物議を醸しているように、先の「ブロッ コリー／トマトII」事件の審決から一転 して、農業技術分野の出願人に打撃を与 えるにもかかわらず、拡大審判部は「唐 辛子」事件において、本質的に生物学的 方法によってのみ生産された植物と動物 は、 EPOでは2017年7月1日以降に提出 された出願を通して特許を受けることは できないと判断しています。

In a controversial departure from its earlier decision “Broccoli/Tomatoes II” and a blow to Applicants in the field of agritech, the Enlarged Board of Appeal in “Peppers” holds that plants and animals exclusively obtained by means of an essentially biological process are not patentable at the EPO through applications filed on/after 1 July 2017.

2015年に拡大審判部は、本質的に生物 学的方法によってのみ生産された植物と 動物製品には特許性があると裁定しま した（G2/12およびG2/13、「ブロッコ リー／トマトII」事件とも呼ばれる）。 ところが2017年7月1日、一部の加盟国と 政治グループからの多大な圧力を受け て、EPOの管理理事会はEPC規則28を改 正し、「EPC第53条(b)に基づき、本質 的に生物学的方法によってのみ生産され た植物または動物に対して、欧州特許は 付与されない」（強調のため下線追加） と定める、EPC規則28(2)を導入しまし た。

In 2015 the Enlarged Board of Appeal ruled that plant and animal products exclusively obtained by means of such essentially biological processes are patentable (G2/12 and G2/13, often referred to as “Broccoli/Tomatoes II”). However, on 1 July 2017, under significant pressure from certain member states and political groups, the Administrative Council of the EPO amended Rule 28 EPC to introduce Rule 28(2) EPC, stating “Under Article 53(b), European patents shall not be granted in respect of plants or animals exclusively obtained by means of an essentially biological process” (emphasis added).

As many practitioners had anticipated, the first Board of Appeal to consider the interpretation of Rule 28(2) EPC held that the Articles of the EPC as interpreted by the Enlarged Board of Appeal in G2/12 and G2/13 must prevail over the Rules and, hence, Rule 28(2) EPC must be considered void (T 1063/18). Nevertheless, the President of the EPO, António Campinos, felt that further clarification was needed and made a referral to the Enlarged Board of Appeal.

Most commentators expected the referral to be deemed inadmissible and, even if it were admissible, expected Rule 28(2) EPC to be deemed void.

G3/19 “Peppers” In a surprising turn of events, the Enlarged Board found the referral to be admissible and considered that interpretation that Article 53(c) EPC in combination with Rule 28(2) EPC excludes animals and plants produced by essentially biological processes from patentability (the full text of the opinion can be found here).

Admissibility

EPC第112条(1)(b)に従い、2つの審判 部が同じ法律問題について異なる決定 を下した場合、長官はその問題を拡大 審判部に付託することができます。T 1063/18は、EPC第53条(b)とEPC規則 28(2)との明らかな矛盾を1つの審判部 のみが検討した決定だったため、多く の人はEPC第112条(1)(b)の要件が満た されていないと感じていました。しか し拡大審判部は、施行規則の改正が EPCの条項の解釈に影響を及ぼし得る かどうかという広義の問題について、2 つの審判部が異なる決定を下したと考 えました。そのため、付託は許容可能 とみなされたのです。

According to Article 112(1)(b) EPC, the President may refer a point of law to the Enlarged Board of Appeal where two Boards of Appeal have given different decisions on that question. Since T 1063/18 was the only Board of Appeal decision to have considered the apparent conflict between Article 53(b) EPC and Rule 28(2) EPC, many felt the requirements of Article 112(1)(b) EPC had not been met.

