Capt R Venkat, Chairman of the Associa on of Mari me Industry Consultants and Independent Experts (AMICIE), expressed his gra tude to all dignitaries and par cipants for a ending the seminar on a Saturday evening He emphasized the purpose of the gathering to discuss construc ve ideas for improving the mari me industry and to prepare a memorandum for submission to decisionmakers.
The seminar was organized by Capt. Suri Pullat, AMICIE's Founder Chairman, who leveraged his network to bring the eventtoMumbai.Althoughaculturalprogramhadalsobeen planned, it was cancelled due to unforeseen circumstances. Capt. Venkat acknowledged the efforts of Kamal Chadha, whoplayedakeyroleinorganizingtheeventbutwasunable toa endduetoinjury
He stated that welfare should not be limited to salaries or shipboardcondi ons,butmustincludetheen reecosystem surrounding a seafarer's professional and personal life—whether on board, ashore, during emergencies, or post-re rement. He stressed the importance of crea ng a robust support structure for seafarers, especially in cases of accidents,abandonment,orrepatria on.
AMICIE was founded eight years ago with the aim of providing professional insights into mari me policies and systems Capt Venkat highlighted the importance of speakingout—especiallyonma ersinvolvinggovernments, administra ons, and flag states rather than remaining silent. He clarified that AMICIE does not interfere in private business opera ons but acts as a think tank, consultant, and advocateforsystemicimprovements.
Despite challenges, the associa on has grown to include 40–50 professionals across the globe. The panel discussion tled “Mariners' Woes and Welfare” wasinauguratedbyCaptVenkat,whoopenedthesessionby underlining the comprehensive nature of seafarer welfare.
Capt Venkat referenced a posi ve example involving Capt Tandon'scompany,whichstoodfirmlybehinditscrewduring the MT Hebei Spirit incident The company not only managed the legal and logis cal challenges but also ensured the crew and their families were fully supported—se ng a benchmark for best prac ces in seafarer welfare. Venkat emphasized that while such private ini a ves are commendable, not all companies operate at the same ethical standard, making it crucial to discuss and document welfarechallengesandrecommendac onablesolu ons.
Taking over, Capt Tandon provided an in-depth perspec ve on the prac cal and structural challenges of ensuring seafarer welfare in today's fragmented shipping industry He pointed out the disjointed nature of ownership and management in interna onal shipping—where the principal employer, beneficial owner, manager, and crew may be spread across mul ple countries. This complexity, coupled with the contractual nature of employment, makes the
establishmentofminimumwelfarestandardscri cal.
Capt Tandon highlighted the role of the (MLC), which mandates these standards globally He acknowledged that while good employers naturally uphold these prac ces, the industry is o en judged by the lowest common denominator—operators who neglect or exploit seafarers. This has resulted in nega ve publicityandreputa onaldamageforthemari mesector.
He also pointed out the common misconcep on that the government or regulatory bodies are not doing enough for seafarers, especially through the Seafarers Welfare Fund Society(SWFS).CaptTandon clarifiedthateightcomprehensive welfare schemes have been in place since 2016, developed under MLC guidelines, and that more effort is needed in informa ondissemina on.Whiletheseschemesareaccessible on the Directorate General of Shipping's website and are now being shared through industry bodies like FOSMA and MASSA, seafarers o en remain unaware of the benefits available to them.
India,henoted,isamongthefewcountriesprovidingprovident fund and gratuity benefits to seafarers on na onal flags and, in many cases, voluntarily on foreign-flagged vessels through bilateral arrangements. However, a coordinated industry effort is needed to bring all operators on board and ensure that substandardprac cesareeliminated.
One key concern raised by Capt Tandon was individual accountability.Heemphasizedthatseafarersmustalsoexercise their duty of care —both when signing contracts and while on board. Many abandonment cases involve seafarers who joined vessels illegally or outside the Registered Recruitment and Placement Service (RPS) framework, o en on tourist visas through informal channels. These individuals o en become vulnerableandhavelimitedrecoursewhenproblemsarise. He urged seafarers to verify their employers, contracts, and recruitment channels before accep ng jobs. Addi onally, if issues such as non-payment of wages arise, they must be proac veandvocalfromtheoutset,ratherthanwai ngseveral monthsinsilencebeforeseekinghelp.

