he Mumbai University, after getting information that the Human Resources (HR) paper of Third Year Bachelor of Commerce (TY BCom) sixth semester had been leaked, quickly replaced it with another set yesterday. he four men accused in the Shakti Mills photojournalist gang-rape case were successfully found guilty by a Mumbai Sessions Court thanks to the dedicated work of the state-run Kalina Forensic Science Laboratory (FSL).

The prosecution primarily relied on the forensic evidence analysed by the FSL team as there were no eyewitnesses to the incident. The forensics team gathered 22 DNA samples from the victim's clothes and body and also from her dupatta which they recovered from the crime scene.

Nirupam was evasive when asked to address issues of corruption in the Congress and of redevelopment in his constituency, and chose instead to speak of the opposition.“There are three corrupt ministers in Modi's cabinet. Only BJP is making a propaganda saying that Congress is a corrupt party. Not everyone is saying that.”

When asked about his efforts in bringing in big ticket projects to his constituency in the past five years, he evaded the question. Instead he spoke of former BJP MLA Ram Naik, “He represented them for almost 25 years, what big project did he bring?” He went on to talk about his new manifesto, emphasizing on what he termed as the most important developments. These include a 24 hour toll free helpline for any woman, student or elderly citizen and water booth installations on a large scale. He also promised a gas connection in each society within the next five years, mentioning that Gorai and Charkop will avail the services in six months itself.

t about 4 pm yesterday, a crowd gathered at Rahul Cooperative Society, Malad West, for something they were clueless about, “Chai pe charcha.”

“I have no clue why we are here.

She asked me to come,” said a resident pointing towards a woman who she said was a Bharatiya Janta Party (BJP) supporter. That was the scene at BJP candidate Gopal Shetty's election rally held in Malad West yesterday.

Looking extremely confident, with his party members flanking him, Shetty arrived 40 minutes late at the venue. But before he started addressing questions, he took a leaf out of Narendra Modi's book and made sure that every one sitting in the audience had a cup of tea in hand.

Shetty started with a dare especially targeted at the journalists.

“Challenge me with any tough question.” The response was immediate and questions were bombarded on a range of issues, from increasing parking problems to the obvious one of inflation.

He chose the last, first.

“Change the government and inflation will vanish,” he declared, and a round of applause followed immediately from his supporters. One of the residents of the Society

Gopal Shetty, BJP pointed out the problem of corruption in getting a no objection certificate for construction of property. Again his answer was simple. “You all know my style of working, I will fix them all. I am going to ask them for answers.”

The BMC has enough money to deal with all kinds of civic issues, he assured his listeners.

He ended with a counter question, “By how much of a margin are you going to make me win?”

“By two lakh votes”, his obliging supporters shouted.

Campaign chief Rajesh Sinha, said, “If we see the entire country as a family that looks to the government for direction, then we are living in a nation that has been orphaned. Only if we have a strong government at the Centre can we can think of mending the lapses in the system.”

t looked like any other day at the Bandra station,until Aam Aadmi Party's Lok Sabha candidate for Mumbai North, Satish Jain, stepped out at 11 am and headed towards the Commissioner’s office to file his nomination papers.Waving at the people on the station, who seemed both shocked and amused to see their candidate travel in a train, he said, “The local trains symbolize the Aam Aadmi of Mumbai. For an occasion as auspicious as filing of nomination, the local trains were our natural choice.”

Jain has been reaching out to people with his padyatras and holding open discussion forums with people in jansabahas. “Our first job will be to provide proper housing, clean water, cheaper electricity, sanitation and clean drainage, this will be our top priority for the people who are staying in slums.”

Which is easier said than done but he surely knows that as much as the common man on whose behalf he is standing for elections.

For Jain, this was and is a parivartan rally. The level of corruption is great and immediate change is required. Rupesh Sawant, a party worker who was a part of the rally said, “Sab jagah pe bahut corruption hai, AAP ke alawa dusri dono party chor hai aur kisi bhi gunde ko seat pe bitha sakti hai.” Another party worker, Sandip Mishra, said, “AAP is the voice of the aam aadmi.

Only they can represent us fairly.”

