新型コロナウイルスによる旅行への影 響のため、EPOは数多くの口頭審理を ビデオ会議で行っています。しかし最 近の審判事件で、口頭審理をリモート で行うことがEPC第116条に定める口頭 審理を受ける権利に適合するかどうか について、疑問が提起されました。

Following the impact on travel due to COVID-19, the EPO has been holding a large number of oral proceedings via videoconference. However, a recent appeal challenged whether conducting oral proceedings remotely was compatible with the right to oral proceedings provided in Article 116 EPC.

In this article, we examine the background of this appeal as well as the statistics on the number of hearings held via videoconference since 2019, to explore its potential impact.

Background In April of last year, due to travel restrictions imposed by COVID-19, the European Patent Office (EPO) announced that all oral proceedings before examining divisions were to be held via videoconference. This decision entered into force on 2 April 2020 via a Decision of the President of the EPO published in the April 2020 edition of the official journal (OJ) (OJ EPO 2020 A39). It applied to all oral proceedings the summons to which was notified on or after that date, and also to any oral proceedings associated with a summons that had already issued if the summons indicated that it was to be held by videoconference or if the applicant had agreed to a videoconference. In a similar vein, by way of a separate decision in the same OJ, effective from 4 May 2020 until 30 April 2021 (at that time), the EPO started a pilot project for oral proceedings by videoconference before opposition divisions, according to which all oral proceedings before opposition divisions would be held by videoconference at the discretion of the division and with the agreement of all parties (OJ EPO 2020 A41). www.hlk-ip.jp

In the November 2020 edition of the OJ, via a notice from the EPO, it was announced that the pilot program would extend until 15 September 2021. However, this Notice introduced a change to the previous wording. No longer would the discretion of the division or the agreement of all parties be required to conduct the oral proceedings via videoconference. Rather, holding oral proceedings via videoconference would now be mandatory. The reason for this departure was as follows: “with a view to guaranteeing effective access to justice and to avoiding a continuous increase in the number of unresolved oppositions, for oral proceedings that are scheduled to take place on or after 4 January 2021, the agreement of the parties to hold oral proceedings in opposition proceedings by videoconference will no longer be required under this pilot” (OJ EPO 2020 A122).

In late March 2021, the Boards of Appeal followed a similar trend, acknowledging the preventative effect of the COVID-19 travel restrictions on parties’ ability to attend inperson hearings. The Rules of Procedure of the Boards of Appeal were amended to introduce a new Article (Article 15a RPBA) which entered into force on 1 April 2021 and which states: “The Board may decide to hold oral proceedings pursuant to Article 116 EPC by videoconference if the Board considers it appropriate to do so, either upon request by a party or of its own motion” (OJ EPO 2021 A19).

In the meantime, an appeal (T 1807/15) was pending concerning a European patent that was maintained in amended form following oral proceedings held in May 2015. The appeal was filed by the opponent. In January 2020, both parties were summoned to (inperson) oral proceedings scheduled for 3 June 2020. In early May 2020, the proprietor requested that the oral proceedings be postponed due to COVID-19 and, via a communication later that month from the Board of Appeal, the oral proceedings were rescheduled for 8 February 2021.

in view of the travel restrictions between the UK (the country of the patentee’s representatives) and Germany (that of the appellant’s representative). Furthermore, the proprietor submitted that oral proceedings would not be suitable for holding via videoconference due to the requirement for simultaneous interpretation from German to English. The appellant agreed with the proprietor that the case was unsuitable for holding oral proceedings via videoconference.

Nevertheless, the parties were informed that the oral proceedings would take place on the scheduled date via videoconference, and they did so. In other words, oral proceedings took place via videoconference without the consent of either party.

At the oral proceedings, the appellant requested, as an auxiliary measure, that the legality of holding oral proceedings via videoconference be referred to the Enlarged Board of Appeal. More specifically, it is enshrined in the European Patent Convention (EPC) that oral proceedings must take place at the request of any party to the proceedings through Article 116(1) EPC, and the appellant questioned whether holding the proceedings via videoconference was compatible with this article. Particularly, they argued that an underlying concept of Article 116(1) was that the parties have the right to be physically represented, citing the “principle of immediacy” of the German Code of Civil Procedure in support of this contention. In other words, in the appellant’s view, a crucial point for oral proceedings under Article 116(1) was the physical representation of each party.

The Board of Appeal referred the following question to the Enlarged Board of Appeal (EPBA) for a decision: referral G1/21: Is the conduct of oral proceedings in the form of a videoconference compatible with the right to oral proceedings as enshrined in Article 116(1) EPC if not all of the parties to the proceedings have given their consent to the conduct of oral proceedings in the form of a videoconference?

Naturally, this referral is relevant for all applicants as it is just as applicable to firstinstance proceedings (e.g. examination) as it is to the opposition procedure. Indeed, there is no distinction in the question that is referred to the EPBA between inter parte (opposition) and ex parte (examination) proceedings. Therefore, whatever the decision of the EPBA is, it will apply to all oral proceedings and a large number of pending cases is therefore potentially affected.

Due to the COVID-19 pandemic there was an obvious inability to conduct oral proceedings in person and, before the abovementioned decisions concerning the mandatory conduct of hearings via videoconference came into effect, a number of hearings were initially postponed. This created a growing backlog of cases awaiting hearings that the decisions mandating the holding of oral proceedings via videoconference were intended to alleviate.

We sought out some recent statistics to gauge the size of this backlog which illustrates the potential practical significance of the above referral (however the question is answered), and the EPO kindly provided us with the following information.

