MAKING SENSE OF A&B’S EAST MAUI STREAM RESTORATION ANNOUNCEMENT Sometimes I get the distinct impression that the Hawaii Legislature, though controlled by the Democratic Party, really has no clue as to what their constituents are actually saying. We saw this last month when local elected officials (with just a couple of exceptions) fell over themselves to endorse Hillary Clinton for the Democratic presidential nomination, while the voters themselves backed Vermont Senator Bernie Sanders by a landslide. And we’re seeing it now with the way the Legislature is handling Alexander & Baldwin (A&B), one of the Hawaii Democratic Party’s greatest campaign benefactors.

On Apr. 20, to the surprise of many, A&B officials announced that they would “fully and permanently restore” a few taro streams in East Maui. “The streams to be permanently restored are the priority streams identified jointly in 2001 by the State Commission on Water Resource Management and the Native Hawaiian Legal Corporation on behalf of its East Maui clients,” stated an A&B news release. In the same release, company president and CEO Christopher Benjamin said the company would act fast to restore the streams.

“Restoration of these priority streams will be implemented as soon as possible,” he said in the Apr. 20 news release. “In some cases, we are able to remove diversions immediately, while others will require reconstruction. Our hope is to work with the East Maui community as we implement this stream restoration plan, as well as on other water matters, as we move forward with the transition at HC&S [Hawaiian Commercial & Sugar] to diversified agriculture.”

If it seems odd to you that A&B would suddenly announce that they’ll restore streams that had been tagged for restoration 15 years earlier, then you won’t be surprised to hear that just one day after the company’s historic announcement–on Apr. 21–state legislators reinserted A&B into House Bill

2501, a water rights measure that would give the company “a three-year extension to lease water from the state,” according to an Apr. 21 Honolulu Civil Beat story.

Sierra Club Hawaii director Marti Townsend immediately cried foul, telling Civil Beat, “We knew that A&B’s commitment to open stream diversification was timed to influence legislators’ vote on the [sic] this bill, and today’s discussion about the SD1 [the version of the bill that includes A&B] just proves it.”

HB 2501 is a monster of a bill. Though very short, it would authorize “holdover permits” on water rights–an action that Native Hawaiian advocates say is outrageous. In fact, the Office of Hawaiian Affairs (OHA) gave three pages of very eloquent testimony on Feb. 26 before the House Committee on Water and Land that just eviscerated the bill.

“This measure would allow the state to continue abdicating its kuleana to East Maui kalo farmers–many of whom have deep ancestral ties to their lands, and who have long sought the modest return of water to just 27 of 100-plus East Maui streams–as well as the cultural practitioners, gatherers, fishers, and others who depend on the public trust in East Maui’s water resources,” stated OHA’s written testimony. “In doing so, this bill may also inadvertently tie the state’s hands in managing and upholding the public trust in our water resources generally, and potentially

undermine the foundation of water management and policy in Hawai‘i.”

According to OHA, in 2003, a circuit court ruled that A&B had to do an environmental assessment before it could get a long-term water lease. “Despite the court ruling, A&B continued to divert water under so-called ‘holdover’ permits, while East Maui kalo farmers and others waited for some stream flow to be restored,” states the OHA testimony. “12 years later, the state and A&B have failed to start, much less issue, an environmental assessment; meanwhile, some kalo farmers have passed away, waiting for water that has still not been returned. Not surprisingly, the state’s practice of issuing ‘holdover’ permits for the last 12 years has recently been found improper by a circuit court. This measure would effectively overrule this most recent circuit court decision regarding East Maui ‘holdover’ permits.”

In case you were wondering, three of the five introducers of the bill represent Maui: House Speaker Joe Souki, D–Wailuku; Rep. Justin Woodson, D–Kahului; and Rep. Kyle Yamashita, D–Upcountry. All three of accepted at least $250 in campaign contributions from A&B’s political action committee (PAC) since March 2015, according to the state Campaign Spending Commission (though any contributions they’ve received in 2016 won’t be known until later this summer). On Apr. 22, Civil Beat reported that A&B’s PAC has, since Nov. 8, 2006, donated an astonishing $600,000 to state candidates and officials.

