ARRESTED FOR FILMING (Note: All of the following letters concern MauiTime Publisher Tommy Russo’s recent arrest for attempting to film Maui Police Department’s Operation Recon, which we wrote about in our Nov. 29, 2012 cover story.)

Videotaping of police in the normal conduct of their business (including arrests) in a public place is completely covered under the 1st amendment. A quick internet search will yield many instances when police have over-stepped and the arrests have been thrown out of court. Principled police welcome video taping, it serves as witness to the good work that they do.

People always complain about cops doing nothing but when there are complaints about things and they do something about it, stupid people only cry about it. Suck it up and mind your own business. And I’m pretty sure Russo could have just listed [sic] and waited till the cops finished the stop then he would have gotten a good explanation from the police about the traffic.

Mr. Russo, if you are looking for an important journalistic task, perhaps you would want to consider partnering with the Maui Police and informing the public about the public safety issues they were enforcing. Although not a resident here, I suspect that the leading cause of criminal death on Maui is road collisions. Both of the violations indicated in your article put both drivers and pedestrians at greater risk.

Tinted windows prevent drivers from seeing other road users at night and more importantly prevent other drivers and pedestrians from establishing eye contact with the driver.

Lift kits on pick-up trucks alter the stability of the vehicle and make them unsafe, especially when attempting to make an evasive maneuver. The high bumper puts other drivers at risk, especially in intersection collisions.

Conducting vehicle stops and enforcement projects are a dangerous situation. That is why the officer depicted in your photos is wearing a reflective vest. Were you? Any traffic stop has the potential of confrontation, violence and in some instances gunfire. Were you prepared for such possibilities, or were you expecting the same officers that you were criticizing to look after you?

I can’t count how many I have seen them break the law while supposedly upholding it, from talking on their cell phones while driving to their speed racer driving antics. I have seen cops drive at least 70 to 80 mph down busy highways. Just because their lights are on doesn’t give them the right to break the law.

It’s like they feel because they have a badge, they feel they are above the law.

These guys do whatever they want and if you speak up you get in trouble.

As free citizens of the United States of America we are supposed to question authority. It is known that people in power abuse their power sometimes. Police are supposed to protect and serve. In Maui they beat you up for your milk money.

MAUI SUNSEEKER You guys ever watch Hotel Impossible on the Travel Channel? Well, you might want to tune in next week because the show’s hotel fixer Anthony Melchiorri will be helping Maui Sunseeker owner Chuck Spence spruce up his 26-room Kihei resort, which he’s owned since 2008 and which caters to adult LGBT clients.

“The hotel presented a unique problem as it receives rave reviews from its clientele but struggles with its occupancy and related cash flow, hence the marketing strategy focus,” states a Nov. 29 press release. “Designer Blanche Garcia joins Melchiorri to upgrade the rooftop deck.”

According to Spence, one of the Sunseeker’s rather unique features caused a bit of a challenge for the cable TV film crew. “It was eye opening for all involved in this show for us from a business perspective and for the cast when they discovered the clothing optional hot tub,” he said in the press release.

The Maui Sunseeker episode of Hotel Impossible airs on Monday, Dec. 17 on the Travel Channel. Check local listings for the time.

TOM CANNON SPEAKS! Finally, after months of waiting, the embattled Wailuku Main Street Association, which has been under withering fire from the state Attorney General’s office for serious mismanagement allegations and had a Dec. 5 say in court, has finally released a full, point-by-point defense. The 84-page response (which is actually two separate documents) to Deputy Attorney General Hugh Jones’ blistering Aug. 30, 2012 report on WMSA was, according to the copy MauiTime obtained, faxed to the courts on Nov. 28 from Mental Health America.

Put simply, WMSA Chairman Tom Cannon denies each and every instance of wrongdoing Jones first detailed in his re-

port. Cannon yields no ground whatsoever.

