018 has been a year of consolidation for Fine & Country Por tugal as well as fur ther expansion in our target areas. A large new prime location office was opened in the centre of Cascais, a new office opened in Duque de Loulé in Lisbon as well as a satellite office in Carvalhal near Compor ta. This has brought our total number of offices to eight. F&C Por tugal total staff is now 37. At this point in time, we do not plan any fur ther expansion but will concentrate on increasing our business in our prime areas. Sales were again buoyant during the whole year. The domestic market remains weak primarily due to the fact that mor tgage credit is still very limited. F&C primary markets are foreign, focusing on Brazil, France, Belgium, Turkey, South Africa, the Middle East and the Far East. Last year was also a great year in terms of international recognition through awards that F&C Por tugal won bringing enormous pride to the shareholders and to the employees. The combination of the strength of the brand of Fine & Country and the excellence of our Marketing Depar tment are the foundations on which the success of the company is built. Tell us about Cascais and Lisbon. What makes them special? Once the stomping ground of some of the greatest seafarers and conquistadors, Lisbon’s rich history is sure to delight any tourist. The wide range of restaurants, bars, and cafes only complements the stunning architecture. You really feel like you’re in another era when you visit the Lisbon Maritime Museum or the Torre de Belem, where ships once passed through on their way to discover the new world. One of the best ways to discover Lisbon is by touring its seven hills, and experiencing its unique beauty firsthand. Cascais is a delightful Por tuguese fishing town that is located on the western edge of the Lisbon coastline, and is the region’s most popular holiday destination. Historically the town was a favorite with the Por tuguese nobility, and today it maintains an elegant blend of traditional Por tuguese charm and outstanding tourist facilities. These factors combine to make a great holiday destination and an enjoyable day trip from Lisbon (which is less than 20 minutes away by train). The pretty historic center of Cascais is filled with family owned restaurants, open-air cafes and stylish bars - ideal for relaxing during the hot summer days or socializing late into the night. What are the most sought-after areas? Quinta da Marinha is the most sought-after area of Cascais. Quinta de Marinha is located outskir ts of Cascais. The resor t and residential development has two 18-hole golf courses as well as four 5 star hotels, an equestrian center, a tennis club and a modern health Club. Chiado is the most sought after area in Lisbon with its traditional protected architecture, narrrow streets full of bars, restaurants and boutique shops.

What are the hottest and coolest months? August is the hottest month in Cascais with an average temperature of 23°C (74°F) and the coldest is January at 12°C (53°F). The best month to swim in the sea is in August when the average sea temperature is 21°C (70°F). July is the hottest month in Lisbon with an average temperature of 24°C (74°F) and the coldest is January at 11°C (52°F). The best month to swim in the sea is in September when the average sea temperature is 20°C (68°F). What are the best schools? Lisbon and Cascais have many excellent international schools, the most famous being the French Lycée in Lisbon, the German School Lisbon, St Julian’s International School Carcavelos, the American International School in Sintra as well as many other. How much do proper ties cost in Lisbon? In the prime areas of Historic Lisbon, apar tments very from €6,000 per square metre to over €10,000 per square metre. A spacious one-bedroom apar tment sells for around €600,000, whereas a luxury threebedroom apar tment around sells for around €1,200,000. What proper ties are the most in demand? In Historic Lisbon and the Central Business District of Lisbon the demand is almost exclusively for one-, two-, and threebedroom apar tments. In Cascais, most buyers are looking for luxury two- and three- bedroom apar tments, as well as for three- and four-bedroom villas with gardens and pool. Finally, what advice would you give to anyone thinking of moving to Por tugal? Ensure that you have a reliable and knowledgeable real estate agent, and view a number of proper ties within your requirements and budget. Remember that prices are always negotiable. Appoint a reputable lawyer, and never give any money to the vendor except with the express authority of your lawyer. Lastly, have a wonderful time living in one of the most beautiful countries in the world.

hat is the Golden Visa? A 5 Year Residency Permit issued by the Portuguese Government to non EU citizens and valid for all Schengen

countries.

What happens at the end of 5 years? The applicant can apply for a Residency extension or a full Portuguese passport.

What are the requirements to qualify for the Golden Visa? A single minimum investment of 500,000 Euros in a property purchase in Portugal qualifies the applicant which includes his spouse and children under 18 for the Golden Visa.

What type of property do I have to buy? Basically any, as long as the total investment exceeds 500,000 Euros. Residential, commercial, retail or agricultural.

Are there any other requirements besides the property purchase? Besides proof of identity, confirmation of not having a Criminal Record & opening a bank account in Portugal, there are noother significant requirements.

How can I apply for the Golden Visa? This would normally be done on your behalf by a lawyer that you appoint in Portugal to handle the process for you as well as the due diligence on the property purchase. We can recommend experienced multi-lingual lawyers for this purpose.

