BY OLIVER DE SILVA aui Community Correctional Center sent inmates to do landscaping work for a prison guard’s private company, a new whistleblower retaliation complaint filed by former MCCC Correctional Officer Hendricks Haapu alleges. A 20-year vet of the prison, Haapu also alleges that he was “overworked, reassigned and verbally and physically harassed” when he complained about the labor to Sergeant Carl Duarte, his supervisor who also ran the landscaping company in question. Haapu filed his complaint against the State of Hawaii’s Department of Public Safety and individual correctional officers at the Maui Community Correctional Center (MCCC).

“A crew of inmates in the Community Workline Program was cleaning a section of land that was contracted to be landscaped by a private company,” Haapu alleges, according to a press release titled “Slave Labor at the Maui Prison” issued Nov. 15 by the civil rights law firm Fujiwara & Rosenbaum, which is representing Haapu. “The inmate crew from the MCCC was landscaping, amongst other private areas, an area of land along a highway on Maui that is owned by the Department of Hawaiian Home Lands ‘DHHL.’” The Community Workline program allows nonprofit organizations and the County of Maui to request assistance from MCCC’s inmates when they need help with labor-intensive tasks. The Community Workline often works with the Department of Parks & Recreation setting up posts, rails, and other types of maintenance.

business that had been awarded a contract by DHHL to landscape the area that the MCCC inmates landscaped,” stated the Fujiwara & Rosenbaum press release.

“Hawaii’s inmates were performing private work for Sergeant Duarte’s private landscaping company and Sergeant Duarte collected the fees for said work from the DHHL. This, at the very least, is a clear violation of the Department of Public Safety’s Department Administration Policy and Procedures... and the State Code of Ethics, Hawaii Revised Statutes.”

Duarte refused to comment for this story.

"Well, it’s too early for me to comment," he said. "I don’t want to say nothing’s wrong or nothing’s right about it."

What's more, information on Duarte’s company wasn't easy to find.

Joseph Rosenbaum, Haapu’s attorney, gave the name as CD Landscaping, but there’s no such business listed with the State of Hawaii’s Department of Commerce and Consumer Affairs. There is, however, a Charles G Duarte Landscape Maintenance LLC located at 924 Lekeona Loop in Wailuku.

A spokesperson for the state’s Department of Public Safety also declined to comment on the complaint.

“The Department Of Public Safety Director has not been served any legal documents yet,” said Toni Schwartz, the department’s Public Information Officer. “We have been advised to reserve comment until we receive it and have had a chance to go over it with our Deputy Attorney General.” ■ To share or save this article, type: mt.hy.pr/1624n1

RADICAL ANTIWHALING GROUP SEA SHEPHERD COMES TO MAUI Speaker Joe?

SPEAKER SOUKI RISES? Maui Representative/American Chemistry Council lobbyist/Speaker Emeritus Joe Souki says he has the votes to regain control over the state House. The legislator who held the Speaker’s title from 19931998 apparently cut deals with a bunch of Republicans to do it, but he’s not been shy about telling the press that he’s in.

Of course, state Rep. Marcus Oshiro (a loyalist of current Speaker Calvin Say whose job as House Finance Committee Chairman would be in serious jeopardy if Souki wins) told the Associated Press on Nov. 24 that nothing’s certain until January, when the House leadership votes take place.

The folks over at Sierra Club Hawaii aren’t waiting until then. Way back on Nov. 21, the organization sent out a press release that “welcomes” new leadership in the state House.

“Many Sierra Club allies are involved in the newly-formed coalition, so we’re excited about the fresh ideas and new leadership that will hopefully emerge within the State House of Representatives,” said the statement. “We believe the early commitment to bipartisanship is a positive step that will result in greater transparency and more balanced decision making.”

The reason Sierra Club didn’t waste any time jumping on the Souki Train?

“Plainly the Sierra Club has been disappointed over the past few years with the assault on Hawaii’s environment, including passage of the Public Lands Development Corporation and aggressive efforts to suspend Hawaii’s environmental review law,” the press release continued.

