ANOTHER MAUI COP’S BEEN ARRESTED Sorry we’re a little late to write about this latest Maui Police Department press release on the latest officer they’ve arrested for something, but yesterday was press day. Anyway, here’s what the department posted on Feb. 17 (you can now get MPD press releases delivered to you direct–details are located at the County of Maui’s website):

It only took Hawaii officials slightly more than 26 years to follow through on a state Auditor’s recommendation to modernize its payroll system, the Department of Accounting and General Services (DAGS) announced on Feb. 16.

“Our state payroll personnel do an amazing job each pay cycle, especially considering that the current system is extremely manual and paper-based,” state Comptroller Douglas G. Murdock said in the DAGS press release. “We appreciate their work and look forward to building on that foundation to add 21st Century payroll capabilities and efficiencies.”

According to the press release, the state’s payroll system currently serves “more than 75,000 full- and part-time employees statewide.” The release also notes that the current system “is more than 40 years old, runs on the mainframe, and relies heavily on paper-based processes.”

To say the system is old is laughable.

State auditors recognized that it was obsolete back in 1989. That’s when they issued their report Study of the Payroll System of the State of Hawaii. Back then, when the system was only about 20 years old, the auditors–specifically, Price Waterhouse–repeatedly used terms like “extremely labor intensive” to describe why it needed to go.

“While the system continues to prepare payroll for some 50,000 employees, it is burdened with major problems,” auditors noted. “The payroll system is extremely labor intensive because of the many manual activities that could be automated. The computerized applications

of the payroll system are outdated when compared to the more modern efficient and flexible technology used in modern payroll systems.”

Ha! “Modern payroll systems.” Keep in mind that when those words were written, John Waihee was Hawaii’s governor and Hannibal Tavares was Mayor of Maui County. The Internet was still largely confined to science fiction and phones were still largely attached to walls.

In the 1989 report, auditors noted that state employees used State Accounting Form D-55 for a timesheet.

Logging the information on the sheet was rather burdensome, auditors noted at the time.

“The present payroll system has no complete time and attendance system for all employees,” the report noted.

“Hourly employees report all hours worked. Salaried employees report hours worked over and above their normal workload, such as overtime. After all D-55 Forms are manually prepared and processed, they are forwarded to ICS [Information and Communications Services division of the Department of Budget and Finance] where time and attendance data are

entered into the computer system and kept for historical purposes.”

This form is still in use to this day.

Indeed, as the tiny type in the lower right corner notes, it hasn’t been revised since July 1, 1977.

The funniest part of all this is that back in 1989, the state Department of Accounting and Government Services completely agreed with the Price Waterhouse auditor’s report.

“While the State has never missed a payroll on payday, we heartily agree that a new payroll system is needed to replace the existing one, to meet the ever changing and increasing demands continually being placed on the system,” then-state Comptroller (and future Honolulu District Court judge) Russel S. Nagata wrote in his official response to then-Legislative Auditor Newton Sue on Dec. 5, 1989.

Not quite believing that even the State of Hawaii would shelve an Auditor’s report for entire generation before dusting it off, I forwarded the 1989 report to Cathy Chin, the Department of Accounting and General Services’ spokesperson, and asked how the payroll system has changed since that damning report came out.

“There have been incremental adjustments, but no whole system modernization,” she emailed back on Feb. 17.

Anyway, perhaps all this will soon just be an obscure footnote of Hawaii history–a small example of how government out here can sometimes move at the speed of glaciers. Comptroller Murdock certainly seems to think so.

“Following through on Gov. David Ige’s call for a more results-driven strategy for ERP [enterprise resource planning], payroll and time and attendance have been identified as targeted projects we can accomplish now,” said Murdock in the Feb. 16 press release.

It’s pretty wonkish, but some pretty farreaching local government reforms will be up for discussion at a public meeting this Thursday, Feb. 25. Yes, it’s time for yet another gathering of the county’s Special Committee on County Governance.