Do I have to visit Portugal to initiate the process? Yes, you should visit Portugal for a minimum of 3 days to meet with lawyers, open a bank account in Portugal and visit a selection of appropriate properties that fit with your investment criteria. 18

What would I be expected to do in order to “reserve” a property that I have chosen?

Blessed with a wonderful Mediterranean style climate, Portugal has long been a favourite holiday and second home destination for foreigners. The coastline, washed by the pristine waters of the Atlantic ocean, offers some of Europe’s finest beaches, whilst Portugal is also recognised as one of the world’s greatest golfing destinations. The country has very low crime rate and is politically stable, and the economy has shown strong signs of growth in recent times. The growing expatriate community is served by numerous international schools, with excellent private and public health care facilities.

You would be asked to pay 10,000 Euros to your lawyer’s “Clients Account” to reserve the property. A further 25% of the purchase price in 30 days after the lawyers have carried out the required due diligence and the balance payment with handover of the keys and title documents.

Are properties both Leasehold and Freehold in Portugal? No, all properties in Portugal are Freehold and registered in the Land Registry as such.

Are there any restrictions on import and export of capital to Portugal? There are none.

Can I ask you to make arrangements to rent the property to create an income? Yes.

What are the benefits of the NHR?

What about other types of income?

The NHR regime:

In general, income from investment (including dividends and interest), royalties, rents, employment, etc., from a foreign source will be exempt with progression in Portugal, provided that the foreign state has taxing rights. Where income is not taxable in the source country and there is no treaty giving taxing rights to the source country, the income is fully taxable in Portugal.

a. Zero % tax on pension and investment income; b. Applies a special tax rate of 20% to employment and self-employment income derived from a “high value-added activity” in Portugal. Typically: Actors, Architects, Auditors, Dentists, Doctors, Directors, Engineers, Fine artists, Investors, Managers, Musicians, Professors, Psychologists and Technicians. This list is exhaustive, but you should take advice regarding the regime and how it applies to you.

What is the non-habitual resident tax regime? The non-habitual resident (NHR) tax regime confers tax advantages to certain individuals who become tax resident in Portugal. Normally, a Portuguese tax resident is liable for tax on their worldwide income. However, if you qualify for the NHR refime you will receive tax benefits that minimise Portuguese tax on income and some gains arising in Portugal. A reduced, rate of tax on Portuguese source employment income will also apply for a period of ten tax years.

Does this include pension income? The legislation permits foreign pension income to be exempt with progression if: a.The income is taxed in the other country in accordance with the double tax treaty between Portugal and that country; or b. The income is regarded as arising outside of Portugal. In pratice, for example, this means that the pension income is usually excluded from taxation both in Portugal and in the home country. An example of this double benefit would be income from your occupational or personal pension.

Income derived from “blacklisted” (under Portuguese law) jurisdiction is not exempt from Portuguese tax. It will be taxed in full at the special tax rate (currently 35%). If the income is not taxable in the source country it will be taxed in Portugal.


What about the capital gains? When assets are sold if the treaty gives taxing rights to Portugal, the gain is taxable in Portugal.Where the gain may be taxed in the source country, the gains is exempt with progression in Portugal. The treaty gives taxing rights to both the source country and Portugal in respect of real estate so gains are exempt with progression in Portugal. Gains on shares are fully taxable if sold as a Portuguese resident, even under the NHR regime.

How do I qualify for NHR? You must not have been resident in Portugal in any one of the five tax years before you arrive in Portugal.The tax year in Portugal is the calendar year. You will need to apply to the tax authorities for NHR tax treatment in your first year of residence.

What happens if I leave and then return to Portugal? If you cease to be resident during the ten year period and then resume residence in Portugal you still qualify for the NHR tax benefits. However, you will not qualify for a new ten year period unless you leave for more than five year tax years; the clock contines to tick until the end of the tenth year from when you first qualified for NHR.

What happens once I have passed the initial 10 year qualifying period? After the completion of the ten year period, if you stay in Portugual, you will be classed as a normal Portuguese tax resident. You will be liable to tax on your worldwide income and gains at normal Portuguese tax rates.

Is there anything else I should know? The tax administration demands a certificate of residence from your current country, as well as “effective taxation of income” in that country, covering the last five years. This requirement is not included in the legislation. However, we recommed submitting applications with all of the information requested in order to avoid unproductive correspondence.To benefit from the regime you have to be resident in Portugal and you should ensure that you are not tax resident elsewhere under a double tax treaty.

What should I do next? This is a general guide to the “non-habitual resident” tax regime in Portugal and statements concerning taxation are based upon our undersanding of current taxation laws and practices, which may be subject to change.