Satish Jain, AAP Jain, a finance man with enviable experience in the corporate sector, does not seem particularly overwhelmed by the fact that this is his debut into the rough and tumble of politics. Nor is he backward about making known his views on the incumbent MP, Sanjay Nirupam if the Congress. “The Congress has been the most corrupt government that this country has ever seen and Nirupam has done very little for this constituency despite being a three time MP.” Vikas Sharma, a BMM student of Chetna College in Bandra, who was passing the procession at the time and who was rather dismissive of the shenanigans. “I am not going to vote for AAP but for the BJP. The county needs a strong and an experienced leader and Modi has both these qualities,” he declared unequivocally.

Kirtikar, also known as Gajabhau, is a popular name in Goregaon.

He is pitted against Gurudas Kamat of the Congress and Mahesh Manjrekar of MNS. Speaking to ADC, Kirtikar said, “Last time Kamat won from this constituency. But later he became 'Delhi ka neta' and ignored the people in this area. This time I am determined to defeat Gurudas Kamat. I have been working in this constituency right from 2009. I am in touch with the people and am engaged in all social activities in my constituency. As many as 36 corporators elected from this constituency are from the Sena”.

“As far as the MNS candidate is concerned, I am sure he will hardly make any impact. Manjrekar is no competition for me and he is not even active in politics. He has only played the role of Shivaji Maharaj in a film. But I have followed the directions of Shivaji Maharaj all my life.

Marathi voters have now realised that voting for the MNS is like voting for Congress. So I do not see any threat from in MNS this election”, he added further.

When asked about his priorities, Kirtikar said, “The primary role of an MP is to resolve issues of

The place to be

She has caramel coloured curls and big brown eyes, a flawless complexion, a figure to match – and loads of talent on the violin. It looks like Nicola Benedetti, one of the world’s most recognisable young talents, has it all, including a capacity for hard work and a generosity of spirit extraordinary in one so young. She plays this evening and tomorrow at the Jamshed Bhabha Theatre at the NCPA.

Unbeatable combo IN the April issue of NCPA’s On Stage magazine, Freyan Patel writes: “What is it about Nicola Benedetti that has fascinated the global media and the classical music world for a decade now? What does it take an artist at only 26 to walk the thin line between commercial and critical success? For that matter, what is it about Benedetti that has the world eating out of her extremely deft hands?

Could it be her looks, which, in her own words, make her “easier to sell”? No doubt a little something called talent has helped too. But ask her and she will be the first to tell you that getting by on good looks and raw talent alone is impossible. Follow her journey, from the little girl who picked up her first violin at four, simply because her older sister Stephanie started lessons, to becoming one of the world’s most famous violinists, and you will find two very important constants: hard work and a passion for music.”

We will accept the lot, but let us warn you – her looks are likely to floor anyone. In that department, she is like the Nigella Lawson of the music world – flawless, riveting to the eye. But

where Lawson is acknowledged to be a walking minefield inviting cholesterol highs and instant coronaries, with her passion for butter and flour and white sugar, Benedetti invites very high praise indeed for the fact that she is a musician.

Early in her childhood, Patel writes, she and her sister were encouraged to pick something and “do that thing properly”. Both picked the violin and for Benedetti, endless hours of practice paid off.

By the age of nine, she had eight grades of music under her belt and was the leader of “the 120-playerstrong National Children’s Orchestra of Great Britain. And a year later, she had earned a spot at the Yehudi Menuhin School, studying under the maestro himself..

Her talent did the rest. Taking her to London and Paris, playing at Westminster Abbey in a memorial to Menuhin. In 2002, at the age of 14 (we calculated), she had won the UK’s Brilliant Prodigy Competition, at which point she left the Menuhin school to train privately with Maciej Rakowski.

We like the frequent mentions of Scotland in her background which is another fascinating part about her development. Benedetti is, of

course, of Italian origin, but her parents settled in West Kilbride, a village in North Ayrshire and she was born there. Which is as Scottish as one can get and accounts for the role the Scottish National Orchestra played in her development.

And already at a young age, this extraordinary young woman, who, when she won the Young Musician of the Year Award, became the first Scot to do so, is known for her eagerness to give back not just to music and the profession, but also to youngsters interested in

COULD be these days this is the office of the Collector, whether in town near the RBI, or at Bandra for the suburbs. For this is where all the candidates land up to file their nominations.

What we find mildly confusing, however, is that many candidates (Satish Jain of the Mumbai North constituency) seem to start their padayatras and rallies even before they file their nominations. So have Priya Dutt and Milind Deora, not to mention the candidates of AAP, particularly Mayank Gandhi and Meera Sanyal.