According to Cannon, WMSA has been a principled model of management for its entire existence, and every bad thing Jones ever discovered about the organization is either wrong or the product of (the apparently numerous) “disgruntled” former members of the WMSA board of directors that provided Jones with information– most notably Sam Clark, whom Cannon laughably derides as a “board bully."

Of course, Cannon also blames the media for the troubles plaguing his organization: “When the Board did not support Clark and [former board member Bryan] Sarasin’s plan to ax our ED [Executive Director Jocelyn Perreira, a long controversial figure on Maui and a particularly juicy target of Jones’ investigation], the two officers worked to discredit WMSA by resigning in a huff and running to the Attorney General spouting falsehoods about our 27-year awardwinning non-profit, falsehoods the Maui News and its weekly surrogates were happy to spread (as Maui News would like to control the voice of local public sentiment and, it seems, will slant its reports in order to incite negative public reaction to do this, to create unwarranted drama, and thus sell more newspapers).”

“Cannon, but Cannon is not a licensed attorney and to the extent that the Response is on behalf of the corporation he has engaged in the criminal offense of the unauthorized practice of law under section 605-2, Hawaii Revised Statutes,” Jones wrote in his own 52-page response to Cannon’s response.

“Controlling authority makes clear that corporations may not appear pro se. Moreover, most of Respondent Thomas Cannon’s Response rests on inadmissible, unauthenticated documents and hearsay. The Response

explanation of a May 5, 2011 check for $200 WSMA wrote to the “Friends of Alan Arakawa,” the current mayor’s campaign committee. The IRS expressly forbids nonprofits from contributing money to political campaigns. The law is clear: thou shalt not give politicians money. A violation of that law could obliterate WMSA’s precious nonprofit tax status. But have no fear: Cannon says it was all just a silly misunderstanding.

“Nothing indicated it was a political event,” Cannon wrote, insisting that he had no idea the words “Friends of Alan Arakawa” denoted a registered political campaign committee. Then Cannon goes on to insist the issue is irrelevant anyway: “The check was sent back, un-cashed, making Deputy AG’s concern a moot point,” he wrote, nonetheless admitting that his organization made an illegal contribution.

conducted a fair and impartial investigation of WMSA,” has relied on “unsworn testimony” from “individuals we have shown him [sic] to be conflicted,” “has not communicated with any existing board members” and “has (in various ways we have detailed) over-reached his authority, including the issuance of his second subpoena.”

Then Cannon ties this little bow around all those accusations: “Deputy AG Jones seems completely unaware of what WMSA does.”

I believe the standard legal rejoinder to a statement like that is: “Duh!” No one looking at WMSA has any clue

is not supported by any affidavit or declaration or by source documents.”

And here I thought things couldn’t possibly get worse for WMSA. Shows what I know.

TRAGEDY And now I’d just like to add my condolences to the family of Jose Krall, owner and pastry chef of the Maui Bake Shop, who died Saturday night in a plane crash a couple miles north of Kahului Airport. It’s strange and, to be honest, seems rather petty to say I’m sad because I’ll miss the shop’s outstanding turkey sandwiches and bowls of split pea soup, but that’s what the guy did.

Krall was a true pastry chef, and ran a gem of an establishment that sold fantastic food that made many people, including myself, very happy. MAUI STUDENTS WIN! Earlier this year, the Maui Mall established “Family Sundays” to celebrate the joy of learning and encourage students to succeed in school. Each month since April, a few exemplary students of Maui County who were nominated by their teachers were recognized on stage for their achievements and entered into a drawing for an iPad or iPod. At the event’s finale on Jan. 6, 2013, all nominated students from previous weeks will be entered into a grand prize drawing to win a MacBook Pro. This past Sunday, freshman Mary Jane Butac from Maui High school was the winner of the iPad drawing. She was nominated by her teachers for not only her 4.0 GPA but also her helpful and positive attitude in the classroom.

The winner of the iPod was Kahului School second grader Mari Yamamoto. She was nominated by her teacher who described Yamamoto as “a walking ray of sunshine.”

