Federal lawsuit: Wisconsin black man arrested while driving with white grandmother sues officers

Akil Carter is suing Wauwatosa police claiming officers violated his civil rights

A man claims he was wrongfully pulled over by Wauwatosa police officers, ordered out of the car to his knees at gunpoint and then handcuffed and placed in the back of a squad car, all because he is black.

The traffic stop happened in September 2018 near 114th and Burleigh streets near the Mayfair Collection.

That claim prompted a federal civil rights lawsuit and a seven-person jury, all of whom are white.

Four women and three men heard opening statements and testimony Monday, March 13, 2023, from the grandmother, her friend, and Officer Patrick Kaine, who initiated the traffic stop that day.

Cameras are not allowed in federal court, but WISN 12 News' Hillary Mintz listened to the testimony.

Akil Carter, the plaintiff in the case, was riding in the back seat of a blue Lexus. Carter is black, he was 18 at the time. His grandmother, Paulette Barr, is white. She was in the passenger seat. Barr's friend Sandra Adams, also white, was in the driver's seat.

Barr and Adams testified in court Monday, telling jurors when the officer's lights came on behind them they had no clue why they were getting pulled over.

Kaine told jurors while he was in his squad car, another man referred to as a "tipster" in court made a U-turn and pulled over to tell Kaine a robbery was happening in a blue Lexus at the next intersection. Kaine said the "tipster" never said how he knew this information or what exactly he saw, but Kaine said the man seemed "adamant" this was happening.

Kaine then proceeded to pull the blue Lexus over.

He's heard on dash camera video obtained by WISN 12

Celebrating the Life of Dora Lee Hogan

Dora Lee Hogan was born on February 14, 1926 to the union of her adoring parents, John Wesley and Barbara Freeman, in Forest City, Arkansas. She earned a diploma from Dunbar High School in Madison, Illinois and would later complete courses at the University of Wisconsin with an emphasis in fostering young children.

News shout over his squad PA system telling Carter to get out of the car with his hands up, then to get to the sidewalk and walk backward toward the officers.

Kaine told jurors he began a "high risk" traffic stop and called for backup.

On the dash camera, Kaine is seen drawing his .40 caliber Glock service weapon as he walks in front of his squad car to where another officer is handcuffing the black teenager.

The officers then brought Carter and placed him in the back of the squad.

Meanwhile, Kaine wet back to his grandmother's car, telling the officer that's her grandson.

Kaine tried to explain the situation and apologizes only for the bad information he received from the "tipster."

Defense attorneys said Carter was detained for six minutes and then let go. The entire traffic stop lasted 11 minutes.

During opening statements, Carter's attorney Joy Bertrand told jurors these officers violated Carter's Fourth Amendment right, the "foundation of this case and freedom," Bertrand said.

Bertrand added it protects people from "unreasonable seizure" and "police must have reasonable, suspicion that a crime is afoot."

Bertrand argued that the officers had no evidence or proof that a crime was being committed in that blue Lexus.

Defense attorneys during their opening statements argued the officers needed to investigate in order to find out if a crime was being committed and that warranted a traffic stop to find out.

During Kaine's testimony, he told the jury during his 28-year career he had encountered people with mental illness and people who make false reports. He also added that he told the "tipster" to meet him near the traffic stop to get more information, but when another officer went to find the man they couldn't, he was gone.

Kaine is set resumed his testimony Tuesday, March 4 for cross-examination.

Former Wauwatosa Police Chief Barry Weber is also named as a defendant in the lawsuit. Weber was seen in federal court March 13. He could be called to testify.

Carter, the man arrested is also expected to testify. Carter said he suffered emotional distress and trauma following the traffic stop. He is seeking damages in the civil case.

Attorneys will give closing arguments before jurors decide the case.

All the officers named in the lawsuit are active members of the department.

Wauwatosa police told WISN 12 News no officers ever faced discipline associated with the traffic stop.

Dora accepted Christ as her Lord and Savior at an early age and was united with Friendship Missionary Baptist Church more than 79 years ago. Throughout the years, Dora proudly served within her church community in many capacities; most notably as Head Secretary, Trustee member, Women’s Committee member, President of Gospel Choir, and on several fundraising and outreach programs. Her faith and commitment to Friendship is a testament of God’s will and unwavering love.

