Thank you for letting us quote your exciting landscaping project. Having a beautiful yard you can be proud of and enjoy year round is our goal.

Attached you will see a full quote of work to be done as well as pictures showing the areas we will be working on.

Please review the quote and highlight any areas you may have questions on. I have broken the actual quote down into simple line items for easy reference and discussion.

The following are the steps we will take once we agree on the project.

When construction is finished and the pool Is filled, we will conduct an orientation on operating the pool equipment.

Final Dive-In :

After the orientation and pool chemicals are balanced, You and your family are ready to enjoy your new outdoor space!

TERMS AND CONDITIONS

1 ATMOSPHERE Pools and Landscape, LLC price includes all materials, labor, taxes and permits to complete all work according to specifications and materials incorporated herein or attached in accordance with the plan concept.

2 Any alteration or deviation from the plan or contract involving extra costs will be executed on a signed addendum and may become an additional charge over and above this contract amount.

3 It is the responsibility of the Homeowner to ensure the plans comply with any applicable Codes, Covenants, and Restrictions of their Homeowners Association.

4 The design submitted with this proposal is exclusive property of ATMOSPHERE Pools and Landscape, LLC and may not be used in whole or part without the express written consent of ATMOSPHERE Pools and Landscape, LLC.

5 ATMOSPHERE Pools and Landscape, LLC shall not be responsible for delays or failure to perform due to: acts of nature, threat to inclement weather, accidents, delays caused by Homeowner, non-issuance of all required permits, lack of availability of construction materials, or other delays beyond contractor’s control.

6. Grade, drainage, and flow of water, at the above-listed project address, are the responsibility of Homeowner, Developer and/or Home Builder. ATMOSPHERE Pools and Landscape, LLC will maintain the grades, drainage, and water flows provided. Under no circumstances will ATMOSPHERE Pools and Landscape, LLC be held liable for damages that may occur due to improper grades, drainage, or water flow. Any issues or concerns with grade, drainage, or water flow shall be addressed before work commences.

7 Homeowner understands and agrees the final payment shall be paid upon substantial completion of this work – BEFORE final interior is finished Any other payment arrangements must be outlined on this contract at the time of signing

8 All landscape and pool materials installed or not remain the property of ATMOSPHERE Pools and Landscape, LLC until paid in full

WARRANTY

Protection Warranty

All workmanship, labor and materials used in construction by ATMOSPHERE Pools and Landscape are covered by the two-year protection warranty to the original owner from the original start-up date unless otherwise specified. Most pool equipment carries a two-year warranty. Some equipment may have shorter or longer manufacturer’s warranties and such warranties apply. All Workmanship warranties are strictly followed as dictated by the Arizona Registrar of Contractors and all workmanship, and materials are to be free from defect from start up on the project. All warranty requests must be submitted via calling into the office and/or e-mailing your request at general-info@azatmosphere.com

Limitations

Defects or failures caused by the lack of maintenance, proper care and/or correct water chemistry. The swimming pool shall be kept full of water at all times except for the purposes of repair or maintenance not to exceed five (5) days. The swimming pool shall be used in a normal and reasonable manner. (Pools should not be drained when it is 90 degrees or more outside.)

Coverage

ATMOSPHERE Pools and Landscape warrants, subject to the conditions set forth herein, that it will either repair or replace at its sole discretion any of the following or other warranted items, provided defect is caused by improper workmanship or materials

Plumbing

All piping systems, water and gas, carry a five-year workmanship warranty subject to outside influences such as negligence, acts of God, expansive soil, or other uncontrollable conditions.

Electrical

All electrical installations carry a five-year workmanship and material defect warranty Computers, bulbs, automated valves, water levelers, etc carry less than two years, so it is advisable to review manufacturer warranties for these items

Shotcrete | Gunite

Home owner is required to “water down” the shotcrete for 3 days after shotcrete is complete – 3 times a day (morning, afternoon and evening). “Water down” means – make sure the shotcrete is wet, standing water is not necessary. This will ensure the shotcrete cures the way it is supposed to.

