, states and localities with a history Subscription Link ETMMedia.net

of suppressing voting rights no longer were required to submit changes in their election laws to the U.S. Justice Department for review (or “preclearance”). The 5-4 decision ruled unconstitutional a section of the landmark 1965 law that was key to protecting voters in states and localities with a history of race-based voter suppression. In her dissent in the case, Justice Ruth Bader Ginsberg famously stated, “Throwing out preclearance when it has worked and is continuing to work to stop discriminatory changes is like throwing away your umbrella in a rainstorm because you are not getting wet.”

power to turn back the clock to an earlier time when election laws and practices in many places were marked by blatant discrimination and racism.

2014: The voting rights movement coalesces to fight suppression

August 2013: States ramp up barriers to voting

On August 11, North Carolina’s governor signed a voter identification law seen by many as an attempt to suppress the votes of people of color. The North Carolina law was just one of many similar laws passed in the wake of the Supreme Court’s June 2013 Shelby ruling. Texas officials, in fact, acted on the same day of the Shelby decision to institute a strict voter identification law that previously had been blocked under Section 5 of the Voting Rights Act because of its impact in suppressing the vote of low-income people and racial minorities. After a lawsuit filed by civil rights groups and the U.S. Department of Justice, the North Carolina law was struck down by a federal judge who said it targeted African Americans with “almost surgical precision.” Officials in Alabama, Mississippi, Florida and Virginia shortly joined the ranks of those intent on exercising their newly won Page 95 E The Magazine for Today’s Female Executive

In response to post-Shelby assaults on voting rights, voting rights organizations across the country stepped up their work to protect and advance the right to vote and move us closer to the vision of a nation of, by, and for the people. This work includes litigation to challenge unconstitutional barriers to voting, on-theground advocacy to advance pro-voter policies at the local and state levels, and nonpartisan efforts to register, educate and mobilize historically underrepresented populations so they can participate more actively in elections and civic life. The State Infrastructure Fund began convening a cohort of nonprofit public interest litigation groups with the aim of streamlining and coordinating the field’s response to a fresh wave of policies to suppress the vote. Coordinated by the Mexican American Legal Defense and Educational Fund (MALDEF), the collaborative of 12 organizations has played an essential role in pushing back against strict voter identification laws, racial gerrymandering, and other tactics aimed at reducing the voting rights of underrepresented populations.

2016: Presidential election and claims of fraud

October 2018: State, local officials keep erecting new barriers to voting continue

After President Trump was elected despite losing the popular vote, he and his supporters made claims that large numbers of people voted illegally. A Washington Post analysis was able to find only four documented cases of voter fraud in the 2016 election out of 135 million ballots cast. The narrative about fraud ultimately resulted in President Trump convening the Presidential Commission on Election Integrity, which disbanded in January 2018 without presenting any evidence or findings. Continued false claims of rampant voter fraud have added fuel to the fire and prompted even bolder efforts to suppress the vote. Adding to the problems, government at all levels has largely failed to make the necessary investments in elections (from technology to poll worker training) to ensure the integrity and efficiency of the electoral system.

A 2018 USAToday analysis found that election officials recently have closed thousands of polling places, with a disproportionate impact on communities of color. The polling place closures are just one example of how states and localities have continued to try to suppress the votes of targeted populations. In 2018, for example, the Georgia Senate passed bills cutting voting hours in Atlanta (where African Americans are 54 percent of the population) and restricting early voting on weekends. The latter measure was seen by many as a not-so-subtle attempt to target nonpartisan “Souls to the Polls events organized by black churches to get their parishioners to vote on Sunday after church. Both Georgia measures were subsequently defeated in the state Assembly.

November 2018: Election draws record number of voters but problems remain

2019: Voting rights groups prepare for the 2020 Census and redistricting

According to early estimates, 116 million voters—nearly half the eligible voting population (49.7 percent)—cast ballots in the 2018 elections. Not only did voter turnout set a 100-year record for midterm races, but the election saw record numbers of women and candidates of color running at all levels. In addition, voters approved a number of important state ballot measures aimed at expanding the electorate and making it easier to vote, including a law in Florida that lifts the permanent ban on voting for people with a felony criminal record. The numbers for 2018 were especially impressive given that many states continue to take aggressive steps to make it harder for people to vote. According to the nonpartisan coalition Election Protection, 23 states created new obstacles to voting in the decade preceding the 2018 election.

