Democracy on the move in Guyana

DEAREDITOR, October5marks31years since the restoration of democratic rule to Guyana after twenty eight years of PNCdictatorialrule.During that period Guyana was reducedtooneofthepoorest countries in the western hemisphere.

The restoration of democraticrulewasindeeda defining moment in the political life of the country

Under the slogan ‘Time to Unite: Time to Rebuild’ the PPP/C administration under the leadership of Dr Cheddi Jagan began a process of economic and social reconstruction. The private sector was designated ‘the engine of growth’, an indication of the changing global dispensation due in large measure to the ending of the Cold War and the collapse of the world socialist system. The Soviet Union, which at one time was seen as the bastion of socialism ceased to exist as the country disintegrated intoanumberofindependent states under the force of Glasnost (Opening) and

Perestroika (Restructuring)

implemented by the Gorbachevregime. The restoration of democratic rule on October 5,1992hastobeseenagainst the background of the changing international dynamics.Guyanaunderthe PPPwas no longer seen as a threat to United States security interests in the region.Itisnosecretthatthe United States and other western nations turned a blindeyetoelectoralfraudin Guyana under the Burnham regime mainly out of political/ideological considerations All of that changed during the late 1980’s which saw a change in United States attitude towardsGuyanainfavourof democracy and human rights.Thefirstindicationof that changing attitude came in the late 1980’s when the George Bush administration called on the then Hoyte administration to restore democracy to the country This was later followed up by President Carter and the Carter Centre which advocated for electoral

reforms which included a new elections commission, anendtooverseasvotingand the counting of votes at the place of poll. This latter proposal was vehemently resisted by Desmond Hoyte who described such a move as a ‘logistical nightmare’. After much arm-twisting Hoyte finally agreed to the oppositiondemands.

By the early 1990’s the writing was on the wall for the PNC regime which had perpetuated its political rule through a combination of forceandfraud.TheOctober 5, 1992 elections produced the first democratically elected government since 1964.

The PPP/C, as was widely anticipated, won a majorityofthevotesandwas duly elected to the seat of power.Andwhilecreditmust begiventotheUnitedStates government for the role it played in the restoration of democracy to Guyana, the combined impact of civil societyadvocacy suchasthe independentmedia, thetrade union movement, religious organizations, private sector

organizations, the diaspora and the political opposition led by the PPP was no less significant.

The spectre of rigged elections again raised its uglyheadintheMarch2020 General and Regional elections when the APNU+ AFC coalition attempted to returnitselftopowerthrough fraudulent means. However, such attempts were successfully thwarted throughthecombinedefforts of the courts, especially the Caribbean Court of Justice (CCJ), the international community and other democratic forces in Guyana.

Democracy in Guyana is still evolving along the lines of greater inclusivity The challengebeforeusistofind ways to further enrich our democracyalongthelinesof OneGuyanaasenvisagedby President Dr Mohamed IrfaanAli.Our democracy is worthcelebrating.Weowea debt of gratitude to all those whostoodupfordemocracy inGuyana.

DEAREDITOR, Allow me to offer a comprehensive response to the slanderous, maliciously false and spurious attempts by ‘embattled’ former Executive Member of the Guyana Cricket Board, Mr Anand Sanasie, who publicly sought to sully my goodname, andcharacter,in orderberatetherecentlyand “successfully” concluded, ‘Washington Conference on Guyana,’ organised by the GuyaneseDiaspora, through aveiledattackasa‘personal axe to grind’ with local businessman, Mr. Dorwain Bess.

To begin, it is of utmost importance to establish the overarchingcontextinwhich Mr Sanasie’sallegationsare rooted He engages in “psychological projection” theactofattributingtoothers the beliefs, behaviours, problems, orinsecuritiesthat onemaythemselvespossess. Mr Sanasie’s unfounded allegations appear to be, in fact, a reflection of his own insecurities.

