Up In Smoke The latest attempt to set up a medical marijuana dispensary in Hawaii—more than ten years after the state legalized pot for medicinal use—was snuffed out in committee this week on Oahu.

When we spoke to him last month, East Maui Sen. Kalani English—who introduced the bill—claimed it had a “really good chance of passing.” He pointed out that it would generate needed revenue and give patients safe access to medicine. “I took this up because I saw people who were suffering, sometimes in the last months of their life,” he said.

Leave it to lawmakers to turn a winwin into a lose-lose. One of the sticking points, according to an AP dispatch, was whether the dispensary should sell to all eligible patients or only those with “serious ailments” like cancer and AIDS—the implication being that medical marijuana is merely a smokescreen for outright legalization.

Maybe it is. Maybe it’s time to have that conversation and finally end the nonsensical, costly, failed policy of prohibition. Maybe next year.

Councilmember Mike White (pictured) manages the Kaanapali Beach Hotel and was, until recently, a member of the

Maui Visitors Bureau board. He’s never made a secret of those ties, but when one of his first actions on the Council was to request more funding for MVB he raised some eyebrows—and sparked formal ethics complaints.

The complaints—filed by Kai Nishiki, White’s opponent for the Makawao-HaikuPaia seat, among others—were dismissed by the Board of Ethics this month. In a statement, White said the ruling affirmed the right of public officials “to draw upon their personal and professional experience” when making decisions. That echoes comments he made to us when we asked him about the issue in January. What some call a conflict of interest, White calls an asset.

Of course, the board’s decision isn’t just about White’s MVB proposal (which was eventually shot down). It’s about his entire tenure on the Council, and the fact that he’s been given permission to represent two groups: the visitor industry and his constituents. NEWS OF THE WEIRD HUNGRY FOR JUSTICE Fairness under the law might depend on whether a judge’s stomach is growling when he pronounces sentence, according to a study of 1,000 parole decisions during 50 courtroom days observed by students from Columbia University and Israel’s Ben Gurion University for an April journal article. The students found that, day after day, judges were increasingly stingy with parole as a morning or afternoon session wore on, but that dramatic spikes in generosity took effect immediately following lunch or a snack break. The lead researcher, Columbia professor Jonathan Levav, expressed satisfaction with the scholarship but disappointment “as a citizen” with the findings.

BAD DOG! Motorist Joel Dobrin, 32, was pulled over in a traffic stop in February in Moro, Oregon, and rushed to hide his alleged drug stash, which was in a sock.

However, his dog intercepted the sock for an impromptu game of dog-tug-of-war.

Dobrin won but lost his grip, and the sock flew out the driver’s window, right in front of the officer. Dobrin was cited, and later indicted, for drug possession.

BORDERLINE OFFENSIVE Recently, Owlchemy Labs, a Massachusetts technology company, announced plans to release an iPhone/iPad app, “Smuggle Truck,” a game in which players compete to drive a pickup full of illegals over rocky terrain from Mexico into the U.S. without too many passengers bouncing out. game “additions” include pregnant women giving birth enroute, and special “green cards” are awarded to winners. Apple rejected the app, and Owlchemy said it will alter the game to feature animals escaping from a forest.

FOR THE BIRDS The port town of Kumai, Borneo, consists of low-rise shops and houses serving a population of 20,000 but also many tall, windowless box buildings perforated with small holes. The structures are actually birdhouses, and the town’s chief industry is harvesting the nests of the hummingbirdlike swiftlet, constructed of its own saliva, which, properly processed, yields a sweettasting paste with alleged medicinal qualities, according to a January BBC News report.

Enemy Territory The birther conspiracy and the killing of Osama bin Laden have more in common than we’d like to admit

People took to the streets, hoisting American flags and joining in chants of, “U.S.A.!

U.S.A.!” Obama’s sagging approval rating immediately climbed, and even former President George W. Bush weighed in with a congratulatory phone call.

Suddenly, no one was talking about birth certificates. Yet the two events—the release of a document from the musty archives of the Hawaii Department of Health and the killing of a vilified Islamic radical in suburban Pakistan—were linked more closely than many realized.

