CEO'S MESSAGE

JAMES OXENHAM HRIA CEO

It's all about the people 2023 HAS BEEN A BUSY YEAR ON MANY FRONTS FOR THE ASSOCIATION AND ITS MEMBERS.

During the most successful convention of the last 50 years, HRIA Women in Hire and Young Professionals saw a strong cohort complete their development programs, with record numbers signing up for the following year. The HRIA also promoted careers in hire at the Western Sydney Careers Expo in front of more than 20,000 school leavers. These highlights all have one thing in common: people. Attracting and developing individuals and cultivating connections between people are two priorities directly from our strategic plan. Globally, the HRIA helped shine the spotlight on the hire industry, aligning with the inaugural European Rental Week, promoting the concept of hire to a wide-reaching audience across social media channels. At the European Rental Conference in June, the focus was ‘Investing in people’ with expert keynotes on the subjects of HR, recruitment, training and retention. Business has been going strong across different sectors and our events members are gearing up for a busy peak period over the summer months, with sporting events, weddings, music festivals, and corporate and community events in full swing. However, the HRIA Events President signals caution

4

as inflation starts to bite among smaller members (pg. 52). Some members are also feeling a slowdown due to challenges facing the residential construction sector, where uncertainty around government support and the legacy of unsustainable pricing models continue to wash through the sector. For the most part, with infrastructure and commercial construction still performing well, the outlook is generally favourable over the short to medium term. With our vision being – ‘To make hire the preferred choice for Australian consumers and businesses,’ the HRIA helps members push the ‘Why hire’ message out. This is particularly important now that we see more demand for sustainable equipment and power. The hire model is sustainable by its very nature, with assets being used by multiple customers over their lifecycle, which are much less likely to sit idle. With increasingly attractive alternatives to diesel, the industry is taking strides to proving itself as a progressive, sustainable business model, helping customers meet ESG targets, cementing hire as the preferred choice. The HRIA works hard to assist members in developing their people. The HRIA programs and events that members attend is a source of great job satisfaction. It is extremely gratifying to learn how our programs help individuals on their career path in the hire industry, and if the HRIA has contributed in any way to the development of tomorrow's leaders, then we are thankful for the opportunity.

The industry is taking another step to proving itself as a sustainable business model, servicing customers, helping them meet their ESG targets, and making hire their preferred choice. NOVEMBER 2023

Coates shines a light on power and HVAC WITH COATES POWER & HVAC BUSINESS NOW UP AND RUNNING, MANAGER KURT EDWARDS SAYS THEY’RE IN A GREAT POSITION TO DELIVER TURNKEY PRODUCTS AND SOLUTIONS TO MEET CUSTOMER NEEDS NOW AND IN THE FUTURE.

When Coates launched its power and HVAC division in August 2023, the aim was to provide smart, innovative and seamless temporary air, power, climate and process cooling solutions to companies across Australia. “It’s no secret that Coates’ business strategy is to expand further into solutions,” explains Manager, Kurt Edwards. “With power and HVAC, we had the foundational elements — power generation and compressed air equipment — already available in our fleet. We identified that adding HVAC equipment allowed us to offer customers a more complete solution.”

NOVEMBER 2023

“With the hardware onboard, it was about putting people and skills into Power & HVAC and shining a light on it.” For Edwards, the opportunity to lead the division was a rare opportunity to bring together his unique mix of skills and experience. With a background in refrigeration and air-conditioning, first as a technician and then having worked in management and sales, electrical engineering, business development and rental, he was well-placed to take on the role. In his first year with Coates, he worked to combine their existing power generation

and compressed air offerings and develop their temperature-control range. He also began recruiting a team that could service their power and HVAC customers. Now in his second year, Edwards continues to build on the company’s offering, ensuring operations across their customer sectors are seamless. To service customers, Coates Power & HVAC have a national team of specialist mechanical and electrical engineers backed up by local sales and product specialists. They’re also supported by fitters and electricians in each of Coates’ major hubs with a plan to bring more tradespeople and expertise into regional branches to be closer and more responsive to customers. “People are our biggest asset,” he says. “We spend time training our new people to ensure they’re up to speed with the equipment and how we do things at Coates, but we really look to the individual to add value.” “I like this idea of, ‘I’ll tell you what I know, then you take it from there and bring your own ideas and skills to the table.’ That’s where we’re at now.”

“You need to come at a challenge from a range of different angles to find the solution that offers the best fit, the most flexibility, is the most robust and reliable.” From Edwards’ perspective, it’s also giving Coates ‘more strings to their bow’ as they work alongside the company’s other solutions businesses. “At Coates, we look to our existing relationships to drive our focus on the areas we want to operate. Sectors like infrastructure, Mining and Construction all have requirements for temperaturecontrol and power generation. Then there are less traditional users of rental like manufacturing, who require cooling or heating solutions, temporary compressed air or assistance with their power systems.” “That’s very much in the power and HVAC space.” With a commitment to customer service being at the core of Coates Power & HVAC’s offering, Edwards sees remote monitoring systems as a key technology for the business as they continue to grow. “Coates has been on an extensive journey with telematics, looking at how plant and equipment is performing and using that critical data and information to better serve our customers,” he says. “Having the ability to monitor our equipment in real-time and respond

quickly to any changes in conditions or issues on site, ensures reliability and provides peace-of-mind for our customers. That’s a real value-adding service tool for our division.” Looking ahead, he has a positive outlook about where Coates Power & HVAC — and the hire industry more generally — will go. “From where I sit, the future is very exciting,” says Edwards. “At Coates, temperature control is new and we’re getting it out into the market now.” “I’ve also been speaking to our utility customers about the challenges that solar, for example, brings and how rental can help take the bumps out of their network through back-up power and by integrating with existing plant. These are interesting spaces to be operating.” Edwards says it’s one of the biggest things he enjoys about the hire industry. “You don’t know what you’re going to learn or what you’re going to be asked to do, it’s very dynamic,” he says. “When you come from an engineering background, you have inputs to get the