Sharing a personal anecdote, Capt Halbe recalled an emo onal moment at a recent MASSA general body mee ng, where a former crew member reminded him of a though ul gesture fromover15yearsago.Whiletheseafarerwasawayatsea,Capt Halbehadreachedouttohispregnantwifetocheckonherwellbeing a gesture s ll remembered by the family He emphasized that such acts, though small, are deeply impac ul and represent the human side of seafarer welfare. However, he admi ed that such personal outreach is difficult to scale industry-wide, reinforcing the need for systemic welfare mechanisms.
Addressing the growing issue of abandoned seafarers, Capt Halbe pointed out that responsibili es for repatria on are clearly outlined under the Mari me Labour Conven on (MLC), yet in prac ce, both flag and port states o en fail to meet their obliga ons. He noted that while it is easy to hold Recruitment and Placement Services (RPS) accountable, they are o en the last link in a much larger and more complex chain of responsibility
In response to this global issue, MASSA proposed an innova ve solu on inspired by the Interna onal Oil Pollu on Compensa on (IOPC) Fund. He suggested the establishment of a Global Abandonment Repatria on Fund, to be contributed to by major flag states such as Panama, Liberia, and Malta. A nominal per-ship fee could be pooled under an interna onal body like the ILO This fund could be used to cover emergency repatria on costs, which are o en minimal compared to the suffering and delay experienced by abandoned seafarers. The idea has garnered verbal support from the Interna onal Chamber of Shipping (ICS), though many stakeholders remain scep cal—notbecausetheideaisflawed,butpossiblybecause itcouldactuallywork.

In conclusion, Capt Tandon reiterated that while government and industry efforts are ongoing, solving mariner welfare issues requires shared responsibility —from regulators, employers, unions, and the seafarers themselves Only through a collabora ve and transparent ecosystem can the welfare and dignityofseafarersbetrulyprotectedandimproved.

Despite India's progress under the FAL Conven on and the Mari me Single Window System, access to shore leave remains inconsistent and unclear across Indian ports. He called for transparency and uniformity, star ng with a simple measure: publicly lis ng shore leave status for each port on their respec ve websites. He noted that while some seafarers can go ashore in one port, others on the
same ship may be denied in another, leading to frustra on andconfusion.
Capt. Halbe concluded by reitera ng the need for structural reforms backed by accountability and transparency. He encouraged all stakeholders to think beyond tradi onal silos and to work together toward prac cal, scalable solu ons for improvingthelivesandrightsofIndianseafarers.
Capt Venkat provided an important update regarding the ongoingissueofTaxDeductedatSource(TDS)deduc onsfor Indian seafarers. During a recent Zoom mee ng with the Central Board of Direct Taxes (CBDT) officials in Delhi, concerns were raised over the high 30% TDS being levied. In collabora onwiththeseafarers'union,aformalrequestwas submi ed to reduce the rate to 5%, which has reportedly been taken seriously by the authori es. Efforts are ongoing, andstakeholdersremainhopefulforafavourableoutcome.
Capt Venkat also shared a light anecdote about oral examina ons from his me, highligh ng the seriousness with which surveyors approached the process. A fellow candidate,unpreparedanda emp ngtoskiptheexam,was failed a er a full 45-minute session underscoring the discipline expected in professional assessments. The story served as a reminder of the need for preparedness and respectinthecer fica onprocess.
CaptMohanNaikdeliveredacomprehensiveaddressonthe ongoing efforts to promote seafarers' welfare. He acknowledged Capt. Venkat, Capt. Pullat, and the organizing teamforhos ngadedicatedseminaronthisvitaltopic.
Wearing mul ple hats, Capt. Naik presented perspec ves fromthreesignificantroles:
detailed the organiza on's ini a ves, including the establishment of the JNPA Seafarers' Club in 2014, with expanded services and a dedicated chaplain offering spiritual and emo onal support. Mission to Seafarers also has a presence in Tu corin, Haldia, and is expanding to Mangalore and Goa. It ac vely supports seafarers facing abandonment, working with government and agencies for theirsaferepatria on.
In conclusion, Capt Naik reaffirmed a con nued commitmenttoexploringnewavenuesforsafeguardingand enhancing the welfare of seafarers, especially in cases involvingcriminaliza on.
Capt Savio Ramos, a seasoned Master Mariner, addressed the gathering with insights drawn from his firsthand experience at sea. He highlighted three cri cal challenges affec ngIndianseafarerstoday: abandonmentofseafarers, denial of shore leave, and difficul es in sign-off at Indian ports.
On abandonment, Capt Ramos referred to alarming data indica ng over 800 cases annually, no ng that the scale of the problem demands the crea on of a dedicated nodal agency While the Directorate General of Shipping (DG Shipping) has intervened in select cases, many seafarers are le without ins tu onal support—par cularly those who join vessels through irregular or unauthorized channels. He cited the ongoing case in Senegal, where Indian seafarers have been imprisoned for nearly five years without concrete evidence in a drug-related case. Despite mul ple efforts, including outreach to the Ministry of External Affairs, resolu onremainselusive.
• As Managing Director of Dynacom Tankers, which manages a fleet of over 150 vessels, he highlighted various in-house welfare measures. These include family insurance coverage (even during leave), onboard internet access, examina on incen ves, and rejoining bonuses—ini a ves aimedatimprovingthequalityoflifeforseafarers.
• As Deputy Chairman and former Secretary General of CMMI, Capt Naik emphasized CMMI's ac ve role in suppor ng seafarers facing abandonment or legal issues. Notable cases included assis ng officers detained in South Korea and those incarcerated following the MV Tosa–Lena Rosa collision in the South China Sea. Through legal aid and interna onal coordina on, CMMI played a pivotal role in securing their release. He also recognized fellow CMMI members present, including Capt. Philip Ma hew and Capt. Halbe.