So even as we cover everyone regularly, in the midst of the proceedings, they go off to the Collector, there to formally sign in, and then take off and continue with what they were doing before!

On Thursday, however, the events at the Collector’s office in town were hardly entertaining and in fact had journalists running for cover as brick bats and stones started flying and the MNS and the Shiv Sena began to use the poles of their flags as lathis.

This is the time when many channels also probably wished they could resort to “drone journalism”, which is what is making itself felt in conflict situations in the middle weast and parts of Australia and the US. You know what we mean – cameras attached to dr5ones that are then flown over the sites of interest so that they get terrific aerial shots of the fracas below without one endangering themselves.

Though knowing what the two Senas are like, they combatants would very likely aim their first stones at the flying cameras!

On a lighter note

OR perhaps we should say’ on a seriously dismaying note’. We were mildly horrified the other day when we caught a glimpse of the eponymously named Koffee with Karan, in the midst of a session with Sonam (I’m jes lak you) Kapoor and her father Anil, looking more like an elderly, pointy-chinned elf than usual.

So Karan Johar was in the midst of a rapid fire round and asked Sonam, “An eye for an eye makes the whole world blind. Who said that”, and she hit a buzzer and said, “Robert de Niro”. Then, enchanted by her own stupidity and implied cuteness, she dissolved into giggles.

By the way, she is supposed to be among the more literate among the Bollywood brigade because she reads.

For Sonam Kapoor, it was Robert de Niro who said ‘An eye for an eye will make the whole world blind’. Who is Mahatma Gandhi!

The Standing Committee of the BMC deals with all financial matters, including clearance of a budget of over Rs.31,000 crore.

Every proposal with more than Rs.10 lakh budget has to be cleared by the committe.

he Brihanmumbai Municipal Corporation (BMC) has a new Chairman of the Standing Committee for the first time in five years. Shiv Sena's Yashodhar Phanse, who replaced Rahul Shewale as nominee for the chairmanship, stood against Congress nominee Bhomsingh Rathod and won, thus spoiling Shewale's chance of being elected for the record-making fifth consecutive year.

The election took place yesterday in the presence of city Mayor Sunil Prabhu, Additional Municipal Commissioner Sanjay Deshmukh and other party leaders and coporators.

Out of the city's 27 corporators, three MNS corporators, Samajawadi Party corporator Rayiz Sheikh and Congress corporator Dyanraj were absent.

Also making news is Trushna Vishwasrao, Shiv Sena corporator, who became the first woman Leader of the House in BMC's 135 years history. The post was allotted to her despite strong claims on the

seat by senior corporator Kishori Pednekar and former mayor Shraddha Jadhav.

The Leader of the House plays an important role in the functioning of the BMC as she heads the ruling party and the civic house. Therefore she must co-ordinate with the other parties to come come to a consensus on various contentious issues.

The post of House Leader acquired statutory status only in 2002.

he World Trade Centre was buzzing with activity as it played host to the 'Made in Pakistan Expo Mumbai 2014' organised by the Pakistan Readymade Garments Manufacturers and Exporters Association (PRGMEA) in collaboration with EVECON, a Pakistan-based event management company under the AEGIS of Ministry of Commerce and Textiles of the Government of Pakistan and the All India Association of Industries (AIAI).

The event is unprecedented in the history of Pakistan-India trade ties; and marks Pakistan’s oray into Mumbai, the heart of the Indian market.

The Expo was officially inaugurated yesterday and will go on till April 7 between 10 am to 8 pm.

A real treat for lovers of Pakistani fashion, fabric and styles, one can choose from fashion garments, the famous lawn print suits (stitched and unstitched), textile fabrics, footwear, dresses, marble items, jewellery, herbal products, spices and food products. The Expo has numerous top Pakistani brands like Lulu's, House of Ittehad, Lala, Khaadi, Qarshi Industries, Gimmick, Pazeb Leather, Dawood Textiles, Cross Stitch, Seema's Boutique, Mehran Spice and Food Industry among others.

Also on offer are Pakistani delicacies like Chicken and Mutton Korma, Reshmi Seekh Kebab, Biryani and lots more.

Bustling with enthusiastic shoppers and equally enthusiastic exhibitors amid tight police security, all of them were extremely happy to be showcasing their products at the expo and enjoying the Mumbai hospitality. Waqar from Cross Stitch, an exhibitor said, “We came to explore the market. It is my first exhibition and trip to India. People are really liking the products. The people here are extremely co-operative and really hospitable”.

