WHAT IS THE STANDARD OF ETHICS AND PROFESSIONALISM YOU SHOULD EXPECT FROM YOUR REALTOR®? When every real estate salesperson finishes his or her specialized training, passes the California Real Estate Licensing Exam, and passes a background check to receive a license, many processes are still ahead to assure that they become the REALTOR® you would choose to represent you.

T

o begin, let’s define some terms that are often misunderstood as interchangeable:

REAL ESTATE AGENT Anyone who earns a real estate license may be called a real estate agent, also referred to as a real estate salesperson. REALTOR® A real estate agent who is a member of the National Association of REALTORS®, which means he or she must uphold the standards of the organization and its code of ethics. Most real estate companies require their agents to be members of this organization, and hold them accountable to this extensive code of ethics. REAL ESTATE BROKER A person who has taken education beyond the agent levels as required by state laws, and has passed a broker’s license exam. Brokers can work alone or hire agents to work for them. REAL ESTATE ASSOCIATE BROKER Someone who has taken additional education classes and has earned a broker’s license but chooses to work under the management of a broker. When you retain the services of any of the above, remember that you are actually retaining the services of the broker, which can be a company or an individual acting as a real estate broker. State laws require that brokers oversee and manage the activities of each real estate agent. The National Association of REALTORS® Code of Ethics actually finds its roots in the Golden Rule. the Code of Ethics has 17 articles that clearly state what is expected of us as we conduct our daily business. Articles one through nine state the Duties to Clients and Customers, articles 10 through 14 state the Duties to the Public, and articles 15 through 17 state the Duties to other REALTORS® Note that the primary content of this document is directed to clients and customers. Let’s look at a few of those. Article 1 When representing a buyer, seller, landlord, tenant, or other client as an agent, REALTORS® pledge themselves to protect and promote the interests of their client. This obligation to the client is primary, but it does not relieve REALTORS® of their obligation to treat all parties honestly. When serving a buyer, seller, landlord, tenant, or other party in a non-agency capacity, REALTORS® remain obligated to treat all parties honestly. Article 2 REALTORS® shall avoid exaggeration, misrepresentation, or concealment of pertinent facts relating to the property or the transaction. REALTORS® shall not, however, be obligated to discover latent defects in the property, to advise on matters outside the scope of their real estate license, or to disclose facts which are confidential under the scope of agency or nonagency relationships as defined by state law. Article 3 REALTORS® shall cooperate with other brokers except when cooperation is not in the client’s best interest. The obligation to cooperate does not include the obligation to share commissions, fees, or to otherwise compensate another broker. Article 4 REALTORS® shall not acquire an interest in or buy or present offers from themselves, any member of their immediate families, their firms or any member thereof, or any entities in which they have any ownership interest, any real property without making their true position known to the owner or the owner’s agent or broker. In selling property they own, or in which they have any interest, REALTORS® shall reveal their ownership or interest in writing to the purchaser or the purchaser’s representative. Article 5 REALTORS® shall not undertake to provide professional services concerning a property or its value where they have a present or contemplated interest unless such interest is specifically disclosed to all affected parties. Article 6 REALTORS® shall not accept any commission, rebate, or profit on expenditures made for their client, without the client’s knowledge and consent. When recommending real estate products or services (e.g., homeowner’s insurance, warranty programs, mortgage financing, title insurance, etc.), REALTORS® shall disclose to the client or customer to whom the recommendation is made any financial benefits or fees, other than real estate referral fees, the REALTOR®, or REALTOR®’s firm may receive as a direct result of such recommendation.

THE CHRISTMAS MIRACLE PUP TECO has quite the remarkable tail to tell. After being found as a stray and rescued by Dog Rescue Without Borders (DRWB), Teco was on the way to his new life in foster care, until things took another little detour. While being transported by an independent driver to his new foster home in Riverside California Teco wriggled out of his collar and was lost. Unfortunately the driver waited to report the missing dog and gave conflicting accounts of where he was lost making finding Teco virtually impossible. His rescuer was devastated. After searching for over 10 days it seemed hope was lost. Teco’s rescuer in Tijuana was getting ready to celebrate Christmas with her family and visited Costco to pick out a Christmas Tree. On her return to pick up her tree guess what she found sitting right next it TECO. If that isn’t a Christmas miracle I’m not sure what is. Now TECO is truly ready for his forever home! A 60 lb, 3 yr old Lab Mix, he is friendly, loyal, social and gets along with everyone. He is indoor/ outdoor trained, great on a leash and loves the car.

DEXTER: Male, Terrier Mix, born November 2013, 9lbs. Handsome Dexter! This little boy is a joy, gets along with people, dogs, and cats. Lives Indoor/outdoor and housetraining is in progress.

IGGY: Female, Chihuahua-Terrier Mix, born November 2013, 9lbs. Iggy is a real sweetheart, gets along with people, kids, dogs and cats. Lives indoors and goes on a pee pee pad.

MILA: Female, Pharaoh Hound Mix, approx 2.5 yrs, 35 lbs. Mila is super friendly with ALL. Loves to play, go out on walks, and enjoy the sunlight in her backyard while relaxing on her cozy bed. She currently lives with other dogs and enjoys their company. Lives mainly outdoors, but sleeps indoors.

Been having a lot of fun with the shows, and helping San Diego grow on some very important issues. Actually had the opportunity to host the Military Ball in Coronado on March 28th...One of those life experiences, you’ll never forget. What a privilege to honor those heroes who have served in America’s finest city. Thank you to the Coronado Chamber of Commerce, and Ruth Ann Fisher with Del Coronado for making this come together.

Craig, we’re through the 1st quarter of 2015, how would you describe the real estate market so far?

A

Low Inventory seems to be the common theme. On the consumer side of things, if you’re a buyer, you’re teased with low mortgage rates, but challenged by the ability to quickly find a home, and get your offer accepted. This is where having an Elite realtor (one you could find in PREMIER) becomes really important. It’s a relationship business, and you have to use someone well connected. If anyone is a serious buyer, my advice is do a full court press. Get after it...You’ll get a place. Stay persistent.

Q

You mentioned lower mortgage rates, what do you think the trend for the remainder of the year will be?

A

Just like the stock market, I anticipate volatility. We are in a global economy, and the U.S. is the cleanest shirt in the dirty laundry contest. The more money fueling our bonds and treasuries, the longer you can expect low mortgage rates. Quantitative Easing no longer exists from the Fed, and the free market picked up where the fed left off. Expect low rates to continue this year. Without a crystal ball, can’t guarantee anything though.

Any advice for sellers?

Low supply, plus high demand- means it’s YOUR MARKET. You should be able to list the property and get plenty of offers. Great opportunity to explore move-up buying, find that PREMIER home.

Are the move-up buyers active?

A

Not as much as they should be. Homeowners can reposition their equity into a bigger better home, and also likely capture a lower mortgage rate. My concern is that when mortgage rates do finally rise, it eliminates the move-up buyer.

Why?

A

Doesn’t always make sense to sell a house with a 3.5% rate to go find a home at a 6%. Not sure about the future of the move-up buyer. But I like the opportunity now!

What’s new with your radio and TV show? Anything fun coming up?

We never stop growing. Helped thousands of people last year with our financial and real estate advice, and we always want that number to grow. I get a little opinionated on the shows, making some friends and enemies along the way, but always shooting our audience straight. It’s going to continue being fun for all involved.