Dora was called to lead a life caring for children. The many children and grandchildren she cared for throughout her life was her most proud accomplishment. She carried the title mom and grandma like a badge of honor. Upon retiring, she would spend her time with family and friends and find ways to still serve her church community.

Being Frank

Recently I became sick while observing a conversation between professional African Americans. It was sickening to watch these pro negroes, Negroes for the white man according to Malcolm X, converse. I won’t call it talking, it was verbal assassination. The way these pro negroes talk about other African Americans is the same way lower class African American kill each other. The two factions just use different weapons. It is time for the African American love for killing each other to stop on all levels.

I watched this group of pro negroes literally assassinate a pro athlete who is now in hot water with the white-run NBA. Who the player is and what their alleged crimes are is not relevant to this article. What is relevant is the way African Americans on all levels will attack and slay other African Americans in the USA. All of the Black Lives Matter rigmarole and Black History Month celebrations have led to no progress in ending the murder of African

Who's tightening the noose?

ery pro negro in the conversation had at least a bachelor's degree. Curtis Mayfield was right when he sang, “Educated fools from uneducated schools.”

Americans by other African Americans – both physically, mentally and spiritually.

We’ll start with the pro negro. The pro negro is just as foolish as the so-called ignorant uneducated negro in the ghetto. The pro negro is more despicable because they don’t offer the victim a clean death. The pro negro hides behind degrees or job titles and claims to be civilized. Yet, these same cultured negroes will slaughter any other African American, via verbal assault or ignoring their plight. The pro negro conversation that I observed

was ironic because a year ago these same negroes loved the NBA player. Now, since whatever has taken place these pro negroes are just like a white lynch mob chasing a black man accused of raping a white woman. You could see the glee on these pro negro faces as they talked about the player's life. One even went so far as to say they had inside sources that claimed the NBA team didn’t want to have anything to do with the player. I could hear the hounds baying and saw the imaginary noose being placed around the player's neck. It was sad because ev-

You have heard the saying, “Ignorance is bliss.” Not in the African American community. Ignorance has become a way of life in the African American community. You hear over and over what society has done to African Americans. All these statements have an air of truth. The statement that is pathetic is this one. After 500 years and 65 years of being educated, African Americans still murder each other with no remorse. The pro negro uses words and character assassination. The ignorant African American uses weapons along with verbal methods to kill other African Americans. The murder rate for African American violence towards each other should not exist. There is no reason acceptable for African Americans to kill each other with all the information about how white society has manipulated African Americans into

self-hate status. None. Why then do the so-called lower class African Americans still commit the act of murder on one another? Didn’t Martin Luther King preach non-violence? Oh, that was non-violence toward whites. African Americans missed the lecture about loving and caring for each other.

Many will say that I am verbally assassinating African Americans. Am I? Or am I pointing out a fact that African Americans on all levels try to ignore. The fact that until African Americans see each other as assets, they will always be slaves on this planet.

Statement from the National Bankers Association on Silicon Valley Bank and Signature Bank

On Monday, March 13, 2023, National Bankers Association (NBA) President and CEO Nicole Elam, Esq., and Chairman Robert James, II, released the following statement regarding Silicon Valley Bank (SVB) and Signature Bank.

“In light of recent industry events, the National Bankers Association wants to assure consumers that your money is safe with minority banks. Minority depository institutions are very different from both SVB and Signature Bank which had high concentrations in crypto deposits and volatile venture capital. Minority banks are not exposed to riskier asset classes and have the capital and strong liquidity to best serve consumers and small businesses. If you’re looking for a place to bring your deposits and have greater impact, bring your deposits to minority banks,” said Nicole

Elam, President and CEO of the National Bankers Association.

“The Biden-Harris Administration, FDIC, and Federal Reserve worked hard this weekend to make sure that these bank failures are the exception, not the rule, and that all Americans can continue to have confidence in our banking system. I also applaud bipartisan leaders in Congress for keeping stakeholders informed about how hard-earned deposits are being kept safe.” said Robert

James, II, Chairman of the National Bankers Association, President and CEO, Carver Financial Corporation.

