Carve out 10 acres for family, example: four 2.5 acre lots. Plus 2 acres for home site lot. Possibly donate some acreage to conservation for tax purposes and to avoid triggering Cape Cod commission regulations.
Confirm with an attorney if you subdivide off 10 acres, can you avoid Cape Cod Commission for the piece you subdivide to keep in the family?
Sell the choice lot with the home estimated value in today's market $3,500,000. This part of the property will have to be surveyed and separated ? may be a challenge to market before this is complete.
Part of the property will stay in the family and the proceeds from the sale of the main home can be used for engineering of the rest.
How long will it take to subdivide the 10 acres and carve out the home site?
What would the cost be? Will this trigger CC Commission?
We are left with possible 13 acres of upland estimating 2 acres will be for roads. (this will have to be confirmed with an engineer).
What would a developer be willing to pay for the 15 acres of upland and the remaining wetland? Let?s say they can get a median price of approximately $400,000 an acre = $5,200,000?$6,000,000? But they are buying the unknown. Would the family be willing to wait for a subdivision approval? The price per acre if sold to a developer may have increased but the value/ price for the intact 40 acres remains the same. Maybe the purchase price has to be on a sliding scale, for instance: $300,000?$400,000 or $3,900,000?$4,500,000? It all depends on how many lots can be accomplished. Maybe large parcels 2 or 3 acres would be easier to get approved?
It is difficult to determine a value and to discuss with any developer/ investor unless we have a preliminary plan available
