One of the newest independents to be welcomed to our diverse town centre is The Merry Cobbler, based on Mill Lane, Mell Square. Owner Robert Grove knows all about Solihull having started out his business in the old Solihull market on the High Street, pre-Touchwood. After decades of success, Robert and The Merry Cobbler have returned to the town and their focus on customer satisfaction has already paid dividends. Not only do they offer traditional cobbler services, Robert’s business also cut keys of all shapes and sizes, engrave trophies and awards and replace watch batteries among many other services. Our Digital Communications Lead, Steven, spoke to The Merry Cobbler owner Robert Grove about life as an independent business in Solihull.


Steven: Could you tell us a bit about The Merry Cobbler and what you offer? Robert: We do a bit of everything! We cut keys for everything and anything including house keys, car keys and safe keys. We repair shoes including replacing zips on boots which not many people do. We can also stitch shoes and undertake all patching work. Replacing watch batteries is another service we provide and for an extra £5 we provide a lifetime guarantee for the watch battery and when they have one we record the details of the watch and they never have to pay for a replacement battery in that watch ever again. If you’ve got a special occasion coming up, we sell engravable items and can also engrave all metals. There’s something for everybody. We are giving a keyring away to every customer with a £1 off voucher for life inserted in the keyring, a brilliant giveaway. S: You are now on Mill Lane, Mell Square but you were also previously in Solihull – could you explain a bit about your history? R: I started repairing shoes in 1976 for a company called Payne’s. I then went to work for Mister Minit and later Sketchley where I was manager of

the year several times. I then went to work for an independent, soon rose through the ranks within the company and ended up learning all the pros and cons of running a company. I was given an opportunity to open a stall in the then Solihull market at the old Mac Fisheries. This was in the days when the High Street was a high street with cars driving up and down and there was a cinema on the High Street too. I identified there was a chance for an independent to start up in Solihull, so I went and winged it with the then manager of the market. I had nothing but a bag of tools, so I was on my knees knocking in a pair of stiletto heels! The father of one of my friends built me a counter and I knew somebody else that had all the machinery. That’s where it all began. When the market shut to make way for Touchwood, I bought a rundown stall in Merry Hill in Dudley and have since bought shops in Derby before coming back to Solihull. S: What makes your independent business unique? R: We are so much cheaper price-wise than our competitors and we do a

very professional job. Our customers tend to be for life as they love our attitude and professionalism. Every one of our customers are very important to us. Solihull has been very welcoming so far. S: Why did you choose Solihull as the destination for your next store? R: I chose Solihull many years back as I have said, and since the day the market closed I have tried to get back into Solihull. I came close at one point but I am just pleased now to be back in the town centre. The people of Solihull are fantastic customers and we want to keep them forever. S: What is the most important advice you would give to somebody planning to open up their own independent business? R: The advice I would give to anybody thinking about starting up a business is, if you are 100 per cent sure it will work and you have enough cash behind you to just about survive, go for it! If you’re going to open up a shop, make sure you have maybe a year’s rent in the bank. High Streets are changing every year and there is no pattern anymore.

Nick Eastwood

Nick Eastwood is Chief Executive of the Wasps Group, which encapsulates Wasps Rugby Club, as well as Wasps Netball. The Group also drives a unique blend of live sport, entertainment, conferences and exhibitions at Ricoh Arena. What does your day-to-day role involve? “My role is that of a custodian for the Wasps Group. This can range from overseeing the day-to-day running of things behind the scenes, to representing the organisation at various events with high-level stakeholders.” What drives you every day? “Working for a sporting organisation drives me on. I love sport, rugby in particular, and I feel really privileged to be in the position that I am currently in at this famous, forward-thinking business.” What does success mean to you? “The development of players such as Elliot Daly who joined Wasps as youngster and is now a fully-fledged England International, as well as seeing people behind the scenes develop in their own roles too are both gratifying for me.”

What’s the biggest lesson you’ve learned from your time in business? “Business is about building relationships with people. It doesn’t matter if you’re negotiating a loan with a big bank or working with an apprentice, everybody should be treated with the same level of respect.” Who inspires you? “My father was the first person to inspire me – he left school at 16 and became a successful businessman off his own back and is still going strong. “I have numerous sporting heroes such as Martin Johnson and Jessica Ennis – all of whom have achieved marvellous things but are so humble.” What would you tell your 18-year-old self? “Eminent US broadcaster Katie Couric’s advice stands out for me, which is to take time to really understand what you love doing, and find somebody who will pay you for it!”