In the same way that partisan interests and those in power have used voting rights laws and policies to suppress the vote, they also have attempted to use the U.S. Census and the subsequent congressional redistricting process to advance their political goals. The Trump administration, for example, fought unsuccessfully for two years to add a question to the 2020 census asking if someone is a citizen of the United States. Voting rights and civil rights groups said this was a transparent attempt to instill fear in immigrant communities, with the result of undercounting the immigrant population and reducing its political power and voice. Other concerns about the 2020 census include chronic underfunding for the work of accurately counting everyone in the nation. To the extent that the census cuts corners, there is a well-founded belief that it will result in an undercount of already underrepresented populations, including lowincome populations and people of color.

What’s Age Got to Do With It? A Discussion of Ageism in Our Society Today

Dr. Barbara Young

“Ageism In our Society Today” At age 50 I had what I call a “grief” moment. I received my first copy of AARP and all of a sudden, I realized that I was getting older. Many of us have heard or read the poem, “Children Learn what they Live”by Dorothy Nolte. It tells how all of us are affected and influenced by what we learn as children and how we carry these behaviors and belief systems into adulthood.

having a positive attitude toward aging an add 7.5 years to your life. But reality speaks that we live in a society that practically worships youth and everyone wants to look younger, be younger and believe that younger is always better. This belief could be farther from the truth! What I

Our attitudes about old age are learned as children as we witnessed how those around us reacted to it. There was also the influence of television show characters and media messages. Whether positive or negative, we will be greatly influenced by these external factors and we will apply these attitudes to others as well as our own aging process. I remember my grandmother being very active and alert; reading the newspaper every day; looking each night at the news, crocheting, making quilts, gathering clothes, making soap and doll clothes to send to a village she adopted in Africa. She also walked four blocks to go to church well-dressed each Sunday well into her 90’s. She died at age 101. We celebrated her 100th birthday in her church with all of her living children, grandchildren, and great-grandchildren. Now is the best time to assess whether the lens in our aging attitude glasses need an adjustment. I believe it is well worth the time. I discovered later with research that It turns out that the longer people live the less they have a fear of dying. It’s called the The U Curve of Happiness – the curve itself is the way aging affects the brain. Moreover, research at Yale University has proven that

have learned is that wisdom takes time and comes from experience s and living! As older adults, we gain wisdom and we deserve respect. I have seen older adults disrespected and what it looks like when there is stereotyping of individuals based on

their age and the condescending tone used that is reserved for children. This is ageism, which is discrimination and stereotyping on the basis of age. We experience it anytime anyone assumes we are too old for something instead of finding

Intentional ageism includes carrying out practices that take advantage of the vulnerabilities of older persons. We see this in health care, attitudes and improper assumptions about ability and levels of health are held and made commonly by practitioners and also in the workplace. It is an accepted fact that many people who seek employment at age 40 or over encounter difficulties. Not hiring someone based on older age is also intentional ageism and is against the law. And today, intentional ageism also includes scam artists! They are a good example of people who prey upon the vulnerabilities of older adults. They have devised all sorts of schemes using the telephone, mail, computers and even in person to access seniors. Once they have their attention, they con their way into getting hundreds – even thousands of dollars out of seniors. They are so good at it they even convince the skeptics. They use psychological tactics that helps them rob seniors of their money and self-dignity. Many times, seniors are so ashamed that they fell for the scam that they are embarrassed to report it to officials as a crime.

out what we are really capable of or too young. Ageism cuts both ways. All “isms” are socially constructed ideas, racism, sexism, homophobia and that means we make them up and they can change over time. Yet, all these prejudices pit us against each other to maintain the status quo. Page 103 E The Magazine for Today’s Female Executive

