Shelton found not guilty in Wilkinsburg mass shooting Jury deliberated nearly four days before reaching verdict

Cheron Shelton, the 33-year-old father of two who ended up as the only person on trial for the shooting deaths of five adults and an unborn baby in Wilkins-

burg in 2016, was found not guilty on all counts by an Allegheny County jury, Feb. 14. Understandably, there were contrasting reactions as the not guilty verdict was read by the jury foreman around 11:35 a.m. For Cheron Shelton’s family,

tears of relief. For the family members of the shooting victims, tears of disbelief. The jury deliberated three and a half days before arriving with a verdict. As more time passed without a verdict, Shelton’s defense attorneys motioned to Common Pleas

Judge Edward J. Borkowski to throw out the death penalty sought by the prosecution. They argued that a death penalty sentence shouldn’t be considered if a jury is taking what they considered to be an elongated period of time to reach a verdict.

Allegheny County prosecutors were seeking the death penalty in the event of a first-degree murder conviction. But in the end, there was no conviction, nearly four years after the March 9, 2016, shooting deaths of Britta-

ny Powell, Jerry Michael Shelton, Chanetta Powell (and her unborn child), Tina Shelton and Shada Mahone. Three others were wounded in the attack, but survived. “It seemed to me that Mr. SEE SHELTON A5

Wilkinsburg mayor Marita Garrett took the first swing, posting on Monday, Feb. 17, to her Facebook page a public rebuke of the Allegheny County Police Department and Allegheny County District Attorney’s Office, for, in her words, their “reckless handling” of the case involving the shooting deaths of five adults and an unborn baby at a backyard cookout, March 9, 2016, in her borough. A not guilty verdict was rendered in the homicide case against 33-year-old Cheron Shelton, Feb. 14. Both County Police Su-

perintendent Coleman McDonough and DA Stephen A. Zappala’s office swung back with their own public statements. Superintendent McDonough accused “the elected official,” who is Mayor Garrett, of spreading “inaccurate” information

seemingly undeterred by the county officials’ statements, swung again on Tuesday, Feb. 18, in an exclusive, nine-minute interview with the New Pittsburgh Courier. While she takes “accountability” if part of her Feb. 17 Facebook commentary about the prosecution “forcing a witness to lie on the suspects for money” was inaccurate, she told the Courier she’s standing by her assertion that county officials mishandled t h e case, thus resulting in a not guilty verdict. She spoke of how the judge presiding over the case threw out the case against one of the original co-defendants, Robert Thomas, just an hour before trial proceedings began. The case against Thomas was lessened after local media outlets reported that one of the witnesses the prosecution could be using in the case against Thomas admitted to killing a child in East Hills in 2013,

One by one, the list of those publicly denouncing the alleged comments made by Allegheny County Common Pleas Judge Mark Tranquilli is growing. And, if proven true that Judge Tranquilli referred to a young Black female juror as “Aunt Jemima” and presumed that her “baby daddy probably sells heroin,” the newly-formed group titled The Pittsburgh Black Lawyers wants the judge removed from office following a thorough investigation by the state’s Judicial Conduct Board. For now, Judge Tranquilli is assigned to perform administrative tasks only, and not to preside over any court cases, an order made and signed by President Judge Kim Berkeley Clark on Feb. 6. The order came two days after Judge Clark originally assigned Judge Tranquilli to summary appeals following the results of a written complaint made to the Judicial Conduct Board by
