This book is published on the occasion of the 25th anniversary of Marcasur. It refers to the work that lawyers have accomplished in the protection of intellectualpropertyrights in Latin America. We have intended to narrate this protection through the history of intellectual property firms in the region, including some of its little-known aspects and their relationship with the community. Law and intellectual property are elements of culture: all cultural manifestations influence law and law also influence culture. To symbolize this relationship between law and culture, the book shows artworks by the most diverse Latin American artists, as an unequivocal and beautiful way of representing our region.

The Latin American art that is exhibited in these pages was selected by the firms themselves and is intended to reflect the symbiosis between two branches, as well as to make our artists and their works known to readers.

We want to thank everyone who has participated in this anniversary edition. We hope you enjoy it as an example of the intense and successful path traveled by intellectual property in Latin America. Our congratulations to all the lawyers for contributing to this rich history under continuous construction.

Abente Stewart-Abogados is the successor to one of the oldest lawfirms in Paraguay. Currently, the tradition of more than 90 years of professional activity continues successfully, always with a clear family participation and leadership.

Dr. Víctor Abente Haedo started the firm in 1928 and his sons Víctor and Luis Abente Saguier succeeded him. In 1967 Victor Abente Brun joined the firm, who together with his children, Víctor and Cecilia Abente Stewart, form the current society under the name of Abente Stewart.

The study has a profile of solid professionalism and maintains ethical values embodied in a code of conduct that has been transmitted from generation to generation.

It focuses its objectives under the phrase "More and better", which summarizes the philosophy of the firm. "The challenges of the future are today’s realities, which require all of us who must live

Case of interest: A recent favorable resolution of the Paraguayan Supreme Court prevented the registration of the trademark Tory Burch by a third party and secured brand protection for its legitimate owner, the renowned North American fashion house based in New York.

In one of their first meetings, one of them, Paulo Parente, was rejected by a client who refused to be addressed by such young lawyer and requested the presence of his father. The anecdote reflects the complications of venturing into an industry where, traditionally experience is valued; but it also shows the audacity of the three lawyers who undertook that road. After this episode, Paulo went to an optician to get some tortoise glasses that gave an image of an older man

when Ana Messina received her law degree from Universidad Nacional Pedro Henríquez Ure-ña (UNPHU), in 1985, few in the Dominican Republic knew about intellectual property. "The practicing of the profession in the country was limited, and at the time no one cultivated industrial property as a substantial area in the practice of law and it even had less notoriety", recapitulates Ana. In year 2000, industrial property agent Regina Poletto founded a new intellectual property office in southern Brazil, in the region of Porto Alegre. In 2006, Claudia Giménez and Sandro Soares joined the company to structure the growth of Soares Gimenez intellectual property, an agile office where nine people currently work. The firm now seeks to incorporate two lawyers and two engineers in the areas of technology and patents to answer to customer challenges and continue to create jobs and opportunities through intellectual property, a branch of law that for Sandro Soares is naturally different from all the rest.

Case of interest: An interesting case that demonstrates our commitment to the best solution for our clients took place in China. The client had their trademark registered by a Chinese manufacturer that proposed making it difficult to market its products if it changed manufacturers in that country.

In 60 days we put together a plan and went to China to execute it with one of the biggest law firms in that country. The most incredible thing is that the entire strategy was designed by our Brazil office without mastering a single word of Mandarin! But the Chinese office translated and applied the strategy with great expertise and in 120 days everything was resolved. Conclusion of the case? Changing a letter by a number does a lot of difference in the descriptive part of the brand, but not in the logo as a whole.