Last month, Post—who teaches political psychology and recently co-authored a book titled Political Paranoia: The Psychopolitics of Hatred—penned an op-ed for The New York Times in which he compared the birther movement to McCarthyism. “A delusion is a fixed belief held in the presence of strong contradictory evidence,” wrote Post. “This is a hallmark of the paranoid, who suspects, without sufficient basis, that others are harming or deceiving him.”

On May 1, the President of the United States went on national television again, this time to announce that he had ordered the successful assassination of Osama bin Laden, the terrorist leader responsible for

release of Obama’s birth certificate but didn’t speak with him until the day after bin Laden’s death. Considering the wild accusations already whizzing around the blogosphere (Osama lives! Osama was already dead!) it was impossible not to connect the two events, though our conversation focused mostly on conspiracy theories in general.

“We’ve had conspiracy theories throughout history—there’s something appealing to those who feel powerless about having a powerful person identified as the enemy conspiring against them,” said Post. Conspiracies often arise, he said, during difficult socio-economic times, and

n April 27, 2011, the President of the United States went on national television to show the world his long-form birth certificate. He did it more than three years after taking office, and many months after releasing his slightly-less-detailed certificate of live birth.

“We don’t have time for this silliness,” he proclaimed. “We’ve got better stuff to do.”

Apparently, not everyone does. Not Donald Trump, the reality star/Republican presidential candidate who helped elevate the “birther” movement from fringe distraction to news-cycle-dominating pseudo-controversy. Not FOX News and the right-wing spin machine, which walked the delicate line between embracing the crackpots and holding them at arm’s length, allowing the issue to fester while keeping their hands clean.

“I take the president at his word” became code for “I won’t say it—but you can.”

And even after the release of the long-from certificate—which clearly and unequivocally states that Barack Hussein Obama II was born at 7:24pm on August 4, 1961, at Kapiolani Maternity & Gynecological

“It can become almost a psychological epidemic,” said Post, “and it becomes very difficult to stand up to it, because it’s comforting to have an outside explanation for your troubles. Much better to believe it’s them or him that is the problem—so that it becomes, in a sense, a moral imperative to strike back. Part of what a hate-mongering leader can do with a paranoid belief is use that to justify this righteous hatred of a particular group.”

Post never went this far—and in fact shied away from discussing any specific political figures except in the broadest terms—but it was impossible to listen to his words and not think about America’s bloody, open-ended war on terrorism. It isn’t a conspiracy theory per se, but it’s certainly a manifestation of The Other as faceless enemy, born out of turmoil and fed by lingering fear.

England slowly slumped into postindustrial decline for two decades.

Then came the ‘90s. The economy improved, the Labor Party and Tony Blair took over, Manchester United won their first title since 1967 and Oasis became the band of the decade with (What’s the Story) Morning Glory?

The album is brimming with familiar singles: “Wonderwall,” “Champagne Supernova,” and the best song, “Don’t Look Back in Anger.” Morning Glory blossoms with the elements of British pop music, from the melancholic violins of the Rolling Stone’s “Ruby Tuesday” to the tambourines and jangling guitars of the Hollies to the tinkling piano of John Lennon’s “Imagine.” Another common thread is frontman Noel Gallagher’s notorious arrogance. In “Don’t Look Back in Anger,” he warns “please don’t put your life in the hands, of a rock n’ roll band/And will throw it all away.” Gallagher’s nasal voice and Mancunian accent is eerily similar to Lennon’s Liverpudlian; the similarity, however, did not justify his claim that Oasis was better than the Beatles.

And Gallagher’s arrogance proved destructive, as the band peaked with this album before devolving into pointless feuds and drug addiction. By that point, the ‘90s were wrapping up, England slipped into two unpopular wars—dragging Tony Blair down with them—the economy tanked again and Manchester United fell into crushing debt. The new century had begun.

W

e were in danger of becoming strictly nostalgia, so it’s been great to feel like we’re a band again,” says Glen Philips, frontman of Toad the Wet Sprocket.