EXCITING NEW FOOD & DRINK OFFERING The operators of award-winning gastropub, Tap & Tandoor, are to work with Mell Square shopping centre owners, IM Properties, to develop Taste Collective – an exciting new food and drink offering to be launched in Solihull town centre in December.

aste Collective will provide a range of experience-led offerings to include cocktails and desserts, alongside four pop-up style, street food kiosks and a covered outdoor pergola style seating area, where people can meet up and socialise throughout the day.

Tap & Tandoor were winners of the Best Independent in last year’s Solihull BID Excellence Awards and have enjoyed considerable success since opening in the former Saddler’s Arms pub in Solihull. Rob Hemus asset director for IM Properties said: “The team behind Tap & Tandoor and Zindiya in Moseley will deliver this new immersive eating experience and have a proven track record for delivering

innovative new eating and drinking experiences within the region. “Both IM Properties and the operator have a shared vision to create a vibrant town centre and are keen to see independents flourish and are inviting local traders to get involved with the pop-up street food element of the scheme. “We’re incredibly excited to be working in partnership with the team behind Tap & Tandoor and Zindiya. SPECIAL REPORT

HOW THE BID AND PARTNERS ARE TACKLING HOMELESSNESS Solihull BID is working with expert organisations to address an incredibly challenging issue. Stacey Barnfield finds out more about alternative approaches to tackling homelessness.

L

ike many town centres across the UK, Solihull is faced with the complex and sensitive issues related to rough sleeping and begging.

Anyone who has visited the town centre recently will have witnessed street begging and at least two or three people with their sleeping bags and belongings around them. Solihull BID, the Business Improvement District for town centre companies, is

working with Solihull Council, West Midlands Police, The West Midlands Combined Authority and expert support organisations such as youth homelessness charity St Basils to attempt to address the issue. The BID believes it should play its part in tackling such a challenging topic, while making sure people affected are treated with the respect and dignity they deserve. Solihull BID has three dedicated Town Hosts – aka ‘the purple

people’ – who patrol the town centre seven days a week, making them the eyes and ears of what’s happening day to day. They engage daily with individuals who present as homeless or those begging to find out more and signpost to the relevant professional organisations to fast track assistance where needed. “If you are in doubt that Solihull has an issue with rough sleepers or beggars here are some illuminating statistics: reports made to our hosts on the begging

They have been recruited to act as a robust measure to deter and disrupt criminal and anti-social behaviour. Being accredited by the Security Industry Authority (SIA), their duties involve supporting retailers to reduce thefts and identify offenders, responding to low level

anti-social behaviour and street begging whilst assisting rough sleepers by signposting them to the relevant support agency. Meanwhile, kind-hearted members of the public are being asked to consider a different approach through an alternative donations scheme called Change Into Action. Solihull BID is partnering West Midlands Combined Authority’s Change Into Action, which encourages people to donate to charities and organisations who are able to offer expert support to the homeless. Change Into Action leaflets are being handed out to the general public informing them of what support is already in place and who to contact with any concerns they may have. Ms Palmer adds: “You will see leaflets in all of our businesses educating the public on what is already being done

to help the increasing levels of rough sleepers and beggars and how to join the campaign to help change lifestyles and enable a safe journey back into the workplace and society. “The BID is encouraging people to donate to Change Into Action as an alternative way of giving. Four BID member businesses – Sporting Barbers, Specsavers, William Hill and Touchwood – have collection tins to assist with those who would prefer to donate change than go online. “Solihull Churches Action on Homelessness are assisting alongside Solihull Council, and SIAS (Solihull Integrated Addiction Services) are providing the professional guidance. Together we are all committed to getting our vulnerable people into a safer place and healthier lifestyle.” Mayor for the West Midlands Andy Street pledged to make

tackling homelessness and rough sleeping a priority. One of the first actions was the creation of a Homelessness Task Force which aims to ‘design out homelessness in the West Midlands’. Meanwhile, a Solihull Council strategy for dealing with homelessness in the borough has also been approved. The initiative comes on the back of figures which suggested hundreds of households are at risk of homelessness in the borough. Data from Solihull Community Housing – the council’s provider of temporary housing – shows an alarming increase in the number of people considered as homeless in the area, with the number applying as homeless in the period from April to the end of November in 2018 seeing a 60 per cent increase on the same period in 2017. “If you want to come and talk to us and share your thoughts, then you can find the BID Gazebo on the High Street from 12pm – 3pm every Thursday,” adds Ms Palmer. “Delivering the message to the public about an alternative way to give will be contentious and our pathway moving forward will certainly not be easy. Our message is clear; however, we are here to help and drive the change into action needed to save lives, treating everyone with respect along the way.” 17