Ageism has crept into the fabric of our society by using things such as humor to become something that has been widely accepted. Black birthday memorabilia, over the hill birthday cards, and senor moments are definite examples of. This is a what is called unintentional age discrimination. I will not use the term senior moment when I lost my keys at age 15, I did not say I was having a junior moment. So, we must be careful of our words; what we say is what we will see. (I am getting old; I no longer drive at night) my right knee is

getting old; but your left knee does not hurt, and you have both knees. Recently I was in a restaurant when a Chinese waitress addressed an older African American woman seated in front of me as Auntie! It so startled me that I later called the waitress over and corrected her. She stated she was not aware of the implications of her addressing this elderly African American woman as “auntie.” This is one of the types of ageism I call unintentional ageism – ideas, attitudes, rules or practices that are carried out without the perpetrator’s awareness that they are biased against persons or groups based on their older age. ow mow m How many of you have fallen prey to this unintentional ageism? And it continues. I also learned that much of ageism is passed down from generation to generation. We do not see things as they are; we see them as Page 104E The Magazine for Today’s Female Executive

WE are! (Anais Nin). How did your grandparents behave as seniors? Did you model your behavior from them? We become adults who filter life through a looking glass we’ve held onto since childhood: which is one of implicit bias. One of the critical issues is that many seasoned individuals, (a term I like to use) accept negative metaphors of aging that are imposed from the outside even though their inner image or personal metaphor does not necessarily correspond to the outer image. My grandmother at age 99 would always say she felt like a “young gal” inside. This is because we are spiritual beings and the spirit never grows old. Older persons sometimes resign themselves to ageist attitudes and the price may be high both individually and in terms of the loss of potential societal contributions. Ageism feeds on denial; our reluctance to acknowledge that we are going to become Subscription Link ETMMedia.net

that older person; it is denial when we try to pass for younger, or the use of anti-aging products, or we get upset when our bodies betray us. I advocate that those is us who are “seasoned” celebrate our ability to adapt and grow as we move through life; to help create solutions for our younger women and men; to see ourselves as human capital and a resource for intergenerational learning. What does the Bible say about aging? “Aging” in the Bible is defined as a sign of experience. The Lord promises His continues love and concern for the elderly. “I will be your God throughout your lifetime -until your hair is white with age. I made you, and I will care for you. I will carry you along and save you. Even to your old age and gray hairs, I am He, I am He who will sustain you. I have made you and I will carry you; I will sustain you and I will rescue you. (Isaiah 46.4. John 12:12 states, “Is not wisdom found among the aged? Does not long-life bring understanding? In summary, we do not stop playing because we grow old. There is a fountain of youth; it is your mind, your talents, the creativity you bring to your life and the lives of people you love; the longer I live, the more beautiful life becomes. Ageing is not lost youth but a new stage of opportunity and strength. The secret of health and aging for both mind and body is not to mourn for the past; not to worry about the future, but to live in the present moment wisely and earnestly. It’s important to know who Kevin Mitnick is to understand the who, what, and why that took him down – and he needed to come down. His illegal cyber activities had potential to do more harm than anyone could imagine. He belongs in the annals of computer security history, but not for good reasons one would hope to aspire. His story is fascinating. He wasn’t the best, or the worst, but he’s become the most well known. And he’s made a lucrative career of it. It is a story that has, and will, continue to be repeated by innovative cyber cowboys, and girls, in unexpected places in the world. It’s a lesson for all - in ways no one could have imagined even fifty years ago. No one could have portended the implications of his actions, nor was the computer world ready for his digital destruction. There’s a villain to the story, and a hero. First, we’ll look at the villain.

sign into the computer, they would actually be talking to my program, pretending to be the computer.” [1] In short course, his escalating cyber deeds would lead Mitnick to hack into the North American Defense Command (NORAD), a feat that inspired the 1983 American Cold War science fiction film, “War Games.” The three-time nominated Academy Awards film