A representative from Zafarsons said, “The response has been very good. I love to come here. Mumbai is just like Karachi”.

Sasha Ahmed who visited the expo said, “I basically love Pakistani dress pieces and their styles. When I heard about this expo, I said to myself that I have to go for it!”

Vijay Kalantri, President, AIAI, said, “There is tremendous scope of doing business with Pakistan. We need to co-operate and work together.”

Before Rahul Shewale, Ravindra Waikar also held the post of the Standing Committee Chairman for four consecutive years, from 2006 to 2010. Shewale has held the chairman position from 2010 to 2014. Had he stood for the elections and won, it would have been a record breaking win for Shewale.

The 227-strong municipal council houses 122 women. However, women hold none of the more important posts like mayor, group leaders and committe chairpersons.

Bharatiya Janata Party corporator Vinod Shelar, who filed his nomination against Congress corporator Dr. Priyatama Sawant, was elected Chairman of the Education Committee with 15 votes.

23-year-old man was arrested byVakola police on Thursday night for molesting a woman. The court also rejected the defence argument that the section is only applicable if

the accused commits the offence after he is convicted. In the present case, trials of both cases were held simultaneously.“If that was the intent of the legislature, it would not have used the word conviction but would have said that it was applicable to the accused who commits the offence after he undergoes the sentence,” the court said.

“The entire tenor of the section makes it clear that it is intended for enhancement of punishment. The court is not dealing with a new offence but adding a new charge to ensure that the principle of natural justice is adhered to,” observed the judge.

even months after a blaze in building with a glass facade, which claimed four lives at Andheri, the fire department and BMC have come out with a fresh set of guidelines for such buildings. The Mumbai Fire Brigade is the first in India which has come up with a policy for construction of such structures.

The fire department has now mandated automatic openings on every floor of such buildings as well as smoke detectors. A fire at the IndusInd Bank office in Andheri claimed four lives in June. In September 2012, a fire broke out in the 13storey First International Finance Centre, a commercial building in the BandraKurla Complex, gutting two floors.

N.H. Nesrikar, deputy fire officer said, “Earlier, the open area was closed due to the glass facade. In the new

policy, the refuge floor will have to be kept open.” On every floor the openings will have to be at every 50 ft. The opening window has to have a minimum width of 1.5 m and height of 1.5 m facing the road.

He added, “Earlier, there were less access points to such buildings. A window that opens automatically with laminated glass of high qaulity, when there is smoke in the building will ease firefighting and help in saving lives.”

The fire department has also made mandatory automatic water curtains on every floor to douse fires.

“Glass facades block ventilation in a building, and worsen the intensity of fire.

Although fire fighters try to break the glass structures, it is dangerous. Ventilation and access for firefighters is a must in such buildings,” said Nesrikar. khushboo.panjabi@afternoondc.in

The Congress did its best to get over this inconvenient, largely harmful corruption taint that stuck to its like a leach.

It looks like it was readily given.

Sonia Gandhi, president of the Congress, has been in no small measure responsible for the Hindu-Muslim divide.

Her party has been attacking the RSS for its Hindutva agenda. She was wrong to suggest that the RSS had decided on polarisation led

by Narendra Modi, there was no emphasis at all on Hindutva. The RSS and all the BJP leaders have been making emphatic speeches about the need for ensuring unity in the country. No BJP leader said anything about any need for dividing the voters on religious lines. It was the Congress and the NCP's Sharad Pawar who were making an appeal for votes on religious grounds.

Not once had the top BJP leader and the PM nominee Narendra Modi made a reference to Hindutva. His election campaign was totally based on governance and growth.

Should the Election Commissioner take action against Imam Bukhari for asking Muslims in the country to vote for the Congress?

This is a dangerous happening.

What happens when Hindu groups strike back and their leaders go on a Hindutva agenda? They can open the dangerous Babri Masjid issue and attack the Muslims. A HinduMuslim poll war would be dangerous to the country. All this while there has been only talk of polarisation, but now it has become a reality.

And it would be a disaster if a communal divide takes place during elections. In such an event, violence would become unavoidable.