However, the Enlarged Board considered that two Boards of Appeal had given different decisions on the broader question of whether an amendment to the Implementing Regulations can have an impact on the interpretation of an Article of the EPC. Thus, the appeal was deemed admissible.

to reflect their understanding of the referral’s “true object”. The Board’s rephrased questions were as follows:

Interpretation of Article 53(b) EPC and Rule 28(2) EPC The Enlarged Board’s answer to the rephrased questions was, in brief, that “a particular interpretation which has been given to a legal provision can never be taken as carved in stone” and that “the introduction of Rule 28(2) EPC allows and indeed calls for a dynamic interpretation of Article 53(b) EPC”. Thus, Article 53(b) EPC should now be interpreted as excluding product claims and productby-process claims directed to plants, plant material, or animals if the claimed product is exclusively obtained by means of an essentially biological process or if the claimed process features define an essentially biological process.

Importantly, “In order to ensure legal certainty and to protect the legitimate interests of patent proprietors and applicants”, the Enlarged Board considered it appropriate that the exclusion has no retroactive effect and thus is only applicable to applications whose effective filing date is on/after 1 July 2017, i.e. the date Rule 28(2) EPC was introduced.

In T 1063/18, the invention related to a “cultivated blocky fruit type pepper plant” and the only method described in the application for obtaining the plant was an essentially biological process, namely crossing two previously known peppers followed by selfing and conventional pedigree selection to create stable fixed inbred lines. In light of G3/19, it seems that claims directed to such a pepper would be deemed patentable in applications having an effective filing date before 1 July 2017, but would be deemed excluded from patentability in applications filed on/ after that date.

Conclusion Whilst this decision will be a blow to Applicants in the field of agricultural technology, others will appreciate clarity on this issue, which has been unsettled for many years. That said, the controversy may not be over, as the opinion is already raising questions about the Enlarged Board’s independence and ability to withstand political pressure.

欧州特許庁は、新規事項の追加を 厳格に評価することで有名です。 クレーム補正において、出願時の 明細書に開示された別個の特徴リ ストに含まれる特徴を組み合わせ る場合、拒絶理由が出される可能 性があります。しかし、最近の審 判部の審決は、別個のリストから の特徴の選択に基づくクレーム補 正について、より広い範囲を出願 人と特許権者に与える可能性を示 しています。

The European Patent Office has a reputation for taking a strict approach to the assessment of added subject-matter.

Objections can be raised when claim amendments combine features pertaining to different lists of features disclosed in the application as filed. A recent Board of Appeal decision, however, may provide applicants and patent proprietors with greater scope to amend claims based on the selection of features from different lists.

とりわけ、EPO技術審判部の審決T 1621/16（異議部の決定に対する審 判請求）における中心的問題は、 複数の収束的代替物リストからの 選択に基づくクレーム補正がEPC 第123条(2)を満たしているかどう か、さらにどのような状況であれ ば満たしているのかでした。

In particular, a central question in EPO Technical Board of Appeal decision T 1621/16 (an appeal from a decision of the Opposition Division) was whether, and under which circumstances, claim amendments based on multiple selections from lists of converging alternatives comply with Article 123(2) EPC.

Article 123(2) EPC prohibits amendments which extend the subject-matter of an application or patent beyond the content of the application as filed. Case law has confirmed that the underlying idea is that an applicant or patent proprietor should not be allowed to improve its position by adding subject-matter not disclosed in the application as filed, as this would give rise to an unwarranted advantage and could be damaging to the legal security of third parties relying on the content of the original application. Following the Enlarged Board of Appeal decision in G 2/10, an amendment is regarded as introducing subject-matter which extends beyond the content of the application as filed, and which is therefore unallowable, if the overall change in the content of the application or patent results in the skilled person being presented with

information which is not directly and unambiguously derivable from the application as filed, even when account is taken of matter which is implicit to a person skilled in the art. This test is known as the ‘gold standard’.

The Boards of Appeal have developed various rules for determining whether particular types of amendment comply with Article 123(2) EPC. A particular class of amendments, which are commonly made to applications in the chemical and life sciences fields, involves the selection or deletion of claim features from lists.

A claim amendment which consists of selecting a feature from a single list does not generally present a problem at the EPO. However, the arbitrary selection of features from multiple lists of features is generally considered to breach Article 123(2) EPC, unless there is a clear pointer in the application as filed to the specific combination of features.

