YET ANOTHER MAUI GMO INITIATIVE LAWSUIT When a hyper-controversial measure like Maui’s GMO Initiative passes by a hair (50.2 percent to 47.9 percent), you can expect immediate litigation. But three lawsuits? Sure, why not.

First out of the gate was the suit filed by the SHAKA Movement–the initiative’s backers–against the County of Maui (apparently to secure a seat at the table to implement and defend the initiative) as well as Monsanto and Dow (possibly because they threatened to sue to overturn the initiative, but who knows) in Maui’s Second Circuit Court. Next, Monsanto and a few other entities filed a suit in U.S. District Court to overturn the initiative. That second suit led to Judge Barry Kurren imposing a temporary injunction against the initiative that’s good until March.

And now we have a third suit, filed on Nov. 21 in U.S. District Court by Earthjustice and the Center for Food Safety. That suit, ac-

U.S. Representative Tulsi Gabbard, D– Hawaii, opposed arming Syrian rebels in the war against the terrorist group ISIL (also known as ISIS or the Islamic State), but today she said she’s sponsoring bipartisan legislation to “directly arm” the Kurdish army–known as the Peshmerga–in Iraq.

Here’s how Gabbard put it in a Nov. 20 news release from her office: “The Kurdish Peshmerga are courageously fighting to destroy ISIL. They are the primary offensive force fighting against ISIL on the ground, and are doing so with inadequate weapons and resources. We should be doing everything we can to get them the heavy weapons and equipment they need to support their fight to eliminate our common enemy.

This bipartisan legislation will help level the playing field for this fighting force, which is vastly outgunned and mostly using outdated light weapons. Systemic changes need to occur within the structure of the Iraqi government, but we cannot wait; we must stop routing these weapons through a still dysfunctional Shiite-led central Iraqi government, which has thus far withheld necessary support to the Peshmerga, and provide equipment and heavy weapons directly to the Kurds. Their needs are urgent. We cannot waste any more time, as ISIL continues to grow, increasing the threat to the United States and our partners.”

The bill, known as H.R. 5747, was led

by Representatives Ed Royce (R-California) and Eliot Engel (D-New York). Gabbard herself is a captain in the Hawaii National Guard and a veteran of the Iraq War. But it’s unclear how this would actually work, especially given that the Pentagon has apparently already promised to start sending small arms and ammunition to the Kurds. “Defense Secretary Chuck Hagel [who suddenly resigned on Nov. 24] said the Pentagon would arm the Kurds directly–assistance they’ve been requesting since the Islamic State turned its sights on Kurdistan–with AK-47s, mortars, and ammunition,” the journal Foreign Policy reported on Aug. 12. “Before, all assistance flowed through Baghdad’s Shiite-led govern-

ment. When the Sunni fighters overran the Iraqi security forces earlier this summer, the government troops abandoned much of their equipment, including U.S.-provided tanks. The Islamic State then seized it. A Pentagon official wouldn’t rule out providing anti-tank weapons and other materiel to the pesh. ‘The U.S. government is coordinating with the government of Iraq to help fill these [weapons] requests as quickly as possible,’ a State Department official told Situation Report in an email.”

Nov. 20 news release from the University of Hawaii. “The tagging efforts are providing new insights into the coastal habitats most frequently visited by tiger sharks around Maui.”

Now the data is coming in. According to the researchers, tiger sharks really prefer shallower waters.

“We are seeing a strong preference for coastal shelf habitats shallower than 600 ft,” said Dr. Carl Meyer, who’s with the Hawaii Institute of Marine Biology, in the Nov. 20 UH news release. “Although these sharks also roam far out into the open-ocean, they are most frequently detected in the area between the coast and the 600 ft depth contour which is up to 10 miles offshore around Maui.”

What’s even more fascinating is that the sharks seem to behave differently around each island.

“We are tracking tiger sharks around O‘ahu and Maui simultaneously so that we can have the clearest possible comparison of tiger shark behavior between these two islands,” said Dr. Kim Holland, UH’s senior shark scientist, in the Nov. 20 UH news release. “Both O‘ahu and Maui have high levels of recreational ocean use, yet Maui has a higher rate of shark

TIGER SHARKS MAKE TRACKS IN HAWAII Despite the minuscule numbers of people killed every year by sharks (and massive numbers of sharks killed by humans each year), there’s something about the creatures that terrifies many visitors to Hawaii.