Though they officially disbanded in 1998, none of the group’s four members (Philips, bassist Dean Dinning, drummer Randy Guss and guitarist Todd Nichols) stopped pursuing music. Toad began “tentatively” playing out a few years ago (their Web site tagline is “quality music on and off since 1986”), and recently reformed to hit the road with earnest. Now that they’re touring and writing new music, Philips says ,“it’s not all about the past.”

Paying homage to British phenom Monty Python, the band’s name references a sketch that lists what Philips calls, “really ridiculous band names [where] Toad the Wet Sprocket was basically the worst of them all.” He says the band had a gig—but didn’t have a name—and “figured it be hilarious to see [Toad] in print and have it be us. So it was kind of a joke that went on too long.” The band then made it big “right out of [high] school,” signing with Sony’s Columbia Records “almost by accident,” according to Philips.

“We had an extraordinary experience. I feel like we worked really hard for it [and] had a commitment to make great music, but none of us were expecting we were going to be able to do this for a living.” Philips says he came from a “quiet, academic family,” and that the band’s “plan was to go through that summer then break up and I was going to go away to college. The next thing we knew we were signed to Sony and going on tour.”

Their early ’90s chart toppers like “All I Want” and “Walk on the Ocean”—plus songs on the soundtracks to Buffy the Vampire Slayer and Mike Myers’s So I Married an Axe Murderer, among others— helped earn the band two RIAA-certified platinum albums (1991’s Fear and 1994’s Dulcinea), and a dedicated fan base.

Soon after the release of their fifth studio album, Coil, in 1997, Toad disbanded.

“When we broke up, we had really good

reasons to stop playing together,” says Philips.

“What I tend to say is any band, given long enough, will turn into Spinal Tap. Watch any episode of VH1’s Behind the Music and it’s all the same crap. We had our own variation.

We just needed to have some time to back up and grow up and get some perspective, basically. In the last couple years we started having a really good time playing music together and started to have the weight of history stop burdening us so heavily. Once we were able to enjoy it more, we were able to do more of it. It was pretty simple.”

What’s less simple is the music industry that Toad has returned to. “The industry is headed off a cliff—which is fine,” says Philips. “Certainly there aren’t going to be many killings made. That will be left to Lady Gaga and those who are more about branding, and make music in the process of making their branding work.”

Overall, Philips says, the music business has “grown up, adapted, messed up and now it’s going to turn into something else. People

are going to have to be more creative.”

But Philips doesn’t let consumers off the hook. “It used to be that downloading on Napster was sticking it to the man,” he says. “I think audiences have to remember that this is somebody’s livelihood. Now, the man is just the band. I think people need to take a long, hard look at their iPods and ask themselves if they’re helping these musicians out.”

In the end, the game may have changed, but Philips says performing still carries the same thrill. “It’s nice to have being doing it for this long and still have most of the audience know the album tracks—not just one or two singles and everybody goes home,” he says. “There are few people who only really got into us from the radio. WHY IT WILL ROCK: Written and directed by elusive genius Terrence Malick, one of the greatest filmmakers alive. The trailer has been giving audiences chicken skin.

UNLESS: This was originally filmed years ago and has been pushed back multiple times. Is that a red flag, or simply Malick being Malick?

BEST CASE SCENARIO: Another Malick masterpiece.

his year’s crop of would be summer blockbusters features the usual assortment of old friends—if you consider Captain Jack Sparrow and Papa Smurf friends—sequels, remakes and comic-book adaptations. From Cars 2 to Transformers 3 to Spy Kids 4 to Final Destination 5, Hollywood is once again betting you’ll pay to see movies with numbers in the title.

Here are ten of the most intriguing flicks from a loud-but-potentially-fun bunch.

X-Men First Class (June 3) THE GIST: Prequel starring Michael Fassbinder and Jennifer Laurence.

WHY IT WILL ROCK: A promising attempt to reboot and revive the mutant franchise.

UNLESS: X-Men simply doesn’t work without the original cast, including Bryan Singer, Patrick Stewart and Hugh Jackman.

