How to protect yourself from Property Fraud Earlier this year saw the longest criminal trial in the UK’s history which resulted in fraudster Edwin McLaren jailed for eleven years for property fraud. Property owners are increasingly at risk from fraudsters who are constantly finding more inventive ways to commit crimes. Simon Nosworthy, Head of Residential Property at Osbornes Law looks at what property fraud is, who is considered vulnerable to property fraud and what home owners can do to protect themselves. What is property fraud? Property fraud can happen in many ways, however common types of property fraud include frauders selling properties they do not own to innocent third parties, or obtaining mortgages and stealing the money. More sophisticated types

of fraud involve persuading people to pay into non-existent investment funds. Simon Nosworthy describes property fraud as when ‘someone steals your identity and sells or mortgages your property by pretending to be you’. Who is especially vulnerable to property fraud? Anyone is a potential victim of property fraud, however, especially vulnerable include properties that are either vacant, tenanted, being refurbished or mortgage free. The elderly are also considered more at risk of property fraud. In the case of McLaren he took advantage of older people by offering his services as a financial adviser, and over time encouraged them to hand over the title deeds of their properties. Why does property fraud occur? Homeowners may be unaware that information held with the Land Registry is available to view by anyone through the Land Registry website. This unfortunately includes fraudsters, who can find out who owns a property and if there are any mortgages over it. Fraudsters can also find out lender details and sample signatures. In 2003 the Land Registry also did away with traditional paper certificates, which had to be presented to the Land Registry on any dealings relating to the property.

How you can protect your property One of the best ways to protect your property is by registering for property alerts at the Land Registry website. Once registered if anyone applies to change the register of your property you will receive an email alert. Although the service will not stop any changes from being made it will alert you to any fraudulent intentions on your property. Homeowners can also place a restriction on your title, which prevents the Land Registry from registering a sale or mortgage on your property unless a solicitor certifies the application was made by you. It is also important to ensure that your property solicitor has a rigorous anti-money laundering and identity check process to reduce the risk of property fraud. Understanding Edgware Last week estate agents Bladon Sears celebrated its 27th anniversary in Edgware. Being based in the area for so many years not only makes the firm experts in HA8, but affords a unique perspective on the way the place has changed. Nigel Sears agreed to elaborate on Edgware What was Edgware like when you first set up shop in 1990? As a young enthusiastic estate agent, we foolishly (or not) opened in the middle of a huge recession. At that time, the majority of our clientele who were selling had been in the area for a good number of years, but decided that it was time to move out of the area, with many relocating to Elstree and Radlett. We found the majority of our buyers were very mixed from all ethnic minorities. There was always a friendly family feel to the area and the Broadwalk Shopping Centre had not been open that long, so that was a definite plus.

What was the housing market like in Edgware then? As I said we opened in a recession, which had gripped the country for about two years. Prices were somewhat in a downward spiral. A typical threebedroom detached house in a good road would be in the region of £130,000 and a three-bedroom semi started at £85,000 in a reasonable road on the Broadfields side of Edgware. Our very first sale was a large two-bedroom flat in Springwood Crescent for £51,000. Did you have a favourite road? I’ve always have been great lover of Canons Drive and the roads off it. In particular, I’ve always loved the houses on the road that have retained the character from when they were first built. The pond is pretty and the lake is gorgeous! Also, Canons Park is at the top of the road, which is marvellous and also very sociable, especially for dog lovers. I used to walk my beautiful golden retriever in Canons Park

every morning, prior to bringing him into work with me, where his reputation preceded him! How much has Canons Drive changed? Actually very little except several houses have been extended and, only on a few occasions, houses have been pulled down and a much larger house built on the plot. By Canons Park, at the top of Canons Drive is North London Collegiate School, which has become even more popular. We find many families moving into these roads once their daughter has been able to secure a place at this very prestigious girls’ school.

How much has the profile of the typical buyer changed? So much. We still have vendors and purchasers from many ethnic minorities and, having been here for 27 years, many of the vendors bought through us and some houses we have sold three or four times. The Broadfields side of Edgware has become very popular with the observant Jewish community, with many purchasers moving from Hendon, Stamford Hill and Golders Green. The infrastructure is very strong, with many kosher shops opening up on Glengall Parade and at the bottom of Edgwarebury Lane going onto Hale Lane. The community feeling is very strong and because of not driving on Sabbath, we find that we move a family with their young children into a house and then, within a few months, we are selling to the parents as they need to be in walking distance from their family. Has the demand to be in a school catchment area impacted on your business? Rosh Pinah Primary School has always been

a huge pull to the area and it continues to do so. Rosh Pinah gives preference to those living within close proximity, making the Broadfields side of Edgware even more popular. How much is a family home in Edgware now? Going back to the properties mentioned from 27 years ago:  A three-bedroom detached house would now start from £700,000.  A three-bedroom semi on the Broadfields side of Edgware starts from £525,000.  And that two-bedroom flat would now have a value of just under £300,000. We now have had a number of sales reaching more than £1million, but a home needs to be big and very beautiful to achieve that price.