Kevin Mitnick was a 12-year old shy and overweight teenager living in California’s San Fernando Valley. He was a brilliant, but shocking bored adolescent. He figured out how to reverse-engineer the Los Angeles public transportation transfer system so he could ride the buses for free. The next year, in 1981, the 13-year old juvenile prodigy Mitnick used early forms of password crackers to steal classmate’s information. He quickly figured out how to use an electronic ham radio device to make free, longdistance calls, becoming an early phone “phreaker” before getting caught and earning a one-year probation for this early misdeed. Mitnick shared his perspective on the early days of hacking to Kill Screen publication dated August 25, 2011: “The funny thing is, when I started hacking, it was a different era. In 1980 I was a senior in high school, and I tried to get into computerscience class. One of the first assignments was to write a program to find the first 100 Fibonacci numbers. I thought it would be cooler to get people’s passwords, so I wrote a program that simulated the computer system at school — when students would Page 110 E The Magazine for Today’s Female Executive

release, but served one year, most of it at a halfway house for people with compulsive disorders. It would be in 1995 that a 25-count indictment against Mitnick would include charges ranging from computer fraud, illegal possession of unauthorized access devices for hacking into personal, corporate, and government computers, possession of unauthorized access devices, and wire fraud. He was finally arrested after a national hacking spree that earned him the merciless spot on the FBI’s most wanted list. It would be until 1999, however, that Mitnick would be sent to prison where he spent 46 months. Although Mitnick had become a cult hero to many, especially those wanna-be hackers and cyber trolls, Steve Gold, a news editor of Secure Computing Magazine and a former hacker himself, told The Independent of London on March 18, 1999, “For all that he's done, there are despots and murderers out there who have suffered less than Kevin.” [3] CNN Interactive covered the trials of Kevin Mitnick in March 1999. Reporter John Christensen quoted Assistant U.S. Attorney Christopher Painter saying, “He's a danger to the community,” said Painter. “We're talking about someone who has consistently and without self-control hacked into systems everywhere. He also was a fugitive and used multiple identities. We think there's a firm basis for holding him, and the courts have agreed.” The deeper and more compelling part of the story is the story behind it - about the innocent man who would unwittingly become the unexpected hunter hacker who finally had the intellectual power to bring down Mitnick.

During the two years preceding his arrest, Mitnick spent one year in a low-security prison, and three years of supervised Page 111 E The Magazine for Today’s Female Executive

Once thought to be impervious to capture, it would be on Christmas Day, 1994 at 2:09 p.m. (Pacific Standard Time) that Mitnick anonymously IP spoofed a computer security researcher working at the University of California at San Diego Supercomputer Center. His name: Tsutomu Shimomura. His email address: tsutomu@ariel.sdsc.edu. Subscription Link ETMMedia.net

Shimomura, a 30-year-old computational physicist and renown security guru, explained the TCP dump packet logs at a presentation given at the Computer Misuse and Anomaly Detection on January 11, 1995 in Sonoma, California. He was able to show the actual logs, and explained, “...that two different attack mechanisms were used. IP source address spoofing and TCP sequence number prediction were used to gain initial access to a diskless workstation being used mostly as an X terminal. After root access had been obtained, an existing connection to another system was hijacked by means of a loadable kernel STREAMS module.” [4] Two different attack mechanisms were used to gain access to an x-terminal workstation: IP source address spoofing and TCP sequence number prediction. Mitnick got root access and hijacked an existing connection. That got him access to the rest of the system. The detail was explained this way: The first IP spoofing probes came from toad.com to determine if the system could be exploited with an IP spoofing attack. Shimomura explained that about six minutes later a flurry of TCP SYNs from 130.92.6.97 to port 513, also a privileged port, filled the connection queue with half-open connections. Then came 20 connection attempts from apollo.it.luc.edu to determine the behavior of x-terminal's TCP sequence number generator. Within 16 seconds the first spoofed packet shut down. What followed, however, was that, “...root access had been gained via IP address spoofing, a kernel STREAMS module named tap-2.01 was compiled and installed on x-terminal... and used to take control of an already authenticated login session...” Shimomura mistakenly thought that firewalls were too restrictive so he did not use one. Although he used encryption and a set of log files to track activity on his machines, the Page 112 E The Magazine for Today’s Female Executive