On Apr. 22, the bill passed out of Conference Committee with A&B’s inclusion intact. The full House and Senate still have to vote on it–and Gov. David Ige needs to sign it–before it becomes law.

MAUI SENATOR WANTS TO REAFFIRM PUBLIC’S RIGHT TO PHOTOGRAPH COPS And now to talk about a completely different bill. Senate Bill 2439, introduced by Sen. Gil Keith-Agaran, D–Kahului, reaffirms the public’s right to record or photograph “a law enforcement officer while the officer is in the performance of the officer’s duties in a public place or under circumstances in which the officer has no reasonable expectation of privacy.”

necessary because back in 2012 the U.S. Supreme Court affirmed the right of the public to film police officers in public places. But then in February of this year, federal District Court Judge Mark Kearney ruled there was, in fact, no First Amendment right to film police officers (a ruling Washington Post columnist Radley Balko called “bizarre” in a Feb. 23 story).

Sigh. According to Hawaii News Now, Keith-Agaran stepped into this maelstrom of legal uncertainty by introducing SB 2439 because of MauiTime Publisher Tommy Russo’s arrest back in November 2012 for photographing Maui Police Officers on Haleakala Highway (a judge later threw out the case, though prosecutors have appealed the ruling).

“State Sen. Gil Keith-Agaran introduced the bill that reaffirms the public’s right to take video or pictures of police in public spaces,” Hawaii News Now reported on Apr. 21. “To underscore the need for the measure, he pointed to a 2012 incident, in which a Maui newspaper publisher was arrested for filming a traffic stop. ‘We wanted to make it clear that yeah, that’s something that you can do, so long as your [sic] not interfering with the actual operations of the police,’ said Kahele [sic], whose district includes Wailuku and Kahului.”

Given such uncertainty over what we feel is a genuine right of the public to hold law enforcement in check, bills like SB 2439 can help out. Of course, in terms of real law enforcement reform, the bill doesn’t come close to SB 3016–the bill we were really hoping would pass this session. That bill would have repealed “the confidentiality protection afforded under the Uniform Information Practices Act for certain information regarding misconduct of police officers that results in suspension.”

But it’s been bottled up in the Senate Judiciary and Labor Committee–chaired by Keith-Agaran–since early February. Of course, given that similar bills have met that same fate in recent years, we weren’t holding out much hope this year, but it’s still a necessary and vital reform that needs to become law.

MAUI ROLLER GIRLS ACCEPTED INTO WFTDA APPRENTICE PROGRAM

A new certificate in music studies will be offered at the University of Hawaii Maui College beginning this fall.

UHMC recently announced their new Academic Subject Certificate (A.S.C.) in Music Studies. It’s the second certificate in music offered by UHMC, following the highly successful A.S.C. in Hawaiian Music that’s offered through the Institute of Hawaiian Music. Not only will students be able to take more music classes, they can receive an additional academic credential for their efforts.

“Our music faculty serves over 300 students and offers over twenty different courses each semester,” said Music Studies Faculty Coordinator Dr. Keola Donaghy in an Apr. 20 news release.

“Our courses include the study of music literature and theory, world, rock and Hawaiian music. We also offer instruction in piano, guitar, ‘ukulele, steel guitar, voice, and music technology....

Music courses are not only electives– many fulfill important requirements for students pursuing a variety of certificates and degrees.”

In order to receive the certificate, students must earn 23 credits by successfully completing at least eight classes in music and musical performance. There are also four required courses: Introduction To Music Literature, Music in World Cultures, Basic Theory and Aural Skills and Contemporary Performance and Recording. Students must also complete six credits in musical performance, learning two different instruments or one instrument and voice. Finally, students may select from a variety of music classes to complete the six elective credits. No audition is required to enter the program.

The Maui Roller Girls have been accepted into the Women’s Flat Track Derby Association’s Apprentice Program.

The Roller Girls were one of just 11 teams worldwide that were accepted in this round, which could lead to the team becoming a full member league.

