Nikki began building LookUpStrata back in 2012 and officially launched the company early 2013.

With a background in Information Management, LookUpStrata has helped Nikki realise her mission of providing detailed, practical, and easy to understand strata information to all Australians.

Nikki shares her time between three companies, including Tower Body Corporate in SEQ, and is currently in her third term on the SCA (WA) Education and Professional Development Committee.

More recently Nikki has become known for presenting regular strata webinars, where LookUpStrata hosts a strata expert to cover a specific topic and respond to audience questions.

Who decides on improvements to common property?

The committee would like to replace all windows and sliding doors simply to update the colour from brown to black.

If this decision is adopted, do all lot owners need to upgrade?

We own a unit in Tweed Heads. Some of the owners corporation committee would like to replace all windows and sliding doors from mission brown to black. There is nothing wrong with the windows and doors apart from the unpopular colour. Is it compulsory for us to go ahead with this very expensive renovation of the building?

If the committee decide to aesthetically improve the windows and doors and this is not based on a need to repair and maintain the building, is everyone in the building required to have their windows and doors changed and pay for the upgrade regardless of whether that individual lot owner wants to make the change or not?

The Owners Corporation needs to pass the special resolution, and, if it passes, yes, all owners are liable to contribute to the costs whether they are in agreement or not.

I have advised strata and they state that the painting of the ceiling needs to be covered by my contents insurance. I have called my insurance company and they said it should be covered and fixed by strata insurance.

In NSW, paint and wallpaper is not required to be insured by strata insurance, although some policies provide cover. Inspirational building makeover nears completion.

For decades the brutalist apartment block at 20 Illawong Avenue, Tamarama, was known as the ugly duckling of the east.

Occupying one of the most sought-after pieces of land in Sydney, the 7 story, 1960’s apartment block had seen better days.

For starters, the building had concrete cancer and there were two council fire orders. There was only one lift to service 78 units and parking for only 50 cars (none of which were under cover), and despite every apartment having 180-degree ocean views, there were no balconies.

Today the building has been completely transformed with the one-time ugly duckling now looking more like a contemporary 5-star hotel overlooking one of Sydney’s most iconic beaches.

Due to efforts of the forwardthinking executive committee led by persistent chairman Christine Smetsers, the owners have not only fixed the defects but improved the property enormously by putting balconies on the ocean side for all 78 units; replacing the existing lift and adding a second lift; building an underground carpark for all units; and adding terraces on the western side of the property.

A strata loan is an unsecured loan to the owner corporation.

The funds can be used for strata improvement projects like refurbishment, renovations, defects, green projects and repairs. This allows owners to complete capital works on their buildings, often without the need to raise special levies.

And this was all achieved with minimal upfront costs being incurred by the owners.

So how did they do it?

Strata finance is gaining momentum in Sydney’s east as owners corporations look to fix defects and undertake aesthetic improvements to aging buildings.

In the process, the concrete cancer; fire orders; and other building defects are now rectified.

When completing a project using a strata loan, owners enjoy the lifestyle benefits and investment returns of completing the project sooner. Owners don’t have to wait around for a sinking fund to accumulate but can get work done at today’s costs and avoid the problem getting worse.

funding solutions assist strata owners affected by building defects and general deterioration,” says Paul Morton, CEO of leading strata lender Lannock Strata Finance.

Embedded Networks How do we leave when charges are too high compared to other services?

How can residents leave an embedded network when the prices charged are not the best in the market.

This question is applicable to New South Wales and Queensland. I’m a property manager and I have a few properties in complexes where embedded networks exist.

I’m often asked by tenants how they can leave the embedded networks due to the prices charged. They sometimes find these charges are not the best in the market. Can you explain how to go about leaving and what impacts there are for any body corporate, the owner and the tenant?

Your Embedded Network Manager is legally obliged, without a cost to you, to assist you in selecting an alternative product of your choice.

If you’re in an embedded network and you’re not getting a better deal than you could get if you were to leave the network, then something is fundamentally wrong with the arrangement you have with your onseller or the seller’s agent.

The cost structures of embedded networks are such that there are almost no circumstances in which you should be paying more and you should be paying significantly less. So there are questions to be answered as to why the residents are not getting a better deal, because they absolutely should be.

Regarding leaving the network, it is a matter of law that all residents, whether you’re an embedded network or not, are entitled to exercise their power of choice.