High-speed trimarans, emblazoned with the Jolly Rogers, chase after lumbering whalers while crews in rubber rafts try to foul the whalers’ screws with heavy cables.

The whaling crews, in turn, fire water cannons and try to ram the Sea Shepherd boats. It’s easy to get the sense, even after watching just one episode, that you’re watching history unfold.

Now Sea Shepherd, which has for some time operated an office in Honolulu, will soon open a chapter on Maui.

“We’re in the process of doing so,” said Deborah Bassett, a writer and activist who took part in Sea Shepherd’s 2011 anti-whaling campaign in the Faroe Islands and is organizing the new chapter from Sea Shepherd’s Oahu office.

“The launch is happening as we speak.

Our long-term vision is to have a chapter on each island [in Hawaii].”

As far as what the Maui chapter might do, Bassett said she’s still studying local issues. “We’re building our campaign now,” she said. “The monk seal issue is very big.

WMSA GRANT MONEY GOES ELSEWHERE So it looks like I speak for everyone when I say that the first annual Paia North Shore ‘Ukulele Festival was a success, if for no other reason than the law ultimately didn’t get involved. But no, as The Maui News reported on Nov. 25, concerns that organizers hadn’t pulled all the necessary permits proved moot as the event went off without a hitch.

This is good because Maui’s small towns need all the help they can get. And now here’s some better news: since the County of Maui isn’t spending nearly a quarter million dollars every year on the Wailuku Main Street Association (WMSA), which is under investigation by the state Attorney General’s office for mismanagement, it’s now able to offer that money to organizations island-wide.

On Nov. 23, the county sent out a press release advertising a Request for Proposals for $243,000 (the same amount as the old WMSA grant) worth of grant money for projects that would “directly benefit” Haiku, Hana, Kaunakakai, Keokea-Waiakoa, Lahaina, Lanai City, Makawao, Paia, Waihee, Waikapu and Wailuku.

According to the press release, “projects would have to meet several criteria: direct benefit to the town, collaboration and community engagement, accountability of the applicant, project “ripeness,” proposed budget, manageable term and scope, and outreach.

“Because this is the first year of this program, and because the Department wants to be able to equally award grants for projects in every town, then each town’s award would be approximately $22,000,” the release continued. “This is the amount that proposals should consider. The Department will receive proposals through December 2012 and will make its first round of awards in early 2013, with each town receiving one grant. From January through March of 2013, proposals will continue to be accepted; those towns that did not receive an award in the first round will receive top consideration for awards during the second round. From March through June 2013, any remaining funds will be used for awards for any town.”

There’s no doubt that the Haleakala Crater (which we know is not technically a “crater” but whatever) is a majestic spot.

But Mother Nature and Haleakala National Park can’t do it all on their own. Keeping the crater pristine is a job for the community. That’s why Haleakala National Park is recruiting middle school interns to work alongside their professional staff and assist with duties like native plant identification, invasive weed control, facilities maintenance, guided hikes and outdoor safety education for spring break 2013.

What’s better than a beautiful day in Hana? How about a beautiful day spent cleaning Hana?

The Community Work Day (CWD) program is depending on you to get involved and keep our island rubbish-free this Friday, Nov. 30 and Saturday, Dec. 1, from 8am to 2:30pm at a stagCleaning up Hana ing area located at the Hana Landfill. Just show up with your disposables and they’ll take care of the rest.

“We host a clean-up three times a year for Hana and once a year to host a similar recycling for residents of Keanae, Nahiku and Kipahulu,” says Community Work Day executive director Rhiannon Chandler. “We want to help those remote communities by providing access to recycling their bulk solid waste items that are not accepted at the landfill. This helps to keep our highways and ‘aina clean and clear of these items being dumped as was more often the case on the Eastside three or more years ago before CWD started this remote communities recycling program.”

CWD will accept appliances, scrap metal, tires, electronic waste–including TVs and computers–and batteries, both household and vehicle. CWD will not accept vehicles or propane tanks at this time. There will be a $5 per tire recycling fee for all tires.

