How the FTC & NLRB Impact Your Small Businesses

Sponsored by:

There’s no doubt about it. The franchise model is under attack at the federal level. Hear from IFA’s Government Relations team on the actions the Federal Trade Commissions(FTC) is taking to potentially upend the business model. We will also touch on another agency rulemaking we saw in August from the National Labor Relations Board (NLRB) on the new (again!) definition of joint employer. Both issues could have far-reaching impacts on the current franchise business model and the way we all do business – from current accepted practices to joint employment. Learn how to talk about these issues to make your case on the Hill to your elected officials.

Moderator: Michael Layman, Senior VP, Government Relations & Public Affairs, IFA

Speakers: Haider Murtaza, Director, Government Relations & Public Policy, IFA; David Humphrey, IFA Chair; Ignite Fitness Holdings; Christina Russell, CEO, Radiance Holdings

9:45 am -10:00 am

An Update from the Minority Business Development Agency (MBDA)

Hear from the first-ever Deputy Under Secretary of Commerce for Minority Business Development (MBDA). Her leadership is to MBDA’s mission to help create a strong, equitable economy driven by our nation’s minority businesses – including franchises. Franchising offers a unique entrepreneurial avenue for underresourced people of color across the country, with nearly a 26% minority ownership rate as compared to just 17% of nonfranchised small businesses.

Speaker: Jessica G. Cavazos, Deputy Under Secretary of Commerce for Minority Business Development

10:00 am - 10:45 am

Advocacy Training and Hill Meetings Preparation

IFA will prep you before your meetings on Capitol Hill and provide guidance on having an effective visit through a professional advocacy training presentation. Having both testified before Congress, they will also share why they have found it essential to speak out to protect franchising and give their first-hand perspective on the impact that government policies can have on your business.

A Conversation with former FTC Commissioner Christine Wilson

Sponsored by: Sponsored by:

The FTC is the primary government agency regulating franchising. For decades, the agency’s Franchise Rule has protected consumers through the pre-sale disclosure of information about franchise offerings that ensures prospective franchisees are equipped to conduct due diligence prior to acquiring a franchise and also serves a critical role in establishing the foundation for strong franchise relationships. Although the Franchise Rule is overdue for an update to bring the regulations in line with the current landscape of franchising and advancements in technology, the FTC under Chair Lina Khan has yet to finalize any updates, instead focusing its efforts on a broad sweeping regulation of franchise relationships. On the heels of the Khan FTC’s move to ban non-compete clauses, this focus on franchise relationships is the latest in a trend of the FTC exceeding its statutory authority for which it recently has come under intense scrutiny, with an investigation of Chair Khan for abuse of power looming. Commissioner Wilson

resigned her position on March 2, 2023, stating, “I barely recognize the FTC. It pains me to observe the tarnishing of its reputation, the diminution of its efficacy, and the exodus of its experienced personnel, many of whom agree with the policy goals of Ms. Khan and your administration.

Speakers: Christine Wilson, Former Commissioner, Federal Trade Commission; Matt Haller, President & CEO, IFA
