This New Resident Guide was created to provide you with valuable information we hope will be of help while you are getting settled.

Montclair offers a variety of distinctive amenities, including three lakefront beaches, parks, and playgrounds. Events are held throughout the year, including Montclair Day and Oktoberfest, and are a great opportunity to socialize with fellow residents and enjoy the community’s fantastic landscape.

Our newsletter, The Montclairion, provides useful community updates straight to your doorstep once a month. For news and announcements as they occur, we have our website, www.montclairva.com, and a twice-monthly email newsletter.

Part of the community’s beauty can be contributed to the architectural standards put into place. Included in your Disclosure Package at the time of sale are the Community Guidelines and Articles of Incorporation, Declaration & Bylaws. These documents detail the rules and regulations for living in Montclair, including requirements for exterior upgrades and maintenance. The Covenants Department of the management staff can answer any specific questions you may have on these architectural standards.

association living By purchasing into a community association, be it a townhome or single family home, the owner agrees to abide by the community’s pre-established guidelines. The owner will often live close to his or her neighbors, share common facilities, and voluntarily sacrifice certain freedoms, all for the cause of protecting communal property values and reducing nuisances.

Reasonable restrictions, consistently enforced over time, will preserve the net value of the community and maintain a high quality of life for residents.

Definition of a Community Association A community association provides a communal basis for preserving, maintaining and enhancing homes and property. All community associations have three basic, defining characteristics: ■ Membership in the association is mandatory and automatic for all owners. This is unlike other associations whose membership is voluntary.

■ Certain documents bind all owners to be governed by the community association. These documents require mutual obligations to be performed by the individual owner and the community.

■ Mandatory lien-based economic charges or assessments are levied on each owner in order to operate and maintain the association.

Purpose of a Community Association People choose to live in community associations for numerous reasons.

Many association owners value the inherent benefits offered by community association living. Community associations are designed to: ■ Manage common areas of the property ■ Manage property interests of owners ■ Provide services for owners ■ Develop a sense of community through social activities and/or amenities Rights and Responsibilities As dues-paying members of the community association, owners are entitled to certain rights and, in return, have certain responsibilities.

Owners have the right to: 1. A responsive and competent community association.

2. Honest, fair, and respectful treatment by leaders and managers.

3. Participate in governing the community association by attending meetings, serving on committees, and standing for election.

4. Access appropriate association books and records.

5. Prudent expenditure of fees and other assessments.

6. Live in a community where the property is maintained according to established standards.

7. Fair treatment regarding financial and other association obligations, including the opportunity to discuss payment plans and options with the association before the foreclosure is initiated.

8. Receive all documents that address rules and regulations governing the community association - if not prior to purchase and settlement by a real estate agent or attorney, then upon joining the community.

9. Appeal to appropriate community leaders those decisions affecting nonroutine financial responsibilities or property rights.

Owners have the responsibility to: 1. Read and comply with the governing documents of the community.

2. Maintain their property according to established standards.

3. Treat association leaders honestly and with respect.

4. Vote in community elections and on other issues.

5. Pay association assessments and charges on time.

6. Contact association leaders or managers, if necessary, to discuss financial obligations and alternate payment arrangements.

7. Request reconsideration of decisions that personally affect them.

8. Provide current contact information to association leaders or managers to help ensure they receive information from the community.

9. Ensure that those who reside on their property (e.g. tenants, relatives, friends) adhere to all rules and regulations.

board of directors Montclair Property Owners Association is governed by a board of directors.

The Board represents the entire community and is empowered by the Association Documents to formulate community-wide policy.

Eleven board members are elected by Association members and serve a three-year term. The officers (President, 1st Vice President, 2nd Vice President, Secretary, and Treasurer) are elected by the board of directors from within the currently-serving members and serve one-year terms. Four of the eleven members are elected as Precinct Representatives. Because Montclair is a large community of around 3,800 homes, the community is divided into four precincts. Each precinct is given a representative to whom residents may direct questions, comments or concerns. Precinct listings by street can be found at the community website at www.montclairva.com.

The board of directors meets on the second Wednesday of every month.

