Legislation on genetics (genetic testing/ prohibition of discrimination on the basis of genetic heritage)
Agreements on the Protection of Patient Rights (Patients’ Charters) have been concluded between the Federal Government and the following federal states (Länder): • Carinthia (BGB1. I Nr. 195/1999) • Burgenland (BGB1. I Nr. 89/2001) • Upper Austria (BGB1. I Nr. 116/2001) • Lower Austria (BGB1. Nr. 36/2002) • Styria (BGB1. I Nr. 153/2002) • Tyrol (BGB1. I Nr. 88/2003)
Federal Physician’s Law (Ärztegesetz 1998 BGBl. I Nr. 169/1998) § 54 (relates to confidentiality)
Gene Technology Act (Gentechnikgesetz – BGBI Nr. 510/1994) – Part IV relates to the issue of genetic testing (§§ 65 – 79) and regulates among other things: allowed purpose of a genetic test, (written) informed consent, persons and premises allowed to perform genetic tests, genetic counselling) which is only allowed for research or medical purposes. The act has been amended several times, for the last time in November 2005, where it was stated among other things that genetic testing for medical purposes is only allowed if performed in accordance with the state of science