technology had become obsolete. Security was breached. Shimomura emailed the logs to a research assistant to check for intrusions, and an automated process mathematically compared all log files with one another. An inconsistency was found and the assistant contacted Shimomura. However, Mitnick deleted the log file to cover his tracks. Three days later, on December 27th at 4:33 p.m., Mitnick escalated his behavior by leaving a threatening message on Shimomuraʻs voice mail, mysteriously speaking in a faux-British accent saying, “Damn you. kill you. (second voice) Hey boss, your kung fu’s really good! (first voice) That's right, my style is the best.” On December 30th at 2:35 p.m., another call came in to Shimomuraʻs voice mail. Mitnick said, “Your security technique will be defeated. Your technique is no good.” The next message, left on January 5, 1995 at 12:28 p.m., was simply eerie music. A third message came on February 4, 1995, after which a Newsweek article mentioned the attack. “Ahh... Tsutomu, my learned disciple. I see you, you put my voice for Newsweek, you put it on Newsweek and you put it on the net. Don't you know that my kung fu is the best? My kung fu is great! Why you put my voice on the net? Disturbingly, of the six messages Mitnick left, this one on February 15, 1995 was delivered after he was arrested: “Hi, it is I again, Tsutomu, my son. I just want to tell you, very important, very important, all these phone calls you received with uh, making reference to kung fu movies? Nothing to do with any computer thing whatsoever. Nothing to do with any, Mitnick, hacking, anything. Nothing. I tell you, it was just an interesting call. That's it. All coincidence. This is getting too big, and nothing wrong has been done by anybody who left any messages on your voice mail. Just to let you know. OK? It's getting way too big.” The last message was on February 15, 1995: “Tsutomu, my friend. I just want to say, want to reiterate, it is big joke. It is big, make fun of kung fu movies. Have nothing to do computer hacking, Mitnick, nothing. You tell me, do not send them, to come and get me. No do not fly out to come and get me. I'm not worth it. Just make fun of kung fu movies. That is it. Thank you.” [5] Mitnick was already the center of attention by the FBI. Since 1992 he had been wanted for a probation violation on a computer theft charge, yet, he continued to copy Shimomuraʻs electronic files. Shimomuraʻs system contained two Internet service providers, the Sausalito-based WELL and the San Jose- based Netcom Subscription Link ETMMedia.net

Communications Inc. to companies that housed thousands of credit card numbers. The potential for theft was enormous as the security of credit card transactions was evaporating. Further, Shimomura knew that material on his system also included computer software controlling cellular phone operations. Shimomura said that material found also included computer software controlling the operations of cellular phones, “One of the reasons I think he broke into my machine is I work with companies that do work for cellular companies,” he said. Shimomura's files also included “some of the tools we have used to track these guys. I believe he was after those tools.” [6]

The Sting

Computational physicist Shimomura suspected Mitnick was behind the thefts, so for two weeks he methodically and meticulously tracked Mitnick Based on information stolen, along with data Mitnick was interested in. Shimomura and government investigators tracked the elusive Mitnick. Shimomura used his own modified cellular technology to trace Mitnick's phone activity to the Raleigh, North Carolina area of the U.S. Shimomura and his team called in the FBI. He found Mitnick. After a two-and-a-half-year computer hacking spree the kept Mitnick on the run, the 24-hour stakeout was successful. The FBI arrested Mitnick at his apartment in Raleigh at 1:30 a.m. on February 15, 1995.

Quickly working together to set a trap, Shimomura, the FBI, other law enforcement agencies and also industry sources started setting an electronic manhunt Mitnick. Shimomura reported widely on the theft of his files, and on-line alerts were sent to computer programmers and professionals, as well as Internet enthusiasts. Mitnick became more audacious and broke into the account of a public policy group that opposed government intrusion in the computer world. Mitnick was using modified cellular technology to try to hide himself. It was time for the sting. Tsutomu had his machines “halted” and his disks analyzed. They looked at the very basic data structure of the disk to recreate the deleted log file, and then created various programs to analyze the bit patterns on the disk to retrieve the log information. Observing Mitnickʻs pattern of hacking, Shimomura teamed up with federal agents on February 8, 1994 as the hunt intensified. Then Mitnick began accessing The WELL through Netcom, a commercial network that contained Shimomura’s stolen files. It was this large ISP network that had become the staging point for many of Mitnicks’ attacks. Page 114 E The Magazine for Today’s Female Executive