Executive Session, which is closed to residents except those involved in violation hearings, begins at 7 p.m. Open Session, open to the public, begins at or around 7:30 p.m., varying depending on the issues discussed in Executive Session.

Speaker’s Time is offered at the beginning of the board meeting, at which time residents may speak to the board about any issues or concerns not included on the meeting agenda. In an effort to ensure all attending are permitted to speak, each speaker is limited to two minutes and the board president may limit duplicate comments on the same issue. Residents wishing to voice concerns on specific agenda items are provided an opportunity to speak after the item has been presented but before a vote is taken.

Items are typically placed on the agenda at the request of board or staff members. Residents who would like the board to review a particular item should contact their Precinct Representative for further information.

Agendas are published at www.montclairva.com and on the management company’s owner-access system, FSRConnect, on the Friday prior to board meetings. A public board package, including all the items to be reviewed at the next Board meeting, can be obtained by logging in to FSRConnect or emailing newsletter@montclairva.com.

committees Committees are created by the board of directors to complete projects or tasks for the Association. There are three types of committees: standing, ad hoc and committees of the board.

Standing committees are established to perform long-term or continuous tasks, such as planning events or creating a budget. A majority of the committees in Montclair are classified as standing committees.

Ad hoc committees are created by the board to address a specific issue. Past examples of ad hoc committees include the Triathlon Committee, Pre-Teen & Teen Committee, and Snow Removal Committee. If the board determines that the community would benefit from continued input from an ad hoc committee, they may elect to provide standing status to that committee.

Committees of the board are comprised of board members appointed by the president. These committees are tasked with functions that fall under the board’s purview. There are five committees of the board: the Architectural Appeals Board, which reviews appeals from the decisions of the Covenants Committee; the Business Review Board, which reviews Home Business Applications; the Financial Appeals Board, which reviews late fee waivers and payment plan requests; the Initial Construction Committee, which reviews applications for new homes; and the Montclair Publications 6 • • •

Advisory Committee, which reviews all outgoing communications.

Standing committees typically meet monthly at the MPOA office at or after 7 p.m. Residents are welcome to join any committee(s) in which they have an interest or feel their experience would be a helpful contribution. To join a committee, complete the Committee Volunteer form on the MPOA website.

Committee meetings are open to the public and all residents are welcome to attend and speak, if desired. However, only standing committee members are permitted to take part in any motions or official decisions.

assessments Each owner is responsible for paying an assessment to the MPOA. These homeowners dues pay for amenities such as landscaping, lake maintenance, community events and other services. Owners have the option of either paying the assessment in full at the beginning of the fiscal year, or dividing the assessment into ten monthly installments, to be paid on the first day of each month, May through February. A processing fee of $2 per month is added to payments made monthly. Any assessment received after the tenth of the month will incur a $35 late fee.

The MPOA fiscal year runs from May 1 through April 30. Payment coupons are mailed to all owners of record that are not signed up for Direct Debit in late March or early April after approval of the fiscal year budget at the Annual Meeting. These coupons are used to make assessment payments at the lockbox or MPOA office. If you misplace or do not receive a coupon book, contact FirstService Residential accounting staff for a replacement by calling (703) 385-1133.

While American Disposal is the only trash company permitted within the community, trash and recycling services are not included in the assessment.

Payment Options ■ Lockbox Payments can be made by check or money order and mailed to the lockbox post office box with a payment coupon.

■ Direct Debit Owners can sign up for the Direct Debit program with FirstService Residential. When using this program, the owner authorizes FirstService Residential to withdraw the recurring assessment amount out of a bank account of their choosing (checking or savings) on the first day of each month that the assessment is due.

■ ClickPay FirstService Residential offers owners the option to make one-time or recurring e-check or credit card payments through ClickPay. Through this platform, owners can manage and pay their assessments online through individual or automatic payments made by e-check (ACH) now for free or by credit card for a nominal fee of 2.95%. Owners wishing to edit their existing setup can do so by contacting ClickPay and referencing their unique owner account number. Residents who have questions or concerns may reach out to First Service Residential at (703) 385-1133.