Mr Sanasie, in his opening tirade, asserts, “Scraping the bottom of the barrel may very well be the applicablesloganhere, asthe APNU/AFC delegation to Washington DC did exactly that, in citing their example

of racial discrimination by the Government of Guyana ”Qualifying this position, without fear of subsequent contradiction, I wouldliketodisclosethatat 07:34hrs the morning following my initial presentation to the ‘Washington Conference on Guyana’ Mr Sanasie contacted me via WhatsApp to say “The last thing you should have done is to use Bessasanexample,Iwould respond.”

An apparent glaring and malicious misrepresentation on the part of Mr Sanasie’s worth noting, is that the discussion on ethniceconomic discrimination at the Washington Conference on Guyana’ was initiated by Conference Delegate Attorney-at-Law, Dawn Holder-Cush,whoreferenced her client Subsequently, Conference Organizer Mr RickfordBurkeelaboratedon this theme, citing Mr Bess, among others, as examples Perplexed by the fallacy in Mr Sanasie’s assertions, I respondedtohisnottosubtly veiled threat, to say “I didn’t speakorrefertobess(sic):get it clear”Ascreengrab of this engagement will also be shared for corroboration and orpublication.

Subsequently,theEditorin-Chief of The Guyana Times, Ms. Tusika Martin,

The PPP, through Mr Sanasie’s ‘projected psychological’ mindset, has clearly sunk to resorting to amplifying a typographical error present in an independent news article, insinuating nefarious intentions behind this seemingly innocuous

Onecontinuestowonder about how autocratic this “Democracy”canbe.

For some inexplicable reasonitrefusestorecognise that citizens, more specifically Guyana’s teachers and public servants are entitled to legal representation as provided for in the Guyana Constitution.

That these agencies are being pellucidly bypassed must be a matter of substantive concern to this Administration’s partners in Caricom, where Guyanese of varying professions, includinglaw, reside.

But then the latter must also reflect on the eloquent indifference of Guyana’s Legal Agencies’ loquacious silenceonsuchasubstantive constitutionalissue.

The post recent interaction that leaves all to ponder is that the Guyana Teachers’Unionisbypassed in order to speak only to individual teachers, regardless of status and pay, that they will benefit from ‘housing loans’ of up to $15Mataninterestrateofup to3.75percent.

‘Nobody losing their job for reducing US$214M questionable

Exxon expenses is alarming’ – Fmr. President Ramotar

Former Guyanese President, Donald Ramotar, has raised serious concerns over the controversial US$214 million in expenses attributedtoExxonMobil.

Two weeks after it announced an investigation into the “unauthorised engagement” by staff of the Ministry of Natural Resources Petroleum Unit with U S oil giant ExxonMobil over the company’s US$214 million questionableexpenses, there has been no official update from the government regarding the progress or findingsofthisprobe.

In a recent interview, Ramotar expressed alarm that no one has faced job repercussions for these questionable expenditures, emphasizing the potential ramifications for Guyana’s

future. During an in-depth discussion on Globespan, moderated by Dr. Asquith Rose, Ramotar underscored the urgency of addressing this issue. He stated, “For instance, wehavethedebate on ExxonMobil expenses. We must be very, very consciousthatExxonishere tomaximizetheirprofitsand they will do so if given the opportunity.”

Ramotar continued by

questioning how a group of individuals from the Ministry of Natural Resources Petroleum Unit could negotiate with ExxonMobil to reduce expenses that were deemed questionable and not justified, all without any repercussionsintermsofjob loss.

The former president emphasised the potential dangers that such actions pose to Guyana’s future dealings with multinational corporations.

He stressed that swift and decisive action is essential to maintain transparency and protect the interestsofthecountry

Vice President, Bharrat Jagdeohadannouncedthata thorough investigation would be conducted to identify the individuals responsibleforengagingthe

oil company in reducing US$214 million in questionable costs flagged byaBritishauditortoUS$3 million During a press conference at Freedom House on September 21, the chiefpolicymakerfortheoil sector told reporters that the Ministry of Natural Resources (MNR) would then provide a report to Cabinet for review which would be used to determine the appropriate disciplinary action.

On Monday, this newspaper reached out to subject Minister, Vickram Bharrat for an update on the investigation. The minister would only say that it is ongoing. He also offered no timeline for the completion oftheinvestigation.