NATIONAL PLANTING DAY! On Nov. 2, Keep the Hawaiian Islands Beautiful (KHIB) held a planting project in celebration of Arbor Day at Ka’a Point in Kanaha. After the tsunami that hit Maui from the Japan earthquake back in 2011, Ka’a point sustained some damage and debris was washed up into the area. Mike Perry, a long-time volunteer and Kanaha champion, removed the debris in hopes of restoring the site to its previous condition.

KHIB’s National Planting Day project was sponsored by a UPS grant of $1,000, and with the help of Perry and members of the Lae’ula O Kai Canoe Club, KHIB was able to plant 80 native plants of four different species throughout the area: the Ma’o, Kulu’i sandalwood, Naio and A’ali’i.

“The species were chosen because they were growing there prior to the 2011 tsunami,” said KHIB state leader Jan Dapitan.

“The native species had emerged when the alien understory was removed by volunteer Mike Perry and an AmeriCorps team several years ago. I love the A’ali’i because it was [the late historian and writer] Inez

Volunteers were trained by Elaine Malina of Maui Outdoor Circle, who gave a brief lesson on proper planting methods to help ensure that the plants would flourish in the area. Hoolawa Farms, a native nursery in Haiku with more than 100 species of Hawaiian endemic and indigenous plants for landscaping and ecological restoration, propagated the plants. For the most part, the plants will be self-sustaining.

“Some watering attention will be needed until established,” said Dapitan. “Then, to protect the site from destructive use, the public will need to be educated to treasure these native species and appreciate the shoreline’s natural resources.”

Some upcoming projects by KHIB include finding community support to establish an environmental court in Hawaii and determining a recycling solution for tires (which is a big problem in

KHIB has the responsibility to build the program in Hawaii.”

If an asteroid is ever on a collision course with Earth, it’s feasible that the planet could be saved by firing paintballs at it, according to an MIT graduate student whose detailed plan won this year’s prize in a United Nations space council competition, announced in October. White paint powder, landing strategically on the asteroid, would initially bump it a bit, but in addition would facilitate the sun’s photons bouncing off the solid white surface.

Over a period of years, the bounce energy would divert the body even farther off course.

The already identified asteroid Apophis, which measures 1,500 feet in diameter and is projected to approach Earth in 2029, would require five tons of paintball ammo.

In October, a federal appeals court overturned the bribery conviction of a City of Chicago zoning inspector–on the grounds that the bribes he was convicted of taking were too small to be covered by federal law. Dominick Owens, 46, was convicted of taking two bribes of $600 each to issue certificates of occupancy, but the law applies only to bribes of $5,000 or more. (Also in October, Chicago Mayor Rahm Emanuel disbanded the city’s ethics board after a 25-year run in which it never found an alderman in violation–even though, during that time, 20 aldermen were convicted of felonies.)

Samuel Cutrufelli, 31, filed a lawsuit in October in Sacramento County, Calif., claiming that Jay Leone, 90, “negligently” shot him.

Cutrufelli had burglarized Leone’s home in Greenbrae, unaware that Leone was home.

When Leone reached for one of his stashed handguns, Cutrufelli shot him in the jaw and then pulled the trigger point-blank at Leone’s head, but was out of bullets. Leone then shot Cutrufelli several times, which Cutrufelli apparently felt was entirely unnecessary.

William Keltner, 52, was arrested in Abilene, Texas, in November, after he underestimated the security at a Wal-mart self-checkout line.

DANCING, DOLLS AND DEMENTIA HOW MAUI ADULT DAY CARE CENTER HELPS THOSE WHO NO LONGER REMEMBER

T

his story began over a misunderstanding about a toy.

During the run-up to our annual Charity Gift Guide, which we published on Nov. 21, the wish list from Maui Adult Day Care Centers included the curious entry “life size dolls.” Not really sure what the organization meant by that, and having very little knowledge of what MADCC did in any case, I emailed back, asking for clarification. “[M]aybe make that baby dolls,” MADCC Program Coordinator Kathleen Couch replied. “I was trying to express

dolls that fit in the arms of a kupuna to give them the feeling that they are parenting again….not small dolls like Barbies, etc. Guess I did not know how to say it.