■ In-Office Assessment payments can be made in-person at the MPOA office by check or money order. Owners are encouraged to provide a payment coupon to ensure payment is allocated to the correct account. Payments can be made at the MPOA office without a payment coupon, however issues may arise with allocation of the payment due to a check reader error. A dropbox is available at the office for after-hours assessment payments. Any payments placed in the dropbox after 5 p.m. on the 10th of each month will be considered late.

lake montclair Lake Montclair is a unique feature of the community, and creates a great deal of activities and opportunities for those who enjoy the outdoors. Fishermen, triathletes, photographers, and all types of nature enthusiasts can take advantage of what the lake has to offer.

The lake was created by damming the waters of Powell’s Creek. The earthen dam, located at Dolphin Beach, helps maintain the water level of the lake.

During instances of inclement weather or for maintenance purposes, a sluice gate is opened to release water from the lake into Powell’s Creek. This lowers the lake to its normal level in cases of inclement weather, and exposes the shoreline in cases of maintenance.

Swimming Nothing will cool you off on a hot summer day like a dip in the lake. Roped-

off swim areas at Dolphin, West, and Beaver Landing beaches are the only authorized swimming spots in the lake and are monitored by lifeguards during the summer season. Swimming while lifeguards are not on duty, or outside of the designated swim areas is permitted, but is at the sole risk of the individual swimmer. There is no diving permitted anywhere on the lake.

Boating There’s no better way to explore Lake Montclair than by boat. On warm weekends you might see a canoe cruise by taking in the sights, a couple of fishermen casting a line from a jon boat, or a party pontoon soaking up the sun. A variety of boats are permitted on Lake Montclair, including kayaks, canoes, jon boats, and pontoon boats. Boating on the lake is exclusive to members of the community, and all boats on the lake must be registered with the MPOA. When you complete the Boat Registration form, available at the MPOA office, you will be issued two stickers: one with a four-digit boat identification number, and one with the current year. Boats must renew their registration annually, and will be issued an updated year sticker upon registration each year.

A community boat rack is available for residents to store their canoes, kayaks, and jon boats if they do not have adequate space at their property, or just want to keep the boat close to the lake. The West Beach boat rack facilities offer storage space for an annual fee of $25 per boat. There are no assigned spaces on the boat racks, and storage is on a first come, first served basis.

A Spring Boat Auction is held annually in April, and any unregistered boats stored at the West Beach boat racks are offered to residents in a silent auction.

The number and type of boats differs from year to year. Residents interested in purchasing a used boat may contact the MPOA office in April for more information on available boats. Any boats that receive no bids during the

auction are discarded.

Fishing Fishing is permitted from boats, community docks, and on the shoreline.

Fishing in swim areas at Dolphin, West, and Beaver Landing beaches, as well as off of the dam, is not permitted. If you’ll be fishing from a friend or neighbor’s shoreline, ensure you have their permission before doing so.

A fishing license from the Virginia Department of Game and Inland Fisheries is required when fishing on Lake Montclair.

Triploid carp (left) are a protected species in the lake. These carp act as a biological control against hydrilla, and should not be hunted, killed, or removed from the lake.

Lakefront Homeowners Because of legislation, such as the Chesapeake Bay Preservation Act, and insurance requirements, homes that reside on the community’s lakefront are bound by specific rules and regulations that may not impact other homes within the community. While they may require more paperwork, these guidelines have been put into place to ensure the safety and environmental quality of the lake.

and must list MPOA as additional insured or certificate holder, where available through the insurance provider. If the insurance provider does not permit the addition of an additional insured or certificate holder, as is the case with most umbrella policies, the owner is required to submit a letter from the insurance company stating such. Any owner who does not have adequate insurance coverage, or does not provide a copy of their insurance, may be subject to fines or the removal of their dock by the Association. In addition to these insurance requirements, lakefront owners must register for FSRConnect. FSRConnect is used to send updates and emergency notifications that are vital for those living in the vicinity of the lake.

Dock Permit Applications are required annually of all lakefront owners with docks. This application, along with a copy of the certificate of insurance and $5 fee, must be submitted to the MPOA office by October 31 each year.

Lake Montclair is owned by MPOA, and is a piece of common property.

