When there are hundreds of conveyancing firms to choose from it is often difficult for sellers or purchasers to decide who to engage to undertake their conveyance. In our experience the decision to engage a particular conveyancer is not always the price, although at Ormeau Legal our fees are extremely competitive and we don’t ask you to pay us anything until settlement. We operate our business from a registered office and have a dedicated team of professionals to ensure that your conveyancing matter runs smoothly. Whilst we can conduct most of our correspondence via email and phone we prefer to use a personalised approach and we encourage you to attend our office to meet with us so that we can explain the necessary searches that should be undertaken and any other questions that you may have. We understand that as a first home buyer the purchase of a property can be both stressful and confusing. Our aim is to assist you throughout the process and be available to answer your questions both during business hours and after hours. WHAT IS ALL THIS PAPERWORK? We are often asked why there is so much paperwork in our initial letters? It is a legal requirement that we send you all of the necessary information and if this is the first time that you have purchased in Queensland you will be left feeling that you have just received enough paperwork to rivel the novel War and Peace! Don’t let that stress you out, just arm yourself with the paperwork and we

are more than happy to sit with you in our office and explain the process with you. The buyers search list is extensive and client’s can be excused for feeling overwhelmed and confused as to what type of searches they should be undertaking. Generally, the standard searches are adequate however, there are instances when you need further searches. An example of when further searches should be conducted is in the example of Mr and Mrs Smith who have attended an open home. The property boasts 4 bedrooms, 2 bathrooms and 2 living areas. The house is comprised over two levels with the lower level consisting of a bedroom, bathroom and living area. It is not uncommon that the lower level does not comply with the local Council building requirements and therefore the additional bedroom, bathroom and living area are not identified and accordingly this affects the value of the property. Whilst the height of the ceiling may only be a few centimetres shy of compling with the local Council requirements the cost of rectifying can be significant. The contract does not tell us that the bedroom, living area and bathroom are downstairs it is only when you describe to us the outlay of the property that we would become aware of the fact that further searches should be undertaken. This is why we say that it is important that you take the time to attend our office and discuss your proposed purchase with us so that we can develop a full understanding of the property that you intend to purchase. It might be that

you are a seasoned investor, in that case we may never need to meet you in person and all of our correspondence can be conducted via email and or phone. We encourage you to send us your contract prior to signing so that we are able to suggest any amendments that we consider necessary to protect your rights. An example of this is where the property has a swimming pool, the contract may say that the swimming pool is to be left in a clean condition but it does not say that the pool pump must be left in good working order. A pool pump can be an unnecesary expense that could have been avoided if the contract contained a special condition. Another example is how you would like to receive the property. The contract could provide for the property to be left in a clean and tidy condition, but what is that really saying? What you deem to be clean and tidy may not be what the seller deems to be a clean and tidy condition. At Ormeau Legal we offer a personalised service and we encourage you to attend our office. FLOOD Floods can occur almost anywhere in Queensland and can rise over days, or in minutes in a ‘flash flood’. Don’t enter floodwater—even water 30cm deep could sweep you off your feet. After heavy rain in your area… • Keep informed about weather patterns and weather forecasts and act quickly on any advice • Stay away from rivers, creeks and drains • Get to higher ground • Never try to drive, ride or walk through floodwater.

Warnings Check the Bureau of Meteorology for: • flood warnings—occurring or expected • warnings for severe storms or cyclones that may cause flash flooding.

When you hear a flood or storm warning: • activate your emergency plan • stay tuned in to warnings and updates on your radio • move vehicles, outdoor equipment, garbage, chemicals and poisons to higher ground • sandbag indoor drains to prevent sewage backflow • plan which indoor items you will raise or empty if water threatens your home (e.g. fridge and freezer) • make sure your emergency kit is fully stocked • secure your pets.

Don’t ignore the dangers

If you need to evacuate, follow the evacuation tips in your emergency plan.

Each year, emergency services receive calls for help from people who have ignored traffic signs and road closures and become stranded in floodwater—putting themselves and their rescuers at risk. Think about the consequences of your actions. Don’t risk your life or the lives of others.

If you need to evacuate… Pack warm clothing, essential medications, valuables, personal papers, mobile phone, photos and mementos in waterproof bags to be taken with your emergency kit. Raise furniture, clothing and valuables on to beds, tables and into roof spaces Empty freezers and refrigerators, leaving doors open Turn off power, water and gas Put sandbags in the toilet bowl and over all laundry/bathroom drain holes to prevent sewage back-flow Lock your home and take recommended evacuation routes for your area Don’t drive in water of unknown depth and current. If you stay (or when you return)… Listen to your local radio station for official advice and warnings Don’t allow children to play in, or near floodwater Avoid entering floodwater. If you must, wear solid shoes and check the depth and current with a stick Stay away from drains, culverts and water over knee-deep Don’t use gas or electrical appliances that have been in floodwater until checked for safety

Don’t play in or around floodwater Children drown every year in floods. Warn children of the dangers—don’t let them play in or around flood water.

Types of floods There are three different types of flood that can occur in Queensland. Flash flooding is the most dangerous. It is often the result of short, heavy bursts of rainfall and can occur anywhere in Queensland. If you enter floodwaters, the speed and power of the fast-moving water could sweep you and your vehicle away. There may be no warning for a flash flood. Mountain or coastal rivers quick onset flooding occurs in the mountain headwater areas of large rivers and in rivers that drain to the coast.

Don’t eat food that has been in floodwater

There is little time to prepare as the floodwater moves quickly down the steep rivers.

Boil tap water until supplies have been declared safe.