outputs. But sometimes in hire, the inputs don’t line up or you don’t have all the information you need. That’s where you need to come at a challenge from a range of different angles to find the solution that offers the best fit, the most flexibility, is the most robust and reliable.” It’s why Edwards and his team have to be adept at solving customer challenges on the go. “The problem might not be in selecting the right equipment,” he says. “The problem might be in how you get it there or how you integrate it with site activity.” “Challenges could arise at any point of the process, from specifying a solution to winning the job, getting equipment to site, commissioning and maintaining the system ensuring operation. A lot goes into a successful project and we operate in very dynamic environments.” In the immediate future, Edwards will continue to build on Coates’ temperaturecontrol range to complete their HVAC suite as most of their other product lines are already well established. “That’s a big focus,” he says. “Basically, it’s about listening to our customers, that’s our priority. We’ll continue to ask questions and see how we can better place ourselves to support them in the future with products and solutions.” “It’s the common theme that runs across the hire industry – listening to customers. We’ve all got our own disciplines but the customer will always be the common element.” 

Listening to our customers, that’s our priority. We’ll continue to ask questions and see how we can better place ourselves to support them in the future with products and solutions. Kurt Edwards Manager – Coates Power & HVAC

SB HIRE & SALES

Hire&Rental

Making a regional difference with Hire SB HIRE & SALES’ GENERAL MANAGER, ALEISHA GRAY, SAYS MOVING INTO THE HIRE INDUSTRY WAS ONE OF THE BEST DECISIONS SHE’S EVER MADE.

It wasn’t the most conventional way to enter the Hire industry, but for Aleisha Gray and her husband Mitch, an opportunity to buy an established Hire business in Kingaroy (around 220km north-west of Brisbane) was too good to resist. At the time, they’d been running an electrical contracting business in the local area for over 10 years and had got to the point where Aleisha wasn’t really involved and was looking for something more. “We weren’t specifically looking for a business in hire, we were just looking

8

for a business in our local area where we could make a difference,” says Aleisha. “We saw this business come up for sale and while we thought about it for a while, it fitted our needs and is probably the best decision we’ve ever made.” SB Hire & Sales has operated in the South Burnett region for more than 30 years. Aleisha and Mitch took over on 1 July 2022, spending the first 15 months giving the business some much needed love and attention. With a relatively new team at SB Hire & Sales — their longest serving team member when they took over the business had been there for six weeks — they’ve had the opportunity to mould the team in a culture they want the business to have, including in how they approach customer service.

“We weren't specifically looking for a business in hire, we were just looking for a business where we could make a difference.”

“We knew from our electrical business that customer service has to be impeccable,” says Aleisha. “It’s so vital to ensure your clients are happy.” “So we presented our values to the team and said, ‘this is what we expect and how we should all be treated so that’s how we want our customers to be treated.’ One of those was that we will sacrifice profit on a sale to make a customer for life. That’s what we’re instilling in our team.” From a customer perspective, there have been changes as well. When they first bought the business, it was primarily catering to small business operators and the DIY sector However, in the last 15 months, their customer base has shifted towards larger companies. “South Burnett is the biggest growing and processing area for Duboisia plant (grown commercially for the pharmaceutical industry),” says Aleisha. “We’re also home to a bacon processing plant and a peanut processing plant plus a coal mine and power station. There’s also a solar farm and battery being built which will be a big change for this community.” As a novice to the hire industry, Aleisha has had to adapt and learn on the job. “Buying an established business was very different to doing a start-up electrical

10

business,” she says. “You’ve got to be patient and do the work. Nothing happens quickly, so you’ve got to do the hard yards to get where you want to be.” “At the start of the year, I was impatient,” says Aleisha. “Then all these projects started to kick-off, we were getting bigger clients, and I was seeing the benefits of all the hard work we’d put in over the previous 12 months.” She credits their growth and success to their passion for small business. “Mitch and I both grew up in the Blackbutt area, about half an hour from Kingaroy, and we wanted to do better for our region. While I had no clue about the hire industry, I just thought we could run the business better.” Aleisha’s love for the industry was cemented in May after attending HIRE23 in Sydney. “I was initially focused on the numbers when we bought this business, but I have fallen in love with the hire industry because the people are completely genuine and I found it so easy to fit in. I also get a rush when I hire things which is one of the best benefits.” “Since Hire23, the support I have had from the HRIA and the industry has been amazing. These events are so important from a learning and networking perspective, and I’ve gained a lot more direction for my business. I’ll be taking my whole team to Brisbane for HIRE24.” Despite being in the industry for a relatively short time, Aleisha is now a

passionate advocate for hire. “It’s a really great industry for anyone who wants to grow and learn,” says Aleisha. “When I left school, I wasn’t interested in university, I needed something that I could put my hands on and get dirty. Hire is such a great industry for someone like me because you can work, there’s variety, and you keep your mind busy.” “Best of all, you can go so far. People might think, ‘I’m just a yard hand’, but one day you could be a salesperson or an Ops manager, a GM or business owner. There’s so much opportunity and it’s such a fulfilling industry.” She also encourages other young women to consider a career in hire. “Women tend to have this cautiousness when they’re going into a male dominated industry, but don’t be frightened,” says Aleisha. “Just get in, learn what you need to and don’t be afraid to ask questions. I think that’s the biggest thing – you’ve got to back yourself and have confidence.” Aleisha and Mitch have three young children — Jack, 8, Billy, 5 and Hugh, 3 — and own a 160-acre farm in the area where they ‘moonlight’ as hobby cattle farmers. They plan to build a house on the farm and stay in the area. “South Burnett is home for us,” she says. “I have massive plans for SB Hire & Sales so we’ll keep doing what we’re doing and bettering ourselves and the business every day.” 