Mitnick admitted using a number of tools to commit his crimes, including: • Social engineering; • Cloning cellular telephones; • Sniffer programs placed on victims' computer systems; and • Hacker software programs. He also admitted that he stole E-mails, monitored computer systems and impersonated employees of victim companies. Mitnick pleaded guilty to four counts of wire fraud, two counts of computer fraud and one count of illegally intercepting a wire communication. He acknowledged altering computer systems belonging to the

University of Southern California and signed a plea deal admission for breaking into a number of computer systems and stole proprietary software belonging to Motorola, Novell, Fujitsu, Sun Microsystems and other companies. Charges against Mitnick related to the following United States Computer Fraud and Abuse Act cyber security laws: • 18 U.S.C. § 1030. Fraud and Related Activity in Connection with Computers; • 18 U.S.C. § 2510 et seq. Wire and Electronic Communications Interception and Interception of Oral Communications; • 8 U.S.C. § 2701 et seq. Stored Wire and Electronic Communications and Transactional Records Access • 18 U.S.C. § 1029. Fraud and Related Activity in Connection with Access Devices

Felony and Fame Mitnickʻs story does not end here. His trial, and the media coverage of the nascent days of cybercrime prosecution, raised public awareness not only about security issues involving networked computers, but also the new technological frontier had not yet found a match to legislation that could deal with these crimes in 80s and 90s. Today, antihacking legislation is far more appropriate for the current cybercrime environment. Mitnick was held without a bail hearing for four and a half years and held in solitary confinement for eight months before being sentenced. In 1999, Mitnick was sent to prison where he spent 46 months in prison. Some considered this punishment excessive. The FBI calculated the value of the damage that Mitnick perpetrated against the following companies: [7]

• Sun Microsystems: hundreds of millions of dollars • NEC America, Inc: the (stolen) software design for a NEC cellular mobile telephone $1,750,000.00 • NOKIA Mobile Phones (UK) LTD: minimum US $135 Million • NOVELL: cost associated with the development of the source code in excess of $75,000,000

The story of Kevin Mitnick, FBI Most Wanted, computer outlaw, and cybercriminal extraordinaire is a good one. But the story of Tsutomu Shimomura is better. He made the “takedown” heard around the globe happen. He demands my respect for his intellectual clarity and moral courage. Shimomura explained, “The real motivation for tracking him, for putting together a team to go after him, was that we considered this was not

• Fujitsu: $5,517,389.61 In his book, The Art of Deception: Controlling the Human Element of Security, Mitnick states that he compromised computers solely by using passwords and codes that he gained by social engineering. He claims he did not use software programs or hacking tools for cracking passwords or otherwise exploiting computer or phone security. [8] Investigative reporter Jonathan Littman wrote The Fugitive in response to Mitnick’s book, alleging the following key points: [9] • Journalistic impropriety by Shimomuraʻs co-author, John Markoff, who had covered the case for The New York Times, based on rumor and government claims, while never interviewing Mitnick himself; • Overzealous prosecution of Mitnick by the government; • Mainstream media over-hyping Mitnick's actual crimes; • Shimomura's involvement in the matter being unclear or of dubious legality. The two men, who both had shoulder-length hair, finally met one another in the courtroom pre-arraignment hearing. “Hello, Tsutomu,” Mitnick said to Shimomura. “I respect your skills.”

acceptable behavior, and it will not be tolerated. My feeling was he had caused a lot of grief for a lot of people, and he had incentive to stop. He had been to prison before, and he still continued. It wasn't acceptable behavior, and something had to happen. It seemed throwing someone in prison is a very inelegant way of stopping someone. I wish there were an elegant way.” Subscription Link ETMMedia.net

Had Shimomura not assembled the puzzle that stopped Mitnick from moving forward in his criminal capacity, the economic damage could have been unimaginable, not to mention how cyber attacks have significant socio-economic impact on both global enterprises and individuals.

Today, continuing to work on advanced technology, Tsutomu Shimomura is CEO and founder of Neofocal that produces innovative semiconductor chips considered to be fundamental technology to provide power to products that use “smart LED” more efficiently.

