Nancy Comenta LETTER FROM THE EDITOR-IN-CHIEF Hay una expresión en español que me decía mi madre cuando yo estaba pasando por un momento difícil en la vida y es tan cierta “no hay mal que dure cien años ni cuerpo que lo resista”.

Entrando en la primavera, por fin el futuro comienza a verse mejor, ya que muchos de nosotros hemos sido vacunados y otros pronto lo estarán. ¡Nunca pensé que esto se prolongaría por tanto tiempo! Pero la luz al final del túnel llegará pronto. Estoy segura de que muchos han notado el tráfico últimamente. ¡La gente está en la calle, afuera de sus casas disfrutando de este clima tan agradable!

Tenemos una edición buenísima, créanlo o no- con algunos eventos, por fin, e incluso un articulo de crucero por Europa.

Esta edición se la dedico a la persona más amable y querida que he conocido, mi madre, que lamentablemente ya no está conmigo, pero siempre la recuerdo por su bondad y su corazón de oro. ¡Espero que todas las Madres celebren este maravilloso día a lo grande!

There is a Spanish expression my mother would say to me when I was going through a rough time and it’s so true “no hay mal que dure cien años ni cuerpo que lo resista” meaning --there is no evil that lasts a hundred years as there is nobody that resists it.

Moving into Spring, and finally, the future is starting to look brighter as many of us have been vaccinated and others will soon be. I never thought this would drag on for so long! But the light at the end of the tunnel is coming soon.

I’m sure many have noticed the heavy traffic lately. People are out and about, and the weather is truly amazing!

We have a lovely issue, featuring some believe it or not—

events! and even a cruise feature for those wanting to add the Rhine River to their bucket list.

I dedicate this edition to the kindest person I’ve ever met, my mom, who unfortunately is not with me, but her goodness and heart of gold are always remembered. I hope all the moms out there celebrate this 2021 Mother’s Day in a grand way!

Riezl Baker Selling Luxury Real Estate while giving back to the Community

R

iezl Baker is a luxury realtor with many talents. She has been a top producer at the beautiful Lake Oconee, Georgia for 20 years, a philanthropist who has been involved in leadership roles for different community organizations, a writer, a marketer, and an excellent cook known for her international dinners that she donates to different charity auctions. She also plays the piano very well, and by ear.

As a realtor, she is a consummate professional and has received numerous awards over the years for her business accomplishments. She was recently recognized as a “Top Luxury Real Estate Industry Leader” by The Atlantan.

Riezl co-founded and launched Luxury Lake Oconee Real Estate Group in January 2020 and finished a record-breaking year, personally selling over 59 luxury homes and properties.

Originally from the Philippines, Riezl grew up in a family that valued education and hard work. “My father had a tireless work ethic who instilled in me that nobody owes me anything, life is a gift, and I owe it to myself to give 100% in everything I do. I worked in his hardware store every summer from 6am-sundown and it taught me a lot of life lessons,” she added.

What is your area of specialty?

My primary focus is international white-collar defense and anti-bribery/ anti-corruption compliance. I represent individuals and companies in criminal investigations and prosecutions in the United States. On the flip side, I counsel companies and manage their anti-bribery/anti-corruption programs, in order to help keep them from running afoul of the U.S.’s anticorruption laws, which are broad and far-reaching. I also serve as outside counsel for international companies’ large-scale transactions that involve government entities.

When a company is involved in international business, there is a risk of corruption, especially when a government client is involved. I advise clients and their employees on what is considered illegal conduct by the U.S. government and established international law.

What types of companies require an International Anti-Corruption/ Anti-Bribery Attorney?

Any company involved in international business should look to implement an anti-corruption policy through outside counsel. International business involves plenty of high-risk areas. For example, most import/export businesses deal with customs, international taxes, and permit approval issues with foreign governments. In much of the world, some low-level and high-level government officials seek to supplement their income via demanding kickbacks or bribes from private companies. As outside counsel, I implement programs and policies designed to prevent companies from engaging in bribery or other corruption.

