A SUPREME Court judge has ruled that while the actions of a husband who repeatedly “forced” him self on his wife were cruel, there is no rape in mar riage under Bahamian law. In a ruling handed down on Monday, Justice Denise Lewis-Johnson granted a divorce for a woman who said she felt like a rape vic tim “for an extensive period of time”.However, Lewis-Johnson noted that the issue raised by parties of non-consensual and forced intercourse, to gether with the use of the word rape, required the court to consider the term in the context of the matrimonial laws of The Bahamas. “The court accepts that rape is a most heinous act of cruelty and a malicious violation of a person,” she said“However, on a strict reading of laws of The Baha mas, there is no rape in mar riage. Pursuant to Section 3 of the Sexual Offences Act, the law does not allow for one spouse to rape the other. In this place we interpret ex

(T&T Guardian) - Fam ily, friends and loved ones said their final goodbyes on Tuesday to Annan Boysie, 40, who tragically lost his life while attempting to cross floodwaters last week. Boysie spent the last 20 years working as an emergency medical tech nician.Speaking during the service at Boodoo’s Fu neral Home in Penal, his boss, Amalgamated Secu rity Services ambulance manager Kyron Grant, described him as unique, dancing to the beat of his own drum. He also remembered him as being extremely“Anythingknowledgeable.youwanted to know in terms of emer gency care...you went to Annan and Annan had it...everything that you required,” Grant said. “His death touched us deeply because he came from work. He was on his way home from work and our imagination of that scene, if you had asked us to guess, would be Annan applying CPR (cardiopul monary resuscitation) to somebody who drowning, not Annan “That’sdrowning.howwe ex pected him if he was to participate in such a scene - that he’d be saving a life. Unfortunately, that’s not the way it happened,” he said.Since the incident oc curred, the country has wondered why Boysie took the chance to drive through the floodwaters; especially after it came to light that he was warned against attempting to do so by bystanders. On social media, many also criti cised his However, decision.one of his former colleagues, Crystal Thomas, reminded those at the funeral that every day decisions are made and risks are taken. “I just want all of us to be aware that we do make mental risk assessments every single day and we do take chances, fortu nately for us, we survive and I don’t want anybody to take it for granted that chance Annan took that we would not have taken it because we have taken worse,” she said. “We driving and on our cellphones. Thousands of people die daily with that. We putting on makeup... while we driving. We do a lot of things that the risk are [sic] high and we get away with it and we here today,” she continued. Following the service, Boysie was cremated at Boodoo’s Funeral Home.

GUYANA CHRONICLE, Thursday September 1, 2022 5

PRESIDENT, Dr. Mohamed Irfaan Ali and a team of government officials recently visited a number of commu nities in Region Nine. The visit from all indications was highly productive as several on-the-spot interventions were made aimed at further enriching the quality of life of the Amerindian people. The interactions between President Ali and the hinter land residents were significant in more than one way. Firstly, and perhaps more importantly, it provided the President with an opportunity to have a firsthand assessment of the chal lenges and opportunities that the region face while at the same time coming up with real-time solutions to extant situations.Ofnoless significance is the opportunity provided by the several visits to hinter land communities for direct interface between President Ali and the broader citizenry.

Those who have been follow ing the President’s visits to the hinterland communities in the media, in particular the social media cannot overlook the warm and fraternal embrace which residents accorded the President and his team of officials. It is not often that residents from far-flung com munities get the opportunity to interface with a Head of State and this opportunity was certainly one worthy of cel ebration. The President, out of characteristic humility and his people-oriented personality, seized the moment not only to conduct government business but also to socialise with mem bers of the community by way of playing games, preparation of meals and other social en gagements.Thefact is that develop ment is all about people. It is about raising the social, cul tural and material conditions of life including food security. This is why much emphasis was placed during the visit to expand food production. Sev eral initiatives were taken to boost agricultural production in the region. Among these are poultry, hatching eggs, cattlebreeding, Black Belly Sheep and honey production which taken together with other tradi tional farming activities could transform the dynamics of agriculture in the region along the lines of greater sustainabil ity and food security.