WOMEN IN HIRE

Onwards and upwards for Women in Hire AS THE HRIA’S WOMEN IN HIRE DEVELOPMENT PROGRAM KICKS OFF FOR A SIXTH YEAR, PROGRAM CHAMPION AND HRIA OPERATIONS MANAGER, LAURA CONNARTY-DUNCAN, REFLECTS ON PROGRESS MADE AND GOALS FOR THE FUTURE.

LAURA CONNARTY -DUNCAN

NATIONALTRAINING CONSULTANT

Six years ago, the HRIA unveiled its Women in Hire Development Program, a structured program designed to give women across our industry opportunities to improve their career pathways and develop leadership skills. This represented a significant move by the HRIA to increase opportunities for women in our industry. Hire has always been a traditionally maledominated industry, however, like most workplaces across Australia, we recognised the inequalities and made a commitment to increasing diversity and improving inclusion. Diverse workplaces enable greater productivity, achieve better problemsolving and achieve better outcomes for employees and customers. From technical departments to storerooms and shopfronts; in HR, marketing, sales, management and everything in between, diversity brings a wealth of skills, knowledge, communication styles and unique point of views. That’s why the HRIA– with the unanimous backing of the HRIA Board and also now benefiting from program supporters, Kennards Hire, Onsite Rental Group, Blackwood Hire, Harry the hirer, Genie and Classic Hire — continues to enthusiastically support the program. Earlier this year, we reviewed the first five years of feedback overwhelmingly telling us that the program needed to expand. In 2023, the program is bigger than it’s ever been. That’s partly due to the Women

12

in Hire of the Year Award being presented for the first time at the HIRE23 Gala Award Dinner in May 2023. This idea was championed by longstanding program mentor and EWPA Vice President, Tim Nuttall. It’s about ensuring we place the same value on developing women in our industry as we do on developing our young professionals, because they represent this industry’s future leaders. In our 2023/24 program, we have 49 mentees, which is our largest cohort to date, with groups in New South Wales, Queensland and Victoria. There’s also a

Victorian Women in Hire Mentors and Mentees at the launch of the 2023 program.

hybrid program in Western Australia and South Australia. Those 49 participants are in the ‘care’ of 36 Mentors, who collectively, bring over 600 years of industry experience to the program. It’s a great reflection on the program that both Mentors and Mentees gain so much from the experience and with a reputation that’s growing throughout the industry, we’re already receiving applications and expressions of interest for our 2024/25 program!

While the program is heavily subsidised by the Association, member companies are recognising the value it brings. Participants make invaluable connections to other women in the industry, build their networks and have a safe space and support throughout their career. We’re also grateful to our male Mentors who continue to champion careers for women in our industry. HRIA Women in Hire has been — and continues to be — an outstanding success for our industry. It’s also a testament to the insights and expertise of our training partner, Strategic Alignment Training’s Aileen Hiskins, who developed the program to meet the unique needs of our industry. As the first female Operations Manager for the HRIA (EWPA and TSHA) in the Association’s 40-year history, I’m so proud to champion Women in Hire. I also have a unique position reporting directly to the Board, ensuring women’s opportunities and equality are represented. Our vision is to ensure there’s a pathway for women

from member to participant of the Women in Hire program, to active attendee at State Meetings. We’d love to see the Women in Hire cohort joining a State Committee and one day, would celebrate female State Presidents and members of our Boards.

How Aggreko keeps the lights on during the build of a hyperscale datacentre THE WORLD'S LARGEST TEMPORARY POWER COMPANY, AGGREKO, TELLS US HOW THEY PROVIDED UNINTERRUPTED POWER SUPPLY (UPS) FOR TESTING A NEW DATA HYPERCENTRE.

The Challenge Overcoming equipment shortages and accelerated data centre construction timelines. The client was supporting the commissioning of uninterrupted power supply (UPS) for a new build hyperscale data centre. The centre had 5 UPS of 600KW capacity each. The client was confronted with an absence of a suitable local load bank fleet to test their UPS. The task at hand was made even more demanding by the data centre’s concurrent construction and testing timeline. This convergence of activities compressed various scopes including construction, electrical work, civil engineering, structural adjustments, and HVAC implementation. Civil construction works were happening simultaneously

14

to the scheduled load testing. This also meant there would be space constraints on site. Because various tasks were occurring simultaneously, with each one predicated on another, it was imperative for each task to progress seamlessly. Any disruptions could potentially impact the already tight deadlines. And to ensure the testing timeline could be followed, it was crucial to foresee and plan for the frequent changes that typically happens with the load testing schedule at the last minute.

activities, Aggreko devised a unique solution aimed at surmounting this challenge. The team strategically positioned load banks and temporary cable runs onto a low-loader truck. This approach allowed the client to relocate the load bank compound after testing was concluded at a specific site location. This manoeuvre facilitated the clearance of access ways and the seamless continuation of subsequent phases of construction and civil works, avoiding the need to postpone civil works for extended durations. Their logistical efficiency of construction was not impacted This workaround also diminished both freight and labour expenses linked to the setup and dismantling at each testing point. In contrast to the previous practice of disassembling and reassembling all equipment, shifting it to the next test point, and arranging everything anew — a process that could extend for 4 to 5 days — the current approach entails merely parking the truck at the next designated testing point. “We are pleased with the ease of working with the team, their flexibility, and the seamless project coordination delivered by Aggreko. This was crucial considering the tight timelines of the project with very high standards of HSE.”

Streamlined access clearance and elimination of setup and tear-down time With a custom solution, resolute commitment, and adaptability, the client steered clear of the time and labour expenses connected to the setup and tear-down for each testing instance. This ensured the uninterrupted flow of various tasks without any delays. Equipped with Aggreko's load bank proficiency and electrical acumen, our customer successfully launched another data centre without incurring costly fully prepared to fulfil its intended purpose.