In 2020 there were an estimated 2759 examining division oral proceedings. An estimated 228 of these were face-to-face and 2531 were held via videoconference (although these figures include late cancellations and “no shows”). The 228 face-to-face number covers the period www.hlk-ip.jp

り、あくまでも概算です。EPOは2020 年の残りの期間については、対面形式に よる審査部の口頭審理は0件またはその 近くまで減少したと確信しています。 興味深いことに、2020年に開かれた審 査部のビデオ会議による口頭審理2531 件のうち、130件が2020年1月に、250 件が2月に開催されていました。このこ とは、新型コロナウイルス以前も、ビデ オ会議による口頭審理が珍しくなかった ことを示しています。実際に当事務所 の経験上、2020年以前でも、審査段階 の事件において、ビデオ会議による口頭 審理の請求は日常的に認められていまし た。 2020年の異議部の口頭審理は950件あ り、そのうち603件は対面形式で（1月 から3月）、347件はビデオ会議による ものでした。347件のビデオ会議による 口頭審理のうち、1月または2月に開催さ れたものはなく、1件が3月に、2件が4月 に開かれました。それ以外は、5月から 年末までに開催されました（ただし、伝 統的なホリデーシーズンである8月には1 件も開かれませんでした）。 今年（1月から5月末まで）は、1604件 の口頭審理が審査部で、1685件が異議部 で開かれました。予想どおり、これら全 てがビデオ会議で行われ、対面形式のも のはありませんでした。 当事務所は確かな動向を知るために 2019年についても考察しましたが、 残念ながらEPOは2019年にビデオ会議 で開かれた口頭審理の件数について、 具体的な数字を把握していませんでし た。2019年に審査部で行われた口頭審 理は5573件で（事例証拠は、そのうち 25‐35％がビデオ会議によることを示し ていますが、先述したように正式な数字 は不明です）、異議部では2862件の口 頭審理が行われました。新型コロナウイ ルス以前にビデオ会議で開かれた異議部 の口頭審理については、情報が得られま せんでした。 興味深い点として、審査段階で予定さ れていた口頭審理の70％以上が開かれ ていません。読者の皆さまはご存じでし

from January to March (e.g. prior to the decisions of the President of the EPO mentioned in the previous section coming into effect) and is an estimate. The EPO is confident that face-to-face examining division oral proceedings dropped to zero or close to zero for the remainder of 2020.

Interestingly, of the 2531 videoconference examining division oral proceedings that took place in 2020, 130 of these took place in January 2020 and 250 took place in February. This indicates that oral proceedings via videoconference were not uncommon even prior to COVID-19. Indeed, it is our experience that, prior to 2020, for cases under examination, a request for a hearing to take place via videoconference was routinely granted.

In 2020 there were 950 opposition division oral proceedings. 603 of these were faceto-face (from January to March) and 347 were held via videoconference. None of the 347 oral proceedings via videoconference took place in January or February, one took place in March, and two took place in April.

The remainder took place from May to the end of the year (although none took place in the traditional holiday season in August).

For the current year (January to the end of May), 1604 oral proceedings have taken place before the examining division and 1685 have taken place before the opposition division. As fully expected, all of these have taken place by videoconference; none were face-to-face.

We have looked back to 2019 attempting to establish any trends but, unfortunately, in 2019 the EPO did not keep any particular metric on the number of hearings taking place via videoconference. In 2019, 5573 oral proceedings took place before the examining division (anecdotal evidence suggests that 25-35% of these took place via videoconference but, as above, no formal number is known), and 2862 oral proceedings took place before opposition divisions. We are not aware of any opposition division oral proceedings taking place via videoconference prior to COVID-19. www.hlk-ip.jp

Interestingly, over 70% of scheduled oral proceedings in examination do not take place. As our readers will no doubt be aware, it is possible for the outstanding objections to be resolved prior to the scheduled date of the hearing in which case the proceedings may be cancelled, following which the procedure concludes in writing.

This is in addition to late-withdrawn cases (possibly to avoid a negative decision) and late decisions not to attend.

The above figures are broadly summarized in the below table, which also includes Boards of Appeal information taken from annual reports. Assuming a normally low level of fluctuations in the number of oral proceedings held each year, there is a possible backlog of over 5000 oral proceedings which built up in 2020.

We note from the calendar of scheduled oral proceedings published on the EPO’s webpage that from mid-September 2021 it is not always yet clear whether the scheduled proceedings will be via videoconference or face-to-face.

So far, we have not seen opposition oral proceedings scheduled as face-to-face hearings in the calendar. On the other hand, Board of Appeal oral proceedings are mostly scheduled to be face-to-face.

Examination oral proceedings are not public and unfortunately the calendar provides no information on whether these hearings are scheduled to be via videoconference. Nevertheless, we fully expect the current EPO attitude to videoconference hearings in examination to be maintained.

Outcome of the G1/21 Referral Oral proceedings were held on 2 July 2021 following which the Enlarged Board of Appeal, on 16th July 2021, stated: During a general emergency impairing the parties’ possibilities to attend in-person oral proceedings at the EPO premises, the conduct of oral proceedings before the boards of appeal in the form of a videoconference is compatible with the EPC even if not all of the parties to the proceedings have given their consent to the conduct of oral proceedings in the form of a videoconference.

The ruling only mentions proceedings before the Board of Appeal and insofar as the parties’ possibility to attend in-person oral proceedings are “impaired during a general emergency.”

Therefore, whether oral proceedings via videoconference may be held without the consent of both parties in firstinstance examination or opposition proceedings, or in the absence of a “general emergency” remains unclear. It is furthermore not yet clear what conditions constitute an “impairment” on the parties’ possibility of attending the proceedings, or what conditions constitute a “general emergency.” www.hlk-ip.jp

In due course, the full written decision will be issued. We will await, with interest, whether it provides clarification on any of the above points. In any case, what is clear from the above statistics is that a large number of applicants, proprietors and opponents may be affected by the decision.