TURN TO PAGE 7

The intention, according to President, is to greatly reduce the cost of food production in the region through crop diversification and capacity building. Several pieces of agricultural equipment were distributed to village leaders including agricultural and transportation machinery. The salient point to note is that such capacity building meas ures were done collaboratively with the President and commu nity leaders and not as was the case under the previous PNC administration, an imposition by the Central politicaltodaythebutlongertiveaofingCouncil,fairsMinistrydevelopment.thebecomeAmerindiansGovernment.todayhaveboththedriversandbeneficiariesoftheirownThroughtheofAmerindianAfandtheNationalToshaospolicymakingaffectthelivesandlivelihoodsAmerindiansaredoneonconsultativeandcollaborabasis.Amerindiansarenoplacedontheperipheryarenowanintegralpartofgovernanceprocesses.ThefactisthatthePPP/Cisthelargestmulti-ethnicorganisationinGuyanawithsignificantAmerindianandhinterlandsupport.Indeed,itisnoexaggeration to state that it is the party with the largest Amerindian sup port. This development came about as a result of the hard work and genuine concern for the well-being of Amerindi ans. The days when the PPP/C was projected as an ‘enemy’ of the Amerindian people has long gone and today there is a growing level of camaraderie and trust in the PPP/C as the only political organisation that truly represents the interests of the Amerindian people. This close relationship between the Amerindian people and the PPP/C ad ministration has been elo quently captured during a meeting with President Ali and residents of the Deep South Rupununi when he said “This is how your gov ernment work, we come to you, we listen to you and we make decisions in your interest.”

Researchers have argued that the PPP/C Government (1992-2015) and (2020 to now) did not and have not practiced racism against any group. Re searchers argue that the PPP/C did and have done more for Africans and Amerindians than the PNC/R, much more than what was done for or given to Indians. As critics have pointed out, the government’s two-year record of diversity and progress is unmatched by any previous administration. Data would show that Africans dominate every State institution. The Chancellor of the Judiciary, Chief Justice, head of Armed forces, head of Police Service, Chief Clerk of parliament, and several other institutions are Af ricans. There is ethnic balance in the government during past and present PPP/C adminis trations. The PPP/C had an African President in 1997. And since 1992, has had an African as Prime Minister when in of fice. The police, army, teach ing service, nursing, and other State employed agencies are overwhelmingly African. So where is the discrimination or apartheid?Apartheid is a govern mental system that is based on racism and organised or de jure segregation, the domination of majority groups by a minority group which consigns them to live in ethnic enclaves under extreme poverty. Subjugated groups live at the pleasure of the dominant group. The mi norities cannot occupy top positions in the governance structure. Apartheid is a version of the caste system which cor relates colour with status: the lighter the colour the higher is the social ranking and the dark er the colour to lower the social

Data would not support ‘apartheid’ claims in Guyana

Dear REGULAREditor, letter writer and columnist GHK Lall in a re cent letter (Aug. 30 in an other media) asserts that the PPP/C administration practices ‘apartheid’ (ra cial discrimination). Like him, I am for inclusive gov ernance (which he has not defined), and I am also sup portive of his advocacy of free speech. On the latter note, I am against libel suits to silence the media. I am also in agreement with him that there was an apartheid system of governance between 1966 and 1992; he cited exam ples to buttress that fact. But I am in disagreement with GHK’s characterisation of governance from August 2020 to now as “apartheid in na ture”. As he pointed out, In dian were victims of PNC dis crimination and persecution triggering mass migration of hundreds of thousands after independence. Indian cul ture was marginalised during the PNC tenure in office and Indians were discriminated against in State employment and service. No culture or group is marginalised now.

Unlike the PNC and WPA which have countless Afro cen tric and Afro national ist figures, the PPP/C has a paucity of Indians who are Indo-centric or who champion an Indian cause.Africans are not the only one crying discrimi nation. Indians also com plain about reverse dis crimination. An impartial study will reveal which group (s) get favoured treatment and dispropor tionately more resources if indeed any imbalance is practiced by the State. To buttress complaints of discrimination and eth nic bias, one needs data, not mere generalisations and ‘cry wolf’ statements but hard statistics – on state employment, sala ries, housing distribu tions, award of contracts, scholarships, etc. Can GHK cite figures to sup port his assertions? Only with reliable and accu rate data, one can get a true sense of purported discrimination and adopt policies to address them.

