CITY OF TAMARAC, FLORIDA

ORDINANCE NO. O-2024-

AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, ADOPTING THE FIRST (1ST) BUDGET AMENDMENT TO THE CITY OF TAMARAC OPERATING BUDGET, REVENUES AND EXPENDITURES, THE CAPITAL BUDGET, AND THE FINANCIAL POLICIES FOR THE FISCAL YEAR 2024, BY INCREASING THE TOTAL REVENUES AND EXPENDITURES BY A TOTAL OF $5,147,461 AS DETAILED IN ATTACHMENT “A” ATTACHED HERETO AND SUMMARIZED IN ATTACHMENT “B” ATTACHED HERETO AND INCORPORATED HEREIN; PROVIDING THAT THE 1ST AMENDMENT IS BEING ADOPTED IN THE SAME MANNER AS THE ORIGINAL BUDGET AND SERVES AS THE NEW ADOPTED BUDGET: PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, Florida Statutes provide that municipalities shall have the governmental, corporate, and proprietary powers to enable them to conduct municipal government, perform municipal functions, and render municipal service, and exercise any power for municipal purposes, except when expressly prohibited by law; and

WHEREAS, Article IV, Section 4.07 of the City Charter of the City of Tamarac empowers the City to adopt, amend, or repeal such ordinances and resolutions as may be required for the proper governing of the City; and

WHEREAS, the City of Tamarac, pursuant to Section 200.065, Florida Statutes adopted its Operating Budget, Revenues and Expenditures, the Capital Budget and the Financial Policies for the Fiscal Year 2024 by approving Ordinance 2023-019 on September 26, 2023; and

WHEREAS, the City Commission desires to amend its Operating Budget, Revenues and Expenditures and Capital Budget pursuant to Section 166.241(8).; and

WHEREAS, pursuant to the provisions of the Code of Ordinances of the City of Tamarac, Florida, public notice has been given of the time and place of the public hearing regarding the 1st Budget Amendment; and

WHEREAS, the Director of the Financial Services Department recommends amending the Operating Budget, Revenues and Expenditures, the Capital Budget, and the Financial Policies for the Fiscal Year 2024; and

WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the business owners, residents, and visitors of the City of Tamarac to amend the Operating Budget, Revenues and Expenditures, the Capital Budget, and the Financial Policies for the Fiscal Year 2024

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA THAT:

SECTION 1: The foregoing whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon

SECTION 2: City of Tamarac Operating Budget, Revenues and Expenditures, the Capital Budget, and the Financial Policies for the Fiscal Year 2024, is amended as detailed in Attachment “A” and summarized in Attachment "B," both of which are attached hereto and incorporated herein.

SECTION 3: All Ordinances or parts of Ordinances, and Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict.

SECTION 4: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.

SECTION 5: This Ordinance shall become effective immediately upon its passage and adoption.

#2 General Fund - City Commission

Appropriate additional funding needed to increase Commission initiative accounts from $6,000 to $25,000 for Mayor and $20,000 for Commissioners (November 6, 2023 Workshop)

#3 General Fund - City Commission

Appropriate additional funding needed to increase the Community Engagement Liaison (CEL) combined weekly hours per elected official from 25 hours to 32 hours (Strategic Planning Item)

#4 Sales Tax Surtax Fund

Re-appropriate funding for two (2) Surtax Projects budgeted in FY 2023. The 2 Projects are the Fire Station 15 Preemption Signal Project which was approved for $498,869 in Surtax funding and the Mainlands 1-5 Resurfacing Project which was approved for $2,697,971 in Surtax funding.

#5 General Fund and Capital Equipment Fund

Appropriate funding for the purchase of two (2) Electric Vehicles, both are Chevy Volts at a cost of 32,477 each. One vehicle to be used by the City Commission as a pool vehicle and one to be used by Community Development Planning and Zoning. Project CV22A in the Capital Equipment Fund includes $30,200 available budget for the Community Development vehicle