For example, where an application discloses a list of possible metal elements (e.g. iron, aluminium, copper and zinc) and a list of possible non-metal elements (e.g. oxygen, nitrogen, fluorine and chlorine), a claim to a composition comprising a metal element and a non-metal element cannot be amended to recite the specific combination of iron and oxygen, unless the application as filed contains a pointer towards the specific combination (such as a statement that the particular combination of iron and oxygen is ‘preferred’).

EPO case law also permits the deletion of items from a list as long as the deletion does not result in the singling out of a particular combination of features not disclosed in the application as filed. The deletion must maintain the remaining subject-matter

既存のEPO判例法の大半は、等価ま たは非収束的代替物、即ち相互に排 他的または一部の範囲のみ重複する 特徴（鉄、アルミニウム、銅、亜鉛 など）のリストに基づく補正に関す るものです。

Much of the existing EPO case law is concerned with amendments based on lists of equivalent or non-converging alternatives, which are features which are either mutually exclusive or only partially overlapping in scope (e.g. iron, aluminium, copper, zinc).

しかし、審判部はT 1621/16におい て、収束的代替物リスト、即ち選択 肢が優先度の最も低いものから最も 高いものへ並べられたリストであっ て、そのリストにおいて優先度のよ り高い各代替物が、優先度のより 低い広範な全ての選択肢（元素、金 属、遷移金属、鉄など）に完全に包 含されているリストから、複数の選 択が行われる場合における、EPC第 123条(2)の遵守を評価する方法を検 討しなければなりませんでした。主 要な問題は、別個のリストから優先 度の異なる代替物を組み合わせるこ とが許容されるかどうかでした。異 議申立人と異議部は、別個の収束的 リストからの複数の中間的選択肢（ 即ち、最も優先度の高い選択肢では ない）の選択に基づく補正は許容さ れず、優先度が同程度の代替物（あ る場合）だけの組合せが可能である と主張しました。 審判部はこの問題に関する既存の判 例法を精査し、判例法には一貫性が ないことを認めました。にもかかわ らず、以下の場合には、複数の収束 的代替物リストからの特徴の選択は EPC第123条(2)を満たしていると、 審判部は結論づけました。 i) クレームに記載された特徴の 組合せが、未開示の技術的貢献 と結びつけられておらず；かつ ii) 出願時の明細書において、ク レームに記載された組合せへの 示唆が存在する場合。 8

In T 1621/16, however, the Board had to consider how to assess compliance with Article 123(2) EPC when multiple selections are made from lists of converging alternatives, which are lists of options ranked from the least preferred to the most preferred, each of the more preferred alternatives being fully encompassed by all of the less preferred and broader options in the list (e.g. element, metal, transition metal, iron). A key question was whether it is permissible to combine more and less preferred alternatives from different lists. The Opponent and the Opposition Division had argued that amendments based on the selection of two or more intermediate options (i.e. different from the most preferred options) from different convergent lists were not allowed and that only alternatives having the same degree of preference could be combined (if at all).

The Board reviewed the existing case law on the matter and found it to be inconsistent. Nevertheless, the Board concluded that the selection of features from multiple lists of convergent alternatives does comply with Article 123(2) EPC if: i) the claimed combination of features is not associated with an undisclosed technical contribution; and ii) there is a pointer to the claimed combination in the application as filed.

Condition (i) was required as the patent proprietor should not derive an unwarranted advantage from linking the specific combination of more and less preferred alternatives to an inventive selection which is not supported by the application as filed. Condition (ii) is required so that the selection is not arbitrary and would be satisfied where the amended claim converges towards one or more examples or specific embodiments disclosed in the application as filed, since these generally represent the most detailed and preferred forms of the invention. An explicit statement in the application as filed that a particular combination of features is ‘preferred’ does not appear to be required.