LEADER of the Al liance for Change (AFC), Khemraj Ram jattan, has declined to say whether or not his party plans to contest the Local Government Elections (LGE) alone as it had done in 2018. Two weeks ago, it was announced that it is highly likely that the LGE will be held by the end of 2022. This announcement came as the Guyana Elections Commission (GECOM) wrapped up its continu ous registration exer cise and moved into the claims and objections exercise, which started lastWhenweek. the Guyana Chronicle reached out to Ramjattan to confirm whether the party would be going solo again, he stated that the party had given the answers to similar questions al ready. The former minister noted that another press AFC Leader, Khemraj Ramjattan conference will be held on Friday and more infor mation in this regard will be revealed. He further added that these confer ences are necessary and the questions are usually answered there. “So, we’re going to deal with it on Friday,” he said. The AFC had opted to contest that election alone following incon clusive talks with its coalition partner -- A Partnership for Nation al Unity (APNU).

BUSINESSMAN Azrud din Mohamed, on Tues day, filed a $200 million lawsuit against police man, Dion Bascom, who had made a number of claims in relation to the police’s investigation into the murder of Ricardo Fagundes, known as “Pa per Shorts.” In the statement of claim seen by the Guyana Chronicle, Mohamed is seeking damages in excess of $100,000,000 for defa mation that was committed by Bascom and broad casted on social media via Facebook. These statements, the document noted, were false, untrue, dangerous, disingenuous, unsubstanti ated, unfounded and base less, among other things. As such, it added that the claims tarnished and low ered the reputation of Mo hammed and caused him embarrassment, public hu miliation and emotional distress.Additional punitive and aggravated damag es amounting to another $100,000,000 for further defamation committed on several days in August, which were also broad casted on Facebook, are also being sought. In those postings, the statements made about the claimant were untrue, irrational, unfair, unsubstantiated and baseless thereby tarnishing and lowering his reputa tion, it Further, added.Mohamed is seeking an injunction to restrain Bascom from ut tering, repeating, posting, sharing or broadcasting any statement similar to those made in the social media broadcast.Inthe document, the businessman requested that the damages be paid at an interest rate of 6 per cent per annum from the fil ing date to the date of the judgement and thereafter at a rate of 4 per cent per annum until fully paid. Bascom, after being ar rested by the police in early August, took to social me dia and alleged that he was mistreated while serving as a member of the force. In the live video which was later deleted, Bascom named several persons in cluding Mohamed regard ing the police’s investiga tion into the murder.

“There is no difference in ethnicity. There is no differ ence in communities. There is no difference between rich or poor. The difference comes when you do things that…destroys peace,” the President said. “We are all part of a big ger family, even bigger than the Guyanese family. We are part of the family of human ity. “And when we start un derstanding that we are all part of a singular family, then we all know that life must be enjoyed by all of us equally as far as possible,” Dr Ali furtherHinterlandnoted. communi ties like those in Region Nine have benefitted from a $25,000 per household cash grant that was implemented to help those residents deal with the rising cost of living, given the economic disad vantage faced by this section of the“Thosepopulation.aregrants that are responsive to your vulner ability. The gov ernment has also removed the Valued Added Taxes (VAT) on water, and reduced or removed taxes on a number of items.Guyanese are also ben efitting from a robust housing programme being imple mented by the government, whereby Guyanese of all races are benefitting from ac celerated house lot allocation, and resource assistance. These support pro grammes include initiatives of the government where land owners will receive sup port with steel and cement for the foundation phase of their housing construction. Some 600 land owners in Region Nine will also benefit from grants towards the construction of their homes. The government has also negotiated with two lending agencies to finance the remainder of the low cost mortgages.

The President was at the time speaking about the many social safety nets that his gov ernment has put in place over the last two years to ease the burden of adverse economic conditions brought on by the COVID-19 pandemic and the war in “InUkraine.everysingle society, the most basic understand ing of developmental studies will tell you that you must be able to have social safety nets that address the vulnerability of communities and address the vulnerability of different people.“Otherwise, you will have a country in which devel opment and growth brings with it a great disparity and inequality, and we cannot al low our country to suffer from inequality and disparity,” the President said. “I am not willing to lead a government that will see this happen. That is why we would invest heavily in transforming your future, ensuring we build the conditions, ensuring we build the facilities that will give you an equal shot of life because you are no different from any other Guyanese whether you are from Region Nine or Region Four,” Dr Ali continued.ThePresident underscored that unity and equitable treat ment are at the heart of the government’s “One Guyana” platform that champions in clusivity and fairness. “We are building ‘One Guyana’ that must bring social prosperity, economic pros perity, food security, energy security to every single one, to every single environment,” His Excellency noted. The President made the re marks to address rhetoric be ing peddled by the main oppo sition party about unfounded accusations of discrimination.