Put simply, it’s a panel of 11 citizens (only nine of which can actually vote on anything) that meet periodically to discuss and possibly craft legislation to bring Maui County into the 20th century in regards to local government.

This would happen through the creation of what’s known as a “county manager form of government”–seating most true executive power in the county in a manager–a professional administrator with considerable experience and most likely a master’s degree in public administration–with the elected mayor either taking on a largely ceremonial role or going away entirely.

It’s not surprising that Mayor Alan Arakawa loathes the idea, as does Keith Regan, his current Managing Director (who lacks the key power to hire and fire department heads). But the Maui County Council wants the idea studied, and has called for the special committee to report back in a fairly expeditious rate, with the hope that if they actually like the idea, they can put something on the ballot in time for the next mayoral election, scheduled for 2018.

Anyway, the meeting takes place at 1pm in the Council Chamber of the Kalana O Maui Building (200 S. High St., Wailuku) this Thursday, Feb. 25.

University of Hawaii Maui’s Sustainable Science Management program continues to benefit from the support of Maui-based Pacific Biodiesel Technologies (PBT) with the selection of new intern Kate Cheney, a junior at the college. The partnership between UH Maui and Pacific Biodiesel furthers sustainability efforts and gives college students experience with a global leader in renewable energy.

The new SSM program at UH Maui recently received a $30,000 endowment from Maui Electric Company and is anticipating consistent growth in program enrollment. “Pacific Biodiesel has been one of the strongest and most consistent supporters of the Sustainable Science Management program since our inception,” said SSM Program Director Tim Botkin. “In particular, internship opportunities with PBT have given our students the chance to work with industry-leading experts striving to incorporate sustainability throughout their business and community practices. This extremely valuable experience inspires thoughtful leadership as our students enter the community workforce.”

INTELLIGENT DESIGN Wired.com’s most recent “Absurd Creature” feature shows a toad devouring a larva of a much-smaller beetle, but the “absurdity” is that the larva is in charge and that the toad will soon be beetle food.

The larva’s Darwinian advantage is that, inside the toad, it bites the hapless “predator” with its hooked jaws and then secretes enzymes to begin decomposing the toad’s tissue (making it edible)–and provoking it to vomit the still-alive larva.

GREAT ART! Fed up with the “pretense” of the art world, performer (and radio personality) Lisa Levy of Brooklyn, New York, sat on a toilet, naked and motionless, at the Christopher Stout Gallery in January to protest artists’ “BS” by presenting herself in the “humblest” way she could imagine. Visitors were invited to sit on a facing toilet (clothed or not) and interact with her in any way except for touching. Levy told the Bushwick Daily website that too much “ego,” “like a drug,” “distorts your reality.”

WAIT WHAT? In January, the U.S. Department of Justice’s inspector general recommended closing down a program of the department’s Drug Enforcement Administration that paid employees of other federal agencies (Amtrak and the beloved Transportation Security Administration) for tips on suspicious passengers. (The program apparently ignored that federal employees have such a duty even without a bounty.)

DEA was apparently interested in passengers traveling with large amounts of cash–which DEA could potentially seize if it suspected the money came from illegal activity (and also, of course, then keep the money under federal forfeiture law). According to the inspector general, the tipping TSA agent was to be rewarded with a cut of any forfeited money.

Chiropractor William DeAngelo of Stratford, Connecticut, was charged with assault in January after an employee complained that she was ordered to lie down on a table and let DeAngelo apply electrical shocks

to her back–as punishment for being the office gossiper, spreading rumors about colleagues. DeAngelo said he was reacting to complaints from patients and staff, but seemed to suggest in a statement to police that he was only “re-educating” the woman on how to use the electrical stimulator in the office’s practice (though she felt the need to report to a hospital afterward).

THE CONTINUING CRISIS Britain’s North Yorkshire Police successfully applied to a judge in January for a “sexual risk order” against a man whose name was not disclosed publicly and whose alleged behavior was not revealed. Whoever he is and whatever he did, he is forbidden to enter into any sexual situation with anyone without providing at least 24 hours’ notice to the police–nor is he allowed to look at or possess any sexually oriented materials. According to the York Press, the order is temporary until May 19, at which time the magistrates may extend it.

