JURY RULES OLD HALEAKALA TRAIL IS PUBLICLY OWNED So it turns out that the public owns the historic old Haleakala Trail after all. Since early 2011, the nonprofit group Public Access Trails Hawaii (PATH) has been fighting to reopen that trail, which was already in place when the Mahele took place in 1848 and introduced the concept of private land ownership to Hawaii. In her 2012 book Haleakala, author Jill Engledow described the trail in some detail: “The original trail began in Makawao near St. Joseph’s Church, continued uphill on what is now Pi‘iholo Road to the junction of Pi‘iholo and Olinda, then continued over what is now Haleakala Ranch land and Haleakala National Park land to the crater rim, where it descended and eventually led to Kaupo.”

In fact, a little over three miles of the trail lie in Haleakala Ranch land, and therein lies the problem. PATH wants that section–indeed, the whole trail–open to the public, but the ranch refused. So three years ago PATH went to court to prove that the trail was public before it was private.

Yesterday, a six-week trial ended with a jury verdict saying that, yeah, PATH had proved its case.

“The court victory today should be celebrated by anyone who wants to recognize, preserve and protect Hawaii’s unique and rich cultural past, including Hawaii’s historical trails,” PATH Executive Director David Brown said in an Apr. 23 news release from his organization.

Of course, as The Maui News pointed out in its Apr. 24 story, the issue of public access to the trail remains an open question.

“We will remain in talks with the state about that,” PATH attorney Tom Pierce said in The Maui News article.

NATURE CONSERVANCY GETS HUGE GIFT Guess this is just a time of good land preservation news. On Apr. 24, The Nature Conservancy announced that Alexander & Baldwin’s subsidiary East Maui Irrigation Co. had agreed to donate 3,721 acres of undeveloped Upcountry rainforest.

“This area has been one of The Nature Conservancy’s highest priorities for more than two decades,” said Mark White, the Conservancy’s Maui Nui program director, in the news release.

“The land lies at the core of the 100,000-acre East Maui watershed and is one of the most intact pieces of native forest in the state.”

But don’t expect a lot of public access–we’re talking land preservation here. According to the Conservancy, the donated land is “entirely undeveloped” and “shares a seven-mile border with the Nature Conservancy’s 5,230-acre Waikamoi Preserve.” The land is also home to “20 threatened or endangered native plants, and to two exceedingly rare native forest birds:

Watching the Maui County Council interact with Mayor Alan Arakawa these days, sometimes you wonder if they would ever agree on anything, including the time of sunset or the number of days left before the 2014 election. So it was actually nice over the weekend to see that members of the council who’ve largely disagreed with the Arakawa Administration for the last two years–over such matters as the demolition of the old Wailuku Post Office and the mayor’s recent proposed property tax rate increases– have found common ground.

I’m speaking of course about the state Legislature’s last-minute vote to restore a small portion of the Transient Accommodations Tax (TAT) monies to Hawaii’s counties. Before 2010, each of the state’s counties received about 44.8 percent of the tax revenues levied on hotel rooms. But after that year, the state–hobbled by massive budget problems and huge unfunded pension obligations–grabbed up a huge portion of that money, reducing the County of Maui’s take to just 22.8 percent.

This year, the County of Maui–as well as Kauai and Hawaii–had hoped to get its share returned to the old 44.8 percentage. But that didn’t even come close to happening, though the Legislature did vote to kick back an additional $20 million to the counties over the next two years.

“Personally, the news about the TAT was highly disappointing to me,” Arakawa said in a press release an assistant sent out on Apr. 26. “My staff and I have had dozens of faceto-face meetings with state legislators here and on Oahu, even before the start of the session, to lobby our position. These really are county monies and should go towards paying for the wear and tear our islands endure when you host millions of visitors every year.

This amount is below even the minimum that we thought we would get. The other county mayors and I all strongly supported removing the cap completely and still do.”