In the event there is an official investigation into a client’s business, our clients will be able to say that they have provided comprehensive training to their employees and have retained outside counsel to manage their third-party transactions. We also vet foreign partners to ensure they are providing legitimate services, and that there are no kickbacks being made to government officials.

In what respect do you represent clients in the U.S? I represent clients that have been charged by the U.S. government or are under investigation for white-collar crimes. I have also spent years litigating commercial and high net-worth family law disputes in civil court, which is a large part of Coffey Burlington’s practice. Because we are in Miami, a big focus of my practice is in defending clients in international money-laundering and bribery cases. In recent years, the Federal Government has brought many corruption and money-laundering cases against foreign nationals or dual-citizens residing in South Florida.

We also work on extradition and Interpol matters, and we defend foreign nationals residing in other countries when the U.S government is looking to extradite them.

Can you describe a recent high-profile case?

I recently successfully represented a very high profile former South American government official before Interpol, and obtained a removal of his Red Notice (which meant he could not leave the United States, or else he would be subject to arrest and extradition to his home country), on the basis that the criminal case against him was politically motivated – which is a tough burden to establish in Interpol. I also succeeded in having a civil case dismissed that had been filed against him in a Miami court. This case received tremendous press attention in my client’s home country, and also was picked up by the Miami Herald, the New York Times and other publications in the United States.

Which are some of the biggest companies you have represented?

I am counsel to a large global oil and gas company, I have represented large national accounting firms, international machinery distribution companies, and others.

We defend individuals who have suffered injustices in their country due to the political manipulation of judges and prosecutors by their executive branches.

The ultimate goal is to obtain a written opinion from the UN condemning the behavior of the foreign country. Clients that feel they have been unjustly persecuted by their home countries place tremendous value in obtaining these opinions, and it helps clear their name in the court of public opinion.

Prior, you were a Coordinator of International Scouting for the Boston Red Sox and oversaw legal issues involving international player age and identity fraud.

Baseball is where I got my first taste of travelling to South America extensively. I was frequently on the road to negotiate with agents and sign players. When you work in international baseball, you see that there are shady elements that exist with the way international players are handled by their agents. It opened my eyes to international corruption and made me excited to make that subject a focus of my practice.

Your first job was as Assistant State Attorney at the Miami-Dade State Attorney’s Office?

Yes. I learned to be a trial lawyer while doing criminal prosecution in Miami.

You get thrown into the fire without any experience, and you are in court all the time. You learn to think on your feet and to be fearless – it was quite a valuable experience.

You have a number of accolades and achievements - what would you say is your top achievement?

Being named partner at Coffey Burlington has been my greatest professional achievement. We are an incredibly exclusive law firm with an outstanding reputation in the national and international legal communities. I compare our roster of attorneys to Marvel’s Avengers – every lawyer at our firm has a slightly different super skill-set, and ultimately, we win and provide the desired results for our clients.

You are an Adjunct Professor of Law at the University of Miami School of Law, where you teach International Anti-Corruption Law and Practice?

Yes, professionally, teaching keeps me on top of my game because I have to continue researching the latest cases/trends in international corruption. I like the intellectual exercise and giving back to the legal community.

What community involvement is the most rewarding for you?

The mentoring of underprivileged high school students, and to see these outstanding kids who are self-starters achieve their dreams is an awesome feeling. I love being a positive influence and seeing the impact that it makes.

What is your #1 code of ethics?

Always be honest with clients, judges and opposing counsel. Your reputation is all you have.

Did you always have a passion for justice?

I always wanted to be a lawyer. I think maybe my interest began with Hollywood movies like “The Verdict” and “A Few Good Men.” More than anything now, I enjoy going to battle for a client and being a champion of their cause.

Your favorite hobby?

