IRS DEBT SETTLEMENT: SETTLING $250,000 FOR $100 BY ROBERT KAYVON

At Tax Resolution Professionals, we recently had a case that was a total debt of $268,000 that settled for a mere $100. Getting the Internal Revenue Service to settle, also known as an Offer In Compromise is a real program that gets real results. The catch is not everyone qualifies like they make it sound on radio advertisements. Pennies on the dollar? Sure, sometimes even a fraction of a penny on the dollar if the numbers come out right. How do you get your IRS debt settled? You file an Offer In Compromise with numbers that

satisfy the IRS’ formula. First, the IRS will look to see if you have more available assets than the tax debt. Second, the IRS will go through your income and expenses then give you a yes or no. Some expenses use the IRS Collection Financial Standards and some use your actual expenses. Based on the IRS formula, you either can pay the debt in full before it expires or you qualify for a settlement. Our attorneys are experts at working this formula and your data in your favor, which is how we get consistently stellar results. When we are working a client’s case, we do all we can legally to make the formula show that at the end of the month, the client has no available income. This is how we get settlements often accepted for $100 or less.

If there are left over funds based on the formula at the end of the month, the settlement amount may be larger or there might be no settlement at all. The more the gap is closed and the less assets, the lower the settlement figure. What if you do not qualify for a settlement at all? Then you either are going to be in a payment plan or be placed in Currently Non-Collectable status. Currently NonCollectable status is essentially a payment plan for $0 per month. The IRS files a lien and leaves you alone for the time being. If you owe under $50,000, the IRS will set you up in a 72-month payment plan without filing a lien. If you owe $50,000 to $100,000, the IRS will place you in an 84month payment plan and file a lien. Cannot keep up with either of those payment plans or owe more than $100,000? The IRS is going to request a full financial statement and supporting documentation. Our tax lawyers are experts at handling these situations as well.

Even if you do not get a settlement, the IRS has only 10 years to collect on the debt from the date it is assessed. There are a few exceptions that might extend this Collection Statute Expiration Date. If you end up in a smaller payment plan on a larger debt or Currently NonCollectable status, you might not get stuck paying the whole debt back. If you are stuck paying the whole debt, good chance some penalties can be removed on the debt. The sale of recreational marijuana became legal to sale in Las Vegas on July 1, 2017. The businesswomen and entrepreneurs in Clark County say that they are launching cannabis-centric businesses with the hope that they can avoid the glass ceiling – which some say prevented them from reaching their desired salaries and corner offices. In the past several years, women have become a driving force in the growth of the cannabis industry here and across the United States. And the world is taking notice, as apparent by the 2015 Newsweek cover that proclaimed, “Legal marijuana could be the first billion-dollar industry not dominated by men.” According to Marijuana Business Daily, women make up roughly 36 percent of executives in the legal marijuana industry, compared to just 22 percent of senior executives in other industries and just 4.2 percent of CEO positions at S&P 500 companies. Truly, this could be a new chance for women that have been in the corporate world who couldn’t get to the next level, or the desired level. The industry itself is breaking old traditions – so it makes sense it is more likely for women to break old gender traditions too.

When was the last time you asked a professional to check it out, making sure it was running in tip-top shape? Are there pieces/parts of your business that could use a little strength training, or an infusion of vitamins to help it grow to the next level, or have a stronger foundation? What would that look like? Once a year it easily pays for itself to hire an outside consultant to look at your business plan, financial records, marketing strategies and how the business is running from a holistic perspective to offer an unbiased opinion about the health of your organiza-

-tion and its future. The consultant can offer creative ways to solve visible cash flow issues, new markets and strategies for increasing sales, how to reduce overhead costs and more. Oftentimes we are too close to the day-to- day operation of a business to see long-term challenges looming on a horizon, or simple solutions to complex problems. "Even the most business-minded cannabis professionals can stumble into some unforeseen regulations that can jeopardize their entire operation.

Luckily, attorneys and others who specialize in issues surrounding the legal cannabis trade say there are no truly esoteric or draconian regulations waiting in dark corners to trip you up. Not quite. But there are some things that might slip under your radar. 1. Trouble With Investigators ADVICE: Get to know your investigators, and cooperate. Arguably, this relationship can make your life immensely difficult or quite easy. Investigators have a tremendous amount of power. Treat them with the respect, keep the lines of communications open. A hostile relationship is not going to be beneficial.

Advice: Start by becoming intimately familiar with OSHA requirements, as well as any cannabis-specific regulations that your state has in place. Colorado, for example, has a Marijuana Regulatory Health and Safety task force. Then, be prepared to focus as many resources as it takes to get compliant. “Once you lose your license,” Kappel says, “it’s very likely that you won’t get it back.” Many cannabis businesses have hired compliance officers, whose sole responsibility is to focus on changing regulations and ensuring the business is 100percent compliant.

A common misconception held by cultivators is that product liability stops with the dispensary. However, a consumer who suffers ill effects from a cannabis product will “go after anyone in the line of production,” says Martina Jaccarino, managing partner at the Jaccarino Law Firm in Nevada. “Growers think they don’t need to act defensively,” she explains. “Dispensaries and processors will pass liability on to cultivators in any way they can. So cultivators need the same types of waivers and protections from that liability as the dispensaries.” One of the best lines of defense against liability, however, is to maintain quality and safety standards — and to back that up with testing, Jaccarino says. But not just any standards. She recommends testing your product against the highest standard in the country — Nevada — because if lawsuits happen, those are the standards to which you’ll be held. An attorney advocating for a plaintiff who suffered adverse effects from cannabis or a related product will argue that it is incumbent upon growers to know and meet the very highest standards, even if those standards are from another state and even if you are meeting the standards in your own state, Jaccarino explains. “In the legal marijuana industry, there is a standard of care that includes knowledge of all jurisdictions,” she says. “There is a fallacy in thinking that because you are compliant with the law that you can’t be found negligent.”