BEST CASE SCENARIO: X-Men: Preschool gets the green light.

Thor (May 6) THE GIST: Godly comic-book epic starring relative unknown Chris Hemsworth.

WHY IT WILL ROCK: Directed by visual wizard and Shakespearen legend Kenneth Branaugh, co-stars post-Oscar Natalie Portman and Sir Anthony Hopkins.

UNLESS: This character is silly even by superhero standards.

BEST CASE SCENARIO: When it comes to superheroes, there’s no such thing as too silly.

2 Super 8 (June 10) THE GIST: A top secret sci-fi thriller, written and directed by J.J. Abrams.

WHY IT WILL ROCK: Abrams is aiming for a Spielberg-like mix of explosions and whimsy—and Spielberg is on board as a producer.

UNLESS: The secrecy and lack of big stars cause it to get lost in a sea of sequels.

BEST CASE SCENARIO: Abrams is no longer known as the guy who created Felicity.

Bridesmaids (May 13) THE GIST: Rowdy comedy starring Kristin Wiig (who also co-wrote), Rose Byrne and Jon Hamm.

WHY IT WILL ROCK: Looks raunchy and funny enough to be this year’s The Hangover (even as it competes against The Hangover Part II).

UNLESS: It winds up more like the hideous Bride Wars and audiences ditch it at the altar.

BEST CASE SCENARIO: Women finally get their own iconic gross-out comedy.

Conan O’Brien Can’t Stop (June 24) THE GIST: Documentary about O’Brien’s summer tour following his Tonight Show debacle.

WHY IT WILL ROCK: A funny and revealing look at the late-night meltdown that spawned a million “Coco” posters.

UNLESS: It can’t dodge the question: why should we pay for something we can see for free every night?

The Tree of Life (May 27) THE GIST: Highly secretive historical 2

Larry Crowne (July 1) THE GIST: Romantic Comedy starring Tom Hanks (who also directed) and Julia Roberts.

WHY IT WILL ROCK: Two big stars, and a return for Hanks to the Sleepless In Seattle genre.

UNLESS: The Hanks/Roberts team-up didn’t lure audiences to Charlie Wilson’s War, which tanked.

BEST CASE SCENARIO: Hanks won’t have to resort to a Bosom Buddies reunion special.

Cowboys and Aliens (July 29) THE GIST: Sci-Fi Adventure starring Harrison Ford and Daniel Craig, from Iron Man director Jon Favreau.

WHY IT WILL ROCK: A genre mash-up featuring James Bond and Indiana Jones?

How can it miss?

UNLESS: The last time we got a sci-fi Western, it was Wild Wild West.

BEST CASE SCENARIO: Fanboys worldwide glue cowboy hats onto their Han Solo action figures.

Rise of the Planet of the Apes (August 5) 3

THE GIST: Sci-fi prequel starring James Franco, Frieda Pinto and Andy Serkis.

WHY IT WILL ROCK: The studio, which nicknamed it Ape-etar, is big on it. Looks nothing like the much-hated 2001 Tim Burton remake.

UNLESS: Considering it’s a prequel to a half dozen movies, the ending is a given.

BEST CASE SCENARIO: Damn dirty apes are hot once again.

Fright Night (August 19) THE GIST: Shot-in-3-D remake of the 1985 horror classic, stars Anton Yelchin, Colin Farrell and Toni Collete.

WHY IT WILL ROCK: Farrell’s performance is what got him the lead in next summer’s Total Recall remake. Director Jim Gillespie also made the wonderful Lars and the Real Girl.

UNLESS: It’s another crappy remake of a good horror movie.

take a deep, preventative breath and try not to jam the drumstick in my eye socket.

I squish my face in an effort to focus and tell myself, â&#x20AC;&#x153;Itâ&#x20AC;&#x2122;s.

Just. Two. Beats. Thatâ&#x20AC;&#x2122;s it.â&#x20AC;?

Boom boom. Boom boom.