Thesecondissueheaddressedwasthedenialofshoreleave, par cularly in Indian ports. Lastly, Capt Ramos raised concerns about sign-off restric ons at Indian ports, ci ng an incident in Gujarat where Indian crew could not disembark due to the absence of immigra on officers. Such logis cal hurdles contravene MLCrights,especiallywhencontractsarecomplete.
Capt Ramos concluded by urging stronger support from government agencies, DG Shipping, and industry stakeholders to address these persistent issues, stressing thatunionsalonecannotresolvethem.

inIndianshippingandmari mepolicy,deliveredacandidand insigh ul address at the seminar Reflec ng on key developments, he acknowledged the successful enactment oftheMerchantShippingAct,2025,whichhaditsearlydra s presentedduringa2017consulta onattheCMMIoffice.
Drawing from his involvement in wage nego a ons for INSA, MUI, and NMB agreements, Capt Ma hews highlighted the persistent issue of taxa on on Indian seafarers He emphasized that despite decades of discussions, there has been no progress on tax relief, which con nues to raise opera onal costs for Indian shipping companies due to the need to gross up wages This, in turn, affects the compe venessandqualityofIndian-flaggedvessels.
He expressed serious concern over the RPSL licensing framework, ques oning how many substandard or unaccountable agents con nue to operate, contribu ng to the high number of abandoned seafarer cases (noted at over 860). He pointed out that reputable companies rarely face such incidents, indica ng systemic lapses in licensing and enforcement.
On the shortage of senior officers, Capt Ma hews noted the need to revamp the examina on and training system, par cularly for orals and wri en exams. He observed widespread misuse of exam slots, with many candidates failing to show up, leading to inefficiencies and delays. He welcomed the Nau cal Wing's move to start structured oral coachingthroughCMMI.
Dr Mankad stressed that this culture of underrepor ng and forced compliance not only violates regula ons but also has serious implica ons for seafarer health and safety The longterm effects of fa gue, disrupted sleep cycles, and chronic stress were noted as key concerns that con nue to go unaddressedinmanyopera onalenvironments.
In conclusion, she called for honest dialogue and systemic change, urging all stakeholders shipping companies, regulators, and unions — to move beyond paper compliance and create a work environment where seafarers' health and well-beingaregenuinelypriori zed.
Capt.PankajKapooremphasizedthepressingrequirementof ins tu ng legal assistance coverage for mariners, substan a ng his point with specific examples, and further deliberated upon the modali es of implementa on with Mr Savios of MUI The panel members were in consensus regarding the development of a group policy in this regard, and Capt. Tandon assured his support by leveraging his establishedinterna onalcontacts.