With approval from the board of directors, owners are permitted to build private docks for their homes on this common property. Because these docks are on Association property, there are specific insurance requirements that are part of owning a dock on the lake. Owners are required to have a general liability insurance policy with no less than $1,000,000 of coverage,

Because Lake Montclair drains into Powell’s Creek, which then flows to the Potomac River and ultimately the Chesapeake Bay, the lake and surrounding shoreline is subject to Resource Protection Area (RPA) requirements. These requirements were put into place to improve the Chesapeake Bay’s water quality. Because of these restrictions, certain shoreline alterations require approval from Prince William County Public Works. Owners who wish to make any exterior improvements within 100-feet of Lake Montclair are required to obtain RPA approval prior to submitting a Property Improvement Request with the MPOA. While this includes improvements such as adding stairs or building a dock, it also includes removal of shrubs, trees, and other plant life that may prevent erosion. recreation areas Montclair boasts many areas for residents who enjoy spending time in the great outdoors. From lakeside beaches to a sprawling golf course, there’s something for everyone right here in the community. Below you’ll find a detailed description of each facility.

Beaches ■ Dolphin Beach - 4398 Spillway Lane The largest and most popular beach in the community, Dolphin Beach plays host to a majority of the community’s events. Here you’ll find a pavilion with picnic tables and grills, a large playground facility, basketball hoops, an ampitheater and ample parking.

■ West Beach - 4616 Spalding Drive West Beach is the place for boat lovers. All boats entering Lake Montclair are launched from this beach, and here community-owned boat racks are available for storage at a fee. There’s small, shaded play and picnic areas, as well as a basketball court and plenty of off-street parking.

■ Beaver Landing Beach - 15462 Silvan Glen Drive The coziest of Montclair’s beaches, Beaver Landing is a hideaway located at the cul-de-sac on Silvan Glen Drive. This small beach has street parking only and is a short walk down a paved pathway between homes. Space for small get-togethers with two picnic areas, one with pavilion cover.

Parks ■ Kids’ Dominion - 3561 Waterway Drive Located behind the MPOA office building, Kids’ Dominion is a large playground area with plenty of activities for all ages. Picnic tables, benches and a pavilion are available to host small parties or just relax in the shade.

Guests to Kids’ Dominion may use the MPOA office parking lot.

■ Hockersmith Park - 15907 Edgewood Drive Hockersmith is a small, shaded park with a basketball court and grassy

area. While Hockersmith’s address is Edgewood Drive, you’ll have better access via Northgate Drive. Street parking only.

■ Anne Moncure Wall Park - 4433 Waterway Drive Owned by Prince William County, Moncure Park is a large facility with multiple baseball fields, tennis and basketball courts, picnic areas, playground, concessions and lots of parking.

Membership-Only Recreation Areas ■ Montclair Country Club - 16500 Edgewood Drive The Montclair Country Club owns and operates the golf course within Montclair and offers clubhouse access, pool membership and tennis courts. Contact the Country Club at (703) 670-7503 for more information on obtaining membership.

■ Southlake Recreation Center - 5070 Higgins Drive Residents of the Southlake area enjoy a little extra with access to the Southlake Recreation Center. Tennis, basketball and volleyball courts, a baseball field, playgrounds, pool and a large grassy area surround the clubhouse, which is available for event rental. Residents who are not a part of Southlake may purchase a pool membership and rent the clubhouse facilities. Recreation Photo IDs are required to access beaches, parks, and other common areas owned by MPOA, as well as to attend community events.

There are two types of Recreation Photo IDs: unrestricted and restricted.

Unrestricted photo IDs are assigned to residents age 12 and older.