BRIGHT IDEAS Christopher Lemek Jr. was arrested in Palmer, Massachusetts, in January and charged in a New Year’s Eve hit-and-run accident that took a pedestrian’s life. Lemek emerged as a suspect a few days after the collision when police, visiting his home, noticed freshly disturbed earth in his backyard. Eventually Lemek confessed to literally burying the evidence–using a construction vehicle to crush his truck and an excavator to dig up his backyard and drop the truck into it.

NO NEED FOR A PRE-UP The 20-year New York marriage of Gabriel Villa, now 90, and Cristina Carta Villa, now 59, apparently had its happy moments, but as Cristina found out when things went bad recently, Gabriel had attempted to protect himself shortly after the wedding–by obtaining a Dominican Republic divorce and keeping it secret. Cristina found out only when she realized in a property accounting that her name was not on the deed to their Manhattan apartment. (She is challenging that divorce as improper even under Dominican law.)

SUSPICIONS CONFIRMED Several Connecticut state troopers involved in a DUI checkpoint in September were apparently caught on video deliberating whether to make up charges against a (perhaps obnoxious) checkpoint monitor. HAWAII BILLS YOU NEED TO KNOW ABOUT DEALING WITH

CRIMINAL JUSTICE, LAW ENFORCEMENT T AND CIVIL LIBERTIES

T

he state Legislature’s been legislating for about a month now. There are a lot of bills still alive over there, including some that might actually do some good.

Because no one has the time to go through them all and figure out what’s good, we’ve compiled a list of 10 bills that deal with criminal justice and law enforcement that we thought were important.

Some of these bills provide necessary corrections to current laws, while others would create far more problems than we already have. While this is by no means a comprehensive list, it does include a variety of bills that, for whatever reason, just aren’t getting the kind of publicity we think is needed.

HB 1907 RELATING TO SEXUAL ASSAULT Because law enforcement agencies nationwide have a scandalous backlog of rape

kits, this bill establishes a sexual assault kit tracking program. It requires law enforcement agencies across Hawaii to send any sexual assault kits they obtain as part of a criminal investigation to an authorized laboratory, then upload the lab results in a “timely manner.” Law enforcement agencies must also submit annual reports to the Attorney General’s office and the Legislature on the number of sexual assault kits they have and their progress on any backlog. The public will have access to these reports.

Who supports it: The Attorney General’s office, Hawaii State Commission on the Status of Women, Planned Parenthood of Hawaii, the American Association of University Women, Hawaii Women’s Coalition and the Joyful Heart Foundation.

Who supports it: The state Department of Transportation. The City and County of Honolulu “supports the intent” of the bill, though noted in testimony that “Sitlie laws in jurisdictions that prohibit sitting and lying on public property, broadly defined, have been held unconstitutional.”

Two citizens also offered testimony in support of the bill.

Who opposes it: The Honolulu Police Department “has concerns” with the bill– mostly that it contains no provisions to increasing department hiring or funding to

HB 1525 RELATING TO PUBLIC ORDER Ugh: this bill “establishes an offense for remaining unlawfully in or upon state property after a request to leave is made by any law enforcement officer under certain conditions.”

Who opposes it: The state Department

of Land and Natural Resources says that the bill is so broad that if it passes, “sunbathing on a beach or in a park could be considered a petty misdemeanor as well as picnicking on a blanket.” The Office of Hawaiian Affairs condemned the bill, saying it “effectively criminalize the meaningful use of all public lands, and place a substantial burden on the exercise of constitutionallyrecognized Native Hawaiian traditional and customary practices throughout the state.”

Five citizens also testified against the bill.

Where it stands now: Referred to the House Judiciary (JUD) Committee on Feb. 18.

HB 2099 RELATING TO LAW ENFORCEMENT This bill sounds rather academic, but actually has a very important purpose. It defines “the term ‘person in custody’ as used in the offense of sexual assault in the second degree and third degree to mean

a person who is stopped by or under the control of a law enforcement officer for official purposes.”

