Through the MSBA Pro Se Appellate Clinic, former attorney Schuyler Troy handled an appeal regarding a child custody dispute that arose after the tragic murder of a child’s mother in 2020, leaving a largely absent father and the maternal grandparents to assume care. The grandfather eventually became the primary caretaker and was awarded sole legal and physical custody after a court trial, despite the father’s and grandmother’s legal challenge. Representing the grandfather on appeal, Schuyler successfully argued that the district court’s decision was well-supported, the statutes were correctly applied, and the father’s constitutional rights were adequately considered. The Court of Appeals unanimously affirmed the district court’s order, allowing the grandfather to maintain custody as the child begins kindergarten.