Dr Deep Mankad, speaking candidly at the seminar on seafarer welfare, addressed a cri cal issue o en discussed behind closed doors — the non-compliance with mandated rest hours on board ships While acknowledging the existence of interna onal regula ons governing work and resthours,sheemphasizedthattheseare,inmanycases,not beinggenuinelyimplemented.
She highlighted that although documenta on may show compliance, the reality on many vessels is different. Officers areo enasked—eitherdirectlyorindirectly—to“adjust”or “tweak”resthourrecordstoalignwithopera onaldemands. “Let'sfaceit,”shesaid,“thishappens.Companiessome mes ask officers to understand the situa on and make changes. So, while the paperwork may look clean, the physical and mentaltollonseafarersisreal.”
These sessions addressed recent mari me disasters along the Indian coast, with a focus on systemic issues, regulatory gaps, and the need for coordinated disaster response mechanisms. Before diving into the core theme, Capt Suresh Amirapu an industry veteran from the port sector—highlighted cri cal issues affec ng Indian seafarers, par cularlyimmigra onchallengesatnon-ECPports.
He explained that unless a port is declared an Immigra on
Check Post (ECP) by the Ministry of Home Affairs, immigra on services including sign-on and signoff cannot be facilitated. This bureaucra c gap o en leaves seafarers stranded. The speaker proposed that ECP clearance must become mandatory for all new ports, and linkedtoboththeenvironmentalclearanceandcomple on cer ficate processes to ensure seafarer access and regulatorycompliancefromincep on.
Shi ing to the main topic, the speaker acknowledged that while shipping remains one of the safest and most environmentally efficient modes of transport, disasters are inevitable due to the harsh marine environment. Capt Pullat emphasized the need for DG Shipping to take a proac ve lead in establishing a mari me disaster response system. He pointed to upcoming content in an e-magazine being released soon, which will provide in-depth insights andexpertanalysisonthesubject.
In closing, he proposed moving directly to Session 4 (Modern Legal Frameworks) with legal expert Capt Pankaj Kapoor, as some shipowners had yet to arrive. The session would then conclude with remarks from Capt. Venkat on buildingasystema cwayforward.

Addressing the core topic, Capt Pullat underlined a cri cal issue: India lacks a structured and coordinated response mechanism for mari me disasters, despite the existence of comprehensive interna onal frameworks like SOLAS, MARPOL, and related IMO conven ons. In recent highprofile incidents off the Indian coast, there was no central authorityeffec velymobilizingrescue,pollu oncontrol,or salvage opera ons. This results in confusion, delayed responses,and avoidabledamagetolife,environment,and
He highlighted several major mari me accidents — MT NewDiamond,MVExpressPearl,andMVWakashio—allof which demonstrated systemic failures in monitoring, coordina on, and response. Par cularly in the Wakashio grounding, Capt Kapoor ques oned how a ship could alter course and dri off-course for four days without detec on, despite mul ple layers of watchkeeping, company oversight,andcoastalsurveillance.Hesuggestedthismight notbemerenaviga onalerrorbutpossiblyGPSspoofingor cyber interference, which he warned is the next major threattoglobalshipping.
He cited another example involving USS An etam, a U.S. Navy ship suspected of GPS hacking before grounding near China—thoughnotofficiallyacknowledged.
In discussing Wan Hai's fire incident off the Indian coast, Capt Kapoor pointed out the issue of undeclared containers, possible external interference, and lack of consigneetraceability These,hestressed,representgapsin portsecurityandcargotransparency

Ms.Trip Sharma,represen ngBoseMitra&Co.,discussed recent mari me legisla ve reforms, notably the Merchant Shipping Act 2025, the Bills of Lading Act, COGSA, and the upcoming Coastal Trading Act. While acknowledging the moderniza on intent, she expressed concern over the superficial nature of updates. The Bills of Lading Act, now rewri en a er 169 years, remains largely unchanged, lacking clarity on key issues like lawful holders, bank rights, and e-Bills of Lading. Similarly, the new COGSA merely revises language without addressing current trading challenges or introducing substan ve reforms. Both Acts grant the government rule-making powers, but provide no guidance on implementa on The Coastal Trading Act, replacing Sec ons 406–407 of the Merchant Shipping Act, introduces licensing clarity, eases requirements for Indian vessels, and emphasizes controlled cabotage. However, like the 2025 Merchant Shipping Act, it awaits implementa on.

