Dear member,
April starts at a very difficult time for international trade, as the US administration announces Tuesday 2nd April as “liberation day,” when they will introduce a wide range of tariffs on imports from Europe.
It does appear that Irish government policy will be to fall in line with the EU response, and there is no sign we will seek sectoral carve-outs.
While ISME members are more exposed on the import than the export side, and therefore to the EU response to the US, sectors such as whiskey face an existential threat from the 200% US tariff.
The EU retaliatory list runs to 99 pages, and includes alcohol, confectionery, boats and other products which Irish SMEs import. These will need quick substitution with products sourced within the EU. Please let ius know if you are affected.
The more worrying impacts of a trade war with the US are changes to US tax policy which might impact Ireland’s corporation tax (CT) take. These could take the form of measures to re-shore intellectual property, or incentivise pharmaceutical manufacture in the continental US.
CT has now overtaken VAT in income terms for Ireland, so a reduction in CT yield would hurt. All the more reason for Minister Chambers to address affecting indigenous enterprise in Budget 2026. We want to see more Irish businesses scale and export in the future, and the tax code is key to achieving this. We will publish our pre-budget submission in the next eight weeks.
Ballot papers for the 2025-2027 National Council will soon circulate. We encourage as many members to stand as possible, and remind members we need to maintain a gender and sectoral balance on our NC.
We will hold an EGM at the end of April to permit a supernumerary member on our Board and our National Council. This reflects the fact that former chair Ross McCarthy has been elected to the board of SMEUnited in Brussels.
The European Accessibility Act comes into effect at the end of June. Its impact on most businesses will be minimal, but we will brief members on those sectors which are affected.
Hopefully, matters of international trade will be clearer when I write to you again in May.

Recent figures from the Central Bank show that nearly 70% of personal injury claims in Ireland are going through litigation, a worrying trend for businesses. Despite the existence of the Personal Injuries Resolution Board (PIRB), which can resolve cases more quickly and at the same compensation levels, litigation volumes continue to rise. This increase in court cases is not in the financial interest of plaintiffs, yet the trend persists.
ISME also revealed that Ireland’s personal injury cases exceed those in England and Wales combined, despite Ireland’s population being much smaller. Additionally, the number of defamation cases is disproportionately high. With personal injury awards already higher than in most European countries, ISME warns against further increasing them and suggests lowering the levels instead.

Ireland has a target to reduce carbon emissions (greenhouse gas emissions) by 51% by 2030, and to achieve a climate neutral economy by 2050 (source: Government Report). The sectoral emissions ceilings (SECs) agreed in July 2022 put in place targets for each sector to achieve this The target for the enterprise sector is to reduce emissions by 35% by 2030. In order to do this, businesses are encouraged to invest in a greener future, through sustainable products, services and business models.

Key events that influenced foreign exchange markets in February
• The European Central Bank cut its deposit interest rate by 25 bps to 2.5% (the sixth cut since July), noting "Risks to growth remain tilted to the downside".
• The Bank of England left the benchmark interest rate unchanged at 4.5% with its Monetary Policy Committee voting 8-1 for no change.
• The US University of Michigan Survey of Consumers for March posted a reading of 57.9, a 10.5% decline from February and the lowest since November 2022.
• The US dollar continued to weaken throughout the month with the euro reaching its highest level against the dollar since the November US election.
• Currency volatility remains elevated amid concerns about tariffs being imposed, and geopolitical and market uncertainty

A recent CIPD/Industrial Relations News survey has found just 60 per cent of employers have a policy for granting leave in relation to domestic abuse/violence, despite it being a legal requirement since 27th November 2023. This legislation provides for victims of domestic abuse/violence or those family members or friends who might provide support to them, to take up to five days’ leave in a 12month period.
The entitlement to domestic violence leave comes from the Work Life Balance and Miscellaneous Provisions Act 2023.
Domestic violence is defined under the Act as violence or threat of violence, including sexual violence and acts of coercive control committed against an employee or a relevant person in relation to an employee.
Employees do not need to be working in their job for a certain amount of time to qualify for this leave. And they do not have to give their employer notice to take the leave in emergency circumstances. However, they should give notice if they are able to.
An employee is not required to give their employer any supporting information or evidence when requesting domestic violence leave. There might be exceptional situations where an employer could ask for supporting documents, but this would be rare and is not in line with the intentions of the legislation.
As an employer you may assign a specific or designated person to handle matters related to domestic violence leave and other available support. The designated person could be a HR Manager or the business owner. It’s important that the designated person is well-trained to handle employee disclosures properly.
All employees who have experienced or are currently experiencing abuse are entitled to domestic violence leave. Employees who are supporting a 'relevant person' are also eligible for domestic violence leave. Who a relevant person is defined within the legislation.
An employee has the right to 5 days of domestic violence leave in any consecutive 12 months. This is the statutory entitlement (that means the legal minimum). An employer can take a decision to pay an employee more than the statutory entitlement, or they may decide to provide additional paid or unpaid special leave.
Part-time employees are entitled to domestic violence leave on a pro-rata basis. This means, for example, if an employee work 50% of a normal working week, they are entitled to 2.5 days’ leave.
The leave does not need to be taken all at once. It can be taken as single or multiple days. An absence for part of a day is counted as one day.
Domestic violence leave is paid by an employer at the employee’s normal daily rate of pay. An employer should not make any reference to domestic violence leave on an employee’s payslip.
Records of Domestic Violence Leave must be kept for a period of three years.