Who supports it: The Sex Abuse Treatment Center in Honolulu supports it, and offered this pretty compelling reason: “[T] he current law does not cover situations where a law enforcement officer inarguably has power and control over another person, but has not effected an arrest, and therefore the other person is not technically in their ‘custody’ as that term is currently defined and interpreted in Hawaii. This was demonstrated by a recent, well-publicized local case where a Honolulu Police Department patrol officer stopped a 17 year old driver for speeding and fondled her breasts, but could not be convicted for committing the crime of sexual assault in the third degree because, although the driver was not free to leave and was within the officer’s control at the time of the sexual contact, she had not been placed under arrest.”

Who opposes it: There is no current testimony from anyone in opposition to this bill.

Where it stands now: Referred to the House JUD Committee on Feb. 17.

SB 2239 PROPOSING AN AMENDMENT TO ARTICLE VI OF THE CONSTITUTION OF THE STATE OF HAWAII RELATING TO THE SELECTION AND RETENTION OF JUSTICES AND JUDGES This is a very big deal. This is a constitutional amendment that would “require justices and judges be elected to serve six-year terms” (though they would still “be subject to the consent of the senate for subsequent judicial terms.” It would also repeal the Judicial Selection Commission.

Ratification would take place at the general election of 2018.

Who supports it: Ho‘omano Pono, LLC and one individual offered written testimony in support of the bill.

Who opposes it: The state’s Judiciary, the Judicial Selection Commission, the state Office of the Public Defender, Hawaii State Bar Association, West Hawaii Bar Association, Kauai Bar Association, Hawaii County Bar Association, Americans for Democratic Action, Hawaii Women Lawyers, American College of Trial Lawyers, Justice At Stake, American Judicature Society, League of Women Voters, ACLU, Hawaii Government Employees Association, William Richardson Law School Dean Aviam Soifer and a host of other individuals, attorneys, retired judges and law firms.

Where it stands now: The Senate Judiciary and Labor (JDL) Committee deferred the measure until Mar. 2.

HB 2629 HD1 RELATING TO CRIMINAL HISTORY RECORD CHECKS This bill authorizes “county police departments to enroll firearms applicants and individuals who are registering their firearms into a criminal record monitoring service used to alert police when an owner of a firearm is arrested for a criminal offense anywhere in the country.” If it passes, the bill “will allow county police departments in Hawaii to evalu-

ate if the owner of a firearm may continue to legally possess and own firearms.”

Who supports it: The Honolulu PD strongly supports the measure. “Currently, a thorough background check is conducted on all applicants to acquire a firearm,” Major Richard C. Robinson of the HPD’s Records and Identification Division said in his Feb. 11 testimony on the bill. “However, once the initial background check has been completed and the permit has been issued, no further checks are conducted on the firearm owner. As a result, the county police departments have no way of knowing if a current Hawaii firearm owner has been convicted of a crime in another state that would prohibit him or her from owning a firearm.”

Who opposes it: The National Rifle Association, of course. “The NRA opposes this measure because it expands upon the existing registration requirements to implement a federal biometric registry of Hawaii gun owners,” Daniel Reid of the NRA emailed the House PBS Committee on Feb. 10. “Positive hits in this system have not necessarily been adjudicated and could cause issues with the an [sic] individual’s ability to exercise their constitutional rights.” Four other individuals also submitted testimony against the bill.

Where it stands now: Referred to the House JUD Committee on Feb. 17.

SB 2149 RELATING TO FORFEITURE Civil asset forfeiture–when police can seize a person’s assets and property before that person is even convicted of a crime–is horrible public policy. It’s legalized theft; an abomination that turns police departments into mercenary outfits. It should be gotten rid of, but this bill does far less: it calls on the Attorney General to “establish a working group” that would review the state’s asset forfeiture laws and make recommendations to improve them.