Drawing on insights from a recent INMEX session he moderated, Mr Birwadkar outlined challenges faced by vendors. Key among them is the lack of volume-based demand, which prevents economies of scale. Vendors also face high customs du es and levies, making locally built machinery less compe ve compared to imports. Despite having the human resources and technical capabili es, manufacturers are dependent on imported components, especially in areas like electrical automa on and PCB manufacturing.
He pointed out that unless local manufacturing of cri cal components is incen vized and customs issues resolved, Indian-built ships will remain costlier than Chinese or SoutheastAsiancounterparts,dissuadingbuyers.
Sharing a case study from his me at Great Eastern, Mr Birwadkar recounted the company's experience of building anchor handling vessels at Mazagon Dock, which ended in li ga on a er severe delays. In contrast, similar ships built in Singapore and Colombo were delivered on me or with minimaldelays.This,henoted,underscorestheopera onal andsystemicinefficienciesinIndianshipyards.
Capt R Venkat highlighted cri cal shortcomings in the dra Shipping Act, emphasizing that it merely replicates interna onal instruments without addressing India's unique mari me needs He cri cized the fragmented approach to including interna onal conven ons, sugges ng an umbrella clause for all ra fied instruments to avoid constant amendments The Act focuses on ship compliance but neglects Indian seafarers, especially those working on foreign vessels. Capt. Venkat ques oned the relevance of giving prominence to OCI shipowners, as it doesnotboostIndiantonnage.
He pointed out the lack of proac ve government measures for seafarers' welfare, no ng that the Seafarers Welfare Fund receives no budget, and promised facili es like hospitals remain unrealized. The Act's provisions mostly comply with interna onal standards like MLC but fail to cater to India's specific welfare requirements or local seafarers' needs. Overall, Capt. Venkat called for a more inclusive, prac cal, and India-centric legisla on rather than mereadherencetoglobalnorms.
In conclusion, while the ambi on is commendable, achieving it requires policy support, infrastructure improvements, and realis c melines. Without addressing these grey areas, India's shipbuilding dreams may face serioussetbacks.
Mr Mohan Lal Pillai, with over 45 years in the mari me industry, shared his extensive experience as a shipbuilder and marine equipment manufacturer. Star ng in the 1980s with import subs tu on for Mazagon Docks, he later specialized in building offshore vessels and barges, including four specialized loophole carriers opera ng in Fujairah for major clients like Shell and Total Despite delivering quality vessels, including exports since 2000, Mr Pillaihighlightedpersistentbureaucra churdlesandlackof ins tu onalsupportthathaveplaguedIndianshipbuilders.
He pointed out the prevalent red tape in governmentcontrolled shipyards such as Mazagon Dock and Cochin Shipyard, where tendering processes and rigid governance impede efficiency and industry responsiveness Unlike private industries where CEOs can make swi decisions,
these shipyards operate more like government departments,limi nggrowthandflexibility.
Mr. Pillai expressed scep cism about the government's ambi ous plans, including a recent surge in mari me ini a vesandlarge-scaleinvestmentslikeHyundai's2,000acre shipyard in Tu corin. He stressed the importance of involving industry veterans in decision-making rather than bureaucratsunfamiliarwithshippingreali es.
Acri calchallengeheiden fiedisthehighfinancialcostfor small shipbuilders, especially regarding bank guarantees and solvency requirements, which are more stringent and expensive compared to other countries like China or Europe This financial burden, coupled with the cyclic nature of shipbuilding demand, discourages new entrants andinvestments.
Advoca ng for a landlord-based shipbuilding model similar to Dubai Mari me City, Mr Pillai suggested developing special economic zones where smaller players could lease facili esandoperateflexibly,reducingtheneedformassive capitalinvestment.
Despite challenges, Mr Pillai remains hopeful that the growing government focus and funding—now proposed at ₹70,000 crores—could boost India's shipbuilding capacity and generate significant employment, benefi ng ancillary industriesandthebroadereconomy.

The seafarers' employment agreement should iden fy the means by which the Various branches of social security protec on will be provided to the seafarer by the shipowner as well as any other relevant informa on at the disposal of the shipowner, such as statutory deduc ons from the seafarers' wages and shipowners' contribu ons which may be made in accordance with the requirements of iden fied authorised bodies
1. Each Member shall ensure that all seafarers and, to the extent provided for in its na onal law, their dependants have access to social security protec on in accordance with the Code without prejudice however to any more favourable condi onsreferredtoinparagraph8ofar cle19of theCons tu on.
2 Each Member undertakes to take steps, accordingtoitsna onalcircumstances,individually and through interna onal coopera on, to achieve progressively comprehensive social security protec onforseafarers.
3.EachMembershallensurethatseafarerswhoare subject to its social security legisla on, and, to the extent provided for in its na onal law, their dependants are en tled to benefit from social security protec on no less favourable than that enjoyedbyshore-workers.
The second area of flexibility in implementa on is provided by formula ng the mandatory requirementsofmanyprovisionsinPartAinamore general way, thus leaving a wider scope for discre onastothepreciseac ontobeprovidedfor at the na onal level. In such cases, guidance on implementa on is given in the nonmandatory Part B of the Code. In this way, Members which have ra fied this Conven on can ascertain the kind of
ac on that might be expected of them under the corresponding general obliga on in Part A, as well asac onthatwouldnotnecessarilyberequired.
The social security aspect has been pushed to Code PartB,whichisnotmandatoryontheFlagstate.
As per MLC 06 : Standard A2 1 – Seafarers' employment agreements Sub Sec 4. Each Member shall adopt laws and regula ons specifying the ma ers that are to be included in all seafarers' employment agreements governed by its na onal law