The Solution Deployed truck-mounted load bank and cabling setup. To tackle the limitations imposed by site space due to the simultaneous construction and commissioning

BY NICHOLAS GUEST, PARTNER, CORPORATE ADVISORY - HLB MANN JUDD

Have you measured your greenhouse gas emissions? THE DAYS OF BUSINESSES OPERATING WITHOUT DETAILED CONSIDERATION OF THE GREENHOUSE GAS EMISSIONS AND SUSTAINABILITY IMPACTS ARE QUICKLY EXPIRING.

Nicholas Guest

PARTNER, CORPORATE ADVISORY - HLB MANN JUDD

Setting the scene Consistent with many global economies, the Australian government is taking an active approach to addressing global climate change. In 2022, the government committed to reduce greenhouse gas emissions across the Australian economy to 43 per cent below 2005 levels by 2030. Australia’s whole-of-economy long-term emissions reduction plan is to achieve net zero emissions by 2050. This has and will drive significant investment and change throughout our economy and presents significant opportunities for businesses in the hire and rental industry. In support of these initiatives, the Australian Treasury released a proposal in June 2023 for implementing mandatory climate-related reporting disclosures. The current proposal would require certain entities (subject to size thresholds) to provide climate-related disclosures from as early as 1 July 2024. The Australian reporting standards for climate-related disclosures will be substantially aligned to the climate management standards set by the

18

International Sustainability Standards Board (ISSB). The ISSB sustainability disclosure standards incorporate some of the established sustainability measurement and reporting guidance in the market, including the Taskforce on Climate-Related Financial Disclosures (TCFD). Reporting entities will be obliged to delve into: 1. Governance: examining the processes, controls and procedures employed to oversee sustainability and climate-related risks and opportunities. 2. Strategy: addressing how these sustainability and climate-related factors could influence their business model and overall financial performance over short, medium and long-term horizons. 3. Risk management: outlining the processes used to identify, assess and manage sustainability and climaterelated risks. 4. Metrics and targets: this means ‘spilling the beans’ on gross GHG emissions (Scopes 1, 2, and 3) in metric tonnes of CO2 equivalent and revealing the company’s GHG intensity using the GHG Protocol.

What the ‘scopes’ really mean Scope 1 – 3 greenhouse gas emissions describe the sources of emissions expressed in kilotonnes of carbon dioxide equivalence. • Scope 1 emissions are the emissions an entity directly controls and owns, such as those produced by their business-owned vehicles. • Scope 2 emissions are the indirect emissions linked to purchased or acquired energy, electricity, heating or cooling consumed by the entity itself. • Scope 3 emissions are the broadest class and stem from activities not controlled or owned by the entity but are a result of the entity’s value chain, including upstream and downstream emissions. When an entity reports on Scope 3, it opens a vast array of emissions data from upstream and downstream partners in its value chain. This means supplier or customer activities might find their way into another organisation’s emission calculations. In response, reporting entities will likely show a preference for suppliers who not only measure their emissions but can also prove they're cutting down their

emission intensity. This has and will drive real changes in customer/supplier relationships.

Impact on small and mediumsized enterprises While the mandatory reporting requirements will initially impact on the largest entities in the economy, there will be rapid flow on impacts to every organisation. Small and medium-sized enterprises (SMEs) will undergo a major transformation due to mounting pressure from supply chain partners and customers who are directly impacted by stakeholder requirements to capture and measure the greenhouse gas emissions within their enterprise activities. As the pressure mounts on reporting entities to reduce their carbon footprint, a greater number of SMEs will find themselves on the path to decarbonisation or risk being shut out from valuable customer opportunities. As such, now is the time for SMEs to consider their impact on supply chain greenhouse emissions and calculate their carbon footprint — a vital first step on the journey towards decarbonisation.

NOVEMBER 2023

While emissions measurement and reporting requirements may seem onerous, there are rapidly developing solutions available to assist SMEs. If not prepared, businesses could potentially run the risk of losing existing clients or being excluded from new client tender opportunities if they cannot provide relevant emission related information when required.

Opportunities Being aware of the sustainability impacts of your business will add value to the business and potentially provide a competitive advantage. There are many ways SMEs can harness benefits from investing in ESG and sustainability. Businesses can differentiate their market position if they are progressive in adopting an emission reduction target, which may add value to their proposition within the supply chains of larger businesses. As companies develop a robust, sustainability reporting ecosystem, they can monitor their progress as they roll out a strong ESG strategy. This should help them to drive value and crucially, make them attractive to customers, suppliers, employees and financial providers.

Personal risks for Directors While it’s important and valuable for entities to establish an emissions related strategy, Directors must be conscious that many aspects of climate-related disclosures are inherently forwardlooking. Under the Corporations Act, forward-looking statements made without reasonable grounds may be taken to be misleading. ASIC has provided guidance that it is actively alert to the risk of ‘greenwashing’ claims made by organisations. To minimise risk, Directors need to actively ensure the content of climate-related disclosures are based on high quality information and can be substantiated. As we progress towards mandatory climate-related disclosures, HLB Mann Judd are ready to assist HRIA business owners and managers commence their emissions measurement and reporting strategy journey. The new cleaner energy generations WITH A GROWING APPETITE ACROSS INDUSTRY FOR NET ZERO POWER SOLUTIONS, PRAMAC GENERAC AUSTRALIA IS LEADING THE WAY.

They may not be a household name just yet, but Pramac Generac has been quietly going about their business in Australia for the past six years. Pramac Generac are part of a global organisation that’s the third largest manufacturer of generators in the world and the largest light tower manufacturer in the world, with over $5 billion in sales in 2022. The Australian team is based in Sydney with salespeople located around the country. Their range of solutions are designed to work across a wide variety of applications where temporary power supply is needed including mobile generators, battery energy storage solutions, light towers and dust fighters. The solutions are also versatile, efficient, have high structural resistance and are ideal for rental applications. Braden Murrin, the company’s General Manager in Australia, says with a growing focus on sustainability, everyone’s looking for opportunities to reduce their emissions. “People want sustainable options in place now because they’re worried about what’s coming down the policy pipeline,” says Murrin.