Who supports it: The Attorney General’s office, the Maui County Prosecutor’s office, the Hawaii County Prosecuting Attorney and the Honolulu PD all love it–probably because it only calls for a toothless commission that everyone will forget about 15 minutes after it convenes.

Who opposes it: The Drug Policy Forum of Hawaii despises this bill. “This working group is unnecessary for one simple reason: the civil asset forfeiture tool is in and of itself wrong,” stated the organization’s Feb. 11 testimony. “We do not need a working group to determine what we already know is unjust: seizing a person’s assets and property without any related conviction, turning the burden of proof onto that property owner to prove that the property is innocent, and lastly, funneling these assets into the coffers of the arresting agency, the prosecutors and the Attorney General.”

Where it stands now: The Senate JDL and Ways and Means (WAM) Committees held a public decision making on Feb. 24 (at press time).

SB 2412 RELATING TO POLICE This bill “requires police commissions to ensure that all full-time police officers

receive crisis intervention training related to interaction with persons with mental disabilities,” according to the state Legislature’s website. It “requires police commissions to establish policies for officer interaction with persons with mental disabilities and homeless persons.”

Who supports it: The state Department of Health likes it. Louis Erteschik of the Hawaii Disability Rights Center didn’t testify for or against the measure, but did note that “We have been aware of several instances where police may have overreacted to encounters with individuals who suffer from mental illness and that in some cases a deadly result ensued.” He also testified that “We believe very much that establishing a training program with clear protocols on how to de-escalate situations would be very useful and we would very much support that.” Four other individuals and researchers testified in favor of the bill.

Who opposes it: There is no stated opposition to the bill.

Where it stands now: Referred to the Senate WAM Committee on Feb. 17.

SB 2954 RELATING TO FIREARMS Right now, each county in Hawaii has its own firearms registration information, according to a PSM Committee report on the bill. If it passes, this measure would create an “active mechanism” to share this firearm registration info across the state.

This system would “enable law enforcement agencies to access critical information more quickly when they are checking on individuals involved in an incident to which they are responding,” according to the committee report. It seems clear-cut, but law enforcement organizations are split on whether it’s a good thing.

Who supports it: The state Attorney General, the Hawaii Rifle Association and three individuals all testified in favor of it.

“The development and implementation of this capability will enable law enforcement agencies to query firearm information more timely when checking on individuals involved in any incident to which they are responding, traffic stops they are making, or warrants they are serving,” the AG testified on Feb. 11. “It will not only enhance officer safety, but public safety, in general.”

Who opposes it: The Maui County Prosecutor’s office.“The proposed bill dilutes the privacy protection that the current statute affords by permitting disclosure for mere “database management” by the Hawaii criminal justice data center,” Deputy Prosecuting Attorney Peter Hanano testified on Feb. 11. “Further, the bill does not specify what the term ‘database management’ encompasses.” A further seven individuals also testified against it.

Where it stands now: Referred to Senate JDL Committee on Feb. 18.

SB 2411 RELATING TO LAW ENFORCEMENT CAMERAS After experimenting with body cameras during a small-scale test last year, the Maui Police Department is now apparently going forward equipping their

officers with body cameras and recently put out a request for proposals to camera vendors, according to the Feb. 18 Maui News. This bill sets out requirements for county police departments concerning body-worn cameras and vehicle cameras.

It also appropriates funds to each county for the purchase of these body and vehicle cameras–if the counties are willing to match them dollar-for-dollar.

Who supports it: The ACLU likes the bill, but wants special privacy protections made explicit. A UH Manoa doctoral researcher testified that the bill is a good way to increase the accountability of law enforcement officers. The Office of Information Practices (OIP) supports the intent of the bill, but notes that it anticipates a “high volume” of requests from the public to see police body camera footage, and says it will need additional staffing and funding to handle those requests, which will likely be on a case-by-case basis.