I love guitars. I have been playing since I was 13, but in recent years I started buying and selling vintage guitars as a hobby as well. It gives me joy to sit and zone out and play a great guitar. I record my own songs and jam with professional players in town. I have represented some musicians and music business clients in the past, and I would love to expand that practice. And I really hope my daughter Bianca becomes a musician after me. I bought the pink guitar you see in this article for her. She has rhythm and a great musical ear!

P.J. Mitchell The average American while in the mist of COVID-19 is asking themselves whether the government can mandate vaccines to the general public. There are two United States Supreme Court cases which deal directly with immunizations.

When evaluating whether governmental action can mandate the utilization of vaccines, we must analyze the United States Supreme Court rulings in the matters of Jacobson v. Massachusetts, 197 U.S. 11 (1905) and Zucht v King, 260 U.S. 174 (1922).

In sum, Jackson stood for the proposition that vaccines can be mandated by state action through the police powers provision of the Tenth Amendment of the United States Constitution which gives states authority to decide when to impose health regulations; Zucht stood for the proposition that there is broad authority to decide when and under what circumstances to impose health regulations.

In 1902, the City of Cambridge, Massachusetts passed a controversial ordinance requiring all adults be vaccinated for small pox. In the event anyone refused the vaccine they would have to pay 40 | April / May 2021 | www.holalatinosnews.com

Spencer West a civil fine in the amount of $5. Jackson objected to the vaccination mandate as the ordinance was a mandate. He brought a lawsuit against the State of Massachusetts for the implementation of this mandate. Most notably, he argued that his constitutionally protected “liberty” interests were being infringed upon by this municipal ordinance. The question was whether the State had overstepped its authority and whether personal liberty protected by the Due Process Clause of the Fourteenth Amendment included a constitutional right to refuse to take the small pox vaccine.

This matter before the Court dealt exclusively with state power and not the federal government’s power to administer the vaccine. According to the Court, it opined that at times individual interests might have to yield to state laws that protect the public’s health. In response to Jackson’s argument regarding his individual liberty interest, the Court held that “the rights of the individual may at times, under the pressure of great dangers, be subjected to such restraint to be enforced by reasonable regulations as the safety of the general public may demand.”

For context, it’s important for the reader to understand that State powers are derived from the

Tenth Amendment of the United States Constitution which in turn grants states the power to establish laws protecting the “welfare, safety, and health of the public”. In general, municipalities are granted their power by the State and these local governing bodies are directly elected by the people.

Specifically, under the police powers granted to the states, which is under the Constitution, the authority to enact “reasonable regulations” as is necessary to protect public health and safety falls on the states. Therefore, vaccines can constitute state action to protect the general public’s health.

Additionally, in 1922, in Zucht v King, 260 U.S. 174 (1922), the Court held that a municipality’s city ordinance that prohibits anyone from attending a public or private school without a certificate of smallpox vaccination was constitutional. Ms. Zucht, who refused the vaccination challenged the ordinance as unnecessary and arbitrary. The Court in its opinion simply stated that the Constitution grants cities broad authority to decide when to impose health regulations. In sum, based on the Court’s prior precedent states can require the people that live within that state be vaccinated.

The main goal in Ayurveda is to eradicate disease through purifying the mind and body, so that we achieve our full human potential. ORGANIC VODKA APPLE KOMBUCHA CRUSH 1 ½ oz Frankly Organic Apple Vodka 1 ½ tsp sugar ½ tsp cinnamon Lemon wedge 3 oz ginger kombucha ½ oz fresh squeezed lemon juice ½ oz maple syrup Mix sugar and cinnamon on a plate. Smear rim of glass with lemon wedge. Dip rim in sugar mix. Add ice to shaker and pour vodka, lemon juice, and maple syrup and shake. Add ice to glass and pour liquid. Add apple slices and kombucha. Garnish with sage and cinnamon stick.

SALTY CINNAMON DOG 2 oz Frankly Organic Grapefruit Vodka ½ tsp kosher salt Zest from 1 lime Pinch of cinnamon ½ fresh squeezed lime juice 4 oz sparkling grapefruit juice Blend salt and zest.