In keeping with its advisory role, the Guyana Revenue Authority (GRA)

had written the ministry on August8,2023advisingthat it had no objection to the US$214M first flagged by IHS Markit and they should proceed to closing the US$1.6B audit of Exxon’s expenses, incurred between 1999and2017 Jagdeo had explained that the ministry did not a d h e r e t o t h i s recommendation and engaged in discussions with Exxontoreducethesesums. The Vice President said the Head of State, Dr IrfaanAli was appraised of the developments and there was an agreement for a full investigation. He said too that the ministry now has to communicate to Exxon that based on the adviceofGRA,thedisputed sums will remain at US$214M Importantly, Jagdeo said Exxon would not be pulled into the investigation. Jagdeo said, “We don’t know what they sent and I am not interested in what they sent because that could be used in arbitration should we go there.Iammoreinterestedin who authorized this and why.”

Dangerousprecedent

In the meantime, the Opposition believes Guyana’s first oil audit has setadangerousprecedentfor the US$40B in reviews still

to be completed These expenses relate to the five sanctioned projects in the prolific Stabroek Block, whereover11billionbarrels ofoilhavebeendiscovered.

Notably, a consortium was hired by the People’s Progressive Party (PPP) a d m i n i s t r a t i o n t o undertake a second audit o f E x x o n M o b i l ’s expenses incurred between 2018 and 2020. That review is still to be finalized. The auditors were tasked with verifying the costs racked up by the company, amounting to someUS$7.3billion.

The five sanctioned projects in the Stabroek Block carry a price tag of about US$40 billion which Guyana must scrutinise to make sure it isnotbeingovercharged EconomicAdvisortothe Opposition Leader, Elson Low recently told Kaieteur Newsthatwiththereduction of the costs from US$214 million to US$3 million, Guyanesearenowlefttofear whatmaybetheoutcomeof the audits yet to be undertaken.

He said with the British auditor flagging over US$200 million in costs as questionable from the US$1 6 billion exploration costs, Guyana couldexpectinflatedcosts amounting to billions of US-dollars from future audits.

Moreimportantly,Low noted that failure by the government to contest those costs or to allow a reduction from the oil companies can deprive the country of much-needed revenue to boost the quality of lives for its citizens.

Programme launched to boost male’s achievement in education

The National Literacy Department of the Ministry of Education on Wednesday launched the Male Achievement in Education Programme at the National Centre for Educational Resource Development (NCERD).

This is a pilot programme being rolled out in collaboration with the Ministry’s Secondary Sector, its Health and Family Life Education Unit, Loyola University, Chicago and the Guyana Defence Force.

In a press release the Ministry of Education said, Professor at Loyola University, Dr. Tavis Jules said that research has shown that a country’s human capital is the most vital resource that it needs to utilize. He said that the pilot programme will target those male learners who wrote the last National Grade Six Assessment (NGSA) but failed to achieve a passing grade. He said, “What we’re proposing here is the targeted intervention towards those students, particularly boys, that will help them to achieve the competent reading grade by the time they get to third form (Grade nine).” Dr. Jules explained that when thinking

Officers of the Guyana Defence Force along with officials from the Ministry of Education and representatives of the Loyola University at the launch about male underachievement, we also need to consider what is the outcome if the problem isn’t addressed. He said that male underachievement is a crisis that was not recognized early because a lot of investment was made in the education of girls. He said that at the beginning of the millennium, research revealed that gender parity is something that needs to be worked on since historically the emphasis has been on getting girls into school.

“What we have seen now is that because we’ve spent the last decade focused on getting girls in school, we have neglected the boys and because we’ve neglected the

boys, everything from absenteeism to traumatic incidents whether they are at home or school, are now causing a distinctive set of behavioural problems. Those behavioural problems are ultimately impacting their academic achievement,” Dr. Jules explained. He said that the programme will seek to capture male learners who fall into this category and bring them up to their reading grade standard by using the Health and Family Life curriculum. According to the Professor, the HFLE curriculum will be used because it targets literacy and helps to develop interpersonal skills. Mr. Sheldon Granville, Education Officer

within the Secondary Sector said that the Unit supports the programme and considers it a matter of national importance to address the issue since every child can contribute to the development of Guyana.

