Pre-Contract Questionnaire

Managing Agent

We will connect with your building’s managing agent to collect all pertinent building information. Please be sure to share any files you might have as that will be helpful in streamlining the process; such as, offering plans, proprietary leases, building financials, alteration agreements, etc…

Once retained, we will provide you with a detailed questionnaire to complete so that we are aware of any details that may have an impact on the sales process. Here are a few elements we look to identify prior to selling:

• Any and all existing mortgages, lines of credit, or liens that may impact the property.

• Your knowledge of any planned increases in common charges/maintenance or planned assessments.

• Citizenship/Residence – foreign national non-U.S. residents should consult with their accountants regarding FIRPTA prior to listing.

• Investment/Second Home vs Primary Residence – don’t forget to consult with your accountant regarding any capital gain taxes when selling your home.

The role of a home inspection (townhouse):

If you’re selling a townhouse, a home inspection can provide a comprehensive assessment of its condition, including the structure, systems, and any potential issues. Your Buildings Approval Process

• Once the contract is signed, the buyer will move forward in completing their purchase application. Allow our team to orchestrate every facet of this process, ensuring your journey transcends expectations with unparalleled finesse and dedication.

• If the buyer is obtaining financing, the bank will conduct a formal appraisal and provide the bank commitment within 30-45 days. Following the receipt of the mortgage commitment, the purchaser will submit their purchase application to your condo/co-op board.

For condo owners, the condo board has 20-30 days to provide the “Waiver of First Right of Refusal” (FROR).

For co-op owners, the co-op will review the purchase application and, if the purchaser is deemed financially qualified, schedule a board interview. Upon board approval or receipt of the FROR waiver, the transaction will be cleared to close.

Upon Accepted Offer

The life cycle of a deal from the seller's perspective

Your attorney will draft the contract and send it to the buyer’s attorney.

We will ensure that the buyer has access to all due diligence materials, including but not limited to the offering plan (for condos) or proprietary lease (for co-ops), building financials, purchase application, and alteration agreement.

The buyer will have 7-10 days to complete their due diligence and conduct inspections.

Upon completion of due diligence and contract negotiations, the buyer will sign the contract and provide a 10% deposit to be held in the attorney’s escrow account.

Once the contract has been fully executed, the buyer will proceed to complete the purchase application and address any contingencies.

If the buyer is obtaining financing, the bank will conduct a formal appraisal and provide the bank commitment within 30-45 days.

Following the receipt of the mortgage commitment, the purchaser will submit their purchase application to the condo/co-op board.

YOU’VE BEEN CLEARED TO CLOSE!

The managing agent of your building, along with both parties' attorneys, will coordinate a closing date, typically within 2-3 weeks unless otherwise specified in your contract or during the negotiation.

At the same time, we’ll help you navigate moving out of your home and turning over keys.

Your attorney will coordinate with you all final paperwork and legal requirements necessary to close.

APPRAISAL

Assessment of the property’s market value, for the purpose of obtaining a mortgage and performed by a licensed appraiser.

ASSESSED VALUE

Value placed upon property for property tax purposes by the tax collector.

CLOSING COSTS

Expenses incidental to a sale of real estate, such as loan fees, appraisal fees, and title insurance.

CLOSING STATEMENT

The statement which lists the financial settlement between Buyer and Seller, and the costs each must pay.

COMMON CHARGE

Monthly maintenance fee paid by condo owners. Property taxes are not included in the common charge.

CONTINGENCY

Certain criteria that have to be met in order to finalize the sale.

CONTRACT DEPOSIT

A percentage of the agreed-upon purchase price paid by the buyer at the time of signing the contract.

CO-OP SHAREHOLDER

Owner of a co-op unit, since what they are actually purchasing are shares of stock in the co-op corporation.

DEBT-TO-INCOME RATIO

The percentage of an individual’s monthly gross income relative to the amount of debt owed.

ESCROW DEPOSIT

Deposit of funds to be transferred upon completion of the deal.

FINAL WALKTHROUGH

The buyer reviews the house just before closing to make sure everything is in the same condition and that all home inspection items are fixed.

FINANCIAL STATEMENT

A formal record of all your financial assets, debts, and liabilities.

FLIP TAX

A tax levied by a co-op and paid by the seller when a sale is made. They are designed to generate funds for the co-op’s cash reserve. Often negotiable.

INSPECTION

An expert conducts a formal review of the property to find visible issues that need to be repaired. Buyers typically make their offers contingent on an inspection, but sellers can conduct a pre-offer inspection to appeal to buyers. The buyer may choose to do additional inspections like radon and a sewer scope.

LIEN SEARCH

A background check on the property and the seller to ensure there are no outstanding debts or claims upon the property.

MAINTENANCE FEE

Fees paid by co-op shareholders that contribute to building operations.

POST-CLOSING LIQUIDITY

The amount of cash the buyer must have on hand after deducting the down-payment and closing costs.

PRE-APPROVED

Advanced approval from a bank or other lending institution for a home mortgage.

PRE-QUALIFIED

Potential buyers provide an overall financial picture and mortgage brokers provide an estimate of what level of loan you will likely be pre-approved for.

RECORDING FEE

A fee paid to the local government to officially report a sale of a home; usually paid by the buyer.

TAX ABATEMENT
