Request to Purchase Terms and Conditions - PROSPERITY
To be eligible to purchase in the first release of Hamilton Townhomes at Mambourin you must agree to the terms and conditions of the Request to Purchase page.
1. These terms and conditions govern your use of the Frasers Property Australia Request to Purchase page for registration of your interest in purchasing a property at Mambourin during the Hamilton Townhomes Release (“Request to Purchase page”). By using the Request to Purchase page, you agree to comply with these terms and conditions.
2. You will receive an email on Wednesday 25 January 2023 with the Request to Purchase page link to register your interest to purchase a property within the release. It is advised that you have your preferred property selected (due to high demand it is recommended that you have multiple preferences). We suggest a minimum of three preferences.
3. For any Family Members of Prosperity members wishing to gain access to this release under the Family Share program, there are criteria that need to be satisfied to qualify for this benefit. Firstly, a referral form must be submitted by Friday 20 January 2023 This can be done here www.frasersproperty.com.au/familyshare. Secondly, sufficient certified documents to prove the relationship between the Family Member and Prosperity member, will need to be supplied by Monday 23 January 2023. Thirdly, the referral must be approved by our internal team in line with the Prosperity Terms and Conditions, which can be accessed here www.frasersproperty.com.au/Prosperity/Terms. Family Members will be notified of their eligibility prior to Tuesday 24 January 2023
4. Request to Purchase in the release opens at 10am (AEDT) on Friday 27 January 2023 and closes at 11am (AEDT) on Friday 27 January 2023 (Request to Purchase Period). During the Request to Purchase Period, you may use the Request to Purchase page to register your interest in purchasing a property at Mambourin (“Request to Purchase”). If you do not register before the Request to Purchase period closes you will not be eligible to participate in the sales release.
5. If you are successful in requesting to purchase a property in the release, following the Request to Purchase Period, you will be contacted by the Sales Team via telephone within 6 hours of the Request to Purchase Period closing. You will be contacted in order of priority, based on the time of receipt of your Registration by the Request to Purchase page.
6. When you are contacted by the Sales Team, you may be provided with an opportunity to purchase a property at the release on Saturday 28 January 2023
7. If following the Request to Purchase Period, the Sales Team is unable to contact you on your nominated telephone number, we will endeavour to leave you a voicemail or SMS, however you will lose your Registration priority and the Sales Team will contact the next Registered Purchaser.
i. The Sales Team will endeavour to contact you on your nominated telephone number a second time. Once you return a call to the Sales Team, you will resume priority ahead of the remaining Registered Purchasers who have not yet been contacted.
ii. If the Sales Team is unable to contact you by telephone after the second attempt and you do not contact the Sales Team before we finish contacting all Registered Purchasers, Frasers Property Australia reserve the right to forfeit your Registration and any opportunity to purchase a Property during the release.
8. You acknowledge that Registration does not give you a legal right or guarantee to purchase a
Property, including during the release There may be more people registering using the Registration page than there are Properties available for purchase. You agree not to make a claim against Frasers Property Australia if you are not able to purchase a Property, or you are impaired from purchasing a Property, for any reason, including the negligence or error of Frasers Property Australia.
9. You may be prevented, delayed or impaired from using the Request to Purchase page for a number of reasons, including due to infrastructure failures like internet or telecommunication outages, or impairment or failure of the Request to Purchase page (including due to technical breakdown) or impairment or failure of your equipment, including due to viruses, hacking or other technical issues. You agree not to make a claim against Frasers Property Australia if you are unable to use the Request to Purchase page, or if you are provided a less favourable registration preference, due to any of the problems set out in this paragraph, irrespective of who is responsible.
10. By submitting this form, you agree that Frasers Property Australia can use your personal information to offer you the opportunity to purchase a Property and to promote its products and services. Frasers Property Australia agrees to comply with its privacy policy in its collection of information, which can be viewed here: https://www.frasersproperty.com.au/privacy
11. These terms and conditions are governed by the laws in force in Victoria. Reference to Frasers Property Australia means Frasers Property AHL Pty Ltd ACN 008 443 696, its related bodies corporate (as defined under the Corporations Act 2001 (Cth)) and includes its officers, employee,s contractors or agents.
12. If any provision of these terms and conditions is held to be invalid, void or for any reason unenforceable, such provision is deemed to be struck out and will not affect the validity and enforceability of the remaining provisions. All information contained within the Contract takes precedence over these terms and conditions.
13. To be eligible to purchase in the Hamilton Townhomes Release at Mambourin you must agree to the terms and conditions of the Request to Purchase page. These terms and conditions apply in addition to Frasers Property Australia’s Prosperity Loyalty Program terms and conditions. To the extent of any inconsistency, these terms and conditions will prevail.