Boom boom. Boom boom. â&#x20AC;&#x153;Like a heartbeat,â&#x20AC;? I whisper, self-coaching. â&#x20AC;&#x153;I have a heartbeat. So how hard can it be?â&#x20AC;? Still, I canâ&#x20AC;&#x2122;t seem to keep the repetitious boom booms up long enough to not ruin the song for everyone else in the class. â&#x20AC;&#x153;I see you wincing over there,â&#x20AC;?

Gandalf tells me with an encouraging smile. A ďŹ rst timer, Iâ&#x20AC;&#x2122;m sitting in his West African drumming workshop in Makawao and weâ&#x20AC;&#x2122;re practicing a seven-part song called â&#x20AC;&#x153;Yankadi,â&#x20AC;? a tribal line dance with lyrics about love.

I try to explain to Gandalf that, though my face is capable of little more than a series of grimaces, it doesnâ&#x20AC;&#x2122;t mean Iâ&#x20AC;&#x2122;m not having fun.

Because despite urges to impale myself for the sake of the class at large, I am indeed enjoying it.

See, itâ&#x20AC;&#x2122;s May andâ&#x20AC;&#x201D;needless to sayâ&#x20AC;&#x201D;I havenâ&#x20AC;&#x2122;t done diddly regarding my overly ambitious New Yearâ&#x20AC;&#x2122;s resolution (dabbling with a different instrument each month, for those who arenâ&#x20AC;&#x2122;t frequent readers). So when a humble green ďŹ&#x201A;yer advertising â&#x20AC;&#x153;African Drumming Workshops with Gandalfâ&#x20AC;? crossed my path, I couldnâ&#x20AC;&#x2122;t resist.

Besides, what better inaugural instruments than the djembe (pronounced â&#x20AC;&#x153;jem-bayâ&#x20AC;?) and dunun (doon-oon), taught by a man known as â&#x20AC;&#x153;Gandalf the Drum Doctorâ&#x20AC;? (who actually looks like J. R. R. Tolkeinâ&#x20AC;&#x2122;s LOTR character, if he were to trade his Elven cloak and pointy hat for a dashiki and khaki shorts)? And all in an open-air makeshift classroom in the 10,000 square-foot nursery of the lush Sacred Garden of Maliko? Sold!

The weekly class costs $15, but when Monday nightâ&#x20AC;&#x2122;s thunder fails to mask my inherent lack of rhythm, I begin to feel I owe my classmates a couple bucks, too, for having mucked up their lesson.

Gandalf is a patient and practiced teacher, and later explains that weâ&#x20AC;&#x2122;re learning songs that are both polyrhythmic and polymetric. â&#x20AC;&#x153;It sounds harder than it is,â&#x20AC;? he says. â&#x20AC;&#x153;The complexity arises from the combination of its parts being shared and created between the players. For the Africans, that challenge is the fun of it.â&#x20AC;?

But the most striking thing about my introduction to drumming is how

analogous my ineptitude in playing is to my foibles in life. Sure, I might approach everything sedulously, but I still end up sucking. My execution is always a moment too late or a moment too soon. My hands sometimes linger on the goatskin drumhead so that tones are muddled and the next beat fuddled. And if my attention wavers in the slightest, everything falls ďŹ&#x201A;at. â&#x20AC;&#x153;Just relax,â&#x20AC;? Gandalf says, bouncing. â&#x20AC;&#x153;Sometimes, it helps to dance.â&#x20AC;?

So I dance. Feeling myself move, I know I am worse at dancing than I am the djembe and dunun. But Gandalf is rightâ&#x20AC;&#x201D;dancing does helps.

The storm is subsiding, but the plaintive rumbling in the heavens makes me feel small. I decide to let go of ego and worry and wince, to take another breath and try again.

Boom boom. Boom boom. Boom boom. Boom boom. (Gasp! Iâ&#x20AC;&#x2122;m doing it!) Boom boom. Boom boom. Boom boom. Boom boom. (Huzzah!) With me ďŹ nally on track, my classmates can more easily fall into their unique rhythms and Gandalf augments it all with a syncopated solo.