According to the Apr. 26 Maui News, Councilman Mike White–perhaps Arakawa’s greatest adversary on the council–was in agreement. “It’s very disappointing because the state, over the last two years, has collected approximately $250 million more than they would have had the changes not been made to the calculations,” White’s quoted as saying.

“The impact directly to Maui is that we’ve received $28 million less than we would have over the past two years.”

Still, the Legislature’s tiny TAT concession might hold good news for the county after all.

“Nevertheless, I believe that with these extra TAT monies, along with some creative cuts from the council, we should be able to eliminate any need for a property tax increase for fiscal year 2015,” Arakawa said in his Apr. 26 email. “We have made some informal

suggestions to the council as to which projects should be delayed in order to find the money they need to do this.”

Of course, that would require the council and mayor to do more than simply agree that the state is being miserly with their money–they’d actually have to work together, which would be something to see.

Also, all’s apparently not well in the donated land. In fact, the Conservancy says that a range of invasive species, including feral pigs, cattle, strawberry guava, Himalayan ginger and pampas grass pose dangers to the native species there. For that reason, the Conservancy is already talking about fencing some of it in.

“The first conservation move is to establish a three-mile, $600,000 fence to block pig and cattle access on EMI land,” White said in the news release. “One mile of fence has already been constructed with funding from the U.S. Environmental Protection Agency, State Department of Health and Maui County Department of Water Supply. News Of The Weird CANADIAN SEX CHANNELS NOT SUFFICIENTLY CANADIAN The Canadian Radio-television & Telecommunications Commission in March reprimanded three pornography broadcast stations–not for excessively erotic fare, but for violating Canada’s protectionist, patriotic rules requiring that at least 35 percent of all content be of Canadian origin. According to its notice, the 24-hour AOV Adult Movie Channel, XXX Action Clips and Maleflixxx were falling short of the 8 1/2 hours a day of north-of-the-border sex action (and, in an additional charge, were failing to provide enough closed captioning to accompany the “Yeah’s” and “Oh, baby’s”).

DRUNK LOGIC Wendy Simpson, 25, explaining her DUI arrest during a March incident in Huddersfield, England, pointed out that she had just minutes earlier walked to a McDonald’s for a late-night meal because she knew she was too inebriated to drive. But the dining room was closed, and she was refused service at the drive-thru window because she was on foot, and, she said, the only option left for her was to go home, get her car and return to the drive-thru.

On the way back, she was arrested.

JUST CANVASSING THE VOTERS Efren Carrillo, a member of the board of supervisors of California’s Sonoma County, was charged with misdemeanor “peeking” last year in Santa Rosa after he, returning home from a club late at night, saw his female neighbor’s light on and decided to drop in on her (though he did not even know her name). He had knocked at her back patio door, carrying beers, but was dressed awkwardly, leading the woman to call 911. “In retrospect,” the county supervisor told police afterward, “I should have had my pants on” (instead of just his socks and underwear).

His trial was underway at press time.

THE SEXY DEFENSE Among the arguments offered in March

by Darrious Mathis’ lawyers for his jury trial in Cobb County, Georgia, (for assault, kidnapping and carjacking) was the assertion that Mathis needed no force in order to have sex with the female victim on the night in question–because Mathis is such a good-looking man. The jury was not so dazzled and convicted him on all charges.

IRONY England’s Stockport magistrates’ court levied the equivalent of a $13,000 fine in March against Lorraine White, 41, who runs a part-time service as a dominatrix (chaining up and whipping “bad” men) in a “sex dungeon.” Her business is apparently

perfectly legal; the citation was for violating fire codes because inspectors could not see how a client, being properly disciplined (handcuffed and chained), might escape the dungeon in the event of fire.