The Congress party is not likely to do anything that would blow off the crisis. It finds itself on the eve of polarisation, in a desperate situation. It is in such a frustrated state that it will be ready to take any measure to get an advantage over the BJP. It is a card which the Congress has played to improve its poll position. There must have been a silent deal between the Imam and the Congress president when they met. Barely a couple of days after the meeting, Imam Bukhari has made the 'appeal' to Muslims to vote for Congress. The Election Commission should act fast or else there will be huge communal trouble.

There are too many humourless stretches in Main Tera Hero—it is not the guffaw-inducing type of film, but a few scattered chuckles type. Arunoday Singh’s comfort level in a film which should have been out of his range is remarkable—he fits right into the D-world craziness. After this boisterous allrounder performance, what Varun Dhawan does next would be interesting to see.

HOSE who have watched King Kong the 1933 classic, would immediately relate the movie to Beauty and the Beast, wherein the monster finds he’s falling in love with a beautiful girl.

King Kong (2005), is a remake of that classic, the same story, only this time it boasts of greatly improved special effects and a play time of three hours. The movie won Academy Awards for sound, sound design and visual effects. A great treat for the kids.

Carl Denham (Jack Black) is a filmmaker who is eagerly waiting for a big hit and would do anything to meet his goal. His dream might just come true when he hears about Skull island, and the giant creature that inhabits the place. Carl is all set to head to the island, shoot the movie and get fame and fortune. But things don’t go according to plan when suddenly his leading lady backs out at the last minute.

Carl finds an unknown and jobless actress Ann Darrow (Naomi Watts) and tries to convince her to join his film. He also manipulates playwright Jack Driscoll (Adrien Brody) into being his screenwriter.

His crew, actors and technicians board a ship and head out. But no one on board knows Carl’s secret plan of Skull island.

Whenn the ship’s crew find out, they try to turn the ship around, only to end up stuck on Skull Island, where they find deranged human inhabitants, wondrous creatures, crawly insects, and lastly the huge gorilla Kong (Andy Serkis). Ann is captured and found

by Kong. Both develop a special bond, but when separated by Ann’s lover Jack, a fight erupts with Kong, leading him to the crew who capture and cart him to New York. But trouble starts when Kong sees a female actor and recalls his bonding with Ann. Kong breaks free and creates havoc on the streets, only to wind up atop the Empire State Building with Ann trying to save him. Watch the moving finale.

al takes up an issue that should concern everybody, if it doesn’t already-- the water shortage that has started killing animals and will soon affect human life in parts of the country (and the world).

But Girish Malik’s film set in the arid Rann of Kutch, cannot settle on the right tone. It’s neither serious enough to be disturbing, not interesting enough to be engaging. It tries for a mix of exotic and realistic, which simply doesn’t work. It also throws too many strands into the air, and can’t get a proper hold on any.

Bakka (Purab Kohli) is a water diviner in a tiny, parched desert village. The inhabitants claim to be starving, but are dressed in gleaming ethnic costumes and all look well-fed. For a film taking a mostly

realistic approach, Jal glosses over details like how the villagers make a living. They drive chhakdas, talk about blue CDs, but there is no evidence of that kind of progress.

When a foreigner (Saidah Jules) arrives to study flamingos, she is shocked to find many dead chicks.

She is able to pull enough strings to get a government team to fetch a huge drill to find fresh water for the birds, but is curiously apathetic towards the villagers—maybe because all they do is leer at her and make crass comments.

In between the water woes, there’s a love story between Bakka

and a girl from an enemy village (Kirti Kulhari), the machinations of her thwarted suitor (Mukul Dev) and the heartbreak of his childhood sweetheart (Tannishtha Chatterjee).

A very contrived plot twist hurtles Bakka into tragedy.

No matter how much one tries to empathise with the characters, Malik’s treatment just never manages to draw the viewer into the desperate world of these neglected villagers. The location is captured beautifully, though, even if it’s all gleaming and touristy with CGI twisters and storms showing up at regular intervals.