For Hawaii’s native kanaka maoli, this is unfortunate, given that to them sharks are ‘aumakua, the reborn spirits of deceased ancestors who serve now as guardians.

For marine biologists, sharks are neither benevolent spirits nor dangerous monsters– they’re mysteries, deserving of studied, careful research. Following a cluster of shark bite incidents in 2012, two internationally recognized shark experts began tagging tiger sharks in the waters around Maui and Oahu in hopes of learning more about the creatures.

In 2013, “24 large tiger sharks were captured and fitted with tracking devices off Kihei, Olowalu and Kahului, Maui,” stated a

Holland added that “We are seeing the exact same depth preferences around O‘ahu, but the most frequently used sites don’t line up with popular swimming and surfing sites to the extent that they do around Maui.”

cording to a Nov. 21 Center for Food Safety press release, is “to defend the County of Maui’s recently passed genetically engineered (GE) crop safety initiative from a legal challenge by multinational chemical companies.”

“Maui County’s betrayal of its own people by agreeing to delay the moratorium without a whimper of resistance proves it cannot be trusted to properly defend our clients’ interests,” said Earthjustice managing attorney Paul Achitoff in the news release. “The people of Maui, Moloka’i, and Lana’i have spoken, in the face of enormous industry pressure: They want the spraying and growing to stop until the impacts are properly studied. Since Maui County won’t defend the law, we’ll have to do its job and make the arguments in court.”

For the record, the GMO Initiative lost in every Molokai and Lanai precinct. But who says we have to let that get in the way of a good lawsuit? ■

HULA O NA KEIKI CONTEST WINNERS The Ka‘anapali Beach Hotel recently announced the winners of its 24th Hula O Na Keiki competition, which took place on Nov. 14-16. The children’s hula competition was designed to preserve Hawaiian culture through ancient dance and music. Children aged five to 17 competed in their respective categories for awards and titles, and the chance to win nearly $14,000 in cash and prizes.

Twenty-three keiki entered the competition as soloists and palua (boy and girl pairs). The participants performed kahiko (ancient) and auana (modern) hula styles, reflecting both traditional and personal interpretations of competition songs.

Honolulu Cookie Company has teamed up with Shane Victorino to help raise money for the two-time World Series Champion’s charity for children. The Oahu-based cookie company will donate a portion of proceeds from its new “Flyin’ Hawaiian” Gift Box to the Shane Victorino Foundation’s community initiatives benefiting underserved children.

“My wife, Melissa, and I are very grateful for all the support that the Honolulu Cookie Company is giving to our Foundation, which allows us to give back to communities that have given so much to us,” said Victorino. “Every year, since we started our Foundation, our goal has been to increase our impact on kids in need—and this year, Honolulu Cookie Company is giving us a real boost,” said the two-time MLB All-Star.

Victorino, nicknamed the Flyin’ Hawaiian, is currently an outfielder for the Boston Red Sox. The Maui-born Gold Glove Awardwinner has hit 107 career home runs.

News Of The Weird WEIRD PATRIOTISM November is tax-publicizing season in Finland, where, starkly unlike America, the government releases all individuals’ tax records to help build public support for the country’s vast welfare state. Thus, reported Foreign Policy magazine, Finnish society gets a “yearly dose of schadenfreude” ... “opening the door for a media frenzy of gossip, boasting and fingerpointing” about “fair share” and who’s more worthy. A few, however, proudly pay high Finnish taxes as a “badge of patriotism,” rejecting common tax shelters.

“We’ve received a lot of help from society,” said one homegrown (and wealthy) entrepreneur, “and now it is our turn to pay back.”

Steve Soifer, CEO of an international support group for people with “shy bladders,” excoriated DirecTV in November for its series of commercials featuring Rob Lowe, whose “awkward” character in one ad stands at a urinal and says, “Fact: I can’t go with other people in the room.” Soifer says the ad ridicules a serious problem -- and compared it to “making fun” of a man missing an arm or leg.