Who opposes it: Why, the State of Hawaii Organization of Police Officers (SHOPO), of course. The powerful police union insists that it–and the county’s four police chiefs–can draft suitable regulations without legislative interference. “The four county police chiefs understand the demands of police work and the standards required,” SHOPO President Tenari Maafala testified on Feb. 5. “Therefore they are best qualified to draft their body camera policies in conjunction with SHOPO.” The Kauai Police Department, which is already deploying body cameras (over the objections of SHOPO), also opposes the bill because its stipulation that officers can’t turn on their cameras for “non-law enforcement purposes” is vague and questionable.

Where it stands now: The Senate JDL and WAM Committees held a public decision making on Feb. 24 (at press time).

SB 3016 RELATING TO THE UNIFORM INFORMATION PRACTICES ACT This is yet another bill that seeks to end the “confidentiality protection afforded under the Uniform Information Practices Act for certain information regarding misconduct of police officers that results in suspension.” This special exemption has been in effect since the mid-1990s, and exists for no other class of public employee. This bill would bring about muchneeded accountability to law enforcement that’s long overdue.

Who supports it: The state Department of Human Resources, OIP, Hawaii State Coalition Against Domestic Violence and the Civil Beat Law Center for the Public Interest. Eleven individuals also submitted written testimony in favor of the bill.

Who opposes it: SHOPO, which makes sense given that they got the Legislature to pass the exemption in the first place.

“There’s a trend now in the food industry with guests and they want to be more involved,” says Barberi. “It started with flights a long time ago, and now you see it more with guests becoming involved in the dining experience. The stuffiness leaves the room when that happens.”

The bar, of course, also keeps it real with a standard Mai Tai and all the basics, and happy hour runs 3-7pm and again from 10pm-2am daily. It features $3 drafts, $4 well cocktails, $5 select tropicals and $8 boilermakers.

ou know that feeling you get when you look at a place and think, “this has a lot of potential.” That’s what Javi Barberi, Dave Fincher and Julian Bonfardin thought about the basement waterfall restaurant located at The Wharf on Front Street in Lahaina. The spot, formerly known as Blue Lagoon, Da Kitchen and Makani Kai, never really had a fitting personality. Until, perhaps, now. Now known as Down the Hatch, the three partners have developed a casual eatery with a bar and a shave ice stand that seems to be humming along. I even like the cute pun in their name, riffing off the “down” stairs location.

The team picked up the place as Makani Kai and operated under that name for a short time while they worked on the rebranding as Down the Hatch. They

say that allowed them to see some of the things that weren’t working for the space and fine-tuning that which did work. But some ideas just snuck up on them, like the decision to counter-order food, rather than rely on table service.

“We launched counter-service on Fourth of July,” says Barberi. “We had two servers call in and say they weren’t coming in. We had to think quickly how we were going to make it through the day short staffed and the counter idea came up. We knew we wanted to do some kind of counter service in the future, but it kind of forced our hand that day.”

I was glad that they changed to counter-service for this location. It really does streamline the experience for you, and makes service faster. Fincher says they’re willing to take chances and sometimes the big risks also involve big payoffs.

“We have Michael Seacrest in the kitchen, and since we are all from the South, there’s a lot of southern influence in the menu,” says Fincher. “Seacrest was experimenting with his mom’s gravy

recipe. We didn’t have sausage when we were trying this out, so we used bacon instead. So that’s what we do, bacon gravy. It’s one of the twists on our chicken and waffles. We’re always evolving and streamlining our ideas. If it’s just crazy enough, it might work.”

The chicken and waffles ($14.50) was one of those dishes that gets recommended to you here, and you should definitely take it seriously. I ordered it because its one of those signature dishes, but I already had a bad attitude about it–how could it be better than the fish tacos my girlfriend just ordered?

Surprisingly, it was the winning dish for the table and every drop of the bacon gravy was dabbed up by their phenomenal savory herbed waffle. It was one of those dishes where you offer a bite, but everyone takes two. Luckily, the portions look like they came from down south, too, leaving plenty to share.

We also tried the Lava Lava Shrimp appetizer ($12.50). It’s crispy fried shrimp in a divine, spicy aioli served in a metal martini shaped vessel. The same shrimp is in the Louisiana Po’boy sando ($14), but this time appears on a huge baguette with lettuce and tomato and tartar sauce, along with a generous helping of shoestring fries.

