GERMAN COURT OF APPEALS CONFIRMS CANUSA’S PATENT INFRINGEMENT La Corte d’Appello tedesca conferma la violazione del brevetto da parte di Canusa

n October 23, 2013, The German Court of Appeals of Karlsruhe confirmed an earlier lower court ruling that ShawCor Ltd., Canusa Systems Ltd. (Canusa) infringed upon STOPAQ’s 2004 patent (EP 1 644 433 B1) which is valid until 2024. STOPAQ’s 2004 patent protects the anti-corrosion composition on which the Company’s pioneering visco-elastic product “STOPAQ Wrappingband” is based. With this judgment, The Court enjoined Canusa from offering or placing its Wrapid Bond product on the German market. The Court ruled also that Canusa must compensate STOPAQ for any damages incurred as a result of the patent infringement. In addition, the Court of Appeals denied Canusa’s request for leave to appeal the decision to the German Federal Supreme Court. “I am very pleased with the courts’ rulings – not only for our company, but also for the people who labored to innovate, create and bring to market our unique visco-elastic technology”, said Frits Doddema, Executive Vice President with Berry Plastics and the Global Managing Director of STOPAQ. “The ruling sends a strong signal to the market that copying proprietary and protected technology will not be tolerated”. l 23 ottobre 2013, la Corte d’Appello tedesca di Karlsruhe ha confermato il precedente verdetto di un tribunale ordinario con una sentenza che dichiara come ShawCor Ltd., Canusa Systems Ltd. (Canusa) abbia violato il brevetto del 2004 di STOPAQ (EP 1 644 433 B1), valido fino al 2024. Il brevetto del 2004 di STOPAQ protegge la composizione anticorrosiva sulla quale si basa l’innovativo prodotto visco-elastico “STOPAQ Wrappingband” dell’azienda. Con questo giudizio, la Corte ha imposto a Canusa di non offrire o collocare il suo prodotto “Wrapid Bond” sul mercato tedesco. La Corte ha deciso inoltre che Canusa debba compensare STOPAQ per ogni danno nel quale è incorsa come risultato della violazione del brevetto.
