PUBLIC RECORD REQUEST - Call for Review
It is my understanding that a Public Records Request (PRR) has been made with respect to a Call for Review by Vice- Mayor deHaan regarding an action of the Planning Board taken on Monday, January 11 , 2010. The purpose of this memorandum is to memorialize the actions - both verbal and in writing - with respect to this Call for Review. On Wednesday, January 13 , 2010 , Vice Mayor deHaan phoned me and inquired as to
the prior Monday. He indicated
was requesting a Call for Review on this decision of the Planning Board on the Kohl's use permit. On Thursday, I contacted Andrew Thomas , Supervising Planner via phone and indicated that this item was to be called for review per City Council policy. Andrew Thomas stated that such requests must be confirmed in writing. On Saturday, January 16, 2010, in a meeting with the Vice- Mayor , I advised him that I had forwarded the

that he
request to Planning and indicated that the request must be memorialized in writing. On January 27, 2010, I confirmed his written request in a response email.
At no time during this process was I apprised that the ' written request' was to be made on a City form. Neither staff nor the Vice- Mayor referenced a standard operating procedure for such calls for review.
Given the aforementioned facts , it appears that the request was ' technically ' received within the requisite ten day timeframe , despite the fact that the form itself had not been completed.