ship would be liable if he were to execute a bond under this sec on or may accept from the agent such security as may be approved by the Central Government.
(4) The fees fixed under sec on 90 shall be payable in respect of every such engagement, and deduc ons from the wages of seamen so engaged may be made to the extent and in the manner allowedunderthesaidsec on90.
Andasperit'srulestheseafarercontributes12% of the basic pay, and the owner contributes +12% as his contribu on as per the Seafarer's Provident FundAct1966.
SEAMEN'S PROVIDENT FUND (AMENDMENT) BILL, 2023 (WITH AMENDMENTS MENTIONED IN COLUMN (3) OF THE BELOW TABLE) The Seamen's Provident Fund (Amendment) Bill, 2023 [proposed amendmentmaybeseeninColumn(3)oftheTable below] seeks inter-alia to broaden the ambit of the applica on of the Act to foreign flagged ships employing Indian seafarers, which will enable amendmenttotheexis ngSeamenProvidentFund Scheme; and Introduc on of a Seafarers Annuity Fund Scheme and Seafarers Gratuity Fund Scheme for Indian seafarers, to be administered by the Seamen'sProvidentFundOrganiza on.
G.S.R. 807 – In exercise of the powers conferred by clauses (d) and (e) of sub sec on (2) of sec on 218 and by sec on 457 of the Merchant Shipping Act, 1958 (44 of 1958) and of all other powers hereunto enabling, the Central Government hereby makes thefollowingrules,namely-
1. Short tle and applica on – (1) These rules may be called the Merchant Shipping (Levy of Seamen's WelfareFee)Rules,1974.
Though the Act provisions are as old as 1974 and there were exemp ons, the DGs started to collect on behalf of the Indian seafarers employed on Foreign flag vessels only from 2014 vide Crew BranchCircular2of2014 MSAct2025.
The legislature has removed the defini on of "Family" from its scope under Sec3 defini ons and thewordisnotfoundanywhereelseintheAct.
And in Sec 5 (1) which has replaced the old MS Act 58'ssec218ontheroleofNa onalwelfareboardof the seafarers now termed as Seafarers Welfare Board has removed the applica on of the welfare forseafarerswhileashore.
We do not know what happened to this proposed BILL, and there is no update on either DG's website ortheSPFOwebsite.
We don't know if the seafarers employed onboard foreignflagsarege ngthePFdepositedwithSPFO, though the original act in the applica on itself had covered all those employed under Sec 114 of the MSAct1958.
The other component is the Seafarers Welfare Fund, and this is paid by the vessel owner based on a no fica on issued on the 15th July 1974 and it's amendments NOTIFICATION MERCHANT SHIPPING.
May be in can be viewed as removal of a specific adjec ve, "Seafarers while ashore" may mean to includethemtoreceivethesamebenefitsasthatof "Seafarers Onboard". Or would it mean that the benefits made available by the owner are only for theseafarer'spresenceonboard?
The MS Act 2025 Part V Seafarers has all sec ons of the MLC 06 as far as Part A is concerned and absolutelysilentonPartBoftheguidelines.
The benefits receivable under MLC 06 have all been made as the responsibility of Owner/RPSL in all sec ons, and when it came to social security, there is no specific responsibility a ached, since it is the primaryresponsibilityoftheState.
Sec 75 All seafarers shall have access to such
branches of social security protec on as may be prescribed.
Should have been "Every shipowner and or his agent shall be responsible for the contribu on of Social Security benefits of seafarers employed by them, and all seafarers (and their families) shall have access to such branches of social security protec onasmaybeprescribed.
Under the old MS Act 58, the contribu on towards SWFS from the owner/RPSL was ensured vide DG Shipping order 16 of 2014. It took about 8 years for theadministra ontorealisethenecessitytobuilda corpus.
It will be interes ng to know what is the Govt of India allocated funds for the establishment of Hospitals for seafarers and their families guaranteedunderMSAct1958.Sec218.
Liberia is one of the largest employers of foreign na onalsandtheirMari melawstatesthatthereis no restric on on the payment of Social Security amounts to the respec ve na onal funds of the seafarers.