Mr. Kevin Joseph, Education Officer attached to the National Literacy Department said that the programme will be supported by the Guyana Defence Force where Lieutenant Colonel Chichester and team will mentor the male learners who will be part of the pilot programme. The programme will target five schools initially and will expand in the future to target more schools and learners.

Because no details have been released on the financial agreement between ExxonMobil and the Government of Guyana for the delivery of natural gas to the plant, IEEFA’s report states that it is also unknown what contractual risk the government is assuming if it does not use all of the 50 million standard cubic feet of gas per day (MMcf/d) that Exxon is building the pipeline to deliver. This is a critical grey-area IEEFA officials urge Guyanese to demand greater clarity on.

BACKGROUND ON GAS PROJECT

The PPP/C’s plan for a gas-to-energy project entails partnering with ExxonMobil Guyana Limited to construct a massive 218 km offshore pipeline structure that would

bring gas from the Stabroek Block’s Liza field onshore and feed into two facilities, a Natural Gas Plant and a 300MW Power Plant, both to be situated at the Wales Development Zone.

The 12 inch pipeline being constructed by Exxon will have the capacity to transport 50 million cubic feet per day (50 MMcf/d) from the offshore Liza field, and will be able to deliver a minimum volume of no less than 10 MMcf/ d. The Government of Guyana and US consortium, LINDSAYCA/CH4 on December 13, 2022 signed the contract for the construction of the integrated Natural Gas Liquids Plant and the 300megawatt (MW) combinedcycle gas turbine (CCGT) power plant at Wales, West Coast Demerara (WCD), Region Three. The historical signing of the contract for the US$759 million project took place at the Office of the President, Shiv Chanderpaul Drive.

In January 2023, President

Irfaan Ali witnessed the signing of a contract between the Guyana Power and Gas Inc. and Engineers India Limited (EIL) for the provision of Consultancy Services for the Wales Natural Gas Liquids (NGL) facility as well as the 300 megawatt (MW) power plant.

That contract is pegged at US$22,143,190. The consultancy is for the Consultant to assist the Government of Guyana through the Gas to Energy Task Force in the design review, construction, supervision and general project management of the development of the integrated plants, and contract administration throughout the project implementation process and thereafter during the defects liability period. Government has said project generation costs, taking account of payment for the pipeline, operations and maintenance, and capital cost recovery will total less than five US cents per kilowatt-hour.

High Court dismisses case against EPA over permit that allows Exxon to flare gas

The High Court on Tuesday dismissed an application filed against Guyana’s Environmental Protection Agency (EPA) to put a stop to flaring by ExxonMobil Guyana Limited in the Stabroek Block.

The case was filed back in January by three Guyanese women: Sinkka Henry, Sherlina Nageer and Andriska Thorington, through their attorneys-atlaw Melinda Janki and RonaldBurch-Smith.

In their application the women said that the EPA acted unlawfully and Ultra Vires the Envirommetal Protection (EP)Act Chapter 20:05 when it issued a modified Environmental Permit(EP)whichgoverned theconductofthepetroleum operations and production byExxonMobilGuyana.

In the Fixed Date Application (FDA), the women sought orders to quashthedecisiontoreplace the original permit dated September25,2020,withthe said modified permit declaring that a charge of

USD$30pertonneofcarbon dioxideequivalentassetout in the modified EP and argued is in breach of the PolluterPaysPrinciple.

Themodifiedpermithad been previously amended pursuanttoanorderofCourt so as to limit its validity to fiveyearsasstipulatedbythe EP Act The applicants sought a number of mandamus orders directing the EPA to issue certain orders and directions to ExxonMobil as regards its operationsfortheproduction ofoil.Thewomenclaimedin their application that the oil

company has been flaring associated gas almost continuously since it began production in December 2019,despiteundertakingto reinject the associated gas, andnotflareit.InMay2021 afterExxonMobilhadflared billions of cubic feet of associated gas, the Environmental Protection Agencypurportedtomodify Esso’s permit to allow it to flare gas in exchange for a US$30 fee per tonne of carbondioxideequivalent.