Chandler says there are special challenges with large-item recycling and

electronics with Hana’s remoteness. It’s not easy for residents to drop off their recyclables at the Kahului intake zones, setting the stage for illegal dump sites in East Maui. These Community Work Day programs have made a difference not just in clean-up, but also educating residents about how to dispose of these items.

“Remoteness can lend itself to dumping these kinds of recyclable items,” says Chandler. “The first time we did this recycling event, some Eastside communities were digging items like tires, metal and even car batteries up from the ground where they had buried them.”

Now Hana also has its own newly installed community drop box program for recycling newspaper, cardboard, aluminum, glass and plastic, which Chandler says is working out well for residents.

Before that, residents had to go to Haiku to recycle those items.

“To keep our island clean and healthy and prevent roadside dumping on especially Hana highway is critical for safety,” says Chandler. “It’s difficult enough to drive without these kinds of solid waste obstacles on the side of the road. Every little bit that we can divert from the landfill and recycle saves money and precious natural resources.”

The recycling event is a group effort between the County of Maui Department of Environmental Management’s Abandoned Vehicles and Metals Section and Recycling Section, Maui Tow & Transport, Hammerhead Metals Recycling and Councilmember Bob Carroll’s Office.

Elderly and disabled community members are encouraged to call CWD for help transporting items to the staging area.

GOVERNMENT IN ACTION Among the federally funded projects highlighted in the “2012 Waste Book” of U.S. Sen. Tom Coburn were a $325,000 grant to develop a “robosquirrel” (to help study the somehow-confusing interaction between squirrels and rattlesnakes) and a $700,000 grant by the National Science Foundation for a New York theater company to create a musical about climate change and biodiversity (which actually opened this year, in Kansas City, and included among its concepts, according to one critic, “flying monkey poop”).

Abuses of the food stamp program were also detailed, such as by one exotic dancer who, while earning $85,000, drew food stamps in an amount roughly equivalent to the sum she spent on “cosmetic enhancements.”

OUR HEROIC MILITARY BUREAUCRATS While the Department of Veterans Affairs remains under criticism for inadequate funding for personnel disabled in the Iraq and Afghanistan wars, it spent in 2010 more than $5 million on training conferences just to teach bureaucrats how to administer parts of its latest collective-bargaining contract, according to an October report in the Washington Examiner. In fact, reported the Examiner, $34 million in payroll goes to department officials who work mainly on union-related activities.

GETTING OUT THE VOTE Just before a primary election in June, Albuquerque, N.M., TV station KOB apparently caught, on camera, a poll worker for two county government candidates offering potential voters miniature bottles of whiskey to sip during free rides to early voting centers.

And Los Angeles’ KCBS-TV reported in October that leaflets sponsored by the Progress and Collaboration Slate for its local candidates in Eagle Rock, Calif., also mentioned an offer of $40 worth of “medical-grade marijuana” as incentive for voting.

n the morning of Tuesday, Nov. 20, two Maui police officers arrested Thomas Russo, MauiTime’s owner and publisher, while he was attempting to film them with his cellphone camera during “Operation Recon,” a massive traffic enforcement operation carried out by the Maui PD during rush hour in which officers handed out pre-printed tickets to vehicles on Haleakala Highway exhibiting illegal window tinting, over-

sized tires, etc. The officers charged Russo with obstructing a government operation, harassment and resisting arrest.

“I stopped to find out why it was so important to back up traffic for miles,” Russo said after being released. “Social media was blowing up my phone, asking what was going on there. I wanted a report from the scene. I was arrested for filming and all other charges from the MPD are ridiculous. The police chose to arrest me in a direct attempt to stop the

documenting of their activities.”

MauiTime strives to report the news and not become the subject of the news.

Russo began filming the police officers carrying out Operation Recon as an act of journalism, not activism.

Of course, the filming of police officers in public places by citizens, though protected by the First Amendment of the U.S. Constitution, is controversial across the country. It’s especially provocative on a small island like Maui.

