AUTHORIZING FY’2025 RYAN WHITE PART “A” FORMULA GRANT PARTIAL AWARD ALLOCATIONS TO PROFESSIONAL SERVICES PROVIDERS AND PROVIDERS AWARDED THROUGH A COMPETITIVE CONTRACTING PROCESS MARCH 1, 2025 THROUGH FEBRUARY 28, 2026

($787,530.00)

WHEREAS, the United States Department of Health and Human Services through its Health Resources and Services Administration (HRSA) has notified the County of Hudson of its FY 2025 HIV Emergency Relief Funds partial award under the Ryan White HIV/AIDS Treatment Extension Act of 2009 (Public Law 111-87) for the period of March 1, 2025 through February 28, 2026, in the amount of SEVEN HUNDRED EIGHTY SEVEN THOUSAND FIVE HUNDRED THIRTY DOLLARS AND 00/100 ($787,530.00) for distribution to various medical and social service agencies; and

WHEREAS, the Hudson County Department of Health and Human Services recommends that said funds be distributed to the following agencies in the amounts listed below, consistent with the Ryan White Part “A” guidelines and priorities set by the HIV/AIDS Planning Council as follows:

WHEREAS, the Local Public Contract Law, N.J.S.A. 40A:11-1, et. seq. permits the awarding of a contract for professional services without public advertising for bids and requires that the resolution and terms of the agreement be made available for public inspection; and

WHEREAS, the terms of the agreement are on file with the Clerk of this Board as required; and WHEREAS, the funding of agencies in categories 1 and 2 above are not subject to “Pay to Play” regulations as they are being awarded as professional services to not-for-profit agencies providing medical and social services; and

WHEREAS, the funding in category 4 is not subject to “Pay to Play” regulations as it is being awarded to a governmental entity which pursuant to N.J.S.A. 40A:11-5(2) is exempt from the bidding requirements; and

WHEREAS, on January 16, 2025, the Division of Purchasing issued a Request for Proposals (RFP) which was advertised as required in the Jersey Journal and Star Ledger for Ryan White FY’2025 Part A Formula Grant for service categories: Home Delivered Meals, and Other Professional Services-Legal; and WHEREAS, one the return date of February 7, 2025, the County received one responsive (1) proposal for the Home Delivered Meals category and two responsive (2) proposals to the Other Professional Services - Legal; and

WHEREAS, on February 21, 2025, the RFP evaluation committee convened and then scored the proposals that were received; WHEREAS, based on the results of the evaluation committee, the Hudson County Department of Health and Human Services has recommended that funds be awarded to Home Delivered Meals and Other Professional Services – Legal, specified in category Nos. 5 and 6 in the amounts listed below, consistent with the priorities set by the HIV/AIDS Planning Council as follows:

WHEREAS, the social service agencies listed in categories five (5) and six (6) were secured through a fair and open competitive contracting process pursuant to N.J.S.A. 40A: 11-4.1 et seq. is therefore not subject to the “Pay to Play” regulations; and WHEREAS, as a result of an additional Request for Proposals (RFP) advertised in

WHEREAS, Holmwood Data Consulting, 563 Van Buren Street, Ridgewood, New Jersey 07450 has the knowledge, experience and professional staff to perform these services; and

WHEREAS, these funds shall be utilized for Quality Management and Administrative Support Services at an hourly rate of ONE HUNDRED TWENTY FIVE DOLLARS AND 00/100 ($125.00), Data Coordination Services at an hourly rate of EIGHTY FIVE DOLLARS AND 00/100 ($85.00) and Ryan White Conference attendance at up to ONE THOUSAND THREE HUNDRED DOLLARS AND 00/100 ($1,300.00); and

WHEREAS, this award is not subject to “Pay to Play” regulations as the award emanated from a fair and open competitive contracting process; and

WHEREAS, the Director of the Department of Finance and Administration has certified that the funds are available for these above referenced contracts in Account No. 02-213-40-860-25-0000.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Hudson, that:

1. The aforesaid recitals are incorporated herein as though fully set forth at length.

2. The Board hereby authorizes the County Executive, Craig Guy, or County Administrator, Abraham Antun, or Deputy County Administrator, David Drumeler, or their lawfully appointed designee to execute any and all documents and take any and all actions necessary to complete and realize the intent and purpose of this resolution.

3. A Notice of this action shall be published by the Clerk of the Board of County Commissioners.

4. This resolution shall take effect immediately.