“People want sustainable options in place now because they’re worried about what’s coming down the policy pipeline,” says Murrin.

“There’ll be a time when policy catches up and carbon credits come into play. That’s why companies are seeking ways to offset their carbon emissions before there’s an impact on their bottom line.” Murrin says customers are turning to battery storage as a greener alternative to a standard diesel generator. “What’s so good about a battery is you can have a generator running and charging the battery throughout the day, but at night, when you only need to power a fridge, security lighting and cameras, the generator stops and the battery kicksin to run the site until morning.” “The other beauty of this solution is if you have a 60kVA generator on site, and you need 80kVA, the battery will kick-in, giving you additional power so you don’t have to over-size the generator.” “To me, that’s really exciting.” Pramac’s hybrid tech is available in their lighting towers and generators. The GRW60HY generator has battery and diesel built-in while the PRO Series mobile light towers include three different power systems in one model: 100% electric (battery), hybrid (battery plus back-up generator) and generator only. For a 100% green option, their VTSolar mobile light towers are powered by three solar panels, with connection to external power sources, if required. Murrin says that as a business, they want to be sustainable and minimise their impact on the environment by providing products that help deliver a cleaner, brighter and more productive world. “That’s a big priority for us,” says Murrin. “It’s easy to go to China to source a generator or lighting tower because there are lot out there. But it’s what you do to separate yourself from the others which is key. Hopefully, we’re starting to show that.” 

SA PRESIDENTS HLB MANN JUDD ADVISORY MESSAGE

BEN QUIRK SA STATE PRESIDENT OWNER OF BLACKWOOD HIRE

South Australia Overview THE HIRE INDUSTRY IN SOUTH AUSTRALIA IS HEALTHY AND HASN’T EXPERIENCED A DOWNTURN IN BUSINESS CONDITIONS SINCE THE END OF THE PANDEMIC.

The ongoing and planned investments in infrastructure, defence spending, energy projects, and the efforts to address the housing shortage are contributing to a positive economic environment for our sector. The major infrastructure projects such as the $15.4B T2D South Road project, nuclear-powered submarine development, and the state’s pursuit of 100% renewable energy by 2030 are creating opportunities for businesses and boosting the state’s overall economy. The growth of the event sector, with events like LIV golf, AFL’s Gather Round and the VAILO Adelaide 500 have been added to the calendar joining Adelaide Fringe Festival, Womadelaide, and the Tour Down Under, further diversifies the economic landscape and provides additional business prospects. However, it’s important to stay vigilant about rising business expenses such as wages, fuel, insurance, and interest rates. Managing price structures and maintaining profitability in the face of these challenges will be crucial for the sustainability and growth of businesses in the hire industry. Networking at our meetings and collaborating with both local and interstate members can help in staying informed about the industry trends, sharing best practices, and identifying potential areas for growth and improvement. Overall, it seems that the hire industry in South Australia has a positive outlook, and there are many opportunities for hire businesses and its suppliers to thrive in the near future. 

CONTRACT LAW

AUTHORS: JENNIFER SHAW, ROBERT KALDE AND IRENE HIGGINS

New prohibitions for use of unfair terms in Australian Consumer and Small Business Contracts ON 10 NOVEMBER 2023, A NEW REGIME WAS INTRODUCED TO FURTHER PROHIBIT THE USE OF UNFAIR CONTRACT TERMS IN STANDARD FORM CONTRACTS WITH CONSUMERS AND SMALL BUSINESSES.

These changes have been brought about by the Treasury Laws Amendment (More Competition, Better Prices) Act 2022 (Amendment Act). The Act also introduced higher penalties for breaches of the Australian Consumer Law, increasing penalties from $10 million to $50 million per for corporations, and from $500,000 to $2.5 million per individuals. For the first time in Australian law, penalties now apply to circumstances where businesses or people conducting a business make, apply, rely upon, or purport to apply or rely upon, unfair contract terms (UCT) in standard form small business or consumer contracts.

In our article from November 2022, we outline the definition of an ‘unfair contract term’ and the types of contracts this UCT regime will apply to. The Amendment Act has expanded the definition of ‘small business contract’ to provide further protection to small businesses under the new UCT regime. Further prohibitive measures have also been introduced by the Amendment Act.

What remedies and penalties are introduced under the new UCT regime? Previously, the only recourse for consumers and small businesses under the UCT regime was to seek orders from the court to render unfair terms void and unenforceable. Under the Amendment Act, the court will have new powers to:

30

Make declarations that a term in a consumer or small business contract is an unfair term Make orders for redress for loss or damage caused by an unfair term,

or to prevent the loss or damage that term could cause • Order injunctions to restrain parties from entering into future contacts that contain the same or similar terms • Issue penalties for including, proposing to include, applying, relying upon, or purporting to apply or rely upon, unfair terms in standard form consumer and small business contracts. Maximum penalties of up to $50 million for corporations or $2.5 million for individuals apply.

• • •

Excessive exit fees Unequal termination for convenience clauses Non-disparagement clauses that restrict a customer’s lawful right to publicly comment about goods and services they have received.

Members should look closely at their standard form contracts passed down to subcontractors and suppliers, especially any contracts with participants who qualify for protection under the changes. Small

Big businesses should look closely at their standard form contracts passed down to subcontractors and suppliers, especially any contracts with participants who qualify for protection under the changes. The Amendment Act also grants the ACCC powers to investigate and determine whether they should commence legal action against a business.