A resident absolutely can leave an embedded network but they shouldn’t need to because they should always be getting the best deal. Depending on the age of the network and the supplier that built the network and the infrastructure (the electricity metre) you have, it may not meet the necessary standards to be supplied electricity by the normal markets.

If you were to use an authorised provider (and certainly with us, we do this as a default when we step in as the authorised party managing an embedded network for our clients), if those metres do not provide the resident with the freedom to choose another retailer without having to invest in new infrastructure, then we will instal that infrastructure at our own cost.

When these laws change, the embedded network would have appointed an Embedded Network Manager. Your body corporate or the agent that’s operating on their behalf will provide you with your Embedded Network Manager’s contact details. They are legally obliged, without a cost to you, to assist you in selecting an alternative product of your choice.

It’s really important to note that you do have that right. If they’re implying you can’t leave or trying to dissuade you from doing so, that is a breach of their obligations. You have absolutely the right to choose your own supplier.

Being reasonable about hard flooring I’m seeking approval for new floorboards, but the committee insists upon a specific and expensive underlay. Can the owners corporation determine what underlay I use if I’m able to meet their requirements with a product I have chosen?

I’m seeking permission from the Exec Committee to update my old floating floorboards to new hybrid flooring.

The committee only approves flooring if you commit to either using a very specific, made to order and expensive underlay or pay for your own acoustic testing report.

I have provided evidence that the underlay I propose exceeds the acoustic report recommendations the committee has provided.

If you have provided probative evidence that your choice of underlay meets or exceeds the strata committee’s specifications, their demands may be construed as being “unreasonable”.

Your works are categorised as ‘‘minor renovations” under the Strata Schemes Management Act, 2015 (NSW) (“Act”) provided they do not involve waterproofing and other exceptions.

If your strata committee is imposing these requirements, it appears that they have been delegated the power to approve “minor renovations” under the Act. The Owners Corporation/ strata committee may only impose reasonable conditions and approval cannot be unreasonably withheld by the Owners Corporation/strata committee as stated in the Act. In our view, if you have provided probative evidence that your choice of underlay meets or exceeds the strata committee’s specifications, their demands may be construed as being “unreasonable”.

Our committee has not repaired water ingress from a balcony into two garages for well over a year. They’ve agreed to allow an unlicensed lot owner to carry out the building and waterproofing repairs. If they go ahead with this decision and there are consequences resulting from amateur workmanship later, perhaps much later, what is our position with insurance? If there are other consequences such as concrete cancer because of the prolonged water ingress, are the committee members themselves who have neglected to repair the leaks over this considerable period financially responsible for those resulting repairs?

You may find that the insurer may not cover any extra damage that has occurred since the Owners Corporation have been aware and not fixed the source of the leak.

Good question. Most policies will exclude damage caused by building errors, emissions or defects that you were aware of. With regard to the one year wait, you may find that the insurer may not cover any extra damage that has occurred since the Owners Corporation have been aware and not fixed the source of the leak.

In regard to damage that happens as a result of an unlicensed tradesperson. You may get some pushback from insurers on that particular issue. You could argue that there was no knowledge that the workmanship was defective. But the insurer doesn’t cover rectification of any defective workmanship, so they won’t cover redoing that work. But you could argue that there was lack of knowledge that it was defective, but you may get some pushback in that.

Questions of who is liable? I guess it’s best answered by a solicitor. You could run an argument that the committee are liable. I know that there are protections in various states for committee members that act in good faith. It does differ from state to state and that is a very specific legal question that would probably be best answered by a solicitor.

Do we need a fire schedule to obtain an AFSS?

We don’t have a fire schedule and without a schedule, our contractor will not be issuing an AFSS. Is this correct?

I am seeking information on “fire schedules”.

We are a small, well maintained, original 1920s Art Deco building and none of us know of any fire schedule requirements.

We’ve had the same fire safety company attending to our inspections for several years so shouldn’t they have known we have no schedule? Or is a fire schedule a recent legislative requirement?

Contact council to request a schedule; or alternatively, engage a fire engineer and certifier to start creating a schedule.

A contractor, no matter how long they have been maintaining the property, cannot simply create a schedule.

The accreditation program in NSW – enforced since July 2021 requires the practitioner to show proof as to where they obtained the schedule. Hence – it can’t simply be created.

The responsibility for providing a schedule to assess-against lies with council – being the regulatory authority.

We recommend you contact council to request a schedule (if you believe one exists due to upgrade works); or alternatively, engage a fire engineer and certifier to start creating a schedule.

