ThedeedisdatedMay 24,1929anditisrecordedwiththeDukes CountyRegistry ofDeedsinBook176, Page399. Thebeachaccessisshownas "PrivateWay"ontheplanrecordedinPlanBook8,Page2. Later,the Clevelands agreedtorelinquish thosebeachaccessrights, andBlomerthagreedto grant replacement beach accessrights. Seethe "QuitclaimDeed Release" dated August 31, 1967andrecorded inBook274, Page563. Thenewrightsinclude therights to use OakTreeWay andHortonLaneto accessthebeachandisshownonthe planrecordedin Book263, Page227. Title totheeasementisclear.

In2013 therewasaneighborlylawsuitconcerninguseoftheright ofway. Thecourtdecisioninthatcasedidnot addresstherightsfoundinthedeedin Book274, Page563and shownontheplaninBook263, Page227.