Unrestricted photo ID holders are permitted four guests per ID, or two guests per ID during community events. Restricted photo IDs are assigned to residents age 11 and younger. Restricted photo ID holders are permitted one guest per ID age 16 or older acting as their caretaker. Restricted photo IDs are optional and are not required if the resident is accompanied by a unrestricted ID holder. Recreation Photo IDs are made available to residents in “good standing” with the association: that is, residents or owners who have paid the annual assessment or monthly installment. To obtain Recreation Photo IDs, complete the Recreation Photo ID Application at the MPOA office. Anyone over the age of 18 requesting a photo ID must provide proof of residency in the form of a driver’s license or piece of mail. Renters must also provide a copy of their current lease or a utility bill. Photo IDs are valid during the current fiscal year (May through April) and must be renewed annually by visiting the MPOA office. Replacements for lost or stolen photo IDs are $10 per ID. The picnic facilities at Dolphin Beach, West Beach, Beaver Landing Beach and Kids’ Dominion are available for reservation during the summer season, Memorial Day through Labor Day. Reservations can be made any day of the week, with the exception of holidays and MPOA-sponsored event days. Morning (10 a.m.-2 p.m.) and evening (3 p.m.-7 p.m.) reservations are available. To reserve a picnic area, you must submit the Picnic Area Reservation form with a copy of the declaration page of your homeowners or renters insurance to the MPOA office. Picnic areas are available outside of the summer season on a first come first served basis.

Reservation of the MPOA office conference room is available, however it is limited to regular business hours.

Beautification Day

A variety of events are hosted throughout the year to encourage the community to come together and celebrate. Large events such as Montclair Day and Oktoberfest offer fun for the entire family, while smaller events such as Beer on the Beach or the Montclair Triathlon cater to special groups. All residents with valid recreation tags are welcome to attend the events, and may bring two guests per recreation tag to join in on the fun. Unless otherwise noted, admission to these events is free.

Lantern Launch

As most of the community’s events are hosted at outdoor venues, they can be dependent on cooperation from Mother Nature. If you have plans to attend an event but the weather does not look favorable, check the website for updates. In the event of a weather-related cancellation, notice will be posted on the community website.

Volunteers are an integral part of the community’s events, and are the driving force for the larger events. Residents seeking service hours for work, school, or other organizations, or that just want to lend a helping hand, are encouraged to volunteer for community events. Volunteer opportunities are posted on our website and in The Montclairion.

maintenance As a large community of over 3,800 homes, Montclair requires constant upkeep and maintenance. Much of the community’s maintenance, such as trash services, landscaping, and cleaning are addressed by companies contracted by the Board of Directors. In addition to these companies, the MPOA management staff employees maintenance professionals for various tasks throughout the neighborhood.

communications The MPOA connects to residents through multiple methods of communication, both print and digital. Important information, such as meeting dates, amendments to the Community Guidelines, event dates and details, and general updates are included in these communications.

We encourage residents to read thoroughly through each communication provided to them to stay properly informed and up-to-date on the community’s business.

The Montclairion is a monthly print newsletter distributed to all residents within Montclair and surrounding areas. Articles range from legally-required community notices to fun pieces on local residents or clubs. Funded through advertising income, The Montclairion offers both display and classified advertising space to interested businesses or individuals. For more information on advertising with The Montclairion, email the Communications Manager at communications@montclairva.com.

In addition to The Montclairion, the association distributes a twice-monthly electronic newsletter emailed to all residents subscribed for FSRConnect.

Since The Montclairion requires a longer lead time for publication, the e-newsletter often contains updates to The Montclairion, or new information that was unable to be included in The Montclairion due to print deadlines.

Residents registered for FSRConnect will also receive any emergency email communications sent by the association. Lakefront owners are required to register for FSRConnect, and will receive lakefront-only notices concerning lowering of the lake.

While out and about in the community, you may spot maintenance staff in their white trucks. Maintenance performs tasks not contracted by separate service companies, such as raking of the beaches during the week, trash disposal of common area receptacles, trimming and/or removal of trees, bushes, and brush, and powerwashing of facilities. At community events, maintenance staff can be found setting up or breaking down tables, tents, chairs, and other necessities, as well as ensuring all equipment remains fully functional during the entire event.

While a majority of the roads in Montclair are owned by the Virginia Department of Transportation (VDOT), there are streets that are owned and maintained either by MPOA or the specific sub-associaiton in which they are located. If you live in a sub-association and have concerns regarding parking, road maintenance or snow plowing, contact your sub-association representative for further information. If you live on one of the streets listed below, the MPOA is responsible for the upkeep of your street, including road maintenance and snow plowing.