Please note; however, that either option may trigger a council fire upgrade order on the building – which while difficult, is both beneficial to your safety and inevitable thanks to the legislation governing councils and AFSS alike.

We strongly recommend engaging the services of a professional.

Legislatively there is nothing stopping you from preparing the 10 Year Capital Works Fund Plan yourselves. I am not aware of any templates as most would consider IP of the preparer.

We do however, strongly recommend engaging the services of a professional.

It is an intricate exercise and requires many years of experience to accurately reflect the future liabilities of the fund. We consider capital works not only within the ten years as required, but also beyond this timeframe to ensure consideration of such expenses by current lot owners. It is also standard practice in the market to produce a 15 year plan so that the report has a 5 year shelf life whilst still complying with the legislation.

It is important to consider escalation, tax and interest factors over the lifetime of the ten year plan.

Sharp increases in construction costs or specific materials can dramatically affect the health of the capital works fund now and into the future, as we have seen recently all across the country.

We, like many others, complete thousands of forecasts per year. The data from this enables us to accurately estimate future works of a similar type, location and scope to those that your property will require now and into the future.

At the end of the day engaging a professional ensures peace of mind and an accurate result. As the SCA states, the purpose of a 10 year capital works fund plan is to ensure sufficient financial reserves are built up to avoid lot owners having to pay large, one-off levies that may cause financial strain. Minor renovations and the ongoing impact on common property

Minor Renovations in NSW can involve interfering with common property without the need for a special resolution. For example: Unit X’s owner replaces the unit block-standard single-glazed windows with double-glazed windows in Unit X only. In the event of damage to Unit X’s windows or to the wall around them (e.g. from water ingress): a. does the owners corporation have to pay only the cost of replacing the unit block-standard single-glazed windows, with Unit X’s owner paying the difference since he wants double-glazing? b. Importantly, how would you formalise (a) above, given that no special resolution is required?

c. w ho pays to fix the wall damaged by water ingress through Unit X’s new, double-glazed windows?

I am relying here on: Section 28 of the Strata Schemes Management Regulation 2016; and Section 110 of the Strata Schemes Management Act 2015.

It would be prudent for the owners corporation to make a by-law even though it is not required to.

Section 110 (minor renovations by owners) of the Strata Schemes Management Act (‘the Act’) does contain two key subsections relevant to the circumstances:

Minor renovations by owners • Section 110(2) – “The approval may be subject to reasonable conditions imposed by the owners corporation and cannot be unreasonably withheld by the owners corporation.”

• Section 110(5) – “An owner of a lot must ensure that: (a) any damage caused to any part of the common property by the carrying out of minor renovations by or on behalf of the owner is repaired, and b) the minor renovations and any repairs are carried out in a competent and proper manner.”

However, in my opinion it does not specifically transfer the ongoing obligation of repair and maintenance for the affected common property to the lot owner in the same way that a special resolution and by-law under section 108 of the Act would do.

Therefore, one of the “reasonable conditions” the owners corporation may want to impose is that the owner of the lot, from time to time, is responsible for the ongoing repair and maintenance of the common property and furthermore any damage caused to the common property as a result of the works.

These should be included in the motion.

One challenge with this approach is that an owners corporation is only required to keep certain records (such as the meeting minutes that contain these conditions) for 7 years, and so the conditions could be lost over time.

For that reason, it would be prudent, in my opinion, for the owners corporation to make a by-law even though it is not required to. This will ensure that the obligations are recorded on title, forever.

It would therefore allow the owners corporation to clarify the answer to the questions you raise long after the decision was made.

Our strata Plan has levies approaching $150k but has not and will not exceed that income, including other incidentals like interest penalties etc. for at least the next year or two.

When a building is projected to exceed the $150K threshold, it is at this time that they must register for GST. The GST Act is very clear.

The accumulated funds brought forward is not relevant to the need to register for GST.

Can I carry out repairs to common property and then withhold levies for reimbursement?

The committee will not repair a rotting timber balustrade on my balcony. Can I organise the repair myself and withhold levies to the value of the work?

It took 6 months for our strata committee to agree on a quote to repair and replace a rotting timber balustrade on my common property balcony. I have had an unsafe balustrade for 7 months now with no rectification in sight.

Can I obtain my own quotes and repair the defect myself? Once repairs have been completed, can I send the bill to the committee for reimbursement or withhold strata levies to the value of the repair?