Mitnick could have wreaked havoc in a multitude of ways—identity theft, cyber

Kevin Mitnick, now 54 years-old, runs his own security firm that does security consulting for Fortune 500 companies and the FBI, performs penetration testing services for the world's largest companies and teaches Social Engineering classes to dozens of companies and government agencies. He is a millionaire. Kevin Mitnick certainly was an intentional computer security hacker, but not to be the only one taken down. Computer forensic technologists, like the unintended Shimomura, are the ones who find the electronic evidence to catch the cybercriminal. It is fundamental to the world of law enforcement. Famous folk were caught by forensics, albeit less sophisticated than the newer cyber crimes, but just as impactful.

bullying, data leakage, distributed denials of service, and malware attacks on medical devices and smart vehicles. He could have brought businesses and governments to their knees and tanked the economy of the globe. No one should have that power, and Shimomura prevented that from happening. The world owes him a great debt.

Catlin Chen: Speaker, Author, and Financial Expert

Not long ago, I was hit head on by a driver who made a U-turn on the freeway while driving at the speed of 65 miles per hour. So how did that happen? Well, he lost control of his car while retrieving his cell phone, which means he must have had his left hand on the steering wheel while retrieving his phone with his right hand, causing his left hand to lose control of the steering wheel, thus making a 180- degree left turn. The driver hit my car first, which caused me to hit another car before mine came to a stop when my entire car hit the center divider. In any case, the driver who lost control ended up hitting two other cars, and since one of them had a passenger, there were four victims in this accident including myself. Even though my automobile was a total wreck, I’m glad everyone involved was ok and not seriously hurt. Page 122E The Magazine for Today’s Female Executive

Upon finding out from the body shop that my car was totaled, my first reaction was to get a rental car while I wait for the insurance companies to sort it out and send me a check to get another vehicle. After all, it does state on my insurance contract I have rental coverage for 30 days. However, little did I know that once the insurance company inspects and verifies my car as a total loss, the insurance company gave me only two business days to get another vehicle or I will have to pay for my own rental car going forward. This doesn’t sound fair at all by any stretch, but what’s really upsetting is that since my car was a lease, I had to deplete my savings account by $3500 as a down payment for another lease. What if I didn’t have any extra funds in my account? Would I have to start walking or taking public transportation everywhere I go while I wait for the settlement for an indefinite period? Not that there is Subscription Link ETMMedia.net

anything wrong with walking or taking public transportation, but it is a bit inconvenient when I often must rely on driving to perform my job duties at work. Keep in mind, there are four people involved and everyone must agree upon and share the minimum liability coverage of the driver at fault. “Being adequately insured and saving up for an emergency fund is crucial for yourself and the well-being of your family” My financial woes don’t end there. Having been injured, now I must seek medical care. My first thought was to see a Doctor who works on contingency which means they will be paid out from my settlement once the case is settled. The problem with that is, the medical provider wanted me to sign a contract stating that if the amount of the settlement isn’t enough to pay the final amount of my medical expenses, I will personally be liable to pay the difference. Now that to me, just sounds like financial suicide. With no other option, I use my own medical insurance to obtain the needed physical therapy. My therapy lasted for about two months. Once my treatment was over, within a few weeks, I received my first medical bill. At this point, my case was no closer to getting settled so I called the patient support line on the bill to let them know that my case is still pending and eventually, I will be able to pay them once the case settled. To my surprise, the representative on the other end advised me that I should begin paying the bill as soon as possible. Otherwise, it might get sent to collections and ultimately ruin my credit I’ve worked so hard to build up all these years. Of course, without hesitation, I made a payment arrangement to pay in monthly installments out of my own pocket. As you can see, just because you may be the victim in an accident, this does not mean you will be financially taken care of. Not only did I have to pay out of my own pocket for a down payment on another car, I had to first start paying for my own medical bills, all Page 123 E The Magazine for Today’s Female Executive