THE POWER OF ONE SENSITIVE SOUL Lt. Col. Sherwood Baker was turned away from Adams High School in Rochester, Michigan, in September by a guard who said a school official sent word that Baker was not allowed in to discuss his daughter’s class schedule until he changed to civilian clothes– because “a student” might be offended by his military uniform. (The Rochester school superintendent later apologized.) And the British Embassy in Washington, D.C., apologized twice in August, first a tongue-in-cheek “apology” for England’s War of 1812 attack on the White House and then for making that “apology” in the first place–because of a backlash on Twitter from Americans complaining the jokey “apology” was “offensive.”

MORE PUBIC RECORDS David Van Vleet asked for certain supposedly public records in Tacoma, Washington, and was forced into federal court when the city turned him down. Van Vleet wanted data from the city licenses of strip club employees (dancers’ stage and real names, date of birth, etc.) so that he could pray for them individually, by name, to make his appeals more effective. In October, Judge Ronald Leighton denied Van Vleet a temporary restraining order against the city.

The Washington, D.C., restaurant Second State recently added an accessory to its bar menu–”hand-cut rock,” i.e., “artisanal” ice, for $1 extra (but free in premium drinks). The local supplier Favourite Ice assures that its frozen water contains no calcium to cloud it and, with a heavy-duty

band-saw blade, “hand-cuts” 200-to-300pound blocks into the cubes that ultimately wind up in the glass. A Favourite Ice founder said his frozen water resists drinkweakening longer than ordinary cubes do.

EWWW–GROSS! Daniela Liverani, 24, of Edinburgh, Scotland, and British singer Katie Melua recently survived inadvertent, grotesque ordeals hosting, respectively, a three-inch leech and a spider. The leech had found its way into Liverani’s nose during an Asian backpacking trip and had poked part-way out several times (though Liverani had assumed it was a nosebleed clot and “sniffed [it] back up”). When she finally saw a doctor in October, she said, the leech played peek-a-boo for a half-hour until the doctor grabbed it with tweezers.

Melua’s tiny spider apparently lived in her ear for a week, creating a constant “rustling” noise until her doctor vacuumed it out. She guessed that it came in through old earbud headphones on an airline flight. Her spokesperson said the singer had no hard feelings and released the spider into her garden.

CHUTZPAH! The law finally caught up, partially, to squatter Darrell Beatty in September, as he was charged with grand larceny for forging a deed to a home owned by Jennifer Merin, 70, in Laurelton, New York. However, he bailed out of jail on Oct. 22 and immediately returned to the house. In fact, Beatty’s two sons had remained “at home” even while Beatty was locked up. The home has been in Merin’s family since 1930. “Mind-boggling,” she said.

THE LAW WORKS IN MYSTERIOUS WAYS The Gothamist news site reported in October that bicyclist John Roemer, who was rear-ended by a driver in Brooklyn in May (and whose intensive-care bill was paid by the driver’s insurance company), is now being sued by the driver in small claims court for $2,000 damage to her car. And in November, a civil court in Lindau, Germany, ordered Rory Gray to pay Dr. Daniel Ubani for calling Ubani “an animal” (for having injected Gray’s father with 10 times a drug’s safe dose in 2008, which led to his death). The court found the epithet unwarranted and ordered Gray to help pay Ubani’s legal expenses.

WELL, OF COURSE! The owner of the world’s largest corn maze (63 acres), at Cool Patch Pumpkins in Dixon, California, told Sacramento’s KOVR-TV in October that “several” times this season, visitors have called 911 to come get them out of the maze. Said owner Matt Cooley, “When it’s dark, all you see is corn.” Also, two months earlier, an emergency crew in Braintree, England, was forced to use special equipment to find and rescue an elderly woman who had fallen while inside the 10acre Blake House Craft Centre maze. ■

Recently at our Makawao location, we commissioned a local artist to create a beautiful bench for our parking lot that the entire community could enjoy. Every day, someone would enjoy the bench–sitting, taking time for a quick bite to eat or having some time to rest in the shade. But on one recent evening, after business hours, someone took the bench from our parking lot. We can understand the temptation and perhaps the reason the bench might have been taken, but the bench is our property and we’d like it returned. ■