SOUNDS LIKE A JOKE The Food and Drug Administration has had run-ins with “homeopathic” products that subtly market themselves as health remedies without ever having sought the required FDA approval. However, in March, a different problem arose, requiring the agency to order a recall of 56 different batches of homeopathic remedies made by the Ferndale, Washington, company Terra-Medica–because they may have (accidentally) been genuine medicine. A variety of the firm’s capsules, tablets and suppositories, said the FDA, might have contained actual penicillin, inadvertently produced as a by-product of fermentation.

HOSTILE WORKOUT PLACE Tiffany Austin called a KTVU reporter in March after being dismissed as a member of the Planet Fitness Gym in Richmond, California, after only one 15-minute workout–because she was “too fit” and therefore making other members uncomfortable. Planet Fitness apparently takes seriously its business slogan guaranteeing “no gymtimidation,” designed to keep out-of-shape women from feeling bad about themselves. Said another member, to the reporter, “It’s unfair to show off your body.”

OUR LITIGIOUS SOCIETY A columnist for the Egyptian newspaper Al-Yawm Al-Sabi proposed in March that Egypt sue Israel in international court for reparations for the 10 Biblical plagues cast from Hebrew curses, including boils, lice, locusts and turning the Nile River into blood. Ahmad al-Gamal asserted that Israelites swiped gold, silver and other precious items as they began their legendary desert wandering. Al-Gamal also wants reparations from Turkey (for the 16thcentury Ottoman invasion), France (for Napoleon’s invasion in 1798), and Britain (for 72 years of occupation).

HOTTEST GOLF INJURY EVER A California model, Elizabeth Dickson, filed a lawsuit in Los Angeles in March against Playboy Enterprises for an injury she suffered as a guest on a Playboy Channel cable TV show in 2012 when she allowed host Kevin Klein to tee a golf ball off of her rear end. According to the $500,000 lawsuit, Klein took a swing at the ball that was teed between her cheeks, missed, and struck her buttocks hard, causing her “pain, suffering, worrying and anxiety.” ■

apas is a fairly new term in Hawaii, but it’s quite popular in Mainland dining. It’s a lot like pupus but the culture of the cuisine is a bit different. While pupus means appetizer or a starter, assuming you follow up with an entree, tapas are just a feast of small plates or “snacks.”

Tapas menus are a list of mix-and-match options that you can share with friends, or devour by yourself.

There’s a verdant feast of sumptuous veggie dishes on the tapas list: Szechwan green beans, bok choy, Portobellos, grilled pineapple, Brussels sprouts, tomatoes, grilled Molokai purple potatoes and edamame.

The tapas dishes have enough to share and most are in the $5 to $7 range, the rest in the $8 to $11. They’re served from 11am until they close. After 8pm, they have a late night tapas happy hour with them 50 percent off for the rest of the evening. You can also sample Chin’s food with his Sunset pre-fixe menu for $24, or his five-course tasting menu at $75. Sugar Cane opens at 8am and is

Meandering through the tapas menu is a tasty excursion that you can start anytime after 11am, which is when they start serving them. Each mini-dish has the special accoutrement that you’d expect from Chin: house-made bacon fixed into jam, deconstructed fusion, port gelee, pomegranate vinaigrette, smoked sea salt.

“My favorite tapas are the Brussels sprouts, pohole salad, pot stickers, prawn skewer, crab beignet and, of course, the bacon croquettes,” says Chin. “All small

It's Cinco De Maui, Gabachos!

Drinking shots is the best way to honor 150-year-old Mexican military victories

G

iven the attention we pay on the U.S. Border Patrol, Mexico has a proud history of quashing invasions. On May 5, 1862, they kicked the French out on their fashionable asses in the Battle of Pueblo. An unexpected win, the 8,000 well-equipped French had already blown through Veracruz on their way to Mexico City. President Juarez was retreating when 4,500 Mexican soldiers in Pueblo stopped the French army in their tracks. It’s not Mexican Independence day (that’s Sept.

16) but it is a holiday in the state of Pueblo.

