Thursday, November 14 will be the last KREIA meeting of 2019 as we conclude another prosperous, productive year with our awesome organization! We will celebrate the meeting this month with some special entertainment, door prizes and a change from the usual structured meeting schedule allowing for music, a few laughs and extra time to network with your favorite mentors and friends.

I personally wish to extend a very special and heartfelt thanks to all the dedicated people who contribute to KREIA each month with their time, leadership and tireless effort to make the monthly KREIA meetings, resources and other outside events possible, beneficial and informative.

As an organization, we are doing well with over 650 members and growing. KREIA is one of the very few remaining and certainly about the largest REIA groups in the nation that is completely non-profit and served by volunteers. The officers, board and volunteers are already working hard to fill the 2020 schedule with relevant content and networking opportunities along with some new and fresh ideas.

I hope each of you has an opportunity to take a breath, appreciate your accomplishments and enjoy time with family and friends this Holiday and Christmas season. As this year winds down, take inventory of your goals achieved and those yet to be conquered. Rest up and be prepared to hit 2020 head on with new challenges and favorable outcomes for all your hard work.

Unofficial L.O.T.S. event this month We normally don’t hold a L.O.T.S. event after the Holiday Party, and this year is no exception. However, the rehabbers who transformed the amazing April 2nd L.O.T.S. house – Chiquita Lindsay, Kisha Lindsay and Richard Wadlington – are inviting KREIA members to their latest rehab. And they’re feeding us! They’re arranging the catering as we go to press.

Indiana Subgroup Luncheon Venue Changes in January For years, Indiana investors have been meeting for lunch and education on the second Wednesday of the month, every month, at Tucker’s Restaurant in New Albany. But on January 8th, there will be a new place to meet up.

Brian Haeseley, who chairs the event, reports that starting in the new year, Indiana investors should gather at another New Albany restaurant: Mark’s Feed Store at 3827 Charlestown Road, which is just south and west of the I-265 exit. If you like BBQ, you’ll love Mark’s.

But please attend the December 11 lunch at the usual location for one last meeting at Tucker’s, 11:45 a.m. – 1:30 p.m. As usual, Kentuckians are welcome, and the event is free for everyone to attend. (You must buy your own lunch.)

Brian says the reason for the change is that Tucker’s has sold the restaurant.

Why You Should Avoid Contract For Deed Deals 10 Fatal Mistakes of New and Veteran Investors, Part 1

By Mike Butler This is the first of 10 Fatal Mistakes of investors. These mistakes aren’t limited to new investors. Many seasoned veterans hiccup and hit potholes too. Some mistakes may seem contrary to popular beliefs, and each will be explained why it made the list.

This new investor tried contacting the shady seller about the refinance loan closing soon, but the shady investor would not return any calls to his new investor buyer.

Ugh-oh… now it gets even worse. The shady investor visits each of the tenants in the duplex and tells them that he is the landlord and they must pay their rent to him. By Hank Schildknecht Many longtime members of KREIA had the privilege of knowing Ed Melton, Sr. Ed was, without a doubt, the greatest recruiter in the history of KREIA. Ed was an active KREIA board member for many years. He was a dedicated mentor to novice investors and enjoyed passing on his experience and wisdom.

St. Matthews L.O.T.S. Home: A Closer Look Katie & Brad Noe transform the ‘Woodpecker House’

By Lauren Willoughby OK, first things first. Why are Katie and Brad Noe calling their current flip project the “Woodpecker House”?

The handout they shared at the Oct. 27 L.O.T.S. event tells the tale: the “before” photos reveal a house sheathed in dark brown vertical wood siding, accompanied by brown wood shutters and a brownish roof. The total package did seem to be flashing an invitation to house-hammering birds.

After the makeover is complete, no one will be tempted to call it the “woodpecker house” again. You can’t tell it from the photo here, but gray blue siding is going up (it was already covering the other side of the house). And a new roof is already in place to match. ???

Can You List Wholesale Properties on the MLS? What’s the Greater Louisville Association of Realtors rule?

By Harry Borders Wholesaling in our market is getting very popular, and it can be profitable when it is done correctly. We’re asked all the time, “Once I get a seller under contract, can I then list the property on the MLS?” The answer is yes. HOWEVER, a Realtor cannot take a listing unless the actual property owner (or a power of attorney for the actual property owner) signs the listing contract. There is a rule that precludes Realtors from listing properties on the MLS if the “seller” only has equitable interest in the property.

Unfortunately, we see this being done improperly quite frequently. Listing it incorrectly is a quick way to get yourself and the Realtor in trouble.

Here’s the MLS rule: 1.25 EQUITABLE INTERESTS: Listings of “equitable interests” or “equitable title” will not be accepted by MSI or input into the MLS database. The terms “equitable interest” and “equitable title” shall refer to an agreement or other arrangement where the seller does not have legal title to the property but has only a right to obtain legal title to the property; provided, however, the terms “equitable interest” and “equitable title” shall not be deemed to include or prevent the listing of a vacant lot in connection with the proposed construction of a new dwelling on the lot where the home builder or contractor holds only a contract or option to purchase the lot. MSI shall have the sole and unfettered discretion in determining whether a proposed listing is a listing of an “equitable interest or equitable title.”

Can you list wholesale properties on other websites?

Yes, but only if you are crystal clear that you are NOT selling real estate but rather you are selling a contract you have related to the purchase of a property.

Also, unless you are simply assigning the first contract to another purchaser, make sure that the contract to sell the property to another party is contingent upon your acquisition of the property. Otherwise, if the sale falls through from the original owner to you, you won’t have anything to sell to the ultimate purchaser.

Every recipient has taken his or her mission very seriously in selecting a deserving KREIA member to receive the 2019 award given in Ed’s memory. This will be the 22nd year that the award has been presented. It is one of the highlights of the year, and we look forward to honoring this year’s recipient at the November meeting.