Beware of Unfair Contract Terms

businesses signing standard form contracts with larger organisations should consider whether any of the terms which they have agreed to may be capable for review or renegotiation.

Businesses trading in Australia should be wary of these changes to the UCT regime. Some unfair terms which may be of particular issue are:

• • •

Automatic renewal clauses Unilateral variation clauses Unequal requirements, penalties or limitations of liability

JLG Industries ‘Service Plus’ boosts fleet maintenance efficiency

SERVICE PLUS OFFERS JLG A SMARTER WAY TO MAINTAIN THEIR MACHINES, BY PROVIDING BETTER FINANCIAL CONTROL OF THEIR FLEET MANAGEMENT COSTS.

Along with the cost savings, Service Plus also has the potential to improve efficiency by allowing users to concentrate on their core business, leaving the management of their equipment to the experts at JLG. A benefit of the program provides known, monthly fixed price for servicing and maintenance of equipment, allowing greater budgetary control and minimising the risk of any ‘surprises’ at the time of servicing. A regular service plan under Service Plus also delivers long term savings and minimises the risk of costly downtime by taking a preventative maintenance approach. Service Plus also ensures machines are regularly checked and comply with Australian Standards and job site requirements, ensuring the safety of operators and other people on site. JLG offers two Service Plus options – ‘Preventative’ and Comprehensive’ — each offered over three- or five-year plans.

Service Plus: Preventative Frequent and annual inspections. This service is available for machines of any age.

Service Plus: Comprehensive ‘Comprehensive’ adds coverage for breakdowns, repairs or parts (some conditions apply). Comprehensive is limited to machines that are up to 12 months old from the date of commission. JLG National Service Analyst, Ryan Pragnell, said the Service Plus program was designed to make ownership of JLG equipment as efficient, hassle-free and enjoyable as possible.

36

“Operating a successful business can be time-consuming and challenging enough without needing to devote extra resources to properly manage a fleet of access equipment,” Ryan said. “Service Plus entrusts JLG with the servicing and maintenance of their fleet, freeing up customers to focus on other important areas, such as business growth. “This not only means that every box is ticked in terms of what’s required for the ongoing performance of the machine, it also ensures that applicable compliance standards are met, while providing full pricing transparency with fixed known costs.” Service Plus at-a-glance benefits • Known and fixed service costs • Maintenance to exacting OEM standards • The use of genuine OEM parts • Servicing by factory-trained technicians • Provides full-service history for equipment • Offers improved resale value • Provides improved ROI • Increases budgetary capability Service Plus is currently only available in metropolitan areas, however JLG can provide other customers Fixed Price Service Plans, as part of the Ground Support offering, which provides “everything you need to stay in the air”.

From scissors to scissor lifts AFTER 30 YEARS OF HAIRDRESSING, JENNY STEER SWAPPED HER SCISSORS FOR SCISSOR LIFTS AS SERVICE COORDINATOR FOR JLG.

Jenny Steer had never really thought about what she could do outside of hairdressing. Over 30 years, she’d built a successful small business with a loyal client base but with the shutdown of the hairdressing industry over COVID, Jenny had time to consider other options. “Hairdressing is very physical on the body and I ended up with a series of back injuries. It wasn’t until I stopped work during the COVID lockdowns that I realised how good my back could be — that’s when I knew I had to stop hairdressing.” Having gone straight from school into a hairdressing apprenticeship, Jenny didn’t think she was qualified to do anything else. “I thought I would have to do a course to get a job outside of hairdressing, not realising I had so many transferable skills and

experiences I could bring to a new role and industry.” With encouragement from her husband, Jenny applied for a role at JLG and was successful. She’s now their Service Coordinator (Victoria) for the west, organising units to be serviced, coordinating technicians, and delivering customer service. “One of the main things I’ve taken from hairdressing, is how important it is to communicate. You have to listen to what people want before you start, then communicate what you’re going to do. That’s where my hairdressing experience has been critical.” “When a machine is down it costs our customers money. So, it’s my role to keep them informed.” Jenny also brings organisational skills and has decades of problem-solving experience to draw on. Now, she’s part of the 2023 HRIA Women in Hire Development Program. “Having worked for myself for such a long time and only with other hairdressers, I thought it would be great to network with other women in the industry,” says Jenny. “I’ve been a mum for so long (her 19-year-old son is an apprentice plumber while her 17-year-old daughter is completing Year 12) and my story has always revolved around hairdressing and kids. It will be nice to have this new chapter just for me.” 

GLASS LIFTING

Access in Action

Quattrolifts' precision glass installation attachment A MAJOR PROBLEM FOR GLASS, WINDOW AND PANEL INSTALLERS IS INSTALLING UNITS ABOVE GROUND LEVEL.

Traditional glazing robots work best for installing at ground level and the operators can stand close to the material to be installed to allow for precise movement. This, however, can be problematic for installing panels into first and second story buildings as the operators are generally too far away to see how the glass must be precisely moved to install the panel. Secondly, whenever a glazing robot is designed to reach a greater height, there is always a cost. Invariably the glazing robot base must grow in weight and outriggers to support the extra forces making it a less nimble mobile machine for use in restricted spaces. The OMNI 800 has overcome this problem by becoming a specialised Glazing robot for working at heights. The OMNI 800 glazes multi storey buildings and houses using a tele-handler or off-road forklift, which can be used inside and outside a building envelope to allow for safe and efficient glazing of glass, windows, panels and stone weighing up to 800 kgs. The OMNI 800 is accurately controlled by wireless remote controls, one used by the forklift driver outside the building envelope and the second remote is used by the operator on the inside of the building at the level where the panel needs to be installed. This allows the installing operator to see close-up what precise movements are required to install the panel safely. There are six degrees of precise speed adjustable movement controlled by the operator inside the building with the remote including: • 300mm forward movement; • 300mm side shift; • 300mm vertical shift; • 95 degrees forward tilt to horizontal;