MAUI FOREST BIRD RECOVERY PROJECT WHAT THEY DO:

They are a research and management organization dedicated to the recovery of Maui’s native forest birds. They focus their efforts on the current most endangered bird which is the Kiwikiu (Maui Parrotbill). There are only 500 of them left in the world and they are only found on Maui! We study their breeding biology, population status, and productivity each year. They are also working hard to restore the leeward dry forest of Haleakala where Kiwikiu were once found. They will reintroduce them

here once the forest is ready for the birds. The biggest need for native forest birds on Maui is more habitat and MFBRP is working towards that goal.

Last year, they planted about 7,000 seedlings in the dry forest of leeward Haleakala. This fall and winter, they are planning on planting even more with the help of dedicated volunteers.

The Actor Michael Keaton is very good in the very flawed ‘Birdman’

I

t’s hard to say what audiences are expecting from Birdman, as the buzz from film festivals, promotional trailers, piles of critical acclaim and even the poster give a disjointed idea of what the film is. If any quick-sell catch phrase could sum this up, it must be The Michael Keaton Art Movie.

Alejandro Gonzalez Inarritu’s film announces its determination to be strange, bold and fearlessly off-putting from the very beginning and never worries about going too far, explaining itself or giving its audience a break. This isn’t to say I didn’t like Birdman, only that I recognize that the movie is full of itself in ways that don’t always work.

Keaton stars as Riggan, a movie star best known for playing the super hero of the title, now trying to show his abilities as a serious Broadway stage performer. While helming a play based on a Raymond Carver story, Riggan’s struggles as an actor and director builds to a self-imposed sabotage; his insecurities as a performer are as extreme as those in his cast. Even worse, he’s hearing the voice of his Birdman character, who acts as a sarcastic muse.

Inarritu has staged the film to make it appear to have been filmed in one continuous shot. It’s an ambitious idea, allowing audiences to share the claustrophobia of being backstage with the actors, marching through long halls that play like the contours of Riggan’s mind. There is an amazing scene, where Riggan is locked out of his theater during a preview performance and must figure out how to re-enter the building and make his cue to return to stage. This one scene (and it’s a killer) is the lone example where the illusion of the continuous take is especially effective, as we feel the suspense as the sequence carries out in real time.

Otherwise, scenes of the actors walking and talking, with the performers leaning into the lens for a fish-eyed effect, becomes redundant. There are also moments of magical realism and startling surrealism (with a drum-based score that can be distracting) that are so in-your-face, I often wished the bombardment of style would shut up so I could hear the characters.

The ensemble cast is impressive. Edward Norton is playing with his image as much as Keaton, cleverly cast as a “difficult” actor. Naomi Watts reveals the pain and drive of a hardworking actress (she gave a similarly bruising performance in Ellie Parker). Zach Galifianakis

is stunningly good in a rare dramatic turn as Keaton’s agent and Emma Stone is scrubbed entirely of glamour as Keaton’s rebellious daughter. Amy Ryan and Andrea Riseborough have some of the nicest character moments as the key women in Riggan’s life.

This plays like Lewis Carroll’s Noises Off or Terry Gilliam taking on A Chorus Line, as tonal shifts and backstage drama intermingle with the nature of reality vs. the safe distance art provides the artists.

As I left the theater, I found the movie to be dizzying and frustrating, though I liked many scenes more upon reflection than when I was watching them. A priceless bit with Riggan confronting an especially cruel theater critic is my favorite moment, in a

film loaded with memorably daffy bits.

There is a great deal of speculation around Keaton’s performance, regarding how much it resembles his own life and whether he’ll win an Oscar for his trouble. While Keaton digs deep and movingly portrays the tortured layers of his beautifully messy character, this isn’t his finest performance. He’s bared his soul before in Clean and Sober and his under-appreciated work in Multiplicity and Pacific Heights were as award worthy as anything he does in Birdman.

If this fusion of fantasy, psychological thriller and dark comedy brings further attention to Keaton and his considerable body of work, then good. He still has a lot of creative (beetle) juice left in the tank. ■