“We are all creation of God but when God said he made us to his own image and likeness… there is no difference in colour.

“I am not here to evaluate what the opposition says about the government. I am not here to respond to the nonsense that you hear them say every day. “I am here to define a pathway to which we are working positively to make your life better, to work with you to give you the best… work with you to enhance your communities, work with you to build sustainability. This is the path that I want all of us to embrace each other with,” the President said. Dr Ali highlighted that all persons are equal in the human race. He called on all Guyanese to see each other as one.

Subsequently, the Guy ana Police Force present ed evidence to show that Bascom, who is a police sergeant, had made false claims as it relates to the murder of Fagundes. At that time, Crime Chief, Wendell Blanhum, had said that Bascom was not being honest and was manufac turing false information out of malice against members of the police force. Mohamed’s Enter prise, in a statement, refuted the allegations made by the policeman in the social media post. The company also dis tanced itself from the al legations and added that it was never a subject of any investigation related to the crime that was re ferred to.

These are sched uled to arrive later this month and will be administered to highrisk patients.

“That is why we have continued with the hygiene and sanita tion programme, we have not stopped, yes, some of the restrictions, regulations are not in play anymore but we still actively encourage tourism and hospitality businesses to keep all the measures up.” Baksh said while many operators are still adopting the safe hygiene and sanitation protocols, the GTA will be rolling out additional programmes in the com ing“Weweeks.would have rec ommended during that period in time and the fact that monkeypox is here and that systems are still in place in a lot of the establishments, its great and I want to encourage them to con tinue to do so. Agriculture Minister, Zulfikar Mustapha, in a recent interview with the Guyana Chronicle, disclosed that works were in progress to extend the farm in the Tacama Savannahs to some 4,000 acres. “Last year we would have started the trial of 125 acres and it was very successful and we harvested three tonnes per hectare and that is aligned in getting the kind of production we want; because of that we said we will expand to 3,000-4,000 acres this year and we will continuously increase so the next three years we can expand to 25, 000,” Mustapha said. Gabriel Jesus has been on the winning side in 46 of the 49 Premier League games in which he has scored and has not lost in any of them

It means Arsenal have won their opening five league matches for the first time since the 200405 campaign, when they went on to finish second.

GUYANA CHRONICLE, Thursday, September 1, 2022 21 (BBC) - Arsenal main tained their 100% start to the season to stay top of the Premier League with a narrow victory over a lack-lustre Aston Villa side.

Gabriel Jesus' third goal of the season was a meagre reward for Arse nal's first-half dominance with the Brazilian for ward sweeping a low ef fort past Villa goalkeeper Emiliano Martinez after he had fumbled Granit Xhaka's deflected shot.

While Arsenal stut tered to a victory by the same score-line against Fulham last weekend they more than merited their three points against Villa.Superior in all depart ments before the break, the Emirates crowd re acted with a mixture of relief and joy when Mar tinelli turned match-win ner with his fourth goal in his last six top-flight matches.Arteta's side had been given an early jolt by Emiliano Buendia's third-minute effort but from there on it was oneway traffic as the Gun ners created a series of excellent chances which should have seen them out of sight by the break. Saka badly miscued to fire wide of an emp ty net from Martinelli's cross, while Odegaard saw his goal-bound shot blocked on the line by Villa defender Ezri Kon sa and Matty Cash also prevented another touch off Saka from creeping over the Martinez, line. despite his error for Jesus' goal, ex celled for the visitors and also made a fine save to tip Martinelli's superb volley over the bar, while centre-back Gabriel also twice went However, close.forall their free-flowing attacking, Arteta will likely have been most satisfied by the resolve that his side showed when they were pegged back. The Gunners will now travel to Manches ter United on Sunday in buoyant mood, though Arteta's next challenge might be how he rotates his squad with the club's Europa League campaign set to begin next week at FC Zurich. Meanwhile, Villa will play host to cham pions Manchester City, who have scored 10 goals in their last two games, needing to quickly address the de fensive frailties that saw Arsenal repeatedly carve them open to reg ister 22 shots on goal.