• •

360 degrees rotation and 30 degrees side pivot. This allows for precision movement for installation. The OMNI 800 has a fully integrated and independent power supply to drive electric actuators and vacuum pumps. All components and batteries are housed under the OMNI’s distinctive blue hood. The OMNI 800 has a genuine Dual-Vacuum System including two vacuum pumps, vacuum sensors, and alarms. This is a minimum safety requirement for use on-site when installing panels so should one vacuum line fail, the second vacuum circuit will still hold the load safely. The OMNI 800 vacuum system includes a fail-safe mode. Should all power be lost to the vacuum system, the vacuum valves will automatically lock maintaining vacuum until the panel can be lowered safely. Once the panel is lowered safely onto a stillage, then each of the vacuum cups can be released manually. The six spring-loaded adjustable vacuum cups (two x 400mm and four x 300mm) deliver greater safety while handling the panel. Each of the 400mm vacuum cups have a working load limit of 200kg and the 300mm cups have a WLL of 100kg. So, if all six vacuum cups are not required, the unused vacuum cups can be isolated and removed allowing for the OMNI to lift smaller panels.

TLA and Harry the Hirer create unique cubed stage for AFL Grand Final parade Festivities for the 2023 AFL Grand Final parade were taken to the next level with a 10-metre-high archway welcoming players and kicking-off an amazing pre-game experience for thousands of footy fans.

After taking boats along the Yarra River in 2022, the traditional and much-loved AFL Grand Final parade returned to the streets of Melbourne on Grand Final eve with a new starting position at Grand Slam Oval, between Rod Laver and John Cain Arenas. “The boats had some great elements, but ultimately, we wanted to bring the fans and players closer together and the new route, back in the iconic Toyota HiLux vehicles, delivered on this,” said AFL EGM Customer and Commercial, Kylie Rogers. The centrepiece of the parade was a 360-degree cubed stage featuring large LED screens on each side together with a threemetre stage. As the starting point for the parade, the structure needed to facilitate the mechanics of players and officials passing through the archway while giving fans, spectators and media a true point of difference. “Our goal was to deliver a better viewing and overall event experience for fans, families and passers-by who were out and about enjoying the Grand Final public holiday,”said Kylie.

We worked with Harry’s on the cube concept over an eightweek period and they’ve been great in getting something that was in our heads and delivering it in real life.”

Tasked by leading sports marketing agency TLA with creating an impressive structure with real presence, Harry the hirer’s Productions Team brought TLA’s vision to life. “We worked with Harry’s on the cube concept over an eightweek period and they’ve been great in getting something that was in our heads and delivering it in real life,” said TLA Major Events Director Jarryd Biffin. On a technical level, Harry’s Productions Team took care of the cube construction, which involved a significant crane lift staggered over sections, full lighting rig, PA towers, LED screens, staging and full coordination of all AV. “The Harry’s Productions team were absolutely amazing in helping us get this vision together and delivering something that that was beyond what we had in our mind originally,” added Jarryd. PRESIDENT’S MESSAGE

Events

ERIN JOHNSTON HRIA EVENTS DIVISON PRESIDENT

Beating inflation with a little give and take While the big hire companies dealing with corporate clients may currently be run off their feet, many smaller event companies dealing directly with the public are starting to feel the inflationary pinch.

Admit it, we’re all feeling the impact of inflation on our daily lives. The rising cost of living is hitting us all in the hip pocket, particularly as mortgage repayments rise, petrol continues to hit new highs and doing the weekly shop has become a balancing act between want and need. That’s all impacting the amount of disposable income available to spend on more discretionary items, like entertaining and, for many people, weddings. In a typical year, there are about 120,000 weddings in Australia with an average budget of around $50,000. However, with the steady increases in mortgage repayments over the last 12 months, people’s savings are dwindling. They simply don’t have the ‘buffer’ they once did to pay for a ‘dream’ wedding. Off the back of the last two wedding seasons, where couples had an excess of savings and a real drive to hold their wedding due to the COVID backlog, what we are now seeing is a huge shift to a point where budget is the number one stressor for couples planning a wedding. While the most obvious way to reduce costs is to limit the number of guests attending, couples are looking for other ways to cut costs. I have received a lot of feedback from couples and other vendors that many are simply postponing their plans to 2025 if they haven’t yet confirmed a venue. This gives them more time to save.

50

I’ve been in the industry for 15 years and have never seen people more price-sensitive than what they are now. In my own business, we’re finding people are paring back budgets, extending the sales cycle because they’re too nervous to push the ‘go’ button, or ‘ghosting’ us after we’ve invested time and effort in preparing a quote because their budget simply won’t stretch that far. This is a hard time for everyone. We know our clients – and potential clients – are struggling and we know our costs are also rising. The best we can do as an industry is to be flexible, communicate more with our clients and provide options that help our clients achieve their dream. Couples are already under so much pressure from family and friends when it comes to weddings. Add to that the stigma of potentially not being able to afford the dream ‘Instagram’ wedding, and there’s often a level of embarrassment around asking for cheaper options. So, talk through their needs and budgets and provide options upfront. We’re now providing two quotes for two separate price points, both of which are in line with the client’s vision but one which also provides options for reducing their spend. Finally, as business owners, we can’t work for nothing, not even for love! My advice is, don’t panic and create a race to the bottom by slashing your prices. That does nothing for our industry. Hold firm on pricing but find ways to add value for your clients in innovative ways that don’t cost you or the client more than you are willing to pay.

“I’ve been in the industry for 15 years and have never seen people more price-sensitive than what they are now.”

KARGO KING INTRODUCES THE NEW CSEVEN ROLL-OFF SYSTEM THE KARGO KING ROLL-OFF SYSTEMS IS SPECIFICALLY DESIGNED AND ENGINEERED TO MEET THE UNIQUE DEMANDS OF PRESENT-DAY RENTAL/HIRE EQUIPMENT FLEETS.