Then we dove into the grilled fish tacos. The menu lets you choose from mahi, Lava Lava shrimp, sweet potato, seared ahi or Baja chicken. Tacos also come with a side of chips and salsa.

Tacos run from $12.50 to $15.75, depending on your order. The Strawberry Summer Spinach salad ($13) was as delicious as it was pretty, with mac nuts, goat cheese and fresh slices of strawberry adorning it.

“My favorite is the dragons,” says Jaz. “I just like the dragons for some reason. They are my favorite color.

My dad had this book with these dragons, and he challenged me to draw one. I didn’t know where to start so my dad and I had a contest: who could draw the best dragon. He drew one with a nicer body, but I still won. We added the mini baby dragon later. I didn’t think I could do it, but after I did, I loved it.”

Kelber says she started at age three, and remembers doing a lot more “scribble scrabble” now that she’s older she does a lot more detail work, and knows how to use color. When she thinks of an artist that she aspires to be, she mentions her aunt.

“The dolphins I drew out of a photograph," says Jaz. “It was the second most challenging thing I have drawn.

Trying to look at a photograph and transfer that. Now I have more detail and more ideas. I know how to use color better.”

Mostly, Jaz uses paints and pen and ink. She has a series of abstract art photography that she’s been working on recently but her go-to medium is pen and ink. There’s a big poster that won first place in the Share the Aloha poster contest Maui Memorial Hospital, and the original hangs at the Hospital.

Kelber says the drawing process isn’t always smooth.

“The challenges with underwater scenes are they’re hard to draw them like you see them in your head,” says Kelber. “And it’s hard to change them.

I think I can’t draw this, but then I do.

Sometimes it makes me scream. Then my dad gets mad at me, my dogs run outside. That is how it goes.”

Her dad Jay Kelber figures into part of the creative process, they both keep sketch notebooks and draw often competing with each other. Jaz motions to her piece, called “Dragon Dreams,”

he art of Jaz Kelber is fanciful, cheerful and often incorporates her own hand-lettered inspirational sayings. Her one-man show hangs at the dining area in Whole Foods, and it’s so diverse you wouldn’t think it was from just one person, let alone an 11-year-old.

I sat down with Kelber at Whole Foods Maui to ask her more about her show and creative process.

“I enter a lot of contests,” says Kelber.

“Most of the contests I’ve entered are about water, how to save water. So then my inspiration comes from water and ocean themes. But I really like underwater features. There are some challenges in drawing underwater features. You can have fun with them, too.”

“My Aunty May is really good,” says Jaz. “I saw this picture of me that she made, and I was like, wow! She uses oil paints. Her style is very realistic. I love her work.”

For her own creative style, she turns a lot to the Internet to look at images and pictures for inspiration. But many elements just come out of her brain, like these little round fish that show up in a lot of her underwater scenes.

“Sometimes an idea just pops in my head, like those circle fish,” says Jaz. “I made those up. They popped into my head and then I did a fast sketch.”

Jaz says she does a lot of contests, but that’s not the reason she creates art.

“With art, I really put my feeling into it, and just let my hand go and draw it,” says Jaz. “I love that emotion of art.”

Deadpool A comic book movie for people who may not like comic book movies ★★★★★ Rated R / 108 Min.

D

eadpool, the latest comic book movie, is different enough from others in the genre and plays like a biting comedy on the expectations of superhero movies. Ryan Reynolds stars as Wade Wilson, a mercenary whose carefree lifestyle is turned upside down when he falls in love and, soon thereafter, learns he has late stage cancer. The good news is that he learns of a treatment that could cure him. The bad news is that the procedure grossly alters his appearance and turns him into Deadpool, an accelerated version of his already “messed up” persona.

