審決G1/19－シミュレー ションに関する拡大審 判部の審決

G1/19 – Decision of the Enlarged Board of Appeal on Simulations

2021年3月10日、拡大審判部は、コンピ ュータで実施されるシミュレーション の特許性に関して待ち望まれていた審 決を公表しました。

On 10th March 2021 the Enlarged Board of Appeal (EBoA) published the highly anticipated decision relating to the patentability of computer-implemented simulations.

付託の背景 拡大審判部に付託された今回の欧州特 許出願は、建物などの環境による歩行 者群の動きをシミュレートする方法に 係るものですが、本審決の趣旨はもっ と広い範囲に適用でき、欧州特許庁に おける全ての種類のコンピュータシミ ュレーションの特許性に影響を及ぼし ます。 本件を付託した審判部は、クレームに 記載のコンピュータシミュレーション には技術的効果がないという見解を示 していました1。対照的に、過去の審決 T 1227/05に基づく評価は、シミュレー ションを機能的な技術的特徴とみなす 見解につながるものでした2。そのため 今回の付託では、コンピュータシミュ レーションは技術的効果をもたらすこ とができるかどうかという問題への答 えを求めています。 拡大審判部に付託された質問 以前の記事で述べたように、本審決に おいて拡大審判部は以下の質問を検討 しました。 1. 進歩性の評価において、技術的シ

Background of the Referral The European patent application which resulted in this referral to the EBoA relates to a method of simulating movement of a pedestrian crowd through an environment such as a building, however the implications of this decision are more widely applicable and affect the patentability of all sorts of computerimplemented simulations at the European Patent Office.

The referring board indicated that they believe that the claimed computerimplemented simulation does not provide a technical effect1. In contrast, an assessment based on an earlier decision T 1227/05, would lead to the view that the simulation does constitute a functional technical feature2. Therefore, the referral seeks to answer the question of whether a computer-implemented simulation can provide a technical effect.

Answers to the Questions The EBoA provided the following answers to the questions: 1. concluded that the COMVIK approach of assessing inventive step of computerimplemented inventions also applies to computer-implemented simulations3.

In the COMVIK approach4 only the features of a claim which contribute to the technical character of the invention are considered when assessing inventive step. Therefore, this decision means that patentability of simulations will be assessed using the same test as other computer-implemented inventions.

The EBoA explained that when the COMVIK approach is applied to simulations, the underlying models form boundaries, which may contribute to technicality if they are a reason for adapting the computer or its functioning, or if they form the basis for a further technical use of the outcomes of the simulation5. According to the EBoA such further use or adaptions to the computer or its functioning must be at least implicitly specified in the claim for it to be patentable.

A negative answer to the first question would have implied that no claims to computer-implemented simulations are patentable. However, the EBoA’s answer does allow for some claims to computerimplemented simulations to be granted, provided they meet the same criteria used in evaluating other computerimplemented inventions6.

The second question comprises two parts.

a direct answer to the question of what criteria are relevant for assessing whether a computer-implemented simulation, claimed as such, solves a technical problem. Therefore, the EBoA have not provided an exhaustive list of criteria for assessing patentability of computer-implemented simulations, but instead have relied on the existing framework used for the assessment of general computer-implemented inventions.

The EBoA state that they agree with the earlier decision, T 1227/05, in which it was found that a simulation can provide a technical effect8, however, only if it is understood that that in this case an intrinsically technical function was provided. Therefore, the EBoA warned against applying this finding as a generally applicable criterion for patentability of simulations. Instead, the EBoA state that calculated numerical data from a simulation usually cannot establish the technical character of an invention in accordance with the COMVIK approach and only in exceptional cases can a calculated effect be considered an implied technical effect9.

Concluding Remarks In summary, this decision provides some welcome guidance on how the EPO will assess the inventive step of inventions which relate to computer-implemented simulations, thereby providing greater certainty to both patent applicants and third parties concerned with the patentability of computer-implemented simulations.

The decision does not, however, give an exhaustive list of criteria for assessing whether computer-implemented simulations are patentable. The referring G1/19 point 69 G1/19 point 133 9 G1/19 point 128 7

Different EPO Board of Appeal decisions have taken different directions with regard to what, in relation to developments concerning graphical user interfaces, might be considered to be sufficiently “technical” to support patentability. An overview of cases that have taken different directions may be helpful.

As one possibility, different directions are represented here by 38 cases which spread over more than 30 years - from T115/85 decided in 1988, to T2255/17 decided in 2020. In “green” cases it was found

The 38 cases are arranged in terms of different types of asserted aims or effects of the GUI developments, extending from (at the top) concern with screen display per se - UI graphic design - to cases (at the bottom) concerned with involvement of the GUI in performance of some (technical?) task involving the system on which the GUI is run, or involving something controlled by that system.

As one illustration of this, the 38 cases are here arranged on a track from earliest (top left) to latest (bottom right). 10 cases on the track, including the two most recent cases, stand alone but there are cross-references between 28 cases on the track which are indicated by points (●) on the grid above the track. For example it can be seen that the earliest case T115/85 is cited (►) by 4 later cases on the track (T619/98, T125/04, T756/06, T336/14) and one of the latest cases on the track T1091/17 cites (▼) 8 earlier cases on the track.

At least for earlier cases, the number of times they are cited by other cases on the track may be some indication of how “influential” they have been for UI case law. For example, T643/00 is a “green” case which is cited by 11 other cases on the track, of which 9 are “red”. T49/04 is a “green” case cited by 6 other cases, of which 4 are “red”. T928/03 is a “green” case which is cited by 5 other cases, all “red”.

T643/00, T49/04 and T928/03 may have been “influential” mainly in the sense that in the “red” cases the Boards of Appeal concerned sought to distinguish from them. T1143/06 is a “red” case which is cited by 10 other “red” cases but only 1 “green” case. T1741/08, another “red” case, is cited by 7 “red” cases and 1 “green” case. The “red” cases T1143/06 and T1741/08 may be considered “influential” in that Boards of Appeal in other cases have in the main sought to follow them.

Nevertheless, this view has not been adopted by the mainstream case law in the course of legal development (cf. G3/08, Headnote 4).