Renowned worldwide as the preferred choice amongst rental/hire fleet operators for their work delivery trucks, Kargo King Roll-Off Systems are by far the safest and most efficient way to load and transport rental/hire equipment.

Safe, Simple, and Efficient Operator safety is the number one priority. The Kargo King Roll-Off system allows you to load, secure, and unload at ground level. This reduces the potential for slips and falls, resulting in less injuries and costly compensation claims. The Kargo King RollOff system allows for the lowest vertical center of gravity and deck height. The Kargo King’s subframe sits 15-20cm lower on the subframe than other systems. In addition loads are secured on the deck and rest on the subframe at the front and rear for greater stability. Kargo King Roll-Off Systems have externally mounted controls, easy to actuate and purposely mounted outside for operators to keep their attention on the load. Many operators have confirmed up to 50% in time saved using a Kargo King vs conventional tilt decks or truck mounted equipment.

PUMPS

Equipment

FLEXTOOL FLEXSHAFT SUBMERSIBLE PUMPS ON WORKSITES, FLEXSHAFT SUBMERSIBLE PUMPS CAN PROVE TO BE HIGHLY ADVANTAGEOUS.

These machines are known for their durability and reliability, making them suitable for pumping various types of fluids. A submersible pump can be useful for dewatering excavation pits and trenches on a building site in the event of heavy rainfall and flooding. Here are a few things to keep in mind when you shop for the ideal machine. There are three different types of flexshaft underwater pumps, and most of them are either 6 or 9 metres long. General purpose pumps are the most popular as they can be used across most applications and are the lightest of the three which helps with onsite handling. A general purpose submersible pump will do the job for excavation pits, construction sites, pier holes and swimming pools. Pumping abrasive fluids polluted with sand, debris, and construction waste requires the usage of abrasion resistant pumps. The final type is a chemical resistant pump, which offers more resistance when pumping chemically polluted fluids such as salty water and industrial waste. To extend the life of the product, chemical resistant

Pumping abrasive fluids polluted with sand, debris, and construction waste requires the usage of abrasion resistant pumps.

pumps should be removed from the area and cleansed with clean water when not in use. It is critical to determine whether your application is appropriate for a chemical resistance pump. Flextool recommends a pump that will provide the best performance and durability – heavy duty and double row oil bath bearings will provide the longest service life. Select a corrosion-resistant stainless-steel spindle, and ensure that the flexshaft has a support spring to protect it when operating over the sharp edge of excavations, pits, and dams. When pumping at depth, an extension shaft will make an existing submersible pump longer. A driving unit is required if you are utilising a flexshaft submersible pump. A high-quality drive unit is designed with durability and efficiency in mind. A heavyduty powder coated tubular steel roll frame houses the drive units. The roll frame not only protects the drive unit but also aids in portability. The top drive units also have built-in lifting hooks for simple and safe onsite handling. Flextool offers a wide range of flexshaft submersible pumps and drive units for a wide range of applications, and all Flextool equipment is backed by the Flextool Promise. Whatever your company's needs are, Flextool has the proper equipment for the task. Flextool.com.au has further information on the Submersible Pumps collection.

AMPD ENERTAINER PROVIDES 5-STAR POWER TO ERBEN’S CIRQUE DUET ERBEN'S CIRQUE DUET IN MOUNT PLEASANT, WA, THE FINAL STAGE OF THE MULTIAWARD-WINNING CIRQUE APARTMENTS AND THE STATE'S FIRST 5-STAR GREEN STAR RESIDENTIAL BUILDING DEVELOPMENT, USES THE DIESEL-FREE AMPD ENERTAINER BATTERY ENERGY STORAGE SYSTEM (BESS).

Cirque Duet's 500Kw state-of-the-art Enertainer from Blue Diamond will help Erben's sustainability path as a Green Building Council of Australia member. Blue Diamond, an independent distributor of off-grid power solutions, is the market leader in low-and-zero emission power solutions to replace diesel baseload power. The BESS solution's CO2 reductions, power usage, and fuel savings drew Erben and Icon Construction to the Enertainer. The Enertainer is built for construction sites and can replace most large diesel generators. The Enertainer solution, deployed and greenlit for operation in under two hours, uses the EnerNet platform to provide construction sites with power consumption, fuel savings, and CO2 reduction analytics. Erben Managing Director Luke Reinecke described the Enertainer's revolutionary power solution for building sites. “It eliminates diesel and significantly reduces the emissions created during the construction phase. Cirque Duet is adjacent to Cirque Apartments and various other residential and commercial buildings. “But, the great thing about the Enertainer is that it cancels out the noise and exhaust that residents would otherwise be subjected to,” said Reinecke. Erben weaves sustainability into every step

58

of the process from initial design and material selection right down to project delivery. “Erben considers the implementation of strategies that develop sustainable buildings as part of doing business. “For Erben, sustainability means developing resilient and energy-efficient buildings that place the wellbeing of people and the community at their heart,” said Reinecke. For a 5-Star Green Star designation and Australian sustainability excellence, buildings must be diesel-free, efficient, powered by renewables, built with low-carbon materials, and offset with nature. Cirque Duet expects the Enertainer to save carbon emissions by nearly 12 tonnes each month, saving 7,000 litres of diesel. Reinecke stated, “Our clients should be confident that Erben can deliver on our sustainability promises and we hope that our use of the Entertainer solution helps demonstrate this commitment. Ampd Energy's Enertainer powers construction sites worldwide with cleaner, quieter, data-rich power. The Enertainer can replace a 500Kva diesel generator and generate up to 440Kw, changing building sites worldwide. Blue Diamond is the authorised national distributor for Ampd Energy and the premier independent distributor of off-grid power solutions for mining and construction.

It eliminates diesel and significantly reduces the emissions created during the construction phase.