Jingle Bell Jog Join Solihull BID to spread plenty of Festive cheer this December by donning a Santa suit and completing our Jingle Bell Jog to raise money for Change Into Action. The Jingle Bell Jog, taking place on Sunday 15th December, will see Solihull town centre swamped with more than 100 Santas! Every single person who completes the 2.5km course throughout the town centre will be given a Santa suit and a special medal. Your local, award winning legal experts Employment Tribunal rules Vegetarianism is not a belief for purposes of Equality Act 2010 A Waiter lost his claim for discrimination on the grounds of religion or belief after claiming he had been discriminated against by his employer for being a vegetarian. Jade Linton of Thursfields Solicitors explores the law relating to religion and belief and examines what an Employment Tribunal might consider in order to determine whether a belief amounts to a protected characteristic under the Equality Act 2010.

The Law

Religion or belief is one of nine "protected characteristics" covered by the Equality Act 2010 (“the Act”). The other protected characteristics are age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, sex and sexual orientation. The Act describes "Belief" as any religious or philosophical belief and a reference to belief includes a lack of belief. Direct religion or belief discrimination occurs where, because of religion or belief a person (A) treats another (B) less favourably than A treats or would treat others. Direct discrimination cannot be justified, but an employer might be able to rely on an exception to avoid liability, such as pointing to an occupational requirement. The Employment Appeals Tribunal (“EAT”) gave guidance on the definition of philosophical belief which included but was not limited to the descriptions below:

The belief must be genuinely held. It must be a belief, not an opinion or viewpoint based on the present state of information available. It must be a belief as to a weighty and substantial aspect of human life and behaviour. It must be worthy of respect in a democratic society, not be incompatible with human dignity and not conflict with the fundamental rights of others. It must attain a certain level of cogency, seriousness, cohesion and importance. It must "have a similar status or cogency to a religious belief". However, it need not "allude to a fully-fledged system of thought". It need not be shared by others. A belief in a political philosophy or doctrine, such as Socialism, Marxism or free-market Capitalism, might qualify. A philosophical belief may be based on science. If Creationism (which is based on faith) is protected, Darwinism (which is based on science) "must plainly be capable of being a philosophical belief".

The Facts

In Conisbee v Crossley Farms Ltd and others ET/3335357/2018 (10 September 2019) The Tribunal heard how Mr Conisbee resigned from his employment as a Waiter with Crossley Farms Ltd after 5 months of employment. Mr Conisbee alleged (amongst other things) discrimination on the ground of religion or belief contrary to the Act, his belief being vegetarianism. At a preliminary hearing, an employment tribunal, using the guidance given by the EAT concluded that this belief did not qualify for protection under the Act.

The Decision

The Tribunal concluded that whilst it was clear Mr Conisbee’s belief in vegetarianism was his opinion and view point that the world would be a better place if animals were not killed for food, the belief alone (whilst an ‘admirable sentiment’) was not enough to have an opinion based on some real, or perceived, logic. The Tribunal did accept that there were many vegetarians across the world; however, felt the reason for being a vegetarian differed greatly amongst those individuals, unlike veganism where the Tribunal felt the reasons for being a vegan appeared to be largely the same thus having a clear cogency and cohesion as opposed to vegetarianism which has “numerous, differing and wide varying” reasons for adopting the practise.

The Comment

An interesting case and one which is bound to raise some questions and debate amongst those who by virtue of their belief in vegetarianism consider it to be a belief worthy of protection under the Act. It was clear that the variation in reasons for holding the belief differed so much as to prevent it from having a certain level of cogency and cohesion. Had it not been for this it is probable the belief may have crossed this hurdle. In any event, the belief as it is currently held was not found to concern human life and behaviour but was rather held to be more of a lifestyle choice thus not satisfying the guidance from the EAT that in order to be protected by the Act a belief must concern a weighty and substantial aspect of human life and behaviour. This decision is not binding on other Tribunals but nevertheless provides some indication of how a Tribunal is likely to approach claims about religion or belief discrimination based on vegetarianism.