The National Bankers Association is the nation’s leading trade association for the country’s minority depository institutions (MDIs). MDIs have always focused on safety and soundness as a part of our conservative, relationship-based business model. We continue to monitor SVB’s impact on large corporate deposit concen-

trations, fintech, tech companies, and larger financial institutions that have partnerships with MDIs or who have made investments in MDIs.

MDIs are in the strongest position ever to support their customers and here’s why:

• Traditional Banking Model with Diverse & Secure Assets: MDIs are diversified in terms of their assets, predominately focused on well-collateralized loans, and are not exposed to riskier asset classes. Unlike both SVB and Signature Bank, MDIs have very limited exposure to the venture capital industry and crypto.

• Well-Capitalized and Strong Liquidity: MDIs are in the strongest position ever. The sector is exceptionally well capitalized, enjoys substantial liquidity overall, and has grown by 33 percent over the last three years in total assets. Nearly $4 billion in new,

permanent capital has flowed to MDIs and currently, the median MDI common equity ratio is 16.4 percent versus 14.8 percent for non-MDIs.

• Positioned for Impact: 77 percent of MDI branches are in areas with a higher average share of minorities compared to 31 percent for all FDIC-insured depository institutions. According to a Dallas Fed Study in 2022, MDIs originate almost 40 percent of their mortgages to minority borrowers, versus only 10 percent by other banks.

Additionally, MDIs originate 30 percent of small business loans to low- to moderate-income communities in comparison to 20 percent at community banks and 24 percent at large banks. Customer deposits are not only extremely safe in an MDI but are far more likely to have a positive impact in the community.

'A Mind is a Terrible Thing to Waste'

The Late Night Ministers Association (LNMA) held the second half of their giveaway revival, February 19, 2023 at the Mount Zion Missionary Baptist Church where Reverend Dr. Louis Sibley, III, serves as pastor. This association meets on the first Sunday of the month beginning August through April for the purpose of fellowshipping and raising funds to support students.

A group of local ministers organized The Late Night Ministers Association and adopted the theme “A Mind is a Terrible Thing to Waste” more than 30 years ago as they focused on the youth in their various churches in the state of Wisconsin. Their conviction was, they would rather help our young people continue with their education rather than visit them in jail or preach their funerals; so, they focused on building this ministry. Today, The Late Night Ministers Association have helped numerous students as they matriculated in various colleges over the years. Many have returned to the community to give back; some have moved to other states; while others are currently enrolled in various universities/colleges throughout the United States. Although a number of pastors who supported this ministry in the beginning have passed or have dropped out, we commend those few who continue the work.

Pictured are (from left) LMNA Executive Secretary, Pastor Edward Thomas, LMNA President Pastor Robert T. Wilson, and Pastor Louis Sibley III.

SIDS rate increases in black infants, tips for protecting your child

During the first year of the COVID-19 pandemic, the United States saw a spike in the number of black infants who died suddenly — worsening a longstanding disparity, a new government study finds.

The increase was seen in what’s called sudden unexpected infant death, or SUID. It’s a term used when a baby younger than one year dies from no immediately obvious cause, often during sleep. SUID includes cases of the much better-known SIDS (sudden infant death syndrome), as well as incidents where babies accidentally suffocate during sleep, and deaths where no cause can be determined.

Overall, the United States has seen a drop in those sudden infant deaths since the 1990s, according to the U.S. Centers for Disease Control and Prevention.

That success is attributed largely to public health campaigns encouraging safer infant sleep practices. For years, parents have been advised to put their baby to sleep on the back, not the tummy; keep cribs free of blankets and other loose bedding; and avoid bed-sharing with their baby.

Despite the declining overall rate of SUID, however, racial disparities have persisted.

Why the spike in black infant deaths?

Now, in this latest study, the CDC found that sudden deaths among black infants rose between 2019 and 2020, but held steady or declined among babies of other races and ethnicities.