It could be stated that Reynolds isn’t stretching here and is doing the same snarky, smartest-guy-in-the-room bit he’s been playing since Van Wilder. While Reynolds isn’t a talent on the level of Eddie Murphy, this is every bit as potent a comeback vehicle for its star as The Nutty Professor was for Murphy 20 years ago. Following a long list of severe flops like Green Lantern, The Change-Up, R.I.P.D. and last year’s Self/Less and Woman in Gold, it seemed that Reynolds’ super star ascension

had permanently stalled. Oddly enough, Deadpool addresses his flops and even teases his acting abilities. There’s so much at stake for the actor with this movie, and Reynolds is so good in this that his tour de force performance has an additional resonance It helps a great deal that it sports a villain so nasty that we love to hate him. Ed Skrein recently starred in the failed franchise spin-off The Transporter: Refueled but he’s top notch here; his Ajax is a threatening, vicious bully and I couldn’t wait for our “hero” to knock his block off. Not helping is the villain’s sidekick, played with no panache whatsoever by Gina Carano. The supporting characters from the XMen universe are also totally unappealing.

Morena Baccarin gives the role of Deadpool’s girlfriend some surprising emotion, but the part is, when you think about it, fairly degrading. It was bold and funny of the movie to address how the studio short-changes the budget with the lack of more recognizable characters but the joke is almost too on the nose. What can you say about an X-Men movie that even Patrick Stewart won’t appear in?

My feelings towards Deadpool are conflicted but mostly on the positive side.

Just three stars, Barry? This looks like the greatest movie ever!

Here’s a comic book movie spoof that successfully addresses the problem with this genre: too many of these movies are interchangeable and made in an indifferent manner. It’s also self-satisfied and visually ugly, with a narrative that’s unnecessarily presented out of sequence.

The action sequences are wow-inducing, shot and edited with energy but minus shaky-cam or incomprehensible staging.

Scenes of Deadpool living with his blind neighbor are so absurd that they get laughs for pushing the idea as far as it could go.

On the other hand, if any character here is a negative stereotype, it’s the Indian cab driver who gets more screen time than needed.

While the love story didn’t move me, the scenes of Deadpool’s painful transformation most certainly did; this section is so compelling and blends humor and horrific imagery to such striking effect that it elevates

the movie. It also made me genuinely care about the title character, whose untouchable demeanor and childish sense of humor are a means of protecting himself.

The juvenile one-liners are hit and miss, but the numerous in-jokes, meta and otherwise, never feel forced. The gags at the top and very end of the film, mocking the opening and post-credits sequences of comic book movies, are refreshing. Conversely, the scenes that pay lip service to the X-Men timeline and push the comic book angle forward are the least interesting. Unlike the obnoxious Kick-Ass and Kingsmen: The Secret Service, this never forgets it’s a comedy and doesn’t transform into a subpar version of the very thing it's spoofing.

Deadpool, the movie and the character, is always at its best when it’s giving a hearty middle finger to everyone: the bad guys, the good guys, franchise expectations and even the studio that financed this fierce little movie. ■

I’m not a skilled carpenter, so when I built a loft bed (and a set of steps for my dog), I sustained a myriad minor injuries: plenty of little cuts, scratches, and splinters. I also had to modify my designs several times, because my inexperience caused me to make a few errors of judgment. Be willing to frequently alter your plans this week, and prepared for scrapes and bruises (emotional or otherwise). You’re attempting something you’ve never tried before. I’d actually be offended if you got it right the first time. Luckily, that’s unlikely. Get out the Band-Aids and get to work.

Every so often, your ruling planet, Mercury, likes to mess shit up. It’s part of his (and your) mischievous nature. Don’t try applying geometry to human relationships. People have attempted this, arguing that a triple is way more stable than a couple, based on the soundness of a triangle. Of course, it (almost) never works, because the more connections there are, the more complicated (and yes, unstable) the interpersonal emotional structures will be. In other words, don’t try to solve your current relationship’s drawbacks or problems by adding new people to it. Make it stable by itself. It’s very difficult to imagine you as frail or delicate; almost everything about you contradicts that. But nevertheless it’s possible for people to underestimate your strength this week.