Equipment

ATMOSPHERE Pools and Landscape honors all equipment manufacturer warranties. Most equipment carries a two-year warranty. ATMOSPHERE Pools and Landscape prides itself in offering the highest quality equipment to you, the client. Due to this, we carry several different lines of equipment that in many cases offer varied warranties. Please ask your design consultant for the warranty information for your specificequipment unique to your project.

Deck

All decks carry a five-year workmanship warranty. ATMOSPHERE Pools and Landscape has set forth many procedures to aid in the prevention of cracking, however, hairline and minor cracks are common in all concrete. The Arizona Registrar of Contractors has published criteria for repairable concrete failures. This statute defines the areas of workmanship criteria.

Tile and Stone

All tile and stone (that have been deemed acceptable by the manufacturer for use around swimming pools) carry a five-year workmanship warranty All tile is subject to some discoloration over time due to lot dyes

There may be some variation in tile color due to dye lots, such is common and not considered a default Due to varying chemistry in water, calcium buildup and discoloration of tile is common It is recommended that your pool be serviced by an experienced professional to help minimize these conditions. All natural stone, including flagstone and slate, are prone to flaking. Over time, many stones will cease in flaking, however, some stones continue this process for many years. This flaking is a natural process that is not consideredpoor workmanship or material defect. Some discoloration and calcification may occur over time and can be expected.

Masonry

All masonry carries a five-year workmanship warranty. ATMOSPHERE Pools and Landscape has set forth many procedures to aid in the prevention of cracking, however, hairline and minor cracks are common in all concrete, including stucco, rock joints in waterfalls, and grout lines. The Arizona Registrar of Contractors has published criteria for repairable concrete failures.

Interior Finishes

ATMOSPHERE Pools and Landscape prides itself in offering the highest quality interior finishes to you, the client. Due to this, we carry several different lines of finishes that in many cases offer varying manufacturers warranties. Please ask your design consultant for the extended warranty information for your specific finish. Regular Pebble and Mini Pebble aggregate products are warranted against failure for 5 years from the date of installation This is for material failure, not chemical abuse or structural failure Workmanship is warranted for 5 years also as long as it is covered by water If the product is out of water, such as on rolled bond beam, etc , the workmanship warranty is for 2 years Micro Pebble is warranted against material failure for 5 years also Labor and workmanship is warranted for Pebble Finafor 2 years. (Please refer to the Pebble Fina Start up letter for further clarification).

Natural stone and application techniques can result in color variations in tone and appearance. This variation in shades is not to be considered a failure. These color and shade variations are one of the highlights of the natural pebble pool finish.

Discoloration, staining, marbling, minor surface cracks or checking, spider cracks, shrinkage cracks, cracks, and minor cracks caused by structural damage are excluded from the warranty.

Cleaning Systems

Paramount PV3, A&A and Blue Square warrants that all cleaning head bodies will be free of defects for as long as the original pool owner owns the pool.

Paramount PV3, A&A and Blue Square warrants that the water valve will be free of defects for three (3) years.

Exclusions

This warranty does not cover pools that are located on properties 1) which are used for rental or commercial purposes or 2) which are located outside the metropolitan Phoenix area ATMOSPHERE Pools and Landscape may elect to provide coverage outside Phoenix but only upon the written authorization of ATMOSPHERE Pools and Landscape management Except to the extent prohibited by applicable law and provided in this Warranty or the Standard Warranty, no other warranties, whether express or implied, including the warranties of merchantability and fitness for a particular purpose, shall apply.