The WFTDA is the international governing body for the sport of women’s flat track roller derby. It is also a membership organization where leagues can collaborate and network. The WFTDA sets standards for rules, seasons, and safety, and determines guidelines for the national and international athletic competitions of member leagues. There are currently 369 WFTDA member leagues and 65 leagues in the WFTDA Apprentice program.

By being accepted into the WFTDA Apprentice Program, Maui Roller Girls now have a stepping stone to full WFTDA membership; the Apprentice Program is designed to ensure that leagues are well prepared for the transition to a WFTDA Member League.

The 11 teams accepted into the Apprentice Program come from around the world, including Dom City Dolls and Parliament of Pain from the Netherlands, and Prague City Roller Derby from Prague, Czech Republic. US teams include Twin City Knockers from Shreveport, LA; Rocket City Roller Derby from Pasadena, TX; and Los Alamos Derby Dames from New Mexico.

Maui Roller Girls extended thanks to those who have supported the team since its inception, including their present and former members. The team spokesperson also thanked the lady who started Roller Derby in Hawaii, Killah Kelly. MAUI HUMANE SOCIETY STARTS 24-HOUR HOTLINE The Maui Humane Society is launching a 24-Hour Animal Response Hotline for Maui residents to call when they see domestic animals, livestock or equine in need of help. MHS decided to initiate this new service in response to the number of calls it receives for animal emergencies from the community.

“Last year, we responded to an average of 294 calls from the public each month, 41 of which were calls from residents reporting animals that required emergency care, or were aggressive, incapacitated or needed to be seized during our open hours,” said Jerleen Bryant, Chief Executive Officer of Maui Humane Society. “We continuously receive messages from residents about animal emergencies after hours so implementing the 24-Hour Animal Response service is critical. It will allow us to respond and assist the public and animals in a timely manner around the clock.”

Residents who witness aggressive, trapped, injured or loose animals are encouraged to call the 24-Hour Animal Response Hotline.

MHS is also encouraging residents to report suspicion of neglected or abused animals; signs of a neglected and or abused animal are no food, shelter or water, coat is missing hair or severely matted, ribs or other bones showing through the fur, living in feces, open sores or have broken bones.

All Humane Enforcement Officers at MHS go through an extensive and ongoing training program so they can effectively determine when humane laws are being violated. They are also trained to handle injured animals, administer drugs to alleviate pain from injury and seize animals when necessary to secure the safety of both residents and animals.

The Maui Humane Society puts every effort toward finding owners of the lost and injured animals that are picked up.

If no owner is found, once they have healed from their injuries, they are placed up for adoption or transferred to another shelter or rescue (many of which are on the mainland) that can help them find new homes.

MHS notes that the 24-Hour Animal Response Hotline is not for reporting stray chickens, wild or game animals, pigs, deer or birds unless residents feel their safety is at risk.

News Of The Weird GOVERNMENT IN ACTION The Pentagon admitted recently that it has no way to know how many parts or devices are in its equipment inventory–except by going through its estimated 30 million contracts (on the text-unsearchable electronic database) one by one. For a recent Freedom of Information request from a software developer (for the Pentagon’s number of “HotPlug” power-extenders for computers), it quoted a retrieval price of $660 million to cover 15 million hours of work.

Ms. Charli Jones Parker, a teacher and girls’ basketball coach at the Pickens Academy (Pickens County, Alabama) was arrested on March 28 and charged with having sex with an underage male student. Her husband, James Parker, a math teacher and coach at Pickens, was arrested two days later and charged with having sex with an underage female former student. The district attorney said the incidents were unrelated and resulted from separate investigations.

INEQUALITY ON PARADE The city council in Palo Alto, California, trying to retain some of its Silicon Valley non-millionaires, proposed a subsidy plan in March to help with steep housing costs. In a town where tiny homes sell for $2 million (and are immediately knocked down and rebuilt), subsidies will be available even to families earning $250,000 a year. LEAST COMPETENT CRIMINALS Bad enough that Alfonso Mobley Jr., 26, is a “sovereign citizen,” self-proclaimed as exempt from obeying laws or paying taxes, but on April 5 he also lost both hands– when a bomb he was working on exploded in Columbus, Ohio. The bomb was made of the same material as that in the November terrorist attacks in Paris. A 2010 FBI report labeled sovereign citizens a domestic terrorist group, but Mobley’s associate (who was not hurt) told police the bomb was to be simply a diversion for their planned bank or armored-car robbery. ■