Sounds kind of bad the way I said it… lol…sorry and thanks for asking.”

But Couch’s answer opened doors I wasn’t ready to walk through. Couch was talking about dementia, about people who were once young but were now old, now slowly losing their mental grasp on their families and own life.

“Dementia is a formidable adversary, and the history of efforts to treat Alzheimer’s has

to temper any excitement about potential medicines for frontotemporal disease,” Denise Grady wrote in the May 5, 2012 New York Times story “When Illness Makes a Spouse a Stranger.” “The drugs for Alzheimer’s have been a disappointment, with just temporary effects on symptoms at best.”

To be honest, it wasn’t something I like to think about. Losing not just my faculties but my memories–including those of people I’ve known and loved my whole life, was too horrible to contemplate. The whole thing, which had started out as a humorous curiosity, was suddenly making

me sad, which I mentioned to Couch.

“It actually can make one sad if one does not understand dementia,” Couch replied.

“With dementia/confusion our kupuna live back in time. The doll represents the child they had years ago and because they live in the past in their mind the doll is very real and honors them as a young parent again. We see a doll… they see their baby and they love it, hold and cuddle it, and they sing and talk to it. We simply ask how their baby is doing and tell them what a wonderful parent they are and they beam with pride. We truthfully and simply are honoring them at the level

they are at, going back in time with them, and these dolls make them feel important, needed, and capable again. It really is an amazing and wonderful thing.”

Call me naive, ignorant or simply young, but I had never heard, much less imagined, that a children’s doll could be used in such a manner. So when Couch invited me to visit their center, I jumped at the chance. At about 10am on Nov. 21, I took a tour of their Kahului facility.

It was a busy place, with 60 or so seniors (center staff calls them “clients”) spread throughout their main hall as a few nursing assistants moved among them.

Maui Adult Day Care Centers provide just that: day care, except for seniors instead of children. According to Sandy Freeman, the MADCC Executive Director, 95 percent of their clients have some form of dementia. MADCC exists, she told me, to give “caregivers”–family members and friends tasked with meeting the senior’s basic needs–time off from having to constantly render care, which can be physically and emotionally exhausting, to work or just relax.

“They can go to work with peace of mind,” Freeman said. “As a caregiver, it was a lifesaver.”

MADCC has been around for 38 years, and there are five facilities throughout Maui, each equipped with a nurse and numerous staffers. According to JoAnn Ridao, director of the County of Maui’s Department of

Housing and Human Concerns.

“It provides for families that are working families,” said Ridao. “And it provides for the socialization of seniors, taking them out of isolation.They’re trying to keep our seniors as independent as possible, for as long as possible.”

The center is also apparently cost-effective. Dropping off a senior there costs $49 per day, which Couch said pales before the costs associated with longer-term care.

“It costs $14-40 an hour for a private caregiver at home,” Couch said as she began walking me through the center.

“And assisted living homes cost $3,000 to $5,000 a month.”

Perhaps thinking of our earlier email exchange on MADCC’s need for more dolls, Couch then walked me over to some tables where a variety of seniors sat reading, completing puzzles or just relaxing. A few are cradling dolls. One older Asian man is bouncing the doll on his knee. Another Asian woman was cradling a doll in one arm as though it was an actual baby and turning the pages of a magazine with her other hand.

“She spoke fluent English,” Couch told me, “but then one day she started speaking Japanese. Japanese was her first language.

But we have a feeling she still understands us because she laughs at things we say.”

Nearby, another client began singing “You are my sunshine.” As she did, another client nearby, who was busy with a coloring book, began singing, too.

“I used to sing in clubs,” she told me af-

Of course, not all of MADCC’s clients have dementia.

“I think it’s a good place,” one woman who said she’s been going to the center for about two years told me. “I think it’s a safe place.They keep a very close eye on people here and supplies them with lots of things to do.”