SHARING A SOCIETY’S CHARGES ON THE BASIS OF THE LAW MEMBER of a cooperative housing society are expected to share the society’s charges in a predetermined fashion as laid down by the Model Bye-laws. The share of each member towards the charges of the society is apportioned on basis as laid down by law. (i) Property taxes: As fixed by the local authority (ii) Water Charges: On the basis of total member and size of inlets provided in each flat. (iii) Expenses on repairs and maintenance of the building/buildings of the society: At the rate fixed at the general body from time to time, subject to the minimum of 0.75 per cent per annum of the constructions cost of each flat for meeting expenses of normal recurring repairs. (iv) Expenses on repairs and maintenance of the lift, including charges for running the lift: Equally by, all the members of the buildings in which lift is provided, irrespective of the fact whether they use the lift or not. (v) Sinking Fund: As provided under the Bye-law No. 13 (c) (vi) Service Charges: Equally divided by numbers of flats. (vii) Parking Charges: At rates fixed by the general body of the society at its meeting under the bye-law Nos. 84/85 (viii) Interest on the delayed payment of Charges: At the rate fixed under the bye-law No. 72 to be recovered from the defaulter members. (ix) Repayment of the instalment of the loan and interest: The amount each instalment with interest fixed by the financing agency. (x) Non-occupancy Charges: At the rate fixed under the bye-law No 43(2) (iii) (c). (xi) Insurance Charges: The built up area of each flat, provided that if there is increase in the insurance premium due to storing any specific goods in any flat, used for commercial purposes. The extra burden of insurance premium shall be shared by those who are responsible for such increased premium in proportion of the built up areas to their flats. (xii) Lease Rest: The built up area of each flats (xiii) Non-Agricultural tax: The built up area of each flat. (xiv) Any other charges: As may be decided by the general body of the society at its meeting.

In addition, the managing committee fixes society charges in respect of every flat. (a) The committee shall fix in respect of every flat the society charges on the basis laid as down under the bye-law no 69(a) Where payment of the society charges is concerned, the Secretary of the society shall prepare a bill / a demand notice in respect of the charges of the society payable by members of the basis of the bye-law No. 69(a) and issue the same to all the member on or before the date fixed by the Committee in that behalf.

Every member of the society shall pay the amount mentioned in the bill/demand notice in full within such period as may be fixed by the committee.

ronically, the most brutal in urban settings aren’t the animals that intolerant residents collectively hound and attempt to eradicate by sheer force even treachery. The law on animals being in place apart, it’s the sheer apathy towards the mute that compounded with collective bullying in societies that leaves petowners defenceless, sometimes even isolated and forced to concede.

Statistics and ‘incidence of dog-bites and consequent deaths’ are hurled in the regular rhetoric aimed to silence animal lovers in cooperative housing societies across the nation. And, in the absence of clear-cut directives to the same, troublemongers have a field day.

In response to a record number of complaints in this regard, Animal Welfare Board of India (AWBI) Chairman Major General (Retd) Dr R. M. Kharb issued a detailed circular last month to address a range of issues.

Issued in place of an earlier circular dated 1st Feb 2014 that stood withdrawn, the one issued on February 20th, seeks to supplement what was earlier issued and to add to it. It reads, “It is well known that in the recent times, RWAs, Apartment Owners’ Associations, Cooperative Group Housing Societies and other gated complexes have taken to imposing many unreasonable restrictions on pet owning residents such as disallowing the use of lifts or parks by pets, or even banning pets altogether. They’re also known to frequently encourage mistreatment, dislocation and dumping of street dogs.”

The circular also acknowledged that compassionate persons that wish to tend to and feed street dogs are often discouraged and pressurised to refrain from doing so. There is widespread resentment against these moves, which apart from being unreasonable are also unlawful and against recent court rulings.

RWAs or an Apartment Owner’s Associations, Cooperative Group Housing Societies, Gated Complexes etc., often get a series of complaints regarding street dogs. There are requests that street dogs be driven away through physical intervention by security guards or members themselves and/or just dumped elsewhere.

“If you accede to these requests, you will not only be violating laws and pronouncements of courts, buy will not achieve any permanent solution either.

The problem will become perennial and you will also run afoul of animal welfare people that are increasing in number by the day and banding themselves into well organised groups,” says the AWBI Chairman. The circular also goes on to set out some dos and don’ts with respect to pet dogs and street dogs.

With regard to pet dogs which are usually targeted by society members who’d promptly ‘legislate’ in general body meetings and pass resolutions banning pets and controlling their behaviour, the circular says: a) Even by obtaining consensus or even if a majority of the residents want it one cannot legally introduce any sort of ‘ban’ on the keeping of pet dogs by residents. Nobody can insist that ‘small

In fact, in trying to ‘ban’ pets, or limit their number, you interfere with a fundamental freedom, guaranteed to the citizens of India i.e. the freedom to choose the life they wish to live, which includes facets such as living with or without the companionship of animals. c) If the resident with pet/s does not violate any civic or other laws, nobody in the society has the right to object. The general body cannot frame or amend bye-laws that are at variance with the laws of the country. Even by a complete majority, a general body cannot adopt an illegality. Please remember, you do not have the right to legislate and ‘lay down law’ for residents and apartment owners or even tenants.