The result was a widening in the disparity that already existed pre-pandemic, says Sharyn Parks, one of

the CDC researchers who worked on the study.

In 2020, black families had double the risk of losing an infant to SUID, versus the average for the country as a whole. For every 100,000 black infants born that year, 214 died suddenly — up from about 190 per 100,000 in 2019, the study found.

Meanwhile, SUID rates were lower, and did not spike in 2020, among white, Hispanic or Asian American infants.

There is no single reason that black infants are dying at a higher rate, experts say.

“It’s obviously a complex issue,” said Dr. Rebecca Carlin, a pediatrician at Columbia University Irving Medical Center, in New York City. She is co-author of an editorial published with the CDC study in the journal Pediatrics

Carlin said that while safe sleeping practices are critical to preventing SUID, there are also social and economic disparities at work.

For one, black women in the United States are less likely to have access to early prenatal care, which, among other benefits, can reduce the risk of preterm birth.

Preterm birth is a risk factor for SUID, Carlin noted.

Similarly, when black families cannot get to routine pediatrician visits, they may not learn about safe sleep practices.

Meanwhile, Carlin said, many black moms lack paid maternity leave from their jobs. That means they have to rely on other caregivers, who may not always know how to put infants to sleep safely. Plus, those same moms may find it impossible to breastfeed — which helps lower the risk of SUID.

The pandemic only worsened the situation, Parks and Carlin added.

“We know the COVID-19 pandemic and mitigation efforts — such as stay-at-home orders — disproportionately affected racial and ethnic minority communities,” according to Parks.

On top of having even more difficulty accessing health care, she says, people of color suffered more job losses, and stress over paying the rent and buying food. Some people lost their homes, and may have moved in with family or friends.

“These factors may have led to more unsafe sleep practic-

es like bed-sharing, thereby increasing the occurrence of SIDS and other sudden unexpected infant deaths,” Parks added.

Plus, Carlin said, many black Americans who did keep their jobs were “essential workers” who had no option to work from home. So mothers had to go to work at a time when childcare centers closed, and many scrambled to find a replacement — perhaps, Carlin noted, family or friends with little infant care experience.

On top of that, she said, those same moms were probably exhausted and emotionally drained: If their babies slept better in bed with them, they may have made that choice.

Parks said the CDC is continuing its routine monitoring of SUID, and it remains to be seen whether rates among black babies changed as the pandemic wore on.

But even if things improved from 2020, Carlin pointed out, the disparity has always been there.

What’s needed, she says, are “systems where new mothers are supported and can focus on parenting instead of paying the rent.”

How to protect your child

A safe sleep environment lowers the risk of SIDS. You can help create a safe sleep environment in the following ways according to the American Academy of Pediatrics (AAP):

• Put your baby on their back for all naps and at night: AAP recommends placing infants to sleep in a supine position for every sleep until the child reaches one year of age. Side sleeping is not advised and is not safe.

• Use a firm, flat sleep surface: A firm, flat, non-inclined sleep surface is recommended to reduce the risk of suffocation or wedging/entrapment.

• Feed your baby breast milk: Breastfeeding is associated with a reduced risk for sudden infant death syndrome (SIDS) and is recommended, unless contraindicated or the parent is unable to do so.

• Never sleep with your baby: It isn’t recommended that you share a bed with your baby under any circumstances.

• Instead of bed sharing, room share with your baby: Infants should sleep in the parents’ room, but on a separate surface designed for infants, ideally for at least six months.

• Keep soft objects and loose bedding out of your baby’s sleep area: Soft objects such as pillows, comforters, and loose bedding should be kept away from the infant’s sleep area.

• Don’t let your baby get overheated: Overheating can increase the risk of SIDS. Your baby only needs one more layer than you would wear in the same environment to be comfortable.

• Try giving your baby a pacifier at nap time and bedtime: A pacifier should be offered at nap time and bedtime to reduce the risk for SIDS.

• Don’t smoke or use nicotine during pregnancy or after your baby is born: Smoke and nicotine exposure and alcohol, marijuana, opioids, and illicit drug use should be avoided during pregnancy and after birth.