Indeed, this particular client seemed so coherent that I asked her what she did for a living when she was younger. “I was a house painter in Chicago,” she said. “I painted inside and outside of houses using ladders.

My boyfriend had his own company, and I worked for him. I liked climbing full ladders, and was never scared. [Now] my daughter and her husband and three grandchildren live here, and I live with them.”

Near the far wall of the center, the whole mood of the place changed. Though some teens strummed ukuleles on a television screen, this part of the center was much quieter. Here, Couch explained, was where those clients who needed a great deal more care than the others. As staffers wheeled a woman named K– (many families requested that their loved ones’ names not appear in this article) into place, another woman named S– sat beside the woman and talked to her.

“S– was best friends with K–,” Couch told me. “K– was like her, but now she’s declined to the point that she can’t walk, talk or feed herself. S– will go and talk and talk.”

As we walked slowly around the room, Couch continued. “They’re at level where families know they can’t be home alone,”

she said. “We give them independence, but make sure their needs are met. We have entertainment that comes in throughout the week. We’re in it to help them survive, and help their caregivers survive.”

Now headed back to the front of the center’s main hall, Couch pointed out a young man in blue scrubs who was working on a puzzle near clients several generations removed from him. He was autistic, Couch said, who busied himself during the day as a kind of volunteer staffer.

“He felt it was necessary for him to look like a CNA, so he got the scrubs himself,” Couch said.

Near the end of my visit, Couch introduced me to Arthur, an old Asian gentleman. When I came by, he was playing Hanafuda with his brother. After Arthur shook my hand, Couch told me that he had been a ballroom dancer, and in afternoons would sing karaoke and dance. She also told me that though Arthur’s very close to his brother, and often plays cards with him, he doesn’t remember that his brother is actually his brother.

“That can be heartbreaking for loved ones,” Couch said after we’d walked by.

The Tropica Experience New Chef de Cuisine Jennifer Evetushick has fun with the menu

ho is one of those food words where proper pronunciation eludes me. My English trained brain wants to say “foe” but the Vietnamese say it as “fuh.” At Tropica, located at the Westin Maui Resort and Spa, it doesn’t matter if you can say it–just order it. The pho comes from Chef de Cuisine

each day what they were passionate about and how we could integrate that into the menu. Out of that, our baby was born.”

Evetushick speaks with a gleam in her eye when you ask about her dishes. Part of her contribution is the enhanced fusion of Euro Pacific and Hawaiian-themed techniques. You will find that passion for technique and presentation in starters like the ahi and crisp pork belly, chile grilled tako and Tropica ceviche. The ceviche features her own housemade tapioca fried cracker.

The tako is boiled in beer before its tenderized and grilled. The ahi and pork belly also has frisée and Maui onion jam.

“Working with Bev Gannon for four years before coming here has framed my culinary

and shallots. The beautiful bowl is further studded with plenty of cracked crab claws, mussels, scallops and fish.

“The pho is started with roasted lobster and shrimp shells,” says Evetushick. “We add tomato paste, sake, aromatic herbs and cover with lobster stock to create a rich broth.

Since it’s traditionally done with veal broth, we wanted to be innovative and change the average diners interpretation of pho. And so we came up with this, a bounty of local seafood packed into a mouthwatering broth with my favorite noodles. And we’re glad we did–we sell about 18-20 per evening!”

The Hamakua mushroom flatbread has morphed into a tapas dish, perfect for sharing as a starter or nibbling with cocktails. The dough is both crisp and chewy and the toppings of goat cheese, truffle

arugula salad and roasted garlic béchamel make it complete.

“Since I drew from my cooks for inspiration, it was easy to get them excited every day about new dishes,” says Evetushick. “They are so supportive and such a strong team. Developing the mis-en-plus for each dish and developing techniques allowed them to connect with a sense of ownership on this new menu. It resonates with them daily, and I’m lucky to work with such a talented, inspired group of people. Overall, the menu has begun to settle in and is getting great reviews. New menus always have a period of time where customers miss the old dishes and flavors, but once they give a new dish a chance, there’s no looking back.”