“Mr. Russo, no matter what you say, you should not have been there videotaping the traffic stop,” Lahaina resident and former Maui PD lieutenant Gordon Cockett emailed the paper shortly after we posted Russo’s video of the incident on our website. “I am a retired MPD officer and I would have arrested you to [sic] for the same offenses. Your media connections and credentials do not give you a waiver. Leave the police alone to do their work.”

Still, his opinion neatly encapsulates the apparent feeling of most Maui cops.

In fact, the courts have ruled repeatedly that citizens have a right to film police officers in the line of duty. When the State of Illinois took the novel approach of prosecuting a citizen for filming a cop by saying he’d violated the state’s wiretap law, the courts howled in protest. On Nov. 26, the U.S. Supreme Court itself ruled that Illinois prosecutors’ use of the wiretap law in this way violates the First Amendment guarantee of freedom of speech.

What’s more, we believe there is no more important journalistic task than scrutinizing the actions of law enforcement personnel during the course of their work. We believe public accountability of those issued firearms and instructed to use deadly force is a valued contribution to our community–especially given that Maui is such a small island and that state law protects police officers who’ve been sanctioned by Internal Affairs from having their names made public.

And we’re not alone in this belief.

“As a general rule, when in public spaces where you are lawfully present, you have the right to photograph anything that is in plain view,” said Dan Gluck, senior staff attorney for the American Civil Liberties Union Hawaii Chapter. “That includes pictures of federal buildings, transportation facilities and police. Such photography is a form of public oversight over the government and is important in a free society... The ACLU of Hawaii has received complaints from across the state regarding the right to videotape police officers, however, and we encourage individuals who feel that their right to document law enforcement interactions may have been violated to contact our office confidentially.”

Carlos Miller, a journalist who was prosecuted in Florida for filming a cop and who now runs the Photographyisnotacrime.com blog, watched Russo’s footage and posted it on his blog. His reaction was far less measured than Gluck’s.

“It shows the typical attitude that we see from cops all over the country,” he said.

“There’s no state where you don’t see that.

The first cop [in Russo’s footage] was cool.

He talked to him professionally. But the second cop was a complete contrast. They always throw in this obstruction charge.

And as just about every news story on Russo’s arrest has noted, this isn’t the first time Russo has run into trouble trying to film Maui police officers. On April 12, 2011, Russo attempted to film members of Duane “Dog the Bounty Hunter” Chapman shoot an episode for his then-still airing cable TV show. After being struck by one of Chapman’s security guys, Russo called the police. But when Russo tried to film Maui Police Officer Nelson Johnson, Johnson then struck Russo repeatedly.

The Maui PD statement on Russo’s arrest was also unusual. It starts out talking up Operation Recon, but the vast majority deals with Russo. Immediately after hearing of the arrest, Mauitime sent Ibarra an email at 11:58am asking for an official statement. He called back three minutes later, seemingly surprised at the arrest. He asked again for the name of our publisher, and said he’d get back to us.

Ibarra didn’t send out a statement until nearly 4pm that day. He also emailed the statement to Maui County Police Commissioners, various police and county officials and nearly every reporter and editor in the state of Hawaii (including the late Maui News City Editor and columnist Ed Tanjii, who died two months ago). Ibarra also very helpfully included a copy of Russo’s booking photo with the press release–all courtesies the Maui PD doesn’t extend to every individual they arrest.

But by then, The Maui News–which had apparently received the MPD’s statement hours before the rest of the state’s media– posted its own story on their website.

In any case, Russo posted $3,000 bail shortly after his arrest. He’s scheduled to appear in Wailuku court on Thursday, Dec. 27 at 10:30am.

And as blogger Carlos Miller noted, regardless of what happens to Russo, the issue of citizens filming cops will not go away.

“Cops have got to get used to the fact that we all have cameras,” he said.