Boom boom. Boom boom. Boom boom. Boom boom.

And then, itâ&#x20AC;&#x2122;s over. We move clockwise to assume a station at the next drum, learn the next part and try to all jive again. With each new round, the rhythm is a little harder and a little easier all at once.

Itâ&#x20AC;&#x2122;s simultaneously depressing and invigorating, but I am no longer grimacingâ&#x20AC;&#x201D;Iâ&#x20AC;&#x2122;m grinning.

This may not always be clear-cut, so those you consider your friends and allies should help you determine just where that line is, and help you fight the good fight if and when it’s violated.

Sometimes you remind me of an oldschool Western medical doctor, addressing each symptom of a problem as it arises (and the symptoms resulting from the “solutions” you’ve implemented), instead of trying to simply discover the root of the problem and nip that cleanly in the bud. The problem(s) before you, while currently occupying an inordinate amount of mental real estate, have one simple, quick solution, which will become obvious to you if you can take about ten steps back to have a gander at the much bigger picture. The real question is: Can you do that? If not, what’s stopping you?

CAPRICORN (DEC. 22-JAN. 19) When a problem is entirely in your head, it can still sometimes be very difficult to distinguish from real difficulties imposed on you from the outside world; it seems just as tangible, daunting, and misery-inducing. And sometimes your lack of leverage can make it even harder to deal with successfully.

This is when you ask for help—something most Capricorns despise doing. Barking orders or making unreasonable demands won’t work out too well, so resist the urge to save face by trying those tactics. Instead, humbly and honestly ask for the help you’ll need—you’ll almost certainly get it.

LEO (JULY 23-AUG. 22) People are allowed to change their minds—they have to be, since they’ll do it whether they’re allowed to or not. It would be nice if they could have figured things out before they’d gone so far (leaving someone at the altar is the extreme case of such a scenario), but sometimes they’re simply unable to wrap their heads around a situation until it’s truly upon them. This can be confounding to Leos, who rarely have such difficulty and are generally forthright about their state of mind. You can’t impart this decisiveness on others, so unfortunately you have to deal with their freaky, changeable minds. In the end, don’t waste energy wishing you could change them—it’s too late for that, even if you could. What happens, or has happened, is completely out of your hands— the only thing you can control is how you react to it.

AQUARIUS (JAN. 20-FEB. 18) In this case, the best place to live might lie outside of your comfort zone. In other words, you’re house-hunting in completely the wrong neighborhood! Exceptions to rules are frequently fantastic because they’re just that—exceptional.

By not considering them, you’re severely limiting your options, and perhaps depriving yourself (and others) of tremendous happiness. It’s time to broaden your horizons, think outside the box, and contemplate scenarios you haven’t dared to imagine before. Most of those might be ridiculous pipe dreams—but one is likely to work out beautifully, and you’ll never know which until you give them a go.

LIBRA (SEPT. 23-OCT. 22) Stuff is just stuff. While I’m sure you realize that rationally, coming to terms with it emotionally is sometimes more challenging, particularly when the material objects in question were gifts or inheritances or otherwise infused with sentimental nostalgia. While their worth to you defies monetary assessment, try to recognize that 99 percent of that value lies inside your head, and can’t be taken away, even if the object is lost, stolen, or destroyed. Sure the item is gone or ruined, but its real value is still intact, inside your head. Try to keep that in mind before you fly off the handle.

SAGITTARIUS (NOV. 22-DEC.21) You can’t control how people react to situations. Even though you tend to approach life with a direct, honest, mostly positive approach, you’ve probably noticed that some people are determined to see the worst in others, convinced the world is “out to get them,” positive that anything that can go wrong, will—or all of the above.

While it’s admirable that you try to help such cynical souls, sometimes it’s best to recognize that their habits are so ingrained that any conflicting perspectives you try to point out to them will be counted as unusual exceptions to the rule, and not the way things are.

CANCER (JUNE 21-JULY 22) It’s kind of you to be respectful of someone else’s emotional state (not inviting his/her recent ex to a party, for example).