Limitations

Coverage under this Warranty includes the repair and replacement of Warranted Items that are damaged during the course of normal use only. Coverage does not include the repair or replacement of any Warranted Items damaged as a result of: 1) a condition that constitutes a violation of any building code in effect at the time of damage; 2) repairs, alterations or service not performed by authorized ATMOSPHERE Pools and Landscape personnel; 3) failure any of the Warranted Items as outlined in the manufacturer’s owners’ manual; 4) any alterations or modifications from manufacturer’s original specifications made to Warranted Items; 5) failure to maintain proper chemical balance of pool water; 6) missing parts; 7) structural changes made by Buyer; 8) fire, electrical failure or surge, water damage, lighting, mud, earthquake, storms, freezing, accidents, pests or any other act of God; 9) neglect or abuse. Coverage under this Warranty does not include the repair or replacement of Warranted Items which are damaged due to normal wear and tear, including but not limited to, skimmer, lids and baskets, rubber gaskets or o-rings, pump baskets, filter pressure gauges, D.E. filter grids, Mega Media elements, Filter Media, light bulbs or remote control batteries. ATMOSPHERE Pools and Landscape is not responsible for matching colors or brands which are no longer available, but will make a reasonable effort to match colors or brands as close as is possible. ATMOSPHERE Pools and Landscape reserves the right to substitute parts or items as deemed necessary by ATMOSPHERE Pools and Landscape. In the event of buildingor similar code changes, ATMOSPHERE Pools and Landscape is not responsible for additional material, expense or performance of service required to restore the pool to its original condition.

Warranty Period

The term of this Warranty will begin on the Effective Date (start-up date) and will continue for the entire time the pool is in possession of the Buyer, provided that Buyer has paid ATMOSPHERE Pools and Landscape its entire payment obligation pursuant to the pool contract

Submission of Claims

To properly submit a claim pursuant to this Warranty, Buyer or Buyer’s authorized agent must notify ATMOSPHERE Pools and Landscape of damage to any of the Warranted Items as soon as the damage is discovered Failure to notify ATMOSPHERE Pools and Landscape within a reasonable time shall void any warranties afforded herein

ATMOSPHERE Pools and Landscape shall not charge a service call for any items that fall under the Standard Warranty (with exception of any warranty exclusionary items noted above).

Governing Law

All workmanship warranties will comply with and are requested by Arizona Revised Statutes as deemed in writing by the Arizona Registrar of Contractors.

Liability

ATMOSPHERE Pools and Landscape and its staff is not responsible for incidental or consequential damages that are as a result of the use or ownership of any ATMOSPHERE Pools and Landscape pool or products.

5 BIGGEST MISTAKES MADE BY HOMEOWNERS

Starting any home building project is always momentous. For most people, it involves living with the work in progress – not to mention lots of decisions, excitement about the changes, and hopefully, a final reveal that makes everyone happy.

Whether you are starting from scratch with a new pool, or remodeling your existing pool, before you start your journey of looking at samples and design drawings, make sure you do not make these building mistakes as outlined by builders themselves.

Before you even begin interviewing pool builders, make some hard decisions. This is the time to ask yourself what you want to accomplish, and why. When you can communicate these specific goals to your builder, you will be able to tap into their knowledge on how to make your vision come to life. Doing research on your likes and dislikes, materials and ideas will only help when you sit down with your builder – and help you feel confident about your choices.

Really Thinking About Your Lifestyle

Do you have an active household? Are children and pets a part of your life? Do you need something that will be low maintenance? Who will be using it? Questions like these may seem simple, but they will tell you and the pool builder a lot about how to determine features for your pool and spa build or remodel.

Neglecting Window Shopping

Get out there and explore your friend’s pools or view photos of pools or spas online. Find out what works best in your area and what does not. If your home has features you are proud of, you can see how others with similar homes have added to the aesthetic in their backyard pool or landscaping.

Home shows are another great way to learn about the latest innovations and styles that work well for our area. It is one of the few times that you will be able to stock up on information and brochures from a wide variety of businesses –and you will get lots of inspiration.

Being Realistic About Your Budget

Once you determine your goals for your building project, set your budget. And, once you set your budget, add on an additional 20% of that amount as a reserve. Do not move ahead unless you can assure that you have that cushion in place. With your budget and reserve set aside, you will not only reduce your stress levels, but you might even have a surplus at the end of the project.

Choosing Your Builder Carefully

The first company you interview may not be the best choice. By talking to at least three builders and getting quotes, you will have a firm idea of your project scope, and possibly learn about some items you did not consider.

Be sure that any company you work with has not only proven themselves in the past by having lots of positive reviews online but will also be there in the future if you need them. Be aware of companies that claim to be experts but only have a year or two of experience. Excellent communication and the ability to listen to your needs are essential for any builder relationship.