was in the store one recent afternoon. You were in the women’s section (closer to the bathing suits). With you was a little boy, who was sitting in the shopping cart seat, swinging his little legs, and a little girl who was in the aisle by the rack that you were looking through. For whatever reason you called him “Stupid” and his little legs stopped swinging. That’s inexcusable! When you were out of ear shot, he mumbled to himself, “I’m not stupid.” As I walked past him, I told him, “You’re right, you’re not stupid.” He smiled and his little legs started swinging again, this time faster then before. I really hope that these poor kids hang onto their self-worth and self-esteem, because you’re certainly not giving it to them. ■

Talking Animals Rule There’s a lot to like in Disney’s new version of ‘The Jungle Book’ ★★★★★ Rated PG / 106 Min.

O

ne of the last end credits to scroll for The Jungle Book is “Filmed in Downtown Los Angeles.” This funny, startling declaration is a full reveal of why this Jon Favreau-directed remake is so remarkable. This liveaction re-telling of the Rudyard Kipling story takes place in an entirely CGI environment and, aside from the main character (and a few briefly glimpsed adults), all of its cast members are CGI talking animals.

The story is mostly the way we remember it, as Mowgli (played by newcomer Neel Sethi) is raised by wolves and mentored by a panther named Bagheera (voiced by Ben Kingsley). A sadistic lion named Shere Khan (voiced by Idris Elba) objects to a “man-cub” being raised in the wilderness. Shere Khan wants Mowgli dead and threatens to declare war on all the animals who protect him. Wanting to keep the peace, Mowgli leaves his tribe, immerses himself in the

jungle and befriends a jovial bear named Baloo (voiced by Bill Murray).

Sethi’s performance as Mowgli is, unfortunately, a key problem. If you’re going to only have one human in the main cast, sporting a bad hairdo and wearing a red diaper for the entire movie, he’d better be a good actor. Sethi is too inexperienced to carry the film and comes across as all too aware he’s in a Disney movie. He’s a cute kid but far too modern and clearly domesticated, unable to pull off playing a child raised outdoors without human interaction. It’s a good thing his CGI co-stars are far better.

Elba is sensational as Shere Khan, somehow evoking a similar menace to his recent, scary turn in Beasts of No Nation. The late, great Garry Shandling plays an ultra-possessive porcupine and, in his final film, gives a hilarious swan song. Lupita Nyong’o has some fine moments as Mowgli’s mother, Scarlett Johansson is a perfect choice for Kaa the snake, while Murray and Kingsley, no strangers to vocal acting, are solid choices. Only the stunt casting of Christopher Walken as King Louie doesn’t pay

off. Walken’s clumsy line readings are too self-consciously weird and his take on “I Wanna Be Like You” doesn’t work.

In general, the music numbers are brief and seem out of place, though Johansson’s ‘60s-tinged, end credits rendition of “Trust In Me” is hypnotic.

Unlike the cast of Babe, the talking animals here take a while to get used to. Initially, it’s creepy hearing childish giggling come from the mouths of wolf cubs. For all the grand visuals on display, even with Favreau at the helm, this is an impersonal product. Unlike the far riskier Maleficent and the recent, more elegant Cinderella, this latest example of Disney’s live-action rendering of animated classics is entertaining but isn’t fully engaging emotionally. The 1967 animated original and even the under-appreciated, Jason Scott Lee-

starring 1994 live action version were far more watchable.

While the new Jungle Book is too scary for the little ones (especially in 3D), older children should love it. The animal battles are exciting, the special effects and photo-realistic animals are spellbinding and, as a feat of visual storytelling, there’s much to offer the eye.

Not so much the mind or the heart, especially since this is supposed to be a parable about when boys become men.

Still, unlike Batman v Superman-Dawn of Justice, this is a real event, a spectacle worth seeing on the big screen. When Mowgli takes on Shere Khan during the fiery climax, Favreau taps into the primal excitement of Kipling’s original story. Not bad for a movie shot in downtown Los Angeles. ■