The litigants therefore contended that the agency’s decision to modify Esso’s environmental permit to allow flaring was irrational and unlawful and that it should be quashed by the court. They also argued that the agency breached the Environmental Protection Act Cap 20:05 by purporting to allow Esso to flare in return for paying a fee.InherrulingonTuesday, Chief Justice (ag) Roxane George Wiltshire noted that whilereferencesmadebythe counsel for the applicant wereacknowledged, thecase ultimately turns on the

“I got the distinct impression that the applicants were cherrypicking what they wanted o relyontosupporttheircase, identifying and relying on clausesorpartsinisolation,” theChiefJusticesaid.

As it relates to the fees, the judge noted that while EPA did not respond to allegation about pollution fee, ExxonMobil’s country

Manager,Alistair Routledge produced evidence of comparative flaring fee for othercountriesincludingthe EuropeanUnionandCentral and South America which said USD $30 fee is in the mid-range of fee charged internationally

To this end, Justice George Wiltshire concluded that the EPA act of issuing the modified EP to Exxon has not breached the EPAct andRegulation.

“Nor has it been proven that the issuance of the said modified EP gave rise and has given rise to an additional adverse effect on theenvironment.

There is nothing in the law that prevents the issuance of a modified EP; and in this case, nothing of the facts rendered the

issuance of the modified EP unlawful, ” she said Additionallythechiefjustice f o u n d t h e E PA’ s implementation of the Polluter Pays Principle in the modified EP is in compliance with section 4 (4)(a)oftheEPAct.

Given her conclusion, the judge said in hindsight, the application should have been dismissed when it became clear that the applicantswerenotpursuing most of their claims and or had evidential basis to supportthemallinrelationto apurelyacademicpoint.

As such the application was dismissed with costs to the EPAin the nominal sum of sum of $150, 000 to be paid on November 3, 202. However, therewasnoorder astocostinfavourofExxon.

NPTAB defends $865M contract award to ‘Guyanese Critic’

T h e N a t i o n a l Procurement and Tender Administration Board (NPTAB) has defended its award of a $865M to Tepui Group Inc.- a company that was registered last year to buildapumpstationatBelle Vue,WestBankDemerara.

Thecompanyisaffiliated with social media commentator, Mikhail Rodrigues, popularlyknown as “Guyanese Critic ” Rodriguesisaclosefriendof leaders in the People’s Progressive Party, particularly Vice President BharratJagdeo.

Below is the full statementbyNPTAB

T h e N a t i o n a l Procurement and Tender Administration Board (NPTAB) wishes to explain again that it follows the systems, processes and procedures enshrined in the Procurement Act and its regulations in the award of contracts.Thisincludesinter aliathefollowing:

•Publicadvertisementof alltenders, publicopeningof bids (in fact NPTAB is singular in that it opens and reads all bids in full view of bidders and the public at large both in-person and virtually),andtheevaluation of bids by a three-person independent evaluation

team The bidding documents contain the criteria to be used for the assessment of the winning bidder (which does not prescribe any role for the gender, race, religion, or political persuasion of the bidder). The evaluators are required to apply the evaluation criteria, and that alone, as the basis for its recommendation to the Board, and the Board’s award is subject to a noobjection of Cabinet, if the value of the award is above G$15million.

• In any bid, there are administrative, technicaland financial criteria to be followedwhichareassessed by the Evaluation Committee in making its recommendationtoNPTAB. These criteria are all fully enshrined in the specific tender document applicable to the specific procurement, whether for goods, works or services.

• F o r c l a r i t y , administrative compliance includesprovisionofavalid business registration, valid Guyana Revenue Authority and National Insurance Scheme compliances, applicable bid security, signed bid form by the authorized representative of the firm, and any other

documentrequiredbythebid document. Non-compliance with any of these would result in the bid not being considered for further evaluation.

• Arithmetic check is then conducted to correct anydiscrepancy

This may result in the actual bid price being different from what was called at the opening of the bid.

• A key aspect of the evaluation process entails assessing technical and financial capacity This includes that the bidder demonstrates specific

construction experience and evidence of financial capacity

• Additionally, bidders must meet the stated equipment and human resources requirements in thebiddocument.