Jennifer Evetushick, who joined the team less than a year ago and has added a few other new signature items to the menu.

“As soon as I accepted the position of chef de cuisine, I observed the how, what and why that made Tropica,” says Evetushick. “I wanted to adapt my own interpretation of how I perceived the experience, and improve it further. I met with resort executive chef Garret Fujieda and resort executive sous chef Ikaika Manaku each week, and we had tastings to transform my ideas into reality. We drew from local ingredients and all of our customer feedback (we ran each potential dish as a special first). I also encouraged feedback from my cooks, asking

viewpoint to focus on the South Pacific,” says Evetushick. “The ingredients you get from these areas are diverse and exciting. I also enjoy the clean lines and simplicity of the Asian influence; it helps you to focus on the pureness of an ingredient without masking with too much of this or that.”

Evetushick’s favorite dish by far is the pho, and her enthusiasm for the work that goes into the preparation is evident in the broth. Pho enthusiasts know that the dish requires a really rich broth. The traditional way calls for meat, but Evetushick has changed it up with a rich shellfish and seafood stock base. She also adds flavors with kaffir lime, lemongrass, miso butter

What’s more, bartender Fred (Freddie) Sconfienza has a wondrous way with the beverage menu at Tropica. He recommends the new seared ahi and buckwheat soba with pickled slaw as a cool dinner dish that can be paired perfectly with his selections.

The award winning Dragonberry Bomb is a superb way to start the cocktail hour, as is the Okole Wow, which features a tiroot liqueur made on the slopes of Haleakala. Maui Pineapple Rum also made at the Haleakala distillery is only going to be found here at the Westin. For a creamy martini treat, there’s the Nutty Hawaiian, rimmed in chocolate and mac nuts with Godiva dark, coconut cream, macadamia liqueur and Stoli Vanilla. “It’s a liquid dessert that appeals to those with sweet cravings,” he said.

“It’s only been about two months, and the menu is developing constantly,” says Evetushick. “It’s what keeps us on our toes as culinary experts. Now the Ka‘anapali Beach Resort presents the 40th Annual Na Mele O Maui 2012. The Sessions Who knew a film about sex and Polio could be funny?

ere’s a true story that shouldn’t work as a movie, let alone a movie this good. John Hawkes stars as Mark O’Brien, a Polio survivor who spends hours of his life in an iron lung and cannot do his day to day activities without the assistance of someone to dress him and push him around on a cart. O’Brien is a poet with a brilliant mind and a healthy, even cynical attitude about his life and, as he ponders his life expectancy, decides he has one enormous mission left: to lose his virginity.

A sympathetic and atypically hip man of the cloth (played by a scene stealing William H. Macy) encourages Mark, whose research about what a man in his fragile condition is capable of leads him to Cheryl, a “sex surrogate” (played by Helen Hunt).

Mark helpfully tells her and us that he isn’t paralyzed but his muscles are working

against him and sex in any conventional way may be out of the question. The film deals with his physical efforts with Cheryl to gain sexual prowess of some sort.

I’m happy to tell you that, yes, it’s a comedy. But that doesn’t let the more conservative audience members off the hook.

The plot description above could be a film that is quite sleazy, mawkish and wrong in a variety of ways. The Sessions works as well as it does because it wants you to laugh, with Mark and not at Mark, and, even more amazing, it turns his journey into a recognizable, even universal one.

Thanks to writer/director Ben Lewin’s screenplay, Mark becomes a real person and you’ll see the wonderful man trapped inside a broken body. Mark’s quest for sex is mostly a springboard need for close physical contact and a desire for romance in his life. His fears about his first time and what having sex means to someone will mirror that of many audience members.

In high school, when sex was the Everest of life experiences and seemed a scary, exciting and intimidating event–this is how Mark sees it, which is how everyone did. His quest for a sexual connection results in scenes that

are frank and contain nudity, to be sure, but this isn’t an exploitative or crass film.