Because of this, it’s considered an international insult if you don’t raise a glass to the tenacious Mexican forces of more than 150 years ago. Here on Maui, we’ll be celebrating in style with margaritas, mariachis, Mexican beer, flamenco and loads of mescal and tequila. Here’s a quick roster of where the Cinco de Mayo festivities will be. Spider-Man Returns Again!

Though he should have stayed away The Amazing Spider-Man 2

O

nce the end credits for The Amazing Spider-Man 2 began to roll, my friend Zach leaned over and asked me, “Did you take any notes for this film?”

I told him I almost never jot anything down during movies, a practice I gave up in college, with my bad handwriting trumping good intentions. In the case of the new Spider-Man, the first sequel in the new series, I just sat there and grew frustrated. Very much in the same way one would sit at a bus stop, waiting angrily for a ride that never arrives.

Ten years after Sam Raimi’s critically acclaimed, wildly popular, Tobey Maguire-starring Spider-Man 2, we have a sequel to the new version, with a new director and cast. Spidey 2.0, with (500) Days of Summer director Marc Webb helming and Andrew Garfield as Peter Parker, worked beautifully the first time.

Garfield’s moody, teenage Hamlet with web shooters was well matched with Emma Stone’s plucky Gwen Stacey. More so than in previous incarnations, the love story truly got my spider senses tingling.

The sequel goes wrong immediately and really never recovers. A pre-title sequence depicts a vivid plane crash, always a fun way to start a summer movie geared towards children. Then, we follow our hero pursuing Paul Giamatti as a Russian villain with a tattoo that circles his forehead. Like much of the movie, this set piece is flashy, noisy, frantic and obnoxious. Giamatti isn’t merely hamming it up–he appears rabid and ready to eat the scenery.

We’re introduced to Jami Foxx’s Max Dillon, an awkward, meek employee of Oscorp (the science-based company that gave us Spider-Man, Lizard Man and is seemingly only good for spawning dangerous mutations). Dillon was once saved by Spider-Man, and he’s turned into a full-blown Spideystalker who “talks” to his hero while rummaging through the fridge. I enjoyed Foxx in the role, even when he transforms into Electro and the character becomes an extended special effect. Dillon’s uber-nerdy demeanorturned-empowered-evil-doer brings to mind Michelle Pfeiffer’s Selina Kyle in Batman Returns. Whereas Pfeiffer had time to shape her character and turned in a tour de force, Foxx has to rush the character development and strain to keep up with the other subplots in this overly busy movie.

Take that... umm... who am I fighting again?

Thankfully, the scenes where the characters just talk to one another provide narrative rest stops from the constant barrage of mayhem. Garfield’s scenes with Stone are soulful and sweet. The love story should have carried the film (as it ably and movingly centered the prior installment). Instead, our charismatic leads, sometimes while still embracing from a romantic interlude, have to shift gears and blurt out mouthfuls of exposition to set up the next action sequence.

The third act offers truly embarrassing sights. The big reveal of Dane DeHaan (very good playing Harry Osborn) in the clanging second climax made me laugh, though I doubt it was intended to be humorous. Then there’s Giamatti’s last minute

return to the film. Giamatti is such a wonderful actor, I wonder if it saddened him, as much as it did me, to see what his requirements were for this movie. The role is small but he manages to look foolish and bellow “I am the Rhino!” The indignities he faced acting opposite Howard Stern in Private Parts seem minor by comparison.

Children may enjoy this intense, though not graphically violent movie but the web slinger slips and trips up almost as badly as he did in the woeful Spider-Man 3. I recently showed my film class the 1989 Batman, which had a simple plot, one hero and one villain. The Amazing Spider-Man 2 is so overloaded, you may forget all the abandoned subplots and supporting characters left in the rubble. ■

Rudd’s songs touch on spirituality, humanity, environmentalism and the rights and mistreatment of the Aboriginal people of his homeland (he includes Australian and Canadian Aboriginal vocals in his songs).