before even settling the case. Once the case settled, the monetary portion I received was so minimal, it did not justify all the pain and suffering I endured throughout this ordeal. Therefore, I made a claim to collect on my underinsured motorist coverage. About the underinsured motorist coverage, keep in mind that I am only able to make a claim if my coverage is higher than the liability amount that I received from the insurance company of the at-fault driver. Let’s say for example, the at-fault driver has only the minimum liability coverage in the state of California of $15,000 per person and $30,000 per accident. Since there are four people who are entitled to split the $30,000, I can only claim the difference of what I’m covered for minus the amount I already received. Let’s just say I only received $9,000 for the liability claim; remember, onethird of that goes to the attorney so my portion is only $6,000. Now, if I only purchased underinsured motorist coverage of $15,000, then the maximum I will be entitled to, if the insurance company agrees, is $6,000 ($15,000-$9,000). Again, one-third goes to the attorney, so I will only end up with $4,000 if my auto insurance company Page 124E The Magazine for Today’s Female Executive

even agree that I deserve extra compensation for my pain and suffering. What’s the moral of the story? I recommend every driver obtain a higher amount of uninsured/underinsured motorist coverage just in case it’s ever needed. Through my own experience, I have now increased my uninsured/underinsured motorist coverage to $100,000 each person / $300,000 per accident. I’m not planning to use it anytime soon, but life is a moving target and no matter how careful you may be, accidents can happen at any time. Therefore, being adequately insured and saving up for an emergency fund is crucial for yourself and the well-being of your family. As a rule of thumb, have at least nine months-worth of emergency funds for those one-off situations you may never have imagined could happen.

Smart A guide to the pandemic economy

By Edward D. Hess & Katherine Ludwig Your job is at risk—if not now, then soon. We are on the leading edge of a Smart Machine Age led by artificial intelligence that will be as transformative for us as the Industrial Revolution was for our ancestors. Smart machines will take over millions of jobs in manufacturing, office work, the service sector, the professions, you name it. Not only can they know more data and analyze it faster than any mere human, say Edward Hess and Katherine Ludwig, but smart machines are free of the emotional, psychological, and cultural baggage that so often mars human thinking.

The crucial mindset underlying NewSmart is humility—not self-effacement but an accurate self-appraisal: acknowledging you can’t have all the answers, remaining open to new ideas, and committing yourself to lifelong learning. Drawing on extensive multidisciplinary research, Hess and Ludwig emphasize that the key to success in this new era is not to be more like the machines but to excel at the best of what makes us human.

So we can’t beat ’em and we can’t join ’em. To stay relevant, we have to play a different game. Hess and Ludwig offer us that game plan. We need to excel at critical, creative, and innovative thinking and at genuinely engaging with others—things machines can’t do well. The key is to change our definition of what it means to be smart. Hess and Ludwig call it being NewSmart. In this extraordinarily timely book, they offer detailed guidance for developing NewSmart attitudes and four critical behaviors that will help us adapt to the new reality.

Black History

edy, Darcy Eveleigh, Damien Cave, Rachel L. Swarns Hundreds of stunning images from black history have long been buried in The New York Times archives. None of them were published by The Times -- until now. UNSEEN uncovers these never-before published photographs and tells the stories behind them.

Eveleigh, Canedy, Cave, and Swarms explore all these questions and more in this one-of-a-kind book. UNSEEN dives deep into The Times photo archives -- known as the Morgue -- to showcase this extraordinary collection of photographs and the stories behind them.

It all started with Times photo editor Darcy Eveleigh discovering dozens of these photographs. She and three colleagues, Dana Canedy, Damien Cave and Rachel L. Swarns, began exploring the history behind them, and subsequently chronicling them in a series entitled Unpublished Black History, that ran in print and online editions of The Times in February 2016. It garnered 1.7 million views on The Times website and thousands of comments from readers. This book includes those photographs and many more, among them: a 27-year-old Jesse Jackson leading an anti-discrimination rally of in Chicago, Rosa Parks arriving at a Montgomery Courthouse in Alabama a candid behind-the-scenes shot of Aretha Franklin backstage at the Apollo Theater, Ralph Ellison on the streets of his Manhattan neighborhood, the firebombed home of Malcolm X, Myrlie Evans and her children at the funeral of her slain husband , Medgar, a wheelchair-bound Roy Campanella at the razing of Ebbets Field. Were the photos -- or the people in them -not deemed newsworthy enough? Did the images not arrive in time for publication? Were they pushed aside by words at an institution long known as the Gray Lady? Page 133 E The Magazine for Today’s Female Executive