Owners cannot undertake repairs to common property and then expect to be reimbursed.

An owners corporation has a fundamental duty to repair and maintain its common property in accordance with section 106 of the Strata Schemes Management Act 2015 (NSW) (‘the Act’).

In this scenario, the owners corporation appears to have failed in its duty and attempting mediation is the correct first step.

On many occasions, the Courts have upheld the view that an owners corporation owns and is responsible for making decisions on how it repairs and maintains its common property. For that reason, owners cannot undertake repairs and then expect to be reimbursed. In fact, section 111 of the Act expressly prohibits it unless under specific circumstances.

Also, the non-payment of contributions (levies) is not considered by the Courts as an appropriate or relevant course of action, as evidenced by many cases in relation to debt recovery.

The saying “two wrongs do not make a right” comes to mind. These are separate issues.

Owners have the right to seek orders from the Tribunal requiring an owners corporation to undertake repairs and maintenance to common property if it fails to do so. An application can be made to the Tribunal now that mediation has been attempted.

Clean the rebar to a bright metal condition and restore any rebar with section loss as instructed by an engineer.

Carry out concrete repair in all affected locations.

Seal the floor to prevent further ingress of moisture.

Our strata manager refuses to discuss items about maintenance.

If we want him to assist with maintenance issues, he charges extra fees under strata consultancy.

Some maintenance issues have been outstanding for more than six months.

Ask the strata manager for an update. If they bill you for this, you get billed but you need to know that information and you need to know what’s been action and what hasn’t.

It depends on the complexity of the issues.

Section 106 of the Act is the requirement that an Owners Corporation must maintain common property. You must maintain common property within your strata scheme.

If your building is dealing with quite an involved waterproofing issue, and I’ve got a few buildings which have these at the moment, it sometimes take three or four months to get

the specification, get tenders, have a general meeting, and so forth. That being said, the time it takes doesn’t remove any liability from the owners Corporation, so you need to always be mindful of that you need to work as quickly as you can.

In terms of your strata manager, if it’s lots of little things and they just haven’t actioned them, that’s really disappointing. If you’re on the committee, you’re charged with the day to day administration of the strata scheme. Ask the strata manager for an update. If they bill you for this, you get billed but you need to know that information and you need to know what’s been action and what hasn’t.

If you get billed when you ask for this list and they get back to you with items that haven’t been actioned, I think the next step would be potentially considering options regarding your strata manager.

WORKING TOWARDS GREENER BUILDINGS IN NSW Australia is gradually taking steps towards a greener future across a variety of sectors, and strata buildings are no exception. According to the International Energy Agency, buildings offer the largest opportunities for low-cost carbon abatement in developed countries like Australia.

As things stand, buildings account for over 50% of electricity use in NSW and Australia and represent over 25% of national emissions. Reducing energy use in buildings has the triple benefit of saving money, reducing emissions, and creating space in the grid for electrifying transport and heating.

In New South Wales, the government’s Net Zero Industry and Innovation Program intends to support and partner with industry to reduce emissions and help NSW businesses succeed in a low carbon world.

The plan is that by accelerating the development of clean technology and decarbonisation, it’s possible to grow the economy and support jobs, all while significantly reducing emissions.

‘Accelerating Net Zero Buildings’, for example, is a $4.8M NSW Government initiative to boost the transition of non-residential buildings towards net-zero emissions. The initiative involves the National Australian Built Environment Rating System (NABERS), which will investigate and develop a framework for measuring, benchmarking and certifying emissions

Through the NABERS framework, the NSW government will be able to leverage the wide reach and world-leading expertise of the organisations in the NABERS community to help NSW meet its emissions reduction goals faster.

It’s vital that we start thinking carefully about carbon emissions in our buildings. Carbon emissions from materials used in construction are expected to become the largest source of carbon emissions in the building sector in the coming decades.

Targeted action on reducing emissions from building materials like steel and cement is therefore crucial for NSW to meet its net-zero target by 2050.

In order to get there, the NSW Gov industry to encourage the voluntary use of low emission building materials (LEBMs). These materials include ‘green’ steel and concrete, and alternative products such as geopolymers.

When you consider that two out of three buildings that will be standing in NSW by 2050 haven’t even been built yet, the importance of reducing emissions from construction materials becomes clear. In order for NSW to reach net-zero emissions by 2050, buildings are a vital piece of the puzzle.