Wailea Kicks Off Its First Annual Wine and Food Festival

ith so much culinary talent concentrated in one spot, it’s about time for Wailea to hold their own Wine and Food Festival. The festival gets its wine knowledge from some of the best professional sommeliers in the business. They come with amazing careers in the wine industry, perfectly suited to sharing and tasting wine with the Wailea set. The event hopscotches through the resorts from The Fairmont Kea Lani, Grand Wailea, Wailea Beach Marriott and the Four Seasons Maui, each taking a turn at hosting some of the fabulous interactive wine “encounters.”

“We’re thrilled to bring this unique new experience to the residents and guests of Wailea Resort,” says Bud Pikrone, General Manager for the Wailea Resort Association.

The signature wining and dining festival event has to be the DaVine Experience on Saturday at 5:30pm. There will be more than 75 wines to taste as you roam the magnificent grounds of the Grand Wailea’s Oceanfront Reflections Pool Lawn. There you can taste Bev Gannon’s ribs, Alan Wong’s duck, Tylun Pang’s lobster tempura, Brian Etheredge’s pork cheek tortellini, and Michelle Fabiani’s red velvet cake. Sommeliers Fred Dame, Geoff Kruth, John Blazon, Jay Fletcher, Drew Hendricks, Andrew McNamara, Pat Okubo, Jason Smith and Joseph Spellman will be on hand to enlighten attendees on the wine. The evening also features live entertainment from SLAM and Soul Congress and a silent auction of art and other items, all proceeds of which will benefit the Maui Culinary Academy.

Those who want to immerse themselves in the team of sommeliers can check out the daily interactive seminars. Pinot zealots will get romanced by the most passionate pinots on Friday, and California’s wine country will divulge their newest secrets.

Saturday features a virtual tour of Italy through their exquisite wine, or you can sample three decades of Cabernet from some of California’s most coveted winer-

ies. On Sunday, it’s technique training with wine and cheese so you can learn how to make the most of your pairing skills. Both Friday and Sunday feature winemaker dinners at Nick’s Fishmarket, Capische?, Fairmont Kea Lani, Longhi’s Wailea, and the Four Seasons. These soirees offer an intimate and personal experience with pairings, and likely the winemakers themselves, so check the website for details.

The final culinary event “Grillin & Chillin’ - Where There’s Smoke There’s Wine” will be a laid back Sunday barbecue. Meat and wine will be celebrated in one of the oldest pairings on the planet.

Killing Them Softly ★★★★★ Rated R / 97 Min.

The key to any great gangster flick is to let the audience in, a quality that The Godfather and Goodfellas both have in common. Those films gave us a cluster of criminals who, despite their efficiently vile methods on the job, were family men and women who were flawed but recognizably, endearingly human. We root against them and admire them at the same time, cringing at their gangland tactics but wanting them to get away with it because, after all, they’re kind of likable.

Killing Them Softly keeps its audience on the outside looking in from start to finish, giving us no one to root for and resulting in a movie that is remarkably off putting, even for a crime film.

Brad Pitt plays Jackie, an “angel of death” sent to oversee a messy transaction between feuding mobsters, who have been at odds since one of their own (played by Ray Liotta) openly admitted to staging a robbery in his own establish-

ment. The story gets more convoluted and bloodier once Jackie steps in and takes control of an increasingly incompetent bunch of trigger happy psychopaths.

This is Pitt’s second film with director Andrew Dominik; their first was The Assassination of Jesse James by the Coward Robert Ford, a challenging, long, character-driven western that is one of my favorite films of the past ten years. I had high hopes for their follow-up, as Jesse James has some of Pitt’s best work as an actor and showcased a filmmaker with brilliant instincts.

This is a director’s movie, for better or worse, as Dominik takes chances and makes choices that ensure this isn’t like any other gangster film we’ve seen. The characters and the world around them appear to be rotting away, as this nightmarish world of The American Dream gone bad portrays every structure as crumbling, every hair style too greasy, and likely every filmgoer wanting to shower as soon as it ends. From the start, you have criminals casually discussing rape, the prostitutes they hire and waxing poetic about their methods of murder (the film’s title comes from a clunky monologue).
