RE: Easement for SafeRoutes to School Project
Dear Rachel:
The City ofSt. George has recently received grants and other financial assistance for construction work for its Safe Routes to School Project. The Kansas Safe Routes to School program works to createsafe sidewalks, street crossings, access points and other improvements to allow students to more easily walk, bike or otherwise go to school without using cars or buses. In some areas of the City, sidewalksand other improvements are needed to create safe routes for students. Inthese areas, other improvements for drainage or utility movement would also be needed because of sidewalk installation.
You are receiving this letter because the City is requesting that you grant a temporary easement, which will allow it to install, improve or widen sidewalks and other areas for better access for students. The temporary easement areas will be run on or next to existing right-of-way unless there are physical or historical obstacles that make this unworkable. Included with this letter is a map of the area needed for construction. This should help you better understand how these improvements will affect your property. Wehave also included a "Right-of-Way Easement" that describes the easement area for filing with the County prior to the construction work. The temporary easement is only for the limited purpose of storing construction equipment, allowing full access to the rightof-way,grading and storage during the construction. This temporary easement will only be in effect for two years, and the actual construction time should take much less time.
Ourplanisforconstruction to begin in early 2025. Typically, your property will be impacted by construction activity for only a few days. When the work isdone, the contractor is responsible for all clean-up and re-seeding. The contractor will provide a one-year warranty on the entire project, including the seeding. Our plan is to return your property to a condition equal to or better than its current condition.
We have also included a brochure labeled "Uniform Relocation Assistance and Real Property Acquisition Act". Obviously, thesesidewalk improvements will not require any owner to move from their property. However,the District hasobtained state funding, which requires compliance withthe Uniform Relocation Assistance and Real Property Acquisition Policy Act of 1970. One of the requirements of thelaw under 49 C.F.R. § 24-102(b) isthat a notice be given to landowners of the City's interest in acquiring "real property"(the easement) which details the basic of protections provided to the landowner by law and 49 C.F.R. Part 24. In other words, we are required by the
government to send you this brochure - even though you won't be relocated for the project or otherwise lose your right to reside on the property during the construction process.
The brochure mentions the possibility of compensation in exchange for your "property" (the easement). If you request compensation for your easement, the City may perform a waiver valuation on the property to determine a good faith offer for the easement, complying with theAct and Regulations.As a practical matter, the sidewalk installation is for a non-profit public entity (the City) and adjoining areas already subject to public travel, so the City is requesting you donate your easement and waive rights under the Relocation Act to help us move forward with this important project as economically and swiftly as possible.
We request that your easement be signed, notarized and returned with the donation form as soon as possible. You can either mail it to the City office or return it in person. If you mail it, please make sure to first have a notary public witness your signature.If you bring it to the office during normal working hours, someone will beable to notarize your signature.
The Safe Routes to School Project is an important step in the improvement of the St. George community for children and adults alike, and a temporary easement across your property is an important part of this process.