A court has, in fact, known to have observed that “dogs are family” and can use lifts for free. Please ensure that this sort of restriction is not therefore imposed in the form of either a ban or any special charges for the use of lifts by pets.

With regard to the use of parks by pets, AWBI says, “Banning pets from garden or parks is short-sighted. Firstly, you may or may not own the garden or park in question. Secondly, pets that are not properly exercised may show aggression in frustration and that surely, cannot contribute to the benefit of the residents. It may be better to fix timings when pets can be walked without inconvenience to other residents. These timings can then be intimated to the general body.

Where the use of leashes/muzzles by pet owners, defecation by pets in community premises, imposition of fines and other similar measures is concerned, a

member may request pet-owners to keep their pets on leash when walking them in common areas. One cannot, however, insist on the use of muzzles. The law already provides for penalties for negligent pet owners, which the aggrieved parties can avail of.

AWBI has even clarified on the issue of cleaning of pet excreta by pet owners. “In the absence of central or state laws requiring cleaning of pet excreta by pet owners, one cannot impose any rule regulating bye-laws with respect to mandatory cleaning of the same or impose special charges or fines on pet owners”.

Nobody can impose fines and special charges of any kind on pet owners, because there is no mandate in law for the same.

If at all any association succeeds in intimidating a pet owner into ‘giving up’ or ‘abandoning’ a pet, it will actually have abetted violating the law and may well be aggravating the menace of ownerless animals on the street, that are not accustomed to living on the street and therefore get involved in and lead to accidents, injuries and deaths. Bear in mind that intimidation is an offence in law.

By law, stray dogs cannot be beaten, driven away or dumped elsewhere or killed. They can merely be sterilised in the manner envisaged in the Animal Birth Control (Dogs) Rules, 2001, vaccinated and then returned back to their original location. For area-wise sterilisation program that the law mandates be followed, dogs have to be returned back to their original habitat after sterilisation and immunisation.

There is a reason for the release of street dogs back into the same locality / territory after sterilisation and vaccination. Dogs being territorial in nature tend to fight off other dogs and keep them from entering their territories and this way the canine population in each locale stabilises.

It may be realised that there is no law that prohibits feeding street dogs inside or outside community premises and gated complexes. Citizens who choose to do so are in fact performing a duty cast upon them by the Constitution of India – of showing compassion to all living creatures. Various Courts, including High Courts, have upheld street dogs feeding since the same reduces human – animal conflict and suspicion and facilitates animal birth control (by making dog catching easier). Under Section 11 of the Prevention of Cruelty to Animal Act and Section 428 and 429 of the Indian Penal Code, animal cruelty is a punishable offence that could fetch imprisonment and fine. Also, any attempt to interfere with or harass persons who choose to tend to and feed community dogs, may tantamount to the offence of criminal intimidation.

“Last but not the least: any aggression or hostility that the dogs may be subjected to, will only render them aggressive and hostile to humans. They may then resort to snapping and biting in selfdefence. If the same happens, the human aggressors shall be the only ones to blame,” says the AWBI chairman.

UMBAI: Interim President of BCCI-IPL Sunil Gavaskar said the uncertainty over Jaipur's status to host the T20 league games and Rajasthan Royals' willingness to play in Ahmedabad led to the franchise's home ties to be shifted to the Motera Ground in the Gujarat city.

"What I can say is the BCCI-IPL had sent letters earlier on to all associations asking for their availability in view of the fact that this year the general elections are on. We have scheduled the matches according to the okays that we have received from various associations. And because

IN BRIEF Seven footballers arrested on spot fixing charges

LONDON: Seven players from Football League clubs in north-west England have been arrested in connection with alleged spot-fixing in matches. The footballers are all aged between 18 and 30, the National Crime Agency said. Six other men originally arrested in December on suspicion of involvement in spot-fixing, then later bailed, have been rearrested, the agency added. All 13 are currently being interviewed by police over allegations of bribery and money laundering.

Spot-fixing is where a player corruptly influences a specific element of a match, for example by intentionally getting a yellow card or conceding a corner, without trying to fix the final score.