• Finally, bidders who have three (3) or more outstanding contracts from any public sector agency, will not be considered for award An outstanding contract is one where more than20%ofthevalueofthe contract is not completed as

t deadline for final completion.

Specifically, with regardstotheconstructionof the Belle Vue Pump Station project, twenty-six (26) companies tendered for that project. Thirteen (13) bids were deemed nonresponsive and were therefore not considered for award. Of the thirteen (13) substantially responsive and compliant bids, the lowest priced responsive bid was awarded the Meeten-Meer Zorg Pump Station, while thesecondlowestresponsive bid was awarded the Jimbo /GrovePumpStation.

Tepui was the third lowest priced responsive bidder and was awarded the BelleVuePumpStation.

Clearly, therefore, merely looking at the bid price announced at the openingofthebidcannotbe used to adjudge the winning bidder and, worst yet, be used to impugn the integrity oftheevaluationprocessand subsequent award of the contract.

As such, the views expressed by Mr Mahipaul in his recent letter to the Kaieteurnewsandtheviews expressedbythesubsequent EditorialofthesaidKaieteur News are without merit and not based on any fact. They are whimsical and apparently fanciful political

gimmickry Both views contradicted themselves in that they both acknowledge that the rules governing an award is not necessarily an award to the lowest priced bid, yet they queried the award to a bid that was not thelowestpricedbidwithout any recourse to the detailed evaluationprocess.

In accordance with the standard procedure, an award is made to the lowest priced RESPONSIVE bid. Responsiveness in this regardissubjecttothestated criteria in the bidding document.

Nothingelse!!!

It is farfetched and indeed malicious for both views to cast aspersions on the integrity of the evaluation process or NPTAB when, clearly no evidence is forthcoming of anymis-procurement.

Subject to the award of any contract, and in accord with provisions in the ProcurementAct,anybidder can appeal an award subject to it being done in the specified form and manner NPTAB is not in receipt of anyappealtoitsawardfrom anybidder

And were there to be an appeal, itwillbedealtwithin the prescribed manner consistentwiththeLaw

Another powerful allround performance by Regal which enabled them to win the 2023 Prime Minister’s Softball Cup Legends category against New York Softball Cricket League (NYSCL).

Playing last Sunday at the Demerara Cricket Club ground in Queenstown, Georgetown, the Regal Legends outfit surpassed the 180 from the allotment of 20-overs set by the Americans.

Regal achieved victory with 30 balls remaining as they continued to hit headlines in this over-50 category for the past few years.

It was another demonstration of their invincibility as they kept winning championships after championships,

both locally and overseas.

Even as recent as last year, they rolled over the same opponents utilizing the psychological advantage on this occasion.

In pursuit of the target, Regal suffered an early blow losing Mohindra Arjune for seven but Yuniss Usuf and the gifted softball player Ramesh Narine quickly associated in a steady, 93-run stand to restore the innings.

Usuf, who had a memorable tournament having accumulated the most runs 356, once again spearheaded the chase by knocking a responsible 68.

Narine was equally brilliant and ensured his innings of 66 not out proved instru-

mental.

Regal win Legends category at GSCL Inc Prime Minister’s T20 Softball Cup

Both caressed a number of boundaries with consummate ease. The pitch was ideal for batting and the lightning fastoutfield, enticed stroke-plays.

They were probably inspired to play stubborn cricket as well as a whopping $1M first prize at stake.

Earlier, NYSCL called correctly at the toss and opted to bat. The innings had an early wobble but Quayam Farooq struck a top-score of 50. Some decent contributions came from Jagdeo Persaud with 35, Ricky Edwards with 21 and 20 from Tony Fernandes.

Skipper and the experienced Mahendra Hardyal finished with 3-33 from his four maximum overs. He started the attack with Rickey Persaud, who received some belting despite being stingy upfront.

At the post-match presentation, Regal also collected a trophy while NYSCL was the recipient of $50,000 and a trophy. Player-of-the-match Narine was given a trophy too for scoring that vital half-century and picking up a solitary wicket. Usuf deservedly named the player-of-the-series.