The Board arrived at these conclusions by comparing the selection from converging lists to (a) selection from nonconverging lists and (b) the deletion of options from non-converging lists. The Board noted that while selection from non-converging lists leads to a singling out of an invention from among several distinct alternatives, the elements of a converging list do not represent distinct features but rather more or less restricted versions of the same feature. Selection from converging lists therefore does not lead to a singling out of an invention but simply to a more or less restricted version of the originally-claimed subject-matter.

This is analogous to the permissible deletion of options from non-converging lists, which also merely restricts the scope of protection.

When considering the particular amendments which had been made in T 1621/16, the Board also found that it was allowable to combine a single selection of a preferred element from a nonconvergent list with multiple selections from convergent lists without adding subject-matter.

EPOにおける新規事項の追加の審査 と新規性の間には、対称性がありま す。どちらの場合も主要な問題は、 対象となる文書（即ち、新規事項 の追加を評価する際は出願時の明細 書、または新規性を評価する際は 先行技術）において、直接的かつ 明確に開示されているものは何か です。したがって、T 1621/16の結論 が、EPOでの新規性の評価方法に影 響を及ぼすかどうかが問題になりま す。例えば、先行技術に開示された 特徴の単一リストから一つの特徴を 選択しても、クレームに新規性を与 えることはないものの、一定の長さ の複数のリストからの特徴の選択を 要求するクレームに記載の組合せは 新規であるというのは、確立され た判例法です。しかし、先行技術に おける複数のリストが収束する場合 も、新規性が与えられるのでしょう か

There is a symmetry between the examination of added-subject matter and novelty at the EPO. In both cases, the key question is what is directly and unambiguously disclosed in the relevant document (i.e. the application as filed when assessing added-subject matter or the prior art when assessing novelty).

Accordingly, there is a question whether the conclusions in T 1621/16 could affect the way novelty is assessed at the EPO. For example, it is established case law that the monodimensional selection of a feature from a single list of features disclosed in the prior art does not confer novelty on a claim, but a claimed combination which requires selection of features from two or more lists of a certain length is novel. However, is novelty still conferred when the lists in the prior art converge?

また、EPOは最近、技術的効果はむ しろ進歩性で扱うべき問題であると いう理由で、選択発明の新規性を評 価する際に技術的効果を考慮しな くなりました。しかし審決T 1621/16 は、EPC第123条(2)の遵守を判断す る際に、クレームに記載された特徴 の組合せに付随する未開示の技術的 貢献の有無を評価するよう求めてい ます。これが意味するのは、複数の 収束的リストからの選択の新規性を 評価する際に、技術的貢献も考慮す べきということでしょうか? これらの問題が今後の審決で取り上 げられることが望まれます。

The EPO has also recently moved away from taking into account technical effect when assessing the novelty of selection inventions, on the basis that this is more a matter for inventive step.

However, the decision in T 1621/16 requires an assessment of whether there is an undisclosed technical contribution associated with the claimed combination of features when determining compliance with Article 123(2) EPC. Does this mean that the technical contribution should also be considered when assessing the novelty of selections from multiple converging lists?

It is hoped that future decisions will address these issues.

The decision in T 1621/16 provides applicants and patent proprietors with arguments which may be helpful when defending amendments based on selections from converging lists before the EPO.

When drafting applications bound for European prosecution, it therefore remains good practice to include explicit basis for different combination of claim features which might be envisaged, and in particular different combinations of more and less preferred options, whenever this is possible. It can in this regard be helpful when drafting to compare the broadest statement of the invention with the specific examples, and to build in explicit basis for particular combinations of options which gradually transition from the broadest statement of the invention to each specific example.

However, as noted in the decision itself, the case law on this matter is not yet consistent and without a decision of the Enlarged Board of Appeal, one cannot be certain that a different Board would come to the same conclusions.

European examiners, who in practice rely predominantly on the EPO’s consolidated Guidelines for Examination (rather than the decisions of the Boards of Appeal), may also continue to object to this type of amendment.
